RESOLUTION NO. 95 -3464
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE
CITY CONFIRMING THE PLANNING COMMISSION'S ACTION AND
REFERRING THE SUBJECT PROPERTY NUISANCE CASE TO THE
CITY'S CODE ENFORCEMENT OFFICER FOR THE PROPERTY
LOCATED AT 9056 BROADWAY, TEMPLE CITY. (SHAW)
WHEREAS, it is a public nuisance for any person owning, leasing, occupying or having charge or
possession of any premises within the City of Temple City to maintain such premises contrary to the
provisions of Temple City Municipal Code Section 4230; and
WHEREAS, the City's Code Enforcement Officer indicates that a public nuisance existed on the
real property located at 9056 Broadway, Temple City, California by allowing garbage, miscellaneous debris
and trash in the front and side yard areas contrary to the provisions of Temple City Municipal Code
Section 4230; and
WHEREAS, the Planning Commission of the City of Temple City on October 24, 1995, held a duly
noticed public hearing and received testimony from owners, witnesses, City personnel and interested
persons to ascertain whether certain premises constitute a public nuisance; and
WHEREAS, the Planning Commission determined that a public nuisance exists on the subject
property and there is sufficient cause to rehabilitate, repair, or demolish said property; and
WHEREAS, subsequent to the Planning Commission hearing, the property owner has removed
a substantial amount of the garbage, miscellaneous debris and trash.
NOW, THEREFORE, the City Council of the City of Temple City does hereby resolve as follows:
SECTION 1. The City Council hereby declares that the following conditions have been partially
resolved on said property in accordance with the provisions of Section 4230, 6232 and 6236-6238 of the
Municipal Code of the City and Section 9332.A.1 of the Zoning Code of the City:
4230(P) Packing boxes and other debris stored in yards and visible from public
streets for unreasonable periods.
6232. Garbage - Containers and location
6236. Public or private places - it is unlawful to discard garbage in or upon any
public or private property within the City
6237. Duration of storage of garbage and debris
6238. Duty of property owners re: garbage collection
9332.A.1.
Parking of Vehicles. No person shall park any vehicle or any component
thereof, for any purpose, in any front or side yard area on any "R" zoned
lot, except in driveway area.
SECTION 2. The City Council hereby forwards the subject public nuisance case to the City's
Code Enforcement Officer for final resolution. Citations shall be issued if the property is not brought into
full compliance and maintained in accordance with all applicable City Codes.

SECTION 3. The City Clerk shall certify to the passage and adoption of this resolution.
