HomeMy Public PortalAboutORD16342BILL NO. 2023-005 SPONSORED BY Councilmember Lester ORDINANCE NO. /10342_, AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, APPROVING A PRELIMINARY PUD PLAN FOR PROPERTY ADDRESSED AS 810 EL DORADO DRIVE, ACCEPTING AND APPROVING THE FINAL SUBDIVISION PLAT OF DOGWOOD PARK SUBDIVISION, A SUBDIVISION OF THE CITY OF JEFFERSON, MISSOURI, AND AMENDING SECTION 19-401, SCHEDULE J, PARKING PROHIBITED, WITH RESPECT TO EL DORADO DRIVE. WHEREAS, F & L Properties, owner of the real estate hereinafter described, having submitted a Preliminary PUD Plan and Final Subdivision Plat of said real estate described as follows: Part of Outlot No. 75 and part of Atchison Street Right of Way, vacated by City of Jefferson Ordinance No. 9205, lying between Outlot No. 75 and the north line of Del Cerro Subdivision Section 1, as recorded in Plat Book 11, Page 11, Cole County Recorder's Office; being part of Section 17 and Section 20 in Township 44 North, Range 11 West, in the City of Jefferson, Cole County, Missouri, more particularly described as follows: Beginning at the most easterly corner of Lot 20 of Del Cerro Subdivision Section 1, as recorded in Plat Book 11, page 11, Cole County Recorder's Office; thence N 54° 03'04"W, along the northerly line of said Del Cerro Subdivision Section 1, 312.56 feet; thence N 35° 42'14"E, 30.43 feet to the southeasterly corner of Lot 113 of Hedgewood Heights Subdivision, Block A, as recorded in Plat Book 4, Page 72, Cole County Recorder's Office; thence continuing N 35° 42'14" E, along the easterly line of said Hedgewood Heights Subdivision, Block A, 222.10 feet; thence N 20`°55'14"E, along the easterly line of said Hedgewood Heights Subdivision, Block A, 389.18 feet to the southwesterly corner of Lot Three of One Elm Plaza Section Two, as recorded in Plat Book 11, page 944, Cole County Recorder's Office; thence S 69°04'46" E, along the southerly line of said Lot Three, 160.11 feet to the southeasterly corner thereof and the westerly right-of-way line of El Dorado Drive; thence southerly along said westerly right-of-way line of El Dorado Drive the following courses: southerly, on a curve to the left, having a radius of 355.30 feet, an arc distance of 53.69 feet (the chord of said curve being S 12°53'29" W, 53.64 feet); thence S 08° 33' 45" W, 428.23 feet; thence southerly on a curve to the right, having a radius of 380.17 feet, an arc distance of 181.82 feet (the chord of said curve being S 22°15'50" W, 180.10 feet); thence S 35° 57'55" W, 50.34 feet to a point on the southerly line of said Outlot No. 75, being the northerly line of said Atchison Street Right- of-way vacated by City of Jefferson Ordinance No. 9205; thence S 38° 27'44" W, 15.01 feet to the Point of Beginning. Containing 3.72 acres. WHEREAS, it appears that the procedures set forth in the zoning code relating to zoning and PUD Plans have in all matters been complied with. WHEREAS, it appears that said plat has been fully and properly signed and accepted by the owner of said subdivision, known and referred to as Dogwood Park Subdivision, that all taxes have been paid, that in all respects the requirements of Chapter 445, RSMo, entitled "Plats" have been fully complied with by the owner of said subdivision, and that in all respects the requirements of the Planning and Zoning Commission of the City of Jefferson, Missouri, relating to plats and subdivisions have been complied with. NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Preliminary PUD Plan, attached as Exhibit A, is hereby approved for the above described real estate. Section 2. Requirements for elements such as future land uses, signage, and lighting of the property shall be limited to the specifications permitted by the RD (Residential Duplex) Medium Density Attached Residential zoning district. Section 3. The Final Subdivision Plat of Dogwood Park Subdivision, lying, being and situated within the corporate limits of the City of Jefferson, Missouri, as shown by the said plat attached hereto as Exhibit B, is hereby approved and accepted by the City Council of the City of Jefferson, Missouri. Section 4. The Mayor and City Clerk are hereby authorized and directed to endorse acceptance of said plat hereon and to certify approval of said plat under the City of Jefferson seal. Section 5. Chapter 19, Motor Vehicles and Traffic, Section 19-401, Schedule J, Parking Prohibited, Subparagraph (a) Streets and highways, of the Code of the City of Jefferson, Missouri is hereby amended by addition of the following: El Dorado Drive: on the east side thereof, between East Elm Street and Del Cerro Drive. Section 6. This ordinance shall be in full force and effect from and after its passage and approval.
