RESOLUTION NO. 96 -3482
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE
CITY APPROVING MODIFICATION OF TRACT MAP 51975 TO
REMOVE A CONDITION REQUIRING A THREE FOOT, SIX INCH
WIDE SIDEWALK ALONG THE PRIVATE CUL-DE -SAC STREET FOR
THE PROPERTY LOCATED AT 9921 -9945 OLIVE STREET IN THE
RESIDENTIAL PLANNED DEVELOPMENT (RPD) ZONE. (OWEN)
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES HEREBY RESOLVE:
SECTION 1. Based upon testimony received at a noticed public hearing before the City Council
and upon facts contained in the Planning Commission Minutes and staff report dated December ,12, 1995,
the City Council hereby approves the requested Modification based upon the findings and subject to the
conditions contained in Planning Commission Resolution No. 95- 1794PC.
SECTION 2. This project is categorically exempt from environmental review in accordance with
the State CEQA Guidelines. An Environmental Impact Report as well as a Supplemental Environmental
Impact Report was prepared and approved for the originally approved project. This request is a minor
modification to the originally approved project and is exempt from environmental review.
SECTION 3. Accordingly, Modification of Tract Map 51975 to allow the elimination of a
requirement for a three foot, six inch (3' -6 ") wide sidewalk along the private cul- de-sac street in the
residential planned development (RPD) zone as previously required by Condition No. 49 of Conditional Use
Permit No. 90 -1052 is approved.
SECTION 4. Approval of this modification as indicated in Section 3 above shall be limited to that
which is outlined in the Planning Commission Resolution and herein; all conditions of approval applicable
to the originally approved project shall be in full force and effect, except as modified herein.
SECTION 5. The City Clerk shall certify to passage and adoption of this resolution and enter
it into the book of original resolutions.
