The approval was granted based on.a finding that the proposed plans are consistent with applicable review standards, with the following conditions: 1) Health Department approval of the septic system shall be secured prior to issuance of a building permit, unless the home is connected to the private Sewer System. 2) All mechanical equipment shall be adequately screened. 3) The new driveway entry shall be designed to include a Swale, to prevent the run -off of drainage onto Gulf Stream Road and to facilitate the free flow of drainage across the front of the property. 4) Prior to building permit application, drainage /grading plans shall be submitted for the rear yard and driveway Swale. 5) The storm shutters on the front elevation of the home shall be consistent in design (rather than a mixture of colonial and Bahamas shutters). The Architectural Review and Planning Board approved both items of the revision subject to submission of a landscape plan that softens the appearance of the addition, said plans to be submitted for the May 27, 1999 ARPB meeting, with 11 copies of the plan in the Town Hall no later than May 14, 1999. The Board authorized that work may be continued on the roof prior to submission of the required landscape plan after you have met all of the Palm Beach County Building Departments requirements. The owner has stated that the home will be painted a creamy yellow color. The proposed Floor Area Ratio ( "FAR ") is significantly below Design Manual limitations. The addition of a two car garage will bring the existing home into closer conformance with the Town's current codes, as no garage is existing at the present time. The property improvements also include the replacement of the existing paved driveway with St. Augustine brick, the addition of a swimming pool in the rear yard, and the removal of asphalt at the front edge of the property (to be replaced with sod). ARPB # 98 -16, page 1 The modifications should generally improve the appearance of the existing home. The design element which caused some deliberation was the replacement of decorative colonial shutters with functional Bahamas shutters. While this style of shutter is not specifically addressed in the Design Manual, the provisions pertaining to architectural consistency would apply. The home is proposed to contain a mixture of Bahamas and colonial style shutters. The rear of the home will have strictly colonial shutters to avoid overhangs above the walkways that are planned along the back of the house. However, staff has concerns about the front elevation and seeks input from the Architectural Review and Planning Board. The existing roof structure presented design challenges for the connection of the Florida Room addition, given the location and the long sloping roof of the previous addition on the north east side of the home. The architect chose a gable roof, running parallel to the gable of the existing home, with a slope matching that of the former addition (the slope was modified as a result of staff input during the review process). Because of termite damage he needed to replace windows and a picture window on the front of his home. He requested double hung single pane windows. After reviewing the Code and the ARPB file of the recent addition/ renovation, I noticed that the windows plans used muntins or had divided panes. Because of this and to maintain consistency of style and previous approval, I told Mr. Moreno that any new windows would require the same style as was recently constructed/ approved. After some discussion he stated that the windows style for the renovation was single pane. I drove by his home and verified the absence of multi -pane windows. This left me unable to justify the use of multi -paned windows for the limited applications he was requesting. Perhaps the CO was given without noticing the discrepancy in the type of windows installed. Mr. Moreno stated that the windows were this type when they purchased the home. He felt that replacing the existing single pane windows with multi -paned type would be inconsistent with the remaining windows and would look bad. The minutes of the April 22 meeting (which I did not see until receiving your letter of June 18`h) did not request or require my presence at the May 27`h meeting. I discussed this matter with my attorney, Adam Kurlander, who was present at the April 22nd meeting, and neither he nor I had any recollection that we were being requested to attend a subsequent APRB meeting. Had we received a notice of the meeting and agenda (as consistently done in the past) we might have been aware that there was a need to meei and discuss these matters wiih the board. However, since there was no negative commentary on the plans as submitted by Mr. Carter and we were not given notice of the meeting, we naturally assumed that the matter was concluded. I have attempted to contact Dan Carter to determine if he is able to appear at the June 24`h meeting on my behalf. Thus far, I have been unable to contact him. If I am able to contact Mr. Carter in advance of the meeting and his schedule permits. his attendance, then he will appear at the meeting on my behalf. If, however, I am unable to arrange for Mr. Carter to appear for me and it is absolutely necessary that I appear or have an agent appear for me, then we will have to request that the matter be held over for a later meeting which I can personally attend (late August /early September) or which Mr. Carter can attend on my behalf. You indicate that there was an Architectural Review and Planning Board meeting on May 27, 1999. I received no notice of either the fact or date of any such meeting. In the past I have always received both written notice and a proposed agenda. Because I was not notified of the meeting, I did not attend. I must admit that I also did not expect that there were any continuing unresolved issues. On April 26, 1999, pursuant to our meeting with city representatives, Daniel H. Carter of Carter & Associates Landscape Architects, Inc. submitted to the Town of Gulf Stream eleven (11) sets of landscape plans for our property at 3777 Gulf Stream Road including additional landscape material as discussed (please see the copy of Mr. Carter's transmittal letter enclosed). At the conclusion of his letter, Mr. Carter states "If this does not meet with your approval, please contact my office at your earliest convenience." I followed up with Mr. Carter and determined that he had received no comments or objections