ROLL CALL The f ollowing Councilmembers were present for roll-call: Present: Deeken, Fitzwater, Hensley, Kemna, Lester, Schreiber, Spencer, Spicer, Ward Absent: Wiseman CLOSED SESSION Pursuant to Sec. 610.021 of the Revised Statutes of Missouri, Mayor Tergin entertained a motion to go into Closed Session to discuss the following: i. Attorney Client Privilege [Sec. 610.021(1)] ii. Hiring, firing, disciplining or promoting of particular employees [Sec. 610.021(3)] A motion was made by Councilmember Spicer to go into Closed Session for the above- stated reasons, seconded by Councilmember Lester and approved by the following roll-call vote at 6:05 P.M.: Aye: Deeken, Fitzwater, Hensley, Kemna, Lester, Schreiber, Spencer, Spicer, Ward Nay: None Absent: Wiseman RECONVENE IN OPEN SESSION Following the Closed Session, the City Council reconvened in Open Session at 6:23 P.M. with the following Councilmembers present: Present: Deeken, Fitzwater, Hensley, Kemna, Lester, Schreiber, Spencer, Spicer, Ward Absent: Wiseman Mayor Tergin and Mayor Elect Ron Fitzwater announced the City Council’s closed session vote to accept City Administrator Steve Crowell’s resignation effective immediately. ADOPTION OF THE AGENDA Councilmember Schreiber motioned and Councilmember Spicer seconded the motion to adopt an amended agenda, adding Lincoln University Student Representative Update after Announcements. The motion passed unanimously by voice-vote. MISCELLANEOUS AGENDA ITEMS Mayor Tergin presented a retirement proclamation from Sister Jean Dietrich of Helias Catholic High School. 2 FIRST REGULAR COUNCIL MEETING, APRIL 17, 2023 PUBLIC HEARINGS a. Approving a Special Exception Permit for a Truck Stop/Travel Plaza for Property Located in the 200 Block of Militia Dr i. Resolution RS2022-51 (Lester) Staff: Eric Barron A Staff presentation was made by Eric Barron, City Planner. Jay Burchfield – Developer – SlverTree Companies, 302 Campusview Dr., Columbia, MO spoke in favor of the bill. There being no one else to speak on the bill, Mayor Tergin declared the evidentiary portion of the public hearing concluded. RS2022-51 sponsored by Councilmember Lester A RESOLUTION OF THE CITY OF JEFFERSON, MISSOURI APPROVING A SPECIAL EXCEPTION USE PERMIT TO OPERATE A COMMERCIAL VEHICLE SERVICE TRUCK STOP/TRAVEL PLAZA FOR PROPERTY LOCATED IN THE 200 BLOCK OF MILITIA DRIVE Councilmember Kemna motioned and Councilmember Schreiber seconded the motion to adopt RS2022-51. Paul Sampson with Central Missouri Professional Services spoke in favor of the bill. Gary Plummer, President/CEO of Jefferson City Area Chamber of Commerce spoke in favor of the bill. Bill 2022-116 was read third time by title, placed on final passage, and passed by the following roll-call vote as Ordinance 16333. Bill 2022-117 was read third time by title, placed on final passage, and passed by the following roll-call vote as Ordinance 16334. Bill 2022-118 was read third time by title, placed on final passage, and passed by the following roll-call vote as Ordinance 16335. ANNOUNCEMENTS BY MAYOR, COUNCIL, AND STAFF City Council committee announcements: • Committee on Administration – There was nothing to report at this time. • Finance Committee – There was nothing to report at this time. • Public Safety Committee – There was nothing to report at this time. • Public Works & Planning Committee –The committee met on April 13th, 7:30 A.M. in Council Chambers. Mayor announcements: • Former Mayor George Hartsfield passed away on April 9th. A visitation and memorial are scheduled for May 19th. • The Hickory and Adams park renovations have been completed. Councilmember Lester noted he’s already seen the neighborhood enjoying the improvements. 