Regular Session Minutes of October 25, 2022 MOTION2022-199 On a motion by Vice Mayor Martinez, seconded by Council Member Nacy, the minutes of the Regular Session of October 25, 2022, were moved for approval. Council Member Bagdasarian was absent at the October 25, 2022, meeting and abstained from the vote. The motion was approved by the following vote: Aye: Cummings, Fox, Vice Mayor Martinez, Nacy, Steinberg and Mayor Burk Nay: None Vote: 6-0-1 (Bagdasarian abstain) 6. PRESENTATION OF PROCLAMATIONS a. Boy Scouts Troop 982 40th Anniversary Mayor Burk read the Boy Scouts Troop 982 40th Anniversary proclamation and presented it to the troop's members. Scout Master Chris Stephenson, Senior Patrol Leader Cole Strickland, Assistant Senior Patrol Leader Grayson Stevenson and Scout Roman Shoja provided some remarks. b. National Veterans and Military Families Month Mayor Burk read the National Veterans and Military Families Month proclamation and presented it to Mr. Ray Delpesche who provided some remarks. c. National Diabetes Awareness Month Mayor Burk read the National Diabetes Awareness Month proclamation and presented it to Dr. Amish Gandhi who provided some remarks. d. Small Business Saturday Mayor Burk read the Small Business Saturday proclamation and presented it to: • Tyra Flynn, owner of the Global Local, and • Deborah Morbeto, owner of A Delightfully Different Gallery, and • Tammy Krohn, owner of 529 Consignment, and • Dana Green, owner of Restocked Sneakers, and • Tatiana and Godfrey McKenzie, owners of Dolce & Ciabatta All recipients provided some remarks. RESOLUTIONS /ORDINANCES / MOTIONS a. Initiation of Zoning Ordinance Batch Amendments Ms. Shelby Miller provided Council with a general overview of the proposed amendments to the Zoning Ordinance. Mayor Burk noted she was pleased that they are adding an expiration date to the Certificate of Appropriateness. MOTION2022-204 On a motion by Vice Mayor Martinez, seconded by Council Member Steinberg, the following was proposed: RESOLUTION 2022--143 Initiating Zoning Ordinance Batch Amendments 5 1 Page COUNCIL MEETING November 15, 2022 The motion was approved by the following vote: Aye: Bagdasarian, Cummings, Fox, Vice Mayor Martinez, Nacy, Steinberg and Mayor Burk Nay: None Vote. 7-0 b. Motion to Rescind Resolution 2022-123 MOTION2022-205 On a motion by Vice Mayor Martinez, seconded by Council Member Cummings, the following was proposed: I move to rescind Resolution 2022-123 — Authorizing Funds up to $5,000 for an Interpretive Exhibit for the Black History Mural Project adopted on September 27, 2022. Council Member Fox asked what oversight the Town has on the narrative for the interpretive sign on a public building. Mayor Burk noted that part of the agreement has the interpretive sign coming back to Council for final approval. Renewal of License Agreement with Lumos Networks, Inc. — Installation of Telecommunications Facilities within Town Rights-of-Wav The Public Hearing was opened at 7:48 p.m. Ms. Christine Newton presented Council with a request to renew a license agreement with Lumos Networks to permit them to continue to operate, install or maintain facilities within the Town's Right-of-way. The current agreement expires on November 16, 2022. Public Speakers: There were no speakers wishing to address the public hearing. The public hearing was closed at 7:52 p.m. 6 1 Page COUNCIL MEETING November 15, 2022 MOTION2022-206 On a motion by Vice Mayor Martinez, seconded by Council Member Nacy, the following was proposed: I move to approve the proposed resolution authorizing the renewal of a License Agreement between the Town of Leesburg and Lumos Networks, Inc. for Telecommunications Facilities within Town Rights -of -Way RESOLUTION 2022-144 Amending Leesburg Zoning Ordinance Section 3.1.9.B.2 Contents of Placards Revising the Information Provided on Notice of Public Hearing Placard Signs The motion was approved by the following vote: Aye: Bagdasarian, Cummings, Fox, Vice Mayor Martinez, Nacy, Steinberg and Mayor Burk Nay: None Vote: 7-0 15. MAYOR DISCLOSURES AND COMMENTS / ADDITIONS TO FUTURE MEETINGS Mayor Burk thanked Mr. Shye Gilad and Ms. Julie O'Brien for hosting the annual ProJet Aviation Expo. Mayor Burk thanked the residents of Leesburg for reelecting her to another two-year term as Mayor of Leesburg. 19. TOWN MANAGER COMMENTS Mr. Dentler noted that two Leesburg landmarks were among the winners at the annual Signatures of Loudoun Design Excellence Program announced at the Board of Supervisors meeting that evening. Mr. Peter Burnett's Net Zero Co -working Space on East Market Street won in the Makeover category and Mr. Don Knutson's King Street Station Public Plaza on South King Street won in the Public Spaces category. 