Mayor Tyrell called the regular meeting of the City Crouncil to order at 7:42 p.m.. on Tuesday., _November 20, ....19..7.3,. in the Council Chamber..:of. _:.the .:;.Ci,ty...Hall. 2. The invocation was given by Bishop Bateman, Church of Jesus Christ of Latter Day Saints (Temple. City, Ward) , 6249 N. Kauffman Avenue. 3. The Pledge of Allegiance to the Flag was led by Mayor Tyrell. 4. ROLL CALL:. P.lanning.. ,Director Drag.i.c.evich.,._.,P.arks.. and Recreation „Director Kobett Councilman Gilbertson moved to excuse Councilmen Briggs and Dennis for cause, seconded by Councilman Merritt and carried. 5. APPROVAL OF MINUTES: Councilman Merritt noted that in the 5th paragraph of Item 11, Page 4, the witness' name should be spelled "Goss ". There being no further corrections, Councilman Gilbertson moved to approve the minutes of the regular meeting of the City Council held on Tuesday, November 6, 1973, as corrected, seconded by Councilman Merritt and carried. UNFINISHED BUSINESS: 6. PUBLIC HEARING: 7:30 p.m. - ADJUSTMENT OF ZONE BOUNDARIES - TEMPLE CITY MUNICIPAL LIGHTING DISTRICT City Manager Koski presented background information, stating that at their October 16, 1973 meeting, City Council adopted Resolution of Intent, No. 73- 1311, to hold a public hearing pursuant to the provisions of the Street Lighting Act of 1919, Part 1 of Division 14 of the Streets and Highways Code; legal notice of public hearing was published in the Temple City Times and legal notices were posted in the affected areas every 300 feet; 20 lights are proposed to be installed as indicated on memo dated November 14, 1973 which included a negative Environ- mental Impact Report; funds are provided in the fiscal year 1973 -74 budget for energy and maintenance. A great deal of information has been disseminated by the news media concerning the energy crisis, however staff recommends the improvement . to be in the best public interest re: pedestrian and traffic safety, and a priority project on the basis of traffic volume. Mayor Tyrell declared the Public Hearing open and invited those present who wished to speak for or against the proposed adjustment of zone boundaries to come forward. No one came forward to speak. Councilman Merritt moved to close the Public Hearing, seconded by Councilman Gilbertson and carried. Councilman Merritt moved to approve the Environmental Impact Report, seconded by Councilman Gilbertson and carried. Councilman Gilbertson stated he felt there is an inequitable distribution of lighting throughout the City and that perhaps lighting should be reduced in some other areas. Councilman Council Minutes, November 20, 1973 - Page 2 1 Merritt agreed that some areas are too dark and need lighting, while others might be cut back. Councilman Gilbertson moved to find the Zone A boundary adjust- ment to be in the best public interest, seconded by Merritt and carried. Councilman Gilbertson moved to adopt Resolution No. 73 -1315 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ORDERING AN ADJUSTMENT OF THE ZONE BOUNDARIES OF THE STREET LIGHTING DISTRICT WITHIN THE CITY and instruct the Superintendent of Streets to cause the street lights to be installed as indicated on Exhibit B, seconded by Councilman Merritt and carried un- animously. NEW BUSINESS: 7. RECOMMENDATION FROM PLANNING COMMISSION - Meeting of November 13, 1973 - OPEN SPACE ZONING ORDINANCE AND CHANGE OF ZONE FROM --RI-and R -4 TO 0 -S FOR CERTAIN AREAS City Manager Koski advised that at their regular meeting held November 13, 1973, Planning Commission adopted Resolution No. 73 -531PC recommending to the City Council establishment of an Open Space (0 -S) zone and imposing the regulations thereof upon certain parcels and areas in the City in accordance with Section 65910 of the Government Code which requires preparation and adoption of an "Open Space Zoning Ordinance" consistent with the Open Space element of the General Plan. Temple City Park and Live Oak Park are currently zone R -4 and R -1 respectively. Councilman Merritt moved to set public hearing for December 18, 1973 to consider creation of a new O -S, Open Space zone and change of zone from R -1 and R -4 to 0 -S Zone for certain areas in the City, and to consider an Environmental Impact Report, seconded by Councilman Gilbertson and carried. 8. RECOMMENDATIONS FROM TRAFFIC COMMISSION - Meeting of November 7, 1973 A. OAK AVENUE SCHOOL - MODIFICATIONS OF EXISTING RED CURB, ADDITIONAL REGULATIONS City Manager Koski presented background information, stating that in an effort to alleviate the problem of congestion and conflicting vehicular- pedestrian - bicycle movement on Oak Avenue, the school district has requested consideration for a modification of the passenger loading zone located on the west side of Oak Avenue, and for placement of a crosswalk across Oak Avenue at Camino Real. The Traffic Commission, at their regular meeting held November 7, 1973 concurred with the Traffic Engineer's recommendations as set forth in memo dated November 8, 1973. Traffic Engineer Envall discussed the placement of the crosswalk across Oak Avenue at Camino Real, stating the crosswalk could be located better on the south line, Councilman Gilbertson moved to approve recommendations of the Traffic Commission as set forth in memo dated November 8, 1973 with Item 2 amended to place a yellow school crosswalk across Oak