SUMMARY STATEMENT:
On June 25, 2009 City Council adopted Resolution 09-07 authorizing the proceedings for Bear Basin and
Meadows Road. Attached is a report from the McCall Public Works Director that addresses the following
questions in relation to the validation: Are Bear Basin Road and Meadows Road public rights -of -way?
Does the City have authority as a highway jurisdiction and designated holder of public right-of-way?
Is the validation of Bear Basin Road and Meadows Road in the public interest?
On August 13, 2009, after hearing public testimony, and answering the above questions, the Council voted
to extend the public hearing until August 27, 2009. Council directed City Attorney, Bill Gigray, to draft
Findings of Fact/Conclusions of Law and Order of Decision validating Bear Basin Road And Meadows Road
as Public Rights -Of -Way.
RECOMMENDED ACTION:
Approve the Findings of Fact/Conclusions of Law and Order of Decision validating Bear Basin Road
And Meadows Road as Public Rights -Of -Way.