20. I would like to call to order tonight's Town Council meeting of November 15th, 2022. If anyone in the room needs hearing assistance, please see the Clerk. Council Member Steinberg will be giving the invocation followed by Vice Mayor Martinez doing the salute to the flag. Council member Steinberg? Council Member Neil Steinberg: Thank you, Mayor Burk. This evening before we get to the work of the Town Council for our community, I'd like to ask for a moment of silence as we remember the lives of three young men lost and two injured at the University of Virginia in yet another random act of violence that has become all too commonplace for our society today. Moment of silence, please. [silence] Thank you all. Mayor Burk: Vice Mayor Martinez. Vice Mayor Fernando "Marty" Martinez: Before we do the Pledge of Allegiance, I wanted to make a couple of comments. Last week, we've been celebrating veterans and we had a phenomenal veterans meeting or event that was wonderful. That was okay because in the back of my mind I'm thinking of all the veterans that didn't come back, and all the families that have to deal with all the trials and tribulations of being a veteran family, the parents who have had sons and daughters killed in action. I just wanted that as we say this pledge of allegiance, please honor our veterans, remember them, salute them. I think that is something that we have in our country. We need to continue to respect our veterans. In closing, our local VFW will be doing our Pledge of Allegiance for us. Mayor Burk: Please stand. Gentlemen, would you come to the mic in the middle? [laughs] All right, we have no certificates of recognition, but we do have a couple of proclamations for tonight. I'm going to read them and go down on the floor to present them. The first one is to the Boy Scout Troop 982. This is Boy Scout Troop 982, celebrating 40 years. "Whereas Troop 982 is a Boy Scout, BSA troop in Leesburg, Virginia that was founded in 1982; and whereas this year marks the 40th anniversary of the Leesburg Scout Troop 982; and whereas Leesburg Scout Troop 982 has produced over 157 Eagle Scouts, the highest rank attainable of a scout; and whereas the Leesburg Scout Troop 982 has proven to be a high adventure troop sending scouts in the last several years to four different states; and whereas Leesburg Scout Troop 982 takes part in scouting programs like the wilderness survival, swimming, shooting sports, and other skills needed to earn the roughly 60 merit badges offered; and whereas since June, 2022, the Leesburg Moose Lodge has been the chartering organization of the troop. Therefore proclaimed that the Mayor and the Council of the Town of Leesburg in Virginia congratulates Leesburg Scout Troop 982 on their 40th anniversary and extend gratitude for their continued service to our community. Proclaimed this day." Then we have a proclamation for National Veterans and Military Families Month. This is, "Whereas, November is National Veterans and Military Families Month; and whereas we recognize and honor the veterans and military families who support our armed forces as they protect our nation from harm; whereas we respect and acknowledge the sacrifices the veterans and military families make on a daily basis; and whereas through November, we show our appreciation to the spouses, partners, children, caregivers, and survivors of our service members and veterans for their selfless sacrifice; and whereas we welcome Ray Delpesche to accept a proclamation on behalf of the National Veterans and Military Family Month. Therefore, proclaimed that the Mayor and the Council of the Town of Leesburg in Virginia do hereby recognized 2022 as National Veterans and Military Family Month and call this observance to the attention of all Leesburg residents. Proclaimed this day." Next one is National Diabetes Awareness Month. "Whereas November is National Diabetes Awareness Month and an opportunity for local and regional advocates to team up and work with partners across the nation to raise awareness to this illness; whereas during National Diabetes Awareness Month, we draw attention to all forms of this dangerous condition, including type one, type Page 2J November 15, 2022 two, gestational diabetes, pre -diabetes and recommit ourselves to finding a cure; whereas diabetes strikes both children and adults of any age. It comes on suddenly, causes dependence on injections or pumped insulin, and carries that constant threat of devastating complications; whereas over the last year and a half, people living with diabetes have faced heightened risk to their health as to