For the latest quarter assessed by the U.S. EPA (January 2019 ‐ March 2019), tap water provided by this water utility was in compliance with federal health‐based drinking water standards. We would like to explain our opposition to Preliminary Parcel Map creating two lots with exceptions to current R-1 Zone District at 87 4 Boyce A venue -18PLN-00030 We live in the same Palo Alto enclave as 874 Boyce Avenue. This enclave has a long history going back to its creation as a neighborhood for segregating "minority's". The explicit real estate covenants and zoning practices were abolished with civil rights act of 1968, but the remnants of this discrimination still exist today. Our enclave is approximately bounded by Boyce(inclusive) on West, Lincoln on East, Forest on North and Channing on South. I spent one early morning measuring the street widths in our enclave and these are some data; width of Boyce at Seneca= 29.5', width of Fife at Addison, 29 .5', width of Addison at Fife, 30'. What is striking is the differences in street width only a few feet away; width of Seneca at Boyce = 46', width of Guinda at Channing = 46', even Addison Ave just South of Channing immediately widens to 37' from 30' North of Channing. In addition to narrow streets our enclave has a large density of split lots and flag lots approved by Palo Alto as deviations from R-1 zoning. The historical purpose of the early Flag lot approvals was to density minority neighborhoods, using the exact same logic that resulted in uncharacteristically narrow streets. Flag lots and split lots have the characteristic that they density neighborhoods, reduce on-site parking and increase parking on the streets. When a street is ONLY 30' wide as is Boyce at 874 Boyce Avenue and cars are parked on both sides of the street I measured the distance between cars as only -13' ! A 13' traffic lane limits traffic to effectively 1-way and in the morning with children bicycling to school the situation is absolutely more dangerous than on normal wider streets. We purchased our home knowing situation and love our neighborhood, but in 2019 Palo Alto planning should not be extending approval of new split lots and flag lots such as at 87 4 Boyce Avenue for the benefit of an individual home owner and the effective continuation of discriminatory practices that we thought were long in the rear view mirror!           October 23, 2019    Dear Palo Alto City Council,    I am a resident of the Southgate neighborhood who has been following the rail issue as it  impacts the Churchill intersection since the last community meeting in March.  I have attended  all the XCAP meetings and recent relevant Council meetings, have been in dialogue with a  number of my neighbors, and would like to share some observations and suggestions based on  this experience.      But first, I want to make the Council aware of a recent survey of Southgate residents concerning  Churchill closure.     Southgate survey      From May to June, a small group of us surveyed over half of occupied Southgate for a predictive  sample of neighborhood sentiment regarding the closure of Churchill.  For a detailed discussion,  see the attachment.  My main point here is twofold: while a majority (around 60%) of residents  have significant concerns about closing Churchill and oppose the option, there is trending by  location in the neighborhood, with those closest to the tracks and on Churchill more likely to  support closure as compared with other current options.  That split creates a dilemma for  planners sensitive to residents’ concerns and I argue later that we need to address the issue  directly.      In spite of these differences, most residents (85%) understand the need for a solution and  encourage the city to continue exploring options with the long‐term best interest of both the  neighborhood and the city in mind.    Churchill closure and traffic studies     The obvious potential problems are reduction of east‐west connectivity and exacerbation of  traffic problems.  I believe that if closure is to be seen as a viable option, a lot more resource  will need to be put into studying whether it is possible to close Churchill without creating  significant, long‐term negative effects for the community at large.  What happens once we take  9500 cars daily and displace them onto the remaining two east‐west connectors (Embarcadero  and Oregon) without widening either of them?     The mitigations proposed do not appear adequate to address this issue.  In addition, the  emphasis in all the traffic studies has been on peak hours.  Residents view this focus as  inadequate, as it does not consider other current non‐peak congestion, such as occurs on  Embarcadero near Town and Country on the weekends, Embarcadero in mid‐afternoon when  both Walter Hayes and Paly finish their school days; Stanford game day; etc.  One relatively  inexpensive way to gain insight into the likely effects of closure that I have heard repeatedly  from Southgate residents is to actually close Churchill for a 2‐week period and study the effects.   Such a study would provide empirical data about where traffic would go and provide better  insight into whether proposed mitigations might be sufficient, at least in the short term.    Viaduct and property impacts    The only alternative to closure currently being considered is a Churchill‐only viaduct.  While the  Viaduct helps preserve east‐west connectivity, addresses the serious traffic issues that will  likely arise as a result of closing Churchill, and preserves more of the City’s options going  forward, there is one significant impact which I believe should be addressed sooner rather than  later.  Although construction and use of a Viaduct does not require property taking, it does have  a potential property impact; most specifically a unique impact for 23 homes along Mariposa.   Addressing esthetics, height, and distance from homeowners’ backyard fences will help.  But  even with that, there is an argument that putting a 25‐foot structure close behind those lots  will significantly affect property values.      