Avenue at the south line of Camino Real (west approach) and across Camino Real at the west line of Oak Avenue, seconded by Mayor Tyrell and carried unanimously. ENCINITA AVENUE AND LIVE OAK - RESTRICTED PARKING City Manager Koski presented background information, that subsequent to City Council request for feasibility study re: placing ...a traffic control signal at Encinita Avenue and Live Oak, Traffic Engineer made a field investigation which disclosed that traffic volumes and /or accident concentrations did not justify a traffic signal under the present accepted warrants, and recommended to the Traffic Commission that approximately 50 feet north and south of the intersection be restricted from parking. The Traffic Commission felt that due to the width of Encinita Avenue and the angle of the roadway, that restricted parking would provide greater safety for left turning movements as well as improved visibility for motorists. Councilman Gilbertson moved to approve the Traffic Commission recommendation, seconded by Mayor. Tyrell and carried. C. PLACEMENT OF "RIGHT TURN ONLY" SIGNS - TEMPLE CITY BLVD,, NORTH OF LAS TUNAS DRIVE City Manager Koski advised that the Parking Commission had referred to the Traffic Commission the problem of left turning vehicular movements from the public parking lots on the east and west side of Temple City the Traffic Commission, at their regular meeting of November 7, 1973 recommended placing "Right Turn Only" signs at the exits to public parking lots No. 5 and 8B, located on the east and west side of Temple City Boulevard with appropriate pavement markings. Councilman Gilbertson moved to approve the Traffic Commission recommendation, seconded by Mayor Tyrell and carried. 9 SIDEWALK IMPROVEMENT PROGRAM - FY 1973 -74 PROJECTS A. LONGDEN AVENUE, south side, Eaton Wash to Rosemead Blvd. B. GOLDEN WEST AVENUE, west side, Garibaldi to Woodruff Ave. C. FREER STREET, north side, El Monte to 200' east of El Monte Ave. D. BROADWAY, south side, Golden West Avenue to Baldwin Avenue E. OAK AVENUE, east side, Workman to Live Oak Avenue F. LA ROSA DRIVE, north side, Temple City Blvd. to Golden West City Manager Koski presented background information, stating that the sidewalks on the select system streets of Longden, Golden West, Freer and Broadway are a part of the City's master sidewalk construction program; that sidewalks on Longden,. Golden West, Freer, Oak Avenue and La Rosa Drive are continuations of the safest route to school; that the work was budgeted in the fiscal year 1973 -74 budget, however the costs do not reflect the cost of driveway aprons that are necessary on Golden West, Broadway and Oak Avenue; the revised estimated cost if $5,054 more than was budgeted and because Broadway has the lowest priority of the projects and the project with the greatest increase in estimated cost, staff recommends that Broadway be deleted from the current fiscal year projects, with the Broadway allocation of $3,900 being applied to the remaining projects. In brief discussion Council agreed they would prefer to see the budget amended and complete all the projects budgeted in fiscal year 1973 -74. Councilman Merritt moved to approve the projects, to include Broadway, and to instruct the Superintendent of Streets to notify the property owners of the proposed construction of sidewalks, and to cause the plans and specifications to be drawn up, and appropriate additional funds in the amount of $5,054 from the Gas Tax Fund and amend the adopted budget accordingly, seconded by Councilman Gilbertson and carried. Council Minutes, November 20, 1973 - Page 4 10 MANDATED ZONING ACTION - ZONING INCONSISTENCIES WITH THE GENERAL PLAN City Manager Koski advised that Section 65860 of the Government Code requires the City's zoning,,ordinance to be consistent with the City's General Plan; that inconsistencies which exist at the present time were discussed by the Planning Commission at their meeting of November 13, 1973 and have set public hearing for November 27, 1973 to consider the matter further, Councilman Gilbertson moved to set public hearing for December 4, 1973 to consider the inconsistencies of the General Plan and Zoning Ordinance, pending final recommendations by the Planning Commission, seconded by Mayor Tyrell and carried, 11. RESOLUTION NO. 73 -1316: Employment of Personnel Councilman Gilbertson moved to adopt Resolution No 73 -1316 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING PERSONNEL, seconded by Mayor Tyrell and carried. 12 RESOLUTION NO. 73 -1317: WARRANTS & DEMANDS, Demand Nos. 8930 through 9007 in the amount of $21,763.59. Councilman Gilbertson moved to adopt Resolution No. 73 -1317 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $21,763.59 DEMAND NOS. 8930 THRU 9007, seconded by Councilman Merritt and carried. 13. COMMUNICATIONS: A. Temple City Kiwanis Club - Request for "Line of Dimes" City Manager Koski presented a communication from the Temple City Kiwanis Club to conduct "Line of Dimes" solicitation on January 18, 1974, from 11:30 a,m. to 5:00 p.m., in the left turn pockets on Las Tunas Drive east and west of Temple City Boulevard, and north and south of Las Tunas, between the east and west alleys; and for "Mothers March" to be held on January 28, 1974 through January 31, 1974, from 6:00 p.m. to 8:30 p.m, Councilman Gilbertson moved to approve the request as outlined in the communication, provided that auto- mobile solicitation be conducted by adults 18 years of age or over, and subject to the City being named additionally insured, seconded by Councilman Merritt and carried, 14, TIME FOR THOSE IN AUDIENCE WHO WISH TO SPEAK: No one came forward. 