RESOLUTION NO. 96 -3477
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE
CITY ACCEPTING AND CONFIRMING THE CITY MANAGER'S
REPORT DOCUMENTING EXPENSES INCURRED BY THE CITY FOR
THE ABATEMENT OF A DECLARED PUBLIC NUISANCE
REGARDING THE REAL PROPERTY LOCATED AT 4831
WILLMONTE AVENUE, TEMPLE CITY, CALIFORNIA (PARCEL 18
OF LOT 10, TRACT 9848, MAP BOOK 137, PAGES 67 -68), AND
ORDERING THE LOS ANGELES COUNTY RECORDER TO PLACE A
FINANCIAL LIEN ON SAID PROPERTY TO RECOVER PUBLIC
FUNDS UTILIZED FOR NUISANCE ABATEMENT
WHEREAS, it is a public nuisance for any person owning, leasing, occupying or having charge or
possession of any premises within the City of Temple City to maintain such premises contrary to the
provisions of Temple City Municipal Code Section 4230; and
WHEREAS, on the 6th day of June 1995, the City Council adopted Resolution No. 95 -3421,
confirming certain actions and decisions of the Planning Commission and declaring the real property
located at 4831 Willmonte Avenue, Temple City (Parcel 18 of Lot 10, Tract 9848, Map Book 137, pages
67 -68) to be a public nuisance and ordering the abatement of said nuisance within thirty (30) days; and
WHEREAS, the person owning, leasing, occupying or having charge or possession of the subject
property failed to comply with the abatement order; and
WHEREAS, the City Manager was directed by the City Council to cause the abatement of said
nuisance by City forces or private contract services and authorized the Manager to enter upon the subject
property to perform the abatement measures; and
WHEREAS, both City forces and private contract services were required and utilized to abate
said nuisance resulting in the expenditure of public funds.
NOW, THEREFORE, the City Council of the City of Temple City does hereby resolve as follows:
SECTION 1. the City Council confirms those abatement measures executed under the direction
of the City Manager, by City forces and private contract services were appropriate and necessary to
effectively abate said public nuisance.
SECTION 2. the City Council, after hearing all objections and protests regarding the abatement
of said public nuisance, confirms and accepts the Manager's itemized report detailing the specific cost of
abatement, including any rehabilitation, repair, or demolition of the subject property performed in
accordance with Temple City Municipal Code Section 4241.
SECTION 3. the City Council confirms the owners of said property were properly noticed
regarding the location, date and time the Manager's report would be formally received by the City Council
and a copy of the written notice, Manager's Report, and related City Council Resolution were served upon
said property owners at least five (5) days prior to submitting the same to the City Council in accordance
with Temple City Municipal Code Section 4235.
SECTION 4. the City Council hereby determines the total cost of abating the above mentioned
public nuisance to be $8,073.54, as detailed in the Manager's Report, and declares such amount constitutes
a special assessment against the subject property.

SECTION 5. the City Council hereby orders the Los Angeles County Recorder to file a Notice
of Lien, as so made and confirmed, shall constitute a lien on said property for the amount of such special
assessment.
SECTION 6. the City Council hereby orders the Los Angeles County Assessor, upon conformation
and recordation of such lien, to add the amounts of the special assessment to the next applicable tax bill
levied against the subject property for municipal purposes and thereafter said amounts shall be collected
at the same time and in the same manner as ordinary municipal taxes are collected and shall be subject
to the same penalties and the same procedure under foreclosure and sale in cases of delinquency as
provided for ordinary municipal taxes.
SECTION 7. The City Clerk shall certify to the passage and adoption of this resolution.

No. 96 -3477, was adopted by the City Council of the City of Temple City at a regular meeting held on the
2nd day of January 1996 by the following vote:
