On July 23, 2009, Joann Butler, attorney for Neighborhood Housing Services proposed a change to the lease, in Section Twenty -Nine - Right of First Refusal and Extension of Lease Term. On August 13, 2009 the Council discussed a letter sent by Nick Partin with USDA and Rural Development outlining specific concerns and reasons for their denial for a Loan Note Guarantee. The City Attorney was directed to work with NHS to resolve the concerns raised by Mr. Partin. The attached draft Lease incorporates changes to Sections 3, 10, 18, 22, and 38 in an attempt to satisfy the requirements of USDA RD. This draft is being reviewed by NHS and USDA. More information will be provided to the Council on August 27. RECOMMENDED ACTION: Approve the Amended and Restated Ground Lease with the changes recommended by Bill Nichols and authorize the Mayor to sign all necessary documents.
