2. Minutes
On motion duly made and seconded the minutes of the
November 4, 1987 meeting were approved.
3. Variance request by Dr. and Mrs. Jared, Lot 62, 915
Emerald Row. (Letter from Homeowners Assoc, regarding
Lots 62 -63 was read and is a part of the Minutes).
After examination of plans and discussion with Dr.
Jared the Board approved the following.
1. Modification to resite the home with a 25' front
setback (to the front wall) and a 31' rear
setback (to the rear wall of home).
2. A 25' front setback exclusive of eaves and overhangs
(which may encroach).
3. An extended angled garage.
4. A minimum lot size.
The recommendations will be brought before the Town
Commission sitting as the Board of Adjustment at their
regular commission meeting February 12, 1988 at 9 A.M.

After examination of plans and discussion the Board approved
the following.
1. Recommend approval of requested variance to front yard
setback with applicant allowed to encroach eaves on garage
to 24' setback line.
2. Recommend variance to minimum lot size.
3. Denied side yard variance from requested 15' and stated it
must meet the 18' setback requirement.
The recommendations will be brought before the Town Commission
sitting as the Board of Adjustment at their regular commission
meeting Feb ruary 12, 1988 at 9 A.M.
The Code Enforcement Officer noted the presence of a trailer in the
community for the next six months on the Natapow property. All
necessary permits have been issued for said trailer.

NOTICE TO RESIDENTS OF THE
TOWN OF GULF STREAM
The following variances have been requested pursuant to Section VII.,
I.1., (Building Site Area Required) and Section VII., J.1., (Front
Yard Required) Gulf Stream Zoning Ordinance (l Single Family
Residential District).
1. A request to allow construction of a single family dwelling
on a lot size of less than 20,000 square feet.
2. A request to reduce the required front yard setback of 35 feet
to 33 feet.
Property location - 935 Emerald Row - Lot 62 - Place Au Soleil.
The Town of Gulf Stream Planning and Zoning Board will review the
request at it's regular meeting on Wednesday, February 3, 1988 at
9 A.M. at the Gulf Stream Town Hall.
The Town Commission, sitting as the Board of Adjustment, will conduct
a public hearing at 9:00 A.M., Friday, February 12, 1988 at 9:00 A.M.
at the Gulf Stream Town Hall, 100 Sea Road. All interested persons will
be given an opportunity to be heard.

Dear Sirs:
This is a letter of justification as required for" variance in Town of Gulf -
stream. As indicated on the attached application, our lot is "under-
sized" by ±4,300 SF. The subject property is located west of the Intra-
coastal Waterway and was parcelled prior to the Town's definition of min-
imum lot requirement. We are not sub - dividing any parcel, but submitting
the lot as it exists.
A second variance requested regards a two foot garage roof overhang.
This overhang is a triangular area measuring approximately 47' square feet.
It is situated 45 feet from the road to the south, 56 feet form the east pro-
perty line, and 61 feet from the west property line. In this position it
has virtually no visual encumberance on any neighbor.
Please take note of the two variances and find that our proposal will be
in harmony with the general intent and purpose of the ordinance, and
that such variance will not be injurious to the area involved, or otherwise
detrimental to the public welfare.

request at it's regular meeting on Wednesday, February 3, 1988 at
9 A.M. at the Gulf Stream Town Hall.

Re: Proposed residence for Lot 63
Dear Sirs:
The following are reasons which are substancial enough
to warrant application for a variance:
a) The subject property was plotted with a total
sq. ft. of 17,691 ( the required sq. ft. is
20,000).
b) Due to the irregular slope of the lot, it
creates unusually large setbacks.
(Please note that the rear property line
is only 69- 0" wide less 30' -0' for setbacks,
leaving 39 -0 buildable area).
c) After plotting the required setbacks, the
remaining buildable area is exce tionally
restricted. (See sketch enclosed .
d) To locate the garageso that you do not have
total front view of the doors created an
additional hardship, in that, the main body
of the house had to be pushed further back
into the narrowest buildable area.
We have,therefore,tried to design a residence which
would have the least encroachment into these setbacks
with the minimum impact to the adjoining lots as well
as the community. Please note that although the garage
encroachment is only one corner , we have provided
a large landscaped area to soften this impact. Also,
it should be noted that the main body of the residence
is 36 -0 °from the front property line.

be elegant and attractive as well as being an asset
to the development.

Our Board of Directors, sitting as our Architectural Committee,
reviewed plans for the referenced lots and adopted the following
positions:

2. Site Plan approval is granted provided Site Plan is modified
to resite the home with a 25 foot front setback (to the front
wall) and a 31 foot rear setback (to the rear wall of the
home).
3. Recommend that variance to front setback requirements be
granted by the Planning Board and Board of Adjustment to
allow for 25 foot front setback exclusive of eaves and over-
hangs (which may encroach).
4. To the extent angled garage siting necessitates variance,
recommend that same be granted.