their illness makes them more vulnerable to the worst effects of COVID-19; and whereas we call upon all residents, government agencies, non-profit organizations, healthcare providers, research institution, and school systems to join in activities that raise diabetes awareness and help prevent, treat, and manage the disease. Therefore proclaimed that the Mayor and the Council of the Town of Leesburg in Virginia hereby acknowledge November 22nd as National Diabetes Awareness Month and recognize (nova Loudoun Hospital as Loudoun's Non-profit Community Hospital and Dr. Amish Gandhi for his dedication towards improving patient health outcomes. Proclaimed his 15th day of November." We have Small Business Saturday and we want to recognize a number of small businesses in our community. "Whereas Leesburg celebrates its local small businesses in the community, the contributions they make to the local economy and the community; whereas advocacy groups, as well as public and private organizations across the country have endorsed this Saturday after Thanksgiving as Small Business Saturday; whereas 96% of the consumers who shop on Small Business Saturdays agree that shopping at small independently owned businesses support their communities and their commitment to making purchases that have a positive social, economic, and environmental impact, and 97% of the consumers who shop on Small Business Saturday agree that small businesses are essential to their communities; and whereas the Council recognizes Tara Flynn, owner of the Global Local, Deborah Morbeto, owner of the Delightfully Different Gallery, and Tammy Krohn, owner of 529 Consignment. These organizations collectively represent the West End Boutiques, a growing retail location on West Loudoun Street; and whereas the Council recognizes Dana Green, owner of the Restocked Sneakers, a business providing highly sought-after designer sneakers to its patrons from its Crescent Place location; and whereas Council recognizes Tatiana and Godfrey McKenzie, owners of Dolce & Ciabatta," oh, my favorite bakery, "a European -style bakery cafe that recently opened its second location in Fort Evans Plaza II; and whereas Council recognizes Paige Lobuts owner of Sienna Sky Boutique, a clothing store in the Village of Leesburg that offers feminine, modern, and minimalist clothing for women. Therefore proclaimed that the Mayor and the Council of the Town of Leesburg in Virginia recognizes November 261h, 2022 as Small Business Saturday and urges the residents of our community and the communities across the country to support small businesses and merchants on this Small Business Saturday and throughout the year. Proclaimed this 15th day of November. Then, we have -- Council Member Bagdasarian: One more. Mayor Burk: Yes, I know. [laughs] I'm sorry. I'm spreading out here. We have the final one is the proclamation for Battery Warehouse. "Whereas the Battery Warehouse has been operating in Leesburg, Virginia since 1992; whereas this year marks 30 years of serving the community by providing extensive selection of batteries; whereas the Battery Warehouse is a one -stop shop, where one can find batteries for automotive, motorcycle, heavy equipment, and marine industry; whereas services at the Battery Warehouse include smartphone battery replacement, tool pack, battery rebuild, watch, and key fob battery replacement; and whereas the Battery Warehouse also serve the community by offering free battery health checks, charge system tests, and starter tests; whereas the Battery Warehouse has specialists with extensive backgrounds in electrical engineering and plumbing who enjoy interacting and serving the town residents. Therefore proclaimed that the Mayor and the Council of the Town of Leesburg and Virginia congratulate the Battery Warehouse on its 30th anniversary and recognize its continued service to the Leesburg community." I will go down and proclaim these. Before that, I would like to get a motion to recognize RJ Deli's 35th anniversary proclamation. Council Member Steinberg: So moved. This is the best part of the meeting because now we're going to present these proclamations. The very first one is to the Boy Scout Troop 982. Usually, we ask everybody to come up. You are most certainly welcome to come up. I don't know who your spokesperson for the group is that would be willing to accept this. Chris Stephenson: Everybody, let's -- [laughter] Mayor Burk: You all don't look like you're 40 years old. [laughter] Chris Stephenson: Thank you. [laughter] Mayor Burk: Come on gentlemen. You can come down on this side too. Everybody fill in. [pause] Mayor Burk: Do we have everybody up here? Are you the