with respect to the plans so submitted. As such, both he and I naturally assumed that they were acceptable as prepared (which, I believe, was perfectly reasonable) including the additional material planted. With respect to the meeting scheduled for June 24, unfortunately I am not present in Florida in the summer months, other than for very brief periods to check on the house. Both business and personal matters require my absence until late August or early September. I would request that, in my absence, you provide copies of both this letter and the Carter Landscaping letter of April 26`h to the members of the Architectural Review and Planning Board at their meeting on June 24`. You advised me that you and your client were upset as a result of the Town having stopped work yesterday on the garage at your client's residence. You indicated to me that it was your understanding as a result of the conversation that you and I had with the Town Manager that the only work that could not be done as a result of the County's stop work order was the actual tiling of the roof. That is not my recollection of our conversation. As you know, a stop work order was issued by Palm Beach County and remains in effect on the property. Because your client was concerned about the effect that rain might have on his unfinished roof, the County, with the approval of the Town Manager, issued a correction notice in order to allow the roof to be hot mopped and tar papered. You and I had a conversation with Kris Garrison, the Town Manager for the Town of Gulf Stream, to clarify this matter because you had a concern that the correction notice issued by the County said that it was subject to the Town Manager's approval. In our conversation the Town Manager indicated that she was not the one to make the determination as to the stop work order and that such a determination was with the County, but that she fully understood and had no objection to the roof being hot mopped and sealed to protect the premises from the rain. You then voiced a concern about other work on the premises feeling that the stop work order relating to the violation on the garage should not apply to work on the remainder of the property. Although the determination as to the stop work order was with the County, the Town Manager indicated that her primary concern was with the portion of the garage which was inconsistent with the architectural approval. It was clear that no work should be conducted on that part of the structure. Adam Kurlander, Esquire April 14, 1999 Page 2 Yesterday the Town Manager in a general drive through the Town noticed that workmen were conducting work on that portion of the garage which was inconsistent with the architectural approval and in violation of the stop work order. She, therefore, instructed the Chief of Police to enforce the terms of the County's stop work order and the Chief followed up by instructing the workmen that they were in violation of the stop work order and that they should discontinue working. There are two issues here of which you and your client need to have an understanding. The first relates to the violation of the architectural approval by the Town. It was that violation which was the subject of our conversation and for which the stop work order was issued. The second issue relates to the County's inspection procedures. It is my understanding that your client is moving forward with construction without having the appropriate inspections required by the County conducted. I am advised that the foundation for the garage was poured, the walls were constructed and work was conducted on the interior of the garage all without having had an inspection from the County. The County requires inspections to be conducted at various phases of the job. I would suggest that in order for you and your client to have a clear understanding relating to the stop work order, the inspection process, and the Town's position relating to the architectural approval, that a meeting be conducted involving you and your client, the Town Manager and myself, along with a representative of the County. The addition of a two car garage will bring the existing home into closer conformance with the Town's current codes, as no garage is existing at the present time. The property improvements also include the replacement of the existing paved driveway with St. Augustine brick, the addition of a swimming pool in the rear yard, and the removal of asphalt at the front edge of the property (to be replaced with sod). The modifications should generally improve the appearance of the existing home. The design element which caused some deliberation was the replacement of decorative colonial shutters with functional Bahamas shutters. While this style of shutter is not specifically addressed in the Design Manual, the provisions pertaining to architectural consistency would apply. The home is proposed to contain a mixture of Bahamas and colonial style shutters. The rear of the home will have strictly colonial shutters to avoid overhangs above the walkways that are planned along the back of the house. However, staff has concerns about the front elevation and seeks input from the Architectural Review and Planning Board. The existing roof structure presented design challenges for the connection of the Florida Room addition, given the location and the long sloping roof of the previous addition on the north east side of the home. The architect chose a gable roof, running parallel to the gable of the existing home, with a slope matching that of the former addition (the slope was modified as a result of staff input during the review process). Mrs. Garrison explained that the revised addition is 359 feet smaller than what had been previously approved. She questioned if the Board felt there should be a new application submitted or if they were comfortable with her reviewing the revision administratively. Mr. Kent believed it should come back for review but the other four members, after looking at the site plan, did not feel another application and appearance before the board would be necessary in that the scope of the approved project had been reduced. Addressing the comment made by Mr. Wietsma concerning the fact that three car garages had been approved for other projects, Mr. Kent pointed out that Attorney Randolph had stated at an earlier meeting that just because something was approved for one project, the Board is not obligated to approve the same thing for another project.
