HomeMy Public PortalAboutResolution 96-34851 1 1 RESOLUTION NO. 96 -3485 A RESOLUTION OF THE CITY OF TEMPLE CITY, CALIFORNIA, DESIGNATING THE PLANNING COMMISSION TO MAKE DETERMINATIONS OF PUBLIC CONVENIENCE AND /OR NECESSITY IN CONJUNCTION WITH THE CALIFORNIA BEVERAGE CONTROL REVIEW OF LIQUOR LICENSES WHEREAS, the State Business and Professions Code was amended (Section 23958.4) to require that local governing bodies make a determination of public convenience and/or necessity in conjunction with the issuance of a liquor license by the California Beverage Control; and WHEREAS, the Department of Alcoholic Beverage Control in a letter dated March 8, 1995 advises that the local governing body may elect to delegate the duties of determining whether or not public convenience and/or necessity are met to a subordinate agency; and WHEREAS, the Planning Commission considers Conditional Use Permit applications for certain on -sale and off -sale alcohol uses, it is duplicative to consider the required determination relative to public convenience and/or necessity as a separate and distinct item. NOW, THEREFORE, THE CITY COUNCIL FOR THE CITY OF TEMPLE CITY DOES HEREBY DESIGNATE THE PLANNING COMMISSION TO MAKE THE APPROPRIATE DETERMINATION OF PUBLIC CONVENIENCE AND /OR NECESSITY IN CONJUNCTION WITH THE FINDINGS RELATIVE TO GRANTING OR DENYING A CONDITIONAL USE PERMIT. SECTION 1. That the City Clerk shall certify to the adoption of this Resolution and shall forward a copy of this Resolution to the Department of Alcoholic Beverage Control. The City Clerk shall enter this resolution into the book of original resolutions. APPROVED AND ADOPTED THIS 20th day of February, 1996.
