AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD APPROVING
GENERAL PLAN AMENDMENT NO, 2008 -01; CHANGING THE GENERAL PLAN
DESIGNATION FROM "R -1" (SINGLE FAMILY: RESIDENTIAL) TO "R -3" (MULTI
FAMILY RESIDENTIAL), ZONE 'CHANGE NO. 2008 -02; CHANGING THE ZONING
DESIGNATION FROM "R -1" (SINGLE FAMILY RESIDENTIAL) TO "PRD" (PLANNED
RESIDENTIAL DEVELOPMENT), AND TENTATIVE TRACT MAP 2008 -01 IN
CONJUNCTION WITH A PROJECT PERMITTING THE DEVELOPMENT OF FIVE (5)
DUPLEX'S, TEN (10) CONDOMINIUM UNITS TOTAL, LOCATED AT 4237 IMPERIAL
HIGHWAY, FURTHER DESCRIBED AS ASSESSOR PARCEL NUMBERS 6192 -023-
024, CITY OF LYNWOOD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA
WHEREAS, on January 28, 2009 the Site Plan Review Committee
recommended approval of the project to develop five (5) duplex's, ten (10) units total
subject to General Plan Amendment No. 2008 -01, Zone Change No. 2008 -02,
Conditional Use Permit No. 2008 -10, and Tentative Tract Map No. 2008 -01; and
WHEREAS, on January 28, 2009 the Design Review Board Committee
recommended approval of the project to develop five (5) duplex's, ten (10) units total
subject to* General Plan Amendment No. 2008 -01, Zone Change No. 2008 -02,
Conditional Use Permit No. 2008 -10, and Tentative Tract Map No. 2008 -01; and
WHEREAS, the Lynwood Planning Commission, pursuant to law, conducted a
duly noticed public hearing on February 10, 2009 and has carefully considered all oral
and written testimony offered at the public hearing regarding approval of the project to
develop five (5) duplex's, ten (10) units total subject to General Plan Amendment No.
2008 -01, Zone Change No. 2008 -02, Conditional Use Permit No. 2008 -10, and
Tentative Tract Map No. 2008 -01; and
WHEREAS, the Lynwood City Council, pursuant to law conducted a duly noticed
public hearing on March 3, 2009 and considered all oral and written testimony offered at
the public hearing; and
WHEREAS, the Development Services Department has determined that the
project will not have significant impacts on the environment. An Initial Study was
performed, conditions were incorporated, and a Negative Declaration was prepared
pursuant to the California Environmental Quality Act (CEQA) guidelines.
Section 1. The Lynwood City Council hereby finds and determines as follows:
A. That the proposed amendment is in the public interest and that there will
be a community benefit resulting from the amendment.
B. That the proposed amendment is consistent with the goals, policies and
objectives of the general plan.
C. That the proposed amendment will not conflict with provisions of this zoning
code, subdivision regulations, or any applicable specific plan.
D. In the event that the proposed amendment is a change to the land use
policy map, that the amendment will not adversely affect surrounding
properties.
E. That the proposed amendment is consistent with the goals, policies and
objectives of the general plan.
F. That a proposed zone change will not adversely affect surrounding
properties.
G. The subdivision meets all the applicable requirements and conditions
imposed by the State Subdivision Map Act and the Subdivision Regulation
of the Lynwood Municipal Code Chapter 24.
H. The proposed subdivision of lots is consistent with the applicable
elements of the General Plan and the Official Zoning Ordinance of the
City of Lynwood.
Proper and reasonable provisions have been made for adequate ingress
and egress to the subdivided lots.
J. The Negative Declaration was noticed as required by California
Environmental Quality Act (CEQA)
Section 2. The Lynwood City Council based upon the aforementioned findings
and determinations, hereby approves General Plan Amendment No. 2008 -01, Zone
Change No. 2008 -02 changing the general plan designation from "R -1" (Single Family
Residential) to "R -3" (Multi Family Residential) and zoning designation from 'R -1" (Single
Family Residential) to "PRY (Planned Residential Development) for 4237 Imperial
Highway (Assessor Parcel Numbers 6192 - 023 -024).
Section 3. The Lynwood City Council hereby adopts the Negative Declaration.
Section 4. The City Clerk is hereby directed to certify the passage and
adoption of this Ordinance and cause it to be published or posted as required by Law.
First read at a regular meeting of the City Council held on the 3rd day of March, 2009,
and adopted and ordered published at a regular meeting of said City Council on the 17th
day of March, 2009.
