Spoke to Council regarding affordable housing and amendments needed to the Zoning Ordinance to help facilitate more affordable housing projects in Leesburg. Mr. McLister also suggested Council allow itself to grant waivers to some of these requirements during the Zoning Ordinance rewrite process. Michael Stanbridge, Nathan Place. Leesburg. Spoke to Council regarding proposed amendments to the Town Code that would allow his RV in excess of 14,000 pounds GVWR to be parked on Town streets for less than 10 days to allow for loading and unloading his RV, when needed. L 4I Page COUNCIL MEETING January 10, 2023 Council Member Cummings disclosed he had a phone conversation with Mr. Kevin Ash regarding the property on King Street and a phone conversation with Mr. Carl Gustafson about the property behind Lightfoot Restaurant. Council Member Wilt disclosed he met with Mr. Carl Gustafson about the proposed development behind Lightfoot Restaurant. Council Member Bagdasarian disclosed he had a phone conversation with Mr. Carl Gustafson about the proposed development behind Lightfoot Restaurant. 18. MAYOR DISCLOSURES AND COMMENTS / ADDITIONS TO FUTURE MEETINGS Mayor Burk disclosed she met with Mr. Robert Keller and Mr. Kyle Cosby regarding property at the Village at Leesburg. Mayor Burk noted that the Sergeant Major John Champe Chapter of the Sons of the American Revolution came to Town Hall to present her with a Certificate of Appreciation for supporting their efforts. Mayor Burk attended the swearing-in ceremony of new 20th Circuit Court Judge Matt Snow Mayor Burk participated in a General Assembly Town Hall and asked the Delegates to carefully consider when making decisions affecting local planning and zoning issues. Mayor Burk advocated for those items to be handled locally and not in Richmond. Mayor Burk attended the swearing-in ceremony and dinner for the Loudoun Volunteer Fire Company and swore in their new officers. Mayor Burk welcomed the new members to Council. 19. TOWN MANAGER COMMENTS Mr. Dentler welcomed the new Council Members to the dais. Mr. Denier announced the recruitment process is underway for the Chief of Police and that Council would soon be receiving requests for surveys and mterviews. Mr. Dentler said the process will take several months. 20. CLOSED SESSION a. Pending Annexation with the Respect to the Joint Land Management Area Mayor Burk noted it was the consensus of Council that no Closed Session was needed. 21. Council Member Nacy All in favor indicated by saying aye [crosstalk] Opposed That passes 7-0 There are no presentations tonight, nor are there any regional commission reports That takes us to our petitioner's section In our petitioner's section, one of the first orders of business is to hear from the public All members of the public are welcome to address Council on any item, matter,or issue Please identify yourself,and if comfortable doing so, give your address for the taped recording Any public speaker will be requested to state their name and spell it for the purpose of the closed captioning In the interest of fairness, we also ask that you observe the four-minute time limit The green light on the timer will turn yellow when you have one minute remaining At that time, we would appreciate your summing up and yielding the floor when the bell indicates your time has expired Under the rules adopted by this Council, the time limit applies to all The first name on our petitioner section is Mike McLister Mike McLister: Good evening Thanks for the time Last time I was here, we had a project that was on one of my properties There was some conflict as it related to what the project was all about, going through the process and whatnot I didn't put that on the agenda.That was not something that I put up I was discussing it through the Planning Commission,through the Zoning I just wanted to clear that up I know we had a discussion about that project, but what I'm here today to talk about is the noble effort to provide affordable housing and affordable office space for the lower to mid incomes We can do this We can do this I've had conversations over the last months, but more recently with some Council members Our current Zoning Ordinances are in conflict with our ability to be able to produce this Discussion had to do with incentives on being able to get this done for low to moderate incomes, to be able to live and works amongst us My point is that it's not incentives that are needed It's the removal of disincentives. Inside our current ordinances,there are so many disincentives that were written in the 1960s that hamper your abtlity to be able to provide this As we know,COVID has changed us The way people live and work has changed It's probably changed forever I'm a proponent of an ability where we have a subset of not just commercial or residential, but we have a subset where people live and work and can live and work amongst us in Leesburg We can help small businesses get this done,but what we have to do is we really have to take a look at some of the ordinances which stop it For example, I went up to do a project where I was trying to give the Town a lot, split a lot, and create nine live-work units We could try nine of them You would get the building to go green You get all the things you want On Royal Street, there's a capital improvement project that's approved, money is approved for the curb and gutter I get greeted with, "You need to pay for curb and gutter" But it's already in the Capital