SUMMARY STATEMENT:
This easement is different than most utility easements acquired by the City, in recognition of the
encroachments that have been constructed over the City's utilities. In particular, a carport and a `fire tower'
have been constructed by Alpine Village over the City's sewer lines. The `fire tower' is a large, covered,
outside staircase used to access part of the building.
Typically, the City is not responsible for any special notice to the owner prior to entering the property, or
any special surface restoration requirements after maintenance or other work which disturbs the surface of
the easement area. In this easement, the City is required to provide 48 hours notice prior to any maintenance
or repairs, except in the case of an emergency. Additionally, after any repairs or maintenance the City is
required to return the surface to compacted gravel (see ¶ 3, page 2).
Typically, the property owner is not allowed to construct any permanent improvements over the easement.
In this easement, Alpine Village is allowed keep the carport and `fire tower' built on the easement. They
may install asphalt, concrete, or landscaping over the easement and are responsible for maintaining and
restoring those improvements after maintenance or repairs by the City (see ¶ 5, page 2). Alpine Village is
responsible for any additional costs incurred by the City as a result of the encroachments (see ¶ 6, page 2).
The agreement has been approved by the City Attorney and executed by Alpine Village. Staff believes that
the terms of the easement will not impede the City's repair and maintenance of the underground utilities.
RECOMMENDED ACTION:
Approve the Alpine Village Underground Utility Easement Agreement and authorize the Mayor to sign
all necessary documents.