spokesperson? Chris Stevenson: Yes, ma'am. Mayor Burk: All right. Thank you, Mr. Stevenson. We really appreciate you coming up. Would you tell us about your organization and how have you been able to maintain 40 years of service to the community through the Boy Scouts? Chris Stevenson: Excellent. Well, thank you, Mayor Burk, for recognition of our troop. It couldn't happen without the support of all the adults here, their families, and their parents. With that, it's been, obviously, 40 years, although I've only been a part of this troop for the last three years. We could see that we are constantly growing with everything. What I do want to introduce is Cole Strickland. He's our senior patrol leader who's leading all of the scouts here this evening. We appreciate this opportunity. We hope to continue to keep giving back to the community. We just finished the Scouting for Food Drive last weekend. We have plenty more opportunities that we look to help give back to the community. If there's anything assistance that the troop can do, please reach out to us and we'll be glad to help out. Mayor Burk: That's wonderful. Thank you very much. Would you like to say a few words about your troop and what you do? You're the senior so has it made much of a difference for you? If so, how? Cole Strickland: I did not think I would have to talk but thank you. [chuckles] Page 40 November 15, 2022 [laughter] We've been around a while. I've only been here for five or six years, a small fraction of the time this troops been around, but it's been very impactful to me. I'm a Life Scout. I'm almost an Eagle Scout. I'm one rank away. I've gotten most of the merit badges and done most of that. I've gone on many campouts. I've seen this troop go from a bunch of older scouts and now they're all really tiny, create a bunch of new ones. I'm really glad to be a part of it, and I hope it goes for another 40 and more. Mayor Burk: Thank you. I'm sure you're very grateful for all the leaders that have taken the time and the effort to instruct you all but I can't resist the former teacher in me, anybody want to say anything? You want to make any comment about your experience as a Boy Scout and this particular troop? Greyson Stevenson: Hi, I'm Greyson Stevenson. I am the assistant senior patrol leader and it's kinda the same thing that what Cole does except I'm a step down. I help make sure that these boys are all doing what they're supposed to be doing. I am currently a first class scout, almost a Star Scout. I've been in the troop for two years and I can't wait to look forward what our troops are going to do. Mayor Burk: Wonderful. Now this is an opportunity guys. Anybody else want to say anything? Are you sure? Roman Shoja: I will. I've been here long enough. Mayor Burk: Okay, here. [laughter] [background conversation] [laughter] Roman Shoja: Hi, my name is Roman Shoja. I'm an Eagle Scout, and so is my brother. He's not here right now. I've been here since 2015 and it's been a wonderful troop. I've seen many generations go through this troop and lots of leadership changes and lots of fun trips. I just have to thank the Town of Leesburg and the Mayor's office and the whole Council for having us here and helping us celebrate our 40th birthday. Thank you so much. Mayor Burk: Very good. Ray Delpesche: Well, first of all, I am always honored to be here. The reason why I'm here is a pleasure that's been bestowed on me to be the Commander of the VFW of Loudoun County and to continue the efforts in helping our veterans community, their families in their time of needs and in their time of troubles when they do need assistance. It's a pleasure of mine to be here and to accept this proclamation on behalf of all the veterans. We have a lot of veterans here in Loudoun County and in Leesburg, in particular, and it's great that I am in a position to assist. I can't do it by myself. I have a wonderful staff that helps me, advising me with what is the best approach when we are faced with whatever challenges that do come up. I'm just blessed that I have this group of good comrades behind who assist me in my everyday efforts in making sure that my veterans in Loudoun County and Leesburg, taking care of us to the best of our ability. It's an honor to be here and to accept this. Mayor Burk: Well, thank you. You also are very generous in taking care of the families of veterans. A lot of times we forget the families and you guys make sure that we don't. We really appreciate all of your efforts and all that you do. All right, our next proclamation is for National Diabetes Month. Dr. Gandhi, would you please join us. This is really, really important and we're so glad