15. MATTERS FROM CITY OFFICIALS: A. Parks and Recreation Commission - Request for Study Session City Council received a request from the Parks and Recreation Commission for study session to discuss the revised line drawing for Live Oak Park Master Plan, and the use of the tennis courts at Temple City High School. Study session was scheduled for Monday, December 3, 1973, 7:30 p.m.. in the north meeting room of the City Hall. B. Lower Azusa Road Improvement Project - Acquisition of Right -of -Way, 9380 Lower Azusa Road City Manager Koski advised that staff had negotiated with the owners of the property at 9380 Lower Azusa Road, who had agreed Council Minutes, November 20, 1973 - Page 5 to dedicate the front 10 feet of their property in exchange for the removal of two trees in front of their property and payment in the amount of $200 for the construction of turn- around pad adjacent to their driveway. Councilman Gilbertson moved to approve the recommendation of staff to authorize the removal of the tree by City forces, payment of $200 for the construction of a turn - around pad adjacent to driveway, and authorize the Superintendent of Streets to accept and record a road deed in exchange_, . seconded by Councilman Merritt and carried. C. Councilman Gilbertson called attention to some material he had received concerning a National Youth Essay Contest in conjunction with America's Bicentennial being sponsored through Sister City and requested the material be forwarded to Temple City's Sister City Association to be brought to the attention of the schools. Councilman Gilbertson advised he noticed an article in the newspaper that Los Angeles County is financing swimming pools for schools throughout the county, Staff was directed to prepare a letter of protest to the County. Councilman Gilbertson advised he had heard a rumor being circulated that he is concurrently serving on the City Council of Rosemead and Temple City, and of his interest in the project on Rosemead Boulevard, Councilman Gilbertson regretted that such a rumor would come from the Homeowner's Association. D. Councilman Merritt stated he would like to publicly declare his faith in and stand behind the President of the United States, saying he deserves the support of everyone. Council concurred with his sentiments, E. Mayor Tyrell introduced Sgt. Bob Norman who was substituting as Council liaison for Lt. Richard Wallace. Mayor Tyrell requested Council to consider the appointment of a citizen's committee on the energy crisis for the purpose of helping to investigate areas wherein the City may have the ability to assist in conserving our energies; the committee to consist of approximately 9 -11 members to include the City Manager and representatives from the utilities. He also requested a report from the Sheriff's Department on the ramifications of the elimi- nation of traffic lights in the downtown area, traffic lights being responsible for the consumption of a great deal of energy. Mayor Tyrell also requested a financial evaluation from staff concerning the establishment of a municipal intracity transportation system to assist people without transportation to shop in the downtown business district. F. In response to Mayor Tyrell's questions concerning lighting of Christmas decorations, Penny Graham, President, Temple City Chamber of Commerce, advised the Chamber Board had held a meeting and surveyed merchants contributing to the lights, and that their anticipated expenditure of energy would be cut approximately one -half. G. Executive Director Koski, Community Redevelopment Agency, advised the City Council that a copy of the final draft of the Disposition and Development Agreement had been received by the Agency from Eugene Jacob, legal counsel, The Agency staff has prepared an Environmental Impact Report which has been trans- mitted-to the legal counsel -for final approval and a tentative Council Minutes, November 20, 1973 - Page 6 hearing date of January 10, 1974 was suggested to the Community, Redevelopment Agency as hearing, .date on the Disposition and Development Agreement. Agency staff expects to have the Reciprocal Easement, Agreement, Environmental Impact Report, final plot plan and financial arrangements for Council review at their regular meeting.,,^of,,December 4, 1973. H. Dr. William Walker, President, Homeowner's Association, requested Council consider the appointment of two more members to the Community Redevelopment Agency. City.AttorneyMartin pointed out that the Council had the option of appointing them- selves as the agency, or appointing an outside group of five or seven members. Also the consideration of new appointments of property owners in the area could be a possible conflict of interest. 16. ADJOURNMENT: Mayor Tyrell moved to adjourn to a Personnel Session at 8:45 p.m., seconded by Councilman Merritt and carried. Following the confirmation of appointments Council adjourned at 9:05 p.m. to the next regular meeting of the Council which will be held on Tuesday,, December 4, 1973, 7:30 p.m. in the Council Chamber of the City Hall.