Improvement Project Doesn't matter It's not going to be done for another year You need to pay your portion" That's an example of a disincentive That's something that's already going to get done You can wait I wanted to give the Town a lot I wanted to split a new revenue-producing lot That lot in the regulations needed to be 10,000 square feet each There's not a lot of those size lots in downtown Leesburg That gets stopped if you are able to do it, we've talked a little bit about this before which is still alive in the regulations It you're going to have more than a couple of units,you need to put a swimming pool If you're not going to put a swimming pool,you can put ajungle gym You're not going to put a jungle gym, but it has to be a tennis court That's a live regulation These types of things hamper the ability to get those done It's nobody's fault Staff didn't wnte it, but it's what we have to live by If I could make a suggestion so that we could probably move forward on some of this is you guys are going away in January on the summit and congratulations on the new Council Congratulations to Vice Mayor I didn't know Mr Spera could probably help with this It'd be great while the Zoning Ordinance is being rewritten, that's taken two and a half years Then, interest rates have tripled, building costs up 150 Page 3 I January 10, 2023 It'd be great if you could grant yourself the waiver ability on certain regulations to accomplish goals in the interim period of the Zoning Ordinances being changed Where if you have goals that you want to get accomplished where we have certain zoning ordinances that we're waiting on to be done in two and a half years that if you create yourself the ability to vote on waiver ability so that you could move forward, suggesting that I would have Thank you for your time Good to see you again Mayor Burt Thank you very much Thank you, Mr Mobster Is there anybody else in the audience that did not sign up that would like to have the opportunity to speak at this point? Oh, excuse me, sir Mike Stanbridge: My name is Mike Stanbndge I believe that I used the online tool to register for the petitioner's section If I may Mayor Burk:You most, certainly, may Oh, you are on here [laughs] I'm sorry I missed it Mike Stanbridge: Not a problem Well, good evening, Madam Mayor, Members of the Town Council I'd like to extend a welcome to new members and a thank you for continued service for members who have served a term or a few in some cases My name is Mike Stanbndge I'm a proud Leesburg resident I grew up here as a child My wife grew up here as well and we're proud to raise our children here in Leesburg As much as we enjoy spending our time in Leesburg, we also enjoy traveling Last year, about 12 months ago, we made a decision to purchase an RV, a class-A motor home. Part of my research for that purchase was the applicable Town ordinances and codes for parking that vehicle in the Town of Leesburg Now, my plan for this vehicle was not to keep it on Town streets It was to store it in a storage facility out of Town when I wasn't using it When we were using it to bring it into Town a day or two before the trip to pack it, service it,goon the trip,and then at the conclusion of the trip, have it in our neighborhood for a day or two as I unpack it and clean it before it goes off to storage In other words, this vehicle is not going to live in the Town It's going to be stored when we're not using it What I found in my research was the section of the Town Code 32-143(A),which states that,"No person shall park the following vehicles on any Town street for more than 10 days Therefore, vehicles listed RVs are one of them" I thought, "All right Well, I don't need 10 days I need a fraction of that" I confirmed this Town Code with a Sergeant at the Leesburg Police Department who confirmed that it was applicable and appropriate to my situation We had a great summer with the RV, did some great trips,had in front of the house as we needed to for packing and packing Up until about two weeks ago, I think it was December 151h, a Captain with the Leesburg Police Department and another officer came to my house responding to a complaint about the RV that I had parked in the neighborhood He informed me that that was not permitted and that I needed to move the RV,which I did I moved it an hour later that day I also explained to the officer that I thought that I was operating under Section A of that Code that said that I had 10 days. He said that that is correct, but there's also Section B that says, "That no person may park the following vehicles in a residential area"There's 16 vehicles listed In that list, it includes any vehicle that has a Gross Vehicle Weight Rating, GVWR, of more than 12,000 pounds Motor homes are not specifically listed as a line item in Section B, but my motor home happens to weigh more than 12,000 pounds,so t applies I said,"Thank you I didn't realize that part of the Code existed," but also during the course of the year through passing conversations with other officers, at least four other officers confirmed that I was in compliance with the Code That Code, the way it is currently written, generated some confusion within the Leesburg Police Department who was charged with enforcing regulation A few days after the conversation with the officer-- By the way, it was a great conversation He expressed empathy, a sincere desire to help me This is not a complaint about the Police Department Page 4 I January 10, 2023 