5 FIRST REGULAR COUNCIL MEETING, APRIL 17, 2023 • Earth Day is April 22nd. Serve Jeff City is April 22nd. Sign up to participate at missionjc.org. • Drug take-back day is April 22nd at the Jefferson City Police Dept. from 10:00 A.M. – 2:00 P.M • The CRMU Amphitheater has added a few shows. The entire schedule can be found at crmuamphitheater.com. • The bulky item pick up days are Monday, April 17 th for addresses west of Hwy. 54 and Monday, April 24th for addresses east of Hwy. 54. • Rachel Senzee, Neighborhood Services Manager provided an MSP Grant Update. LINCOLN UNIVERSITY STUDENT REPRESENTATIVE UPDATE This was Octavia Ailsworth’s last City Council meeting. She announced the following: Springfest: Springfest is this week from April 16th - April 22nd. Everyone is invited to High Street for LU TAKEOVER DOWNTOWN on April 20th from 6:00 P.M. – 9:00 P.M. LU Vocal Ensemble and various LU students will be performing. This free event is open to the public. Come to The Linc for a fun-filled day of rides, games, a bounce house, face painting, a kids’ corner, and a petting zoo on April 22nd from 12:00 P.M. – 5:00 P.M. Admission is $5 for ages 4-12, $10 for those 13 and up, and is free for kids three and under. Feed at the petting zoo will have an additional fee. Honors Convocation: Honors Convocation will take place this Thursday from 11:00 A.M. to 1:00 P.M. in Richardson Fine Arts Center. Spring Open House: Prospective students are invited to learn about all aspects of life at Lincoln University of Missouri. This will take place this Friday, April 21st from 9:00 A.M. to 3:00 P.M. in the SUC Ballroom. LU-MRRL Lecture Series: Immersive Reading Experience: The LU-MRRL Lecture Series invites you to attend the next event, “The Immersive Reading Experience: Creative Writing Students of Lincoln University”, happening at the Missouri River Regional Library, on Monday April 24th at 6:30 P.M. Spring Commencement and closures: Spring Commencement, as well as the conclusion of the Spring Semester will be on May 13th. James Noah, President of the IAFF Local 671 Labor Union and Josh Young spoke in favor of the bill. They both thanked Councilmembers and City Staff for working with the union through the negotiation process. They also spoke in favor of bill 2022-124. Councilmember Schreiber requested to suspend the rules and take up bill 2022-123 for third reading and final passage. With no objection, bill 2022-123 was third read by title, placed on final passage, and passed by the following roll-call vote as Ordinance 16338. APPROVAL OF APRIL 3, 2023 CLOSED SESSION MINUTES Councilmember Lester motioned, and Councilmember Ward seconded the motion to approve the April 3, 2023 Closed Session Minutes. The motion passed by the following roll - call vote: Aye: Deeken, Fitzwater, Hensley, Kemna, Lester, Schreiber, Spencer, Spicer, Ward, and Wiseman Nay: None UNFINISHED BUSINESS Mayor Tergin presented a summary of her eight years serving as the Mayor of the City. She thanked the City Councilmembers, Staff, and citizens for working with her during her term. She then recognized each of the Councilmembers for their service, with special recognition to those leaving the City Council, Councilmembers Kemna, Schreiber, and Ward. Each of the three received a plaque with a key to the City. ADJOURN SINE DIE A motion to adjourn sine die was made by Councilmember Wiseman, seconded by Councilmember Spicer, and approved unanimously at 8:04 P.M. ADMINISTRATION OF OATH OF OFFICE TO NEWLY ELECTED OFFICIALS Honorable Jon E. Beetem, Presiding Judge, 19th Judicial Circuit swore into office the following: Mayor – Ron Fitzwater Councilmembers – Jeff Ahlers (Ward 1), Aaron Mealy (Ward 2), Scott Spencer (Ward 3), Derrick Spicer (Ward 4), and Mark Schwartz (Ward 5) Scott Evans and Gaylin Carver were not in attendance. They were sworn in respectively as Municipal Judge and City Prosecutor at an earlier time.
