HomeMy Public PortalAboutResolution 96-34811 RESOLUTION NO. 96 -3481 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY REVERSING THE PLANNING COMMISSION'S DECISION AND THEREBY DENYING CONDITIONAL USE PERMIT 95 -1250 FOR THE ESTABLISHMENT OF A 60 FOOT HIGH CELLULAR MONOPOLE LOCATED IN THE REAR ONE -THIRD OF THE LOT AND NOT CLOSER THAN 300 FEET FROM LAS TUNAS DRIVE FOR THE PROPERTY LOCATED AT 5944 TEMPLE CITY BOULEVARD IN THE CITY CENTER (CC) DISTRICT OF THE DOWNTOWN SPECIFIC PLAN. (L.A. CELLULAR) THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES HEREBY RESOLVE: SECTION 1. Based upon testimony received at a noticed public hearing before the City Council and upon facts contained in the Planning Commission Minutes and staff reports dated November 28, 1995 and December 12, 1995; and based upon information contained in the City council Staff Report and attachments thereto dated February 6, 1996, the City Council finds: 1. That the site for the proposed use is not adequate in size, shape, topography and circumstances in that the 8,750 square foot lot is improved with a 2,520 square foot commercial building and the proposed monopole and associated equipment would be detached from other structures on this rather narrow lot; furthermore, the subject lot is adjacent to residential lots which would be adversely impacted by the presence of the proposed monopole and equipment; and 2. That the site does not have sufficient access to streets and highways, adequate in width and pavement type to carry the quantity and quality of traffic generated by the proposed use in that access would be limited to a narrow alley; surrounding properties would be adversely impacted during construction and routine maintenance; furthermore, the proposed location of the monopole and storage equipment is currently utilized for parking purposes and the presence of the facility as proposed would interfere with the ingress and egress to on -site parking, and 3. That the proposed use will have an adverse effect upon the use, enjoyment or valuation of adjacent property or upon the public welfare in that the subject commercial site is in proximity to residential uses and commercial businesses which would be impacted by the presence of the "industrial appearance" of the monopole and accompanying equipment; the addition of a monopole would exacerbate the existing adverse aesthetic impact of utility poles/lines along this alley, the City's long -term objective is to underground utilities and the addition of a monopole would be contrary to that policy. 4. While there is no objection to a cellular monopole at an appropriate location, the proposed location is inappropriate and contrary to many of the adopted policies and programs for improving the City Center (CC) District of the Downtown Specific Plan Area. As proposed, the monopole and equipment storage area would not be adequately concealed from view and would result in an adverse impact upon property values in the immediate vicinity. The applicant is invited to select a more appropriate location. SECTION 2. As the proposed development project is hereby denied, no action was taken relative to the California Environmental Quality Act (CEQA). SECTION 3. Accordingly, Conditional Use Permit 95 -1250 is denied, based upon the above enumerated findings. Resolution No. 96 -3481 PAGE 2 SECTION 4.