whatsoever He could have ticketed the RV and been [inaudible], so no complaint whatsoever about the police officer A few days later, I contacted the Town Zoning Department with a question of, if there was a list or a map of non-residential areas in Town that I could park the RV Figured, "If it can't be parked in a residential area, maybe there's a non-residential area I can park it in" I was told that, "Such a list did not currently exist, but it was a good idea and they would look into it" I also contacted Town Attorney's Office for clarification on the applicable Code, and they were very helpful They told me that, "In addition to Sections A and B, there's also a Section C that says that that prohibition I mentioned in Section B, it doesn't apply to vehicles that are loading and unloading equipment or furniture if they're parked for 48 hours or fewer I said, 'Well, yes, the RV could conceivably fit into that category, but when you read that, outside the context in RV, what does that vehicle sound like?" "Well, it sounds like a moving truck It sounds like delivenng a couch or perhaps an appliance It doesn't sound like an RV" My ask for the Town Council is to take a look at this Code and see if it can be reworded, so,one, it's easier to enforce by the Leesburg to Police Department, and for my case specifically, if the 14,000 pound limit was removed, I would be in compliance Also, instead, if an exemption for RVs was included in that 14,000 pound limit, I would also be in compliance In other words, I don't want to store my RV in Town I have a storage facility for it I just want to be on the right side of the law, so to speak, when I'm loading it before a trip and unloading it after a trip I feel like that's a reasonable ask, and if it pleases the Council, if you could take a look into that and see if any adjustment could be made, I and my family would very much appreciate that Thank you for your time Mayor Burk:Thank you Mr Stanbridge, we are doing exactly that Thank you for your email to let us know about the inconsistency, and the Town Manager and the Town Attorney are in the process of looking at it. I believe you've made an exemption in regards to-- Christopher Spero: It says you emailed 12 30 today Mike Stanbridge Yes,sir Christopher Spero: I sent you an email at 12 30 today,they addressed the situation In the interim,the exception under 32-143 Sub C-2 is going to be applied to motor homes, and then we will bring a proposed amendment after staff gets together If you look at the email that I sent you at 12 30 this afternoon, it directly addresses all of the issues that you raised this evening Mayor Burk: So good job [laughs] Mike Stanbridge: Thank you. Council Member Steinberg: I will even it up I have none Mayor Burk: My disclosure I have is, December 141h I met with Robert Keller and Kyle Cosby in regard to property at the Village of Leesburg On December 209h the Sergeant Major John Champe, Chapter of the Sons of the American Revolution came to Town Hall and gave me a certificate of appreciation for supporting their efforts. I'm very proud to be able to support the Sons of the American Revolution and was very delighted to accept their thanks On January 6'^, I went to, Matt Snow was sworn onto this 20'h current Circuit Court, excuse me, the Circuit Court of Leesburg, Fauquier and Rappahannock Congratulations to Judge Snow On January 7'^,the General Assembly had a Town Hall I spoke to the Delegates and asked them to carefully make decisions in regard to local planning and zoning and that it should be done locally and not in Richmond On that same night the Loudoun Volunteer Fire Company had their annual dinner and swearing in and I was privileged to swear in the officers I did, though, read their entire swearing in paragraph and then looked up at them expecting them to read it back to me all at once.We had to redo that, but it worked out just fine I want to thank them very much and I want to welcome the new members to the Town Council Manager, Mr Dentler? Kaj Dentler: Thank you Just one announcement for you other than welcome to the dais, Mr Wdt and Dr Cimino-Johnson Council Member Cimino-Johnson:Thank you Page 6 I January 10, 2023 Kaj Dentler: The announcement is that you'll be starting to get information from me soon over the next few weeks as we begin to move forward with the recruitment process for the new Chief of Police Some, I think I've talked to most of you It's a long process that we go through It's a very thorough, community engaged process with our vanous stakeholders Part of that process will include surveys and interviews All of you will be interviewed by the recruiting firm that's doing it to begin to find out what the community is looking for, what type of leaders, what are the challenges as they begin to build a profile that we will then, actually, put out The profile will probably be out late January, early February, and then we'll go through it We probably will not have achieved till late spring, early summer, but I just want to mainly let you know the process is well underway You'll be contacted soon I'll forward your information, but in case you get asked,we're moving forward Mayor Burk: All right Thank you Two things I want to clarify that we will not be having a closed session tonight Secondly, again, I want to say to the new members do not expect that this is how the meetings are going to go This is very unusual to end this quickly Don't get comfortable Do I have a motion to adjourn?