that you're here because the goal of these proclamations is to inform and educate people. You represent lnova. I'm sure you'll explain your position, but would you please say words about what it means to have diabetes and what Inova is doing to make a difference. Amish Gandhi: Absolutely. Well, first, I'm very honored to have me and invite me and represent Inova at this very important proclamation. I think the relationship between physicians, healthcare Page 61 November 15, 2022 providers, and community leaders has to be part of the diabetes awareness process of treating and helping patients. l don't want to bore you with the facts, but I'm a board -certified endocrinologist, and what that means is I'm a diabetic specialist. I trained in Baltimore. I've been very happy to have to move to Ashburn, Virginia in 2009. No, l graduated- so then I moved in 2013. I've been practicing in Loudoun County since 2013. The nice thing about being in one location now for nine years-- Diabetes, unfortunately, doesn't go away. We can get it in remission, we can manage it, but just going in the community, I see my patients in the grocery store, on the street, and they become like friends and family to me. I think that's part of the Loudoun County community that I've really appreciated. They trust me with their healthcare, and I'm proud and privileged to be their healthcare provider. I've been part of a lnova Health system since 2006. We've certainly blossomed in this diabetes area, hiring more endocrinologists, more dieticians, diabetes educators, and trying to get into the early stages of the disease. Some of the facts about this is diabetics are now making up over 10% of the United States population. One in three likely have pre -diabetes, whether they know it or they don't know it. Ail ethnicities are affected, all social, economic backgrounds are affected by this unfortunate illness. The complications, unfortunately, we probably know, eyes are affected, organs like kidneys, heart, nerves are affected. The societal burden on this is both an economic and healthcare burden in hundreds of billions of dollars both in the cost of healthcare and cost of loss productivity, wages, et cetera, from people missing work. That's not to mention the suffering of individuals and families who have to go through these complications. The nice thing, one of the reasons I became an endocrinologist is we can intervene early. There's, obviously, genetic predispositions, but this is a condition where lifestyle choices, early medications play a huge role. There's many studies of diabetes prevention and simple interventions on a lifestyle basis, losing 5% to 7% of body weight, exercising 30 minutes, 5 days a week, and dietary modification, low on carbohydrates, saturated fats can prevent this illness and/or control blood sugar. Recently, they followed these patients over 20 years. The people who we intervened on early with lifestyle or early metformin medication had about a 20% reduction over 20 years in not developing this disease, and those that didn't develop the disease had 60% less eye disease, 40% less kidney disease, and 40% lower risk of heart damage. The immense position to say, "Okay, we want as a community to grow," and it's not just the doctors that are involved and that's why I'm glad to be in this forum because the workplace, the school, the community, public parks, nutrition in the school system, healthy food choices at restaurants, and then even in a workplace, having stress reduction, physical fitness as part of an employer's platform for their employees, all of this plays a role in how we can impact this illness and make early interventions. I think as a community, we want to advocate early screening, get your physical exam, do a fasting blood sugar, do a hemoglobin A1C, blood sugar screening, and then intervene on those numbers. They're not just numbers, they're a risk factor for your future health. I think as a community if we use this November Diabetes Proclamation and just say, "Okay, it's not just November, but we want to be eating healthy, exercising, and following our health on a day-to-day basis. We can start reducing that 10% number." This is not just Loudoun County, but all across the country, the nation is a big problem. Again, thank you for having me and, I'm grateful to be part of the Loudoun County community and continue to treat patients here. Mayor Burk: Thank you. Thank you very much. An example of that would be to clarify the minor special exception process ambiguous language currently. We want to get that more detailed for applicants. Another one would be to update another category's update uses and use standards. An