TAYLOR This is to confirm that at the Public Hearing held by the Town Commission on November 9, 2007, your application for a Special Exception to permit conforming one story additions to an existing non - conforming structure that encroaches into the west side setback 2.04 ft. and into the south (rear) setback 8.02 ft. as provided in Section 70- 75(c)(1), and for a Level 3 Architectural /Site Plan Review to permit a one story addition and a covered entry consisting of a total of 2,082 sq. ft. to an existing one story single family dwelling at 940 Indigo Point was considered. The application was approved as submitted with the following two conditions: 1) Prior to painting the exterior and prior to a Certificate of Completion /Certificate of Occupancy, a Gulf Stream paint permit will be required. 2) If the proposed site plan is altered because of the requirements of the Health Department, a revised site plan will require approval from the Architectural Review and Planning Board. As a result of the removal of the existing unsafe roof system our Office has revised both the new and existing roof geometries to more fully comply with the intent of Land Development Regulations (LDR) of the Town of Gulf Stream. Section 70 -107 of the LDR states: (A) Generally. Additions and rehabilitations should be designed to match the design of the remainder of the existing structure so when finished, the addition or rehabilitated portion appears to be an original part of the structure. Whenever possible, existing discouraged or prohibited design elements should be removed or replaced and preferred elements incorporated. Very large additions or significant rehabilitations will be treated as completely new structures. In our initially approved design the existing roof system was to remain and a new roof system was introduced to augment and directly abut the existing. While this approached produced a visually pleasing design, there were limitations in the extent of rehabilitation due to the existing roof system remaining. However, once the existing roof system was removed an opportunity was created to eliminate existing discouraged or prohibited items with respect to the LDR. Please note that the approved plate heights have not been changed from the approved design. Only roof geometries have been modified. The following are a few code references that we believe apply to the now removed existing roof system. We have also included copies of the approved elevations with commentary. In the new roof geometry the existing flat roof has been eliminated. Sec. 70 -100 Roof and eave heights (Elevation Diagram) Discourages and/or prohibits excessive eave elevation changes. The new roof geometry reduces number of eave elevations changes and increases visual continuity. Sec. 70 -238 Roofs The existing roof system had gable ends that were inconsistent with Gulf Stream - Bermuda Architecture. The new roof geometry eliminates gable ends and incorporates the preferred hip roof design. It is our belief that our modifications to the roof geometry has produced a more harmonious, visually appealing design that more fully complies with the LDR.
