SUMMARY STATEMENT:
A request for a 6 month extension of the Final Plat submission deadline. Per McCall City Code Section
9.2.07.A.3, a Final Plat application must be submitted within 18 month of the date of Commission approval
of the associated Preliminary Plat, unless an extension of time is applied for and granted by the
Commission. This request was approved by the Planning & Zoning Commission at their regularly
scheduled meeting on August 4, 2009. This request is appearing before the Council at the recommendation
of the City Attorney because the application was received after the associated deadline had passed, due to
the applicant being delayed by City Staff and the City Engineer. It was assumed that had the applicant been
responded to in a reasonable amount of time by the City that they would have easily produced the extension
request letter on time. But because their inquiries, as to the date of the deadline, were not answered until
the deadline had passed the applicant was unable to submit the extension request letter in time. It is the
City Attorney's opinion that we should accept the applicant's request, due to the unique circumstances of
the application. The applicant is actively working towards submitting a Final Plat application.
The new deadline for Final Plat submission would be January 23, 2010.
RECOMMENDED ACTION:
Approve the Final Plat submission deadline extension request for SUB-07-12, establishing a new
deadline of January 23, 2010.