example of that one is to clarify pool and hot tub regulations. Again, we're a little outdated to the International Building Codes, so we just want to get that updated in our Ordinance. Another category is limited sign criteria. One of the ones we want to change in there is to add a sign size limitation to our temporary signs. Currently, we have a practice but we want to get codified. The last section is our Airport Noise Data. Currently, our Ordinance is just referencing an outdated set of data. We just want to get that updated to the most current set of data. Again, we do have our motions you can find on the last page of your staff report with the resolution attached. If anyone has any questions, I'm willing to try to address them. Christine Newton: Good evening, Madam Mayor, Members of the Council. I am Christine Newton, the Deputy Town Attorney. I just want to give you a very quick presentation because I know you all Page 13i November 15, 2022 are pretty familiar with these license agreements. Town requires a license agreement to permit any outside entity to operate, install, or maintain facilities in the Town's Right-of-way. We have a current license agreement with Lumos. You may also know them as Segra. They do business under that name. That agreement is going to expire on November 161h, tomorrow. Proposed license agreement is necessary to allow Lumos to continue to install, maintain, and operate its facilities in their existing and their previously approved locations after the expiration of this license agreement. You all approved an amendment to their existing license agreement just recently because of the timetable for them to install additional facilities that benefit the County. They haven't quite installed all of those, so that's why this says to continue to install. All right, the previous agreement, November 171h, 2017, is what that should say, authorizing specific Rights -of -way for a term of five years. The fiber installed under this license agreement is generally for the use of LCPS and County facilities. It's been amended four times to adjust the fiber map, and you can see that those were 2019, one in 2021, and two of them this year. The terms and conditions of the agreement, just very basically, there is a statutory public rights away use fee that applies for the State Code and also in accordance with our Town Code. The term of the license agreement is gonna be five years. That is because if there is going to be a use of the public Right-of-way for longer than five years, you need a franchise agreement and the bidding process that goes with that. The license agreement will protect the Town's interest by requiring safe practices, a bond in insurance and indemnification by Lumos.. Here is the map and you can barely see it, but there are a couple little segments that are blue that, represent the newest amended fiber. I have a couple of motions. Any questions? I have just two small ones. I would like very much to thank Julie O'Brien and ProJet's Shye Gilad for hosting their annual ProJet Aviation Expo. This is an opportunity for students from around the area, from Pennsylvania, West Virginia, Maryland, and Virginia, to come to the Leesburg Executive Airport and meet numerous vendors in the aviation field. The intent is to get students that are interested or might be interested to learn about the aviation field. It's not just pilots and stewardesses, stewards, it's also mechanics, it's reception people, it's food catering. There are just so many jobs that are associated with aviation, and this is a huge opportunity. They have hundreds of kids come from all over the area to participate in this and they have given out over $1 million in scholarships. 1 want to congratulate them and thank them very much for doing this every single year, and hope they will continue to do so. Then finally, I just want to thank the residents of Leesburg for participating in our democratic process. It happens often in Virginia, but it's very gratifying to see that Leesburg residents are so committed. We had a large number of people come out to vote. I am delighted that I will be continuing on as your Mayor for another two years, another term. My door is open. I'm always interested in what people have to say, how they see our communities, and what are some improvements. I will continue with Meet the Mayor on a monthly basis and all the other outreach because I think it's important to hear from our communities and the people that live within them. Thank you very much for having the trust in me to continue to be your Mayor. I'm truly honored and proud to say that I am the Mayor of Leesburg. Thank you very much.
