The meeting was called to order at 8:05 a.m. by William A.
Mayer, Chairman.

Discussion ensued on the problem of large houses on small

and Zoning Board study this problem and make recommendations
.to improve existing Planning & Zoning Codes with reference
to this particular problem.
After further discussion and the filing of a letter from an
immediate neighbor, Mr. Stahl, containing four conditions
under which he would have no objection to the granting of
said variance request,the Board on motion duly made and
seconded recommended approval of said variance provided Mr.
Stahl's letter is forwarded to the Town Commission and also
provided all four points in Mr. Stahl's letter are followed
by all concerned. Copy of which is attached hereto.
Site Plan Review
Owner: Mr. Donald Walsh Lot 90, Place Au Soleil, 915 Orchid
Lane. Request to add an addition to an existing family
residence. Re- submitted plans that were previously reviewed
by the Board and denied.
The Board was informed by Mrs. Gwynn that the plans as
submitted do not meet Town setback requirements.
The Chairman read aloud a letter from the Place Au Soleil
Home Owner's Association Architectural Committee expressing
its concern for the planned addition as a temptation for use
as a multi - family dwelling.
Recognizing that the door and its location are the problem
Mr. Mayer recommended the plans be approved by the Home
Owner's Association of Place Au Soleil and then brought back
to the Planning & Zoning Board.
There being no further business to come before the Board
the meeting was adjourned at 9:30 a.m.

Town of Gulf Stream
In regard to the five variances request for Lot 19 Polo Cove
and as neighbors on the west side of the property, my wife and I
do not register any objections to the granting of the variances.
However, this position of "no objections" is based on the following:
1. We understand that the ground floor elevation will be 8.07'.
2. Auger pilings, or other non - driven pilings, will be used wherever
piles must be installed.
3. The owner will inform us 48 hours prior to commencing demolition
or installation of piling.
4. The drainage plan as presented is acceptable and the Town is
requested to insure implementation as designed.
As a final comment, I consider it appropriate and timely for the /
Planning and Zoning Board to undertake a study of the problems created
in the Town by the construction of large houses on small lots and to
prepare recommendations for the Town Commission as to how the Zoning
Code might be amended to minimize such problems in the future.

forty feet twenty five inches to ttfirty three feet five inches,
(40'25" to 33'5 ") as required in Section VII, J.1. front yard
required. To reduce the east side yard requirement from fifteen
feet to eleven feet ( 1510" to 11'0 ", and the west side yard
requirement from fifteen feet to eleven feet 5 inches (11'5 ")
as required in Section Vll, K.l. Lot 19, Polo Cove. 543 Palm
Way.
The Planning apd Zoning Board will conduct a public hearing
May 4, 1988 at 9 A.M. and the Town Commission sitting as the
Board of Adjustment will conduct a public hearing on May 13, 1988
at 9 A.M. Gulf Stream Town Hall, 100 Sea Road, Gulf Stream. All
interested parties will be given an opportunity to be heard. Plan
are on file at the Town Hall.

Questions 6 Answers:
Question: (A) That special conditions and circumstances exist
which are peculiar to the land, or building
involved and which are not applicable to other
lands, structures, or buildings in the same zoning
district.
Answer: (A) There is an existing building on the site, and that
it would be a hardship financially not to use part
of this existing structure and would also be
aesthetically poor.
Question: (B) That the special conditions and circumstances do
not result from the actions of the applicant.
Answer: (B) As stated in A there is any existing building on
the site.
Question: (C) That granting the variance requested will not
confer on the applicant any special privilege that
is denied by the Zoning Code to other lands,
buildings, or structures in the same Zoning
District.
Answer: (C) Previous variances within the area with existing
structures have been granted due to the configur-
ation of the site and the existing structure place-
ment.
Question: (D) That a literal interpretation of the provisions of
the Zoning Code would deprive the applicant of
. rights commonly enjoyed by other properties in the
same Zoning District under the same Zoning Code and
would work unnecessary and undue hardship on the
applicant.
Answer: (D) As this area was originally planned and houses laid
out with smaller set backs in keeping with the area,
it would work unnecessary and undue hardship on
the owner to build a residence under larger set
backs now in force.
Question: (E) That the variance granted is the minimum variance
that will make possible the reasonable use of the
land, building or structure.
Answer: (E) The variance request by the owner is the minimum to
grant to allow for the reasonable use of the land.
Question: (F) That the grant of the variance will be in harmony
with the general intent and purpose of the ordin-
ance and that such variance will not be injurious
to the area involved or otherwise detrimental to
the public welfare.
Answer: (F) The granting of the said variance will be in
harmony with the general intent and purpose of the
ordinance covering the area involved and would not
be detrimental to the public welfare; it would
indeed, as previously stated, be in harmony with
the area.
Question: (G) That no non confirming use of neighboring lands,
structures, or buildings in other districts shall
be considered grounds for the issuance of a
variance.
Answer: (G) The insurance of the variance would be in no way
considered a non - conforming use of the neighboring
lands, structures or buildings in other districts,
and no permitted use of land,structures or build-
ings in other districts shall be considered ground
for this variance being granted.
Lastly I would like to state that in fact we would
be improving the existing set back to the eves
line by 116 ". Also, the proposed two story section
would be considerably further set back than the
existing two story section.

Dear Board Members:
We are requesting a building variance for our property at 915 Orchid Lane
in Gulf Stream as shown in the drawing submitted by AIA Room Additions.
The variance is requested to enable us to add on a "mother's living area"
for our mother, who needs to be with us. We could not ask you for a
second -story addition, because the stairs would not be easy for her.
No variance is requested on the east and west sides of our property which
adjoins our neighbors. We are requesting a variance only to the rear
(north lot line) which adjoins no homes, but only some solar panels and
a tennis court.
Your kind consideration in this matter is greatly appreciated.
