Mayer, Chairman Charles E. Eaton, Vice Chairman Thomas E. Brandt William Lynch (Mrs.) Joan Orthwein Also present: (Mrs.) Barbara Gwynn, Town Clerk Richard Brandt, Code Enforcement Officer 2. Minutes On motion duly made and seconded the Minutes of the March 2, 1988 meeting were approved. ttt Concerned about a disputed boat -lift and dock erected in their area and with questions on Deed restrictions several residents appeared before the Board. After discussion of the issues and examination of maps, Chairman Mayer assured the residents that this matter would be taken up with the Town Attorney and that it would cane before the Town Commission. 3. Site Plan Review and Variance Request. Owner, Mr. Robert Place, Lot 40 - 2564 Ave. Au Soleil. Request to reduce rear yard setback to twelve feet to construct a screen enclosure. All interested parties having been notified and advertised and there being no objection, the Board on motion duly made and seconded approved this request. After discussion and examination of plans, Notice made and there being no objection by the neighbor that the structure is to be used only as a garage owner will so state that restriction, the Board o n seconded approved the request. Site Plan Review of advertisement having been s and that the file reflect and that a letter from the motion duly made and Mr. Ton Walsh. Request to construct a single- family residence. Range 43 E. of Ocean Blvd. After examination of plans and discussion with the Code Enforcement Officer and there being no objections by the neighbors, the Board on motion duly made and seconded approved the request. After discussion and examination of plans the Board on motion duly made and seconded approved the request. Plan Review Dr. and Mrs. Allen Jared. Lot 62, Place Au Soleil. Request to construct a single - family residence. After discussion with the architect about the addition of an outside storage room not showing on the plans he submitted but which he will submit and the said storage room being within the required setback the Board on motion duly made and seconded approved the request. Discussion ensued on the Charlton matter and on Deed restrictions. Concern for Board consideration limited to the Codes without similar consideration for Deed restrictions will be brought to the attention of the Town Attorney and the Town Conrni.ssion. Noting that the Boards responsibility is to the community, Mr. Mayer and the Board suggested Deed restrictions be filed with the Town and that Site Plan applications contain the question "are there any Deed restrictions on the property "7 Further discussion on usage control of structures followed.