Although everyone knows that loss of property values is among the stakes, up to this point  there has been no discussion of how to address that impact, and I believe there should be.  The  viaduct has merits from a number of perspectives, but it’s hard to support it if those residents  would be expected to take a financial hit for the good of the community. Because the issue  hasn’t been formally acknowledged and no plan has been suggested to address it, the current  reality for those residents is that the City doesn’t have, and won’t have, a plan.  This pending,  uncompensated loss is driving a lot of emotion around the viaduct possibility, no matter what  other merits it might have.  Any impact would need to be objectively assessed and valued, but  in terms of current budget, there does appear to be room to put such a placeholder without it  being a game changer in terms of the overall target.  Doing so would signal a commitment to  treat these property owners fairly, which is a principle I’m assuming everyone would support.    Other options and taking enough time    Because both of the two existing solutions have significant side effects, and because the  decision has such long‐lasting implications for the city, 85% of the residents in our survey  encourage the City to keep exploring options, including some which may have been previously  dismissed.  For example, no one likes to consider property taking, but should it be completely  off the table?  If we don’t dismiss it, what becomes possible and how do we value the positive  effects of those possibilities?  Alternatively, have we looked carefully enough at each option to  be sure that designs can’t be modified to make them more palatable?    If we are committed to finding the best solution, I believe we should open up the design space  by inviting – or at least entertaining – serious proposals from the community.  We in Southgate  have shared with both XCAP and City Council a well‐thought‐out, non‐property‐taking proposal  created by a Southgate resident and request that resource be made available for an initial  technical review.   In summary, let’s proceed efficiently but take enough time and resources to do our homework,  find the best long‐term solution for the community, and make sure that impacted neighbors  and residents are treated fairly.     Thanks,    Steve Carlson  1611 Portola Avenue  Palo Alto CA         Southgate Survey of Attitudes toward Churchill Closure  June‐July 2019      During the months of June and July, a small group in Southgate conducted a door to door survey to assess  neighborhood awareness and opinion regarding the possible closure of Churchill Avenue.  Thus far, we have  presented survey results to City Staff and AECOM leadership, XCAP membership, and survey respondents.    Survey:  Southgate residents were asked the following questions:    1. Are you aware of the possible plan to permanently close Churchill?  2. Are you in favor of (or resigned to) this option?  3. Would you encourage the city to continue exploring alternatives?  4. Would be interested in hearing about new developments?  Respondents were also given space to provide comments.    Results:     Penetration:    We gathered survey responses from 127 households with proportional geographic  representation.  Given that a number of properties were unoccupied between rentals or due to  renovations, we estimate that we covered around 60% of the neighborhood.   Awareness of the City’s preferred option of closing Churchill:    75% had some level of awareness, although understanding of the alternatives varied widely  within this group.   25% were completely unaware that Churchill closure is being considered.   Awareness of the City’s timeline for making this decision:   Fewer than 10% were aware of the plan to make a decision by October.   Attitudes toward Churchill closure:   30 (24%) favored closing Churchill   76 (60%) opposed closing Churchill   20 (16%) were unsure   Data trends   There were certain patterns in the data, with folks on Mariposa and Churchill being more likely to  support closure and most of the rest of the neighborhood tending to be against.  Even so, we  found diversity of opinion in every corner of the neighborhood, with some Mariposa neighbors  registering N on closure and neighbors in other areas choosing Y on closure.     Attitude toward exploring alternatives:    85% of all respondents encouraged exploration of alternatives, including many who favored or  were resigned to closing Churchill   Engagement:    92% of all respondents were interested in being updated regarding developments    Concerns of Residents Opposing Churchill Closure:  Based on analysis of respondent comments, opponents of  closing Churchill have the following concerns:     Impact on the neighborhood:     sense of isolation and disconnection from much of Palo Alto   longer travel times for simple trips   access to emergency services   changing the character of the neighborhood over time   Impact on greater Palo Alto community:    traffic congestion/gridlock on already congested arteries   air pollution as more drivers sit in traffic   Impact of proposed mitigation of opening Park Avenue   possibility of cut‐throughs from Paly drop‐offs   increased traffic on neighborhood streets as other streets are more congested   increased congestion in Evergreen and California business district  Concerns of Residents Supporting Churchill Closure:  Based on analysis of respondent comments, proponents of  closing Churchill had these concerns:     Visual impact of remaining grade separation alternatives (viaduct, modified hybrid) for properties along  the track.    For residents along Mariposa, concern about property value impact of other options   Concern about train noise if train is elevated   Compromise of safety and possibility of property damage in the event of derailment of an elevated train   Vision of a quieter neighborhood if peak hour traffic on Churchill is eliminated    One value of this outreach effort has been a significant increase in awareness and engagement.  Southgate  residents have a much better understanding of the reasons for the need for some sort of change at the rail  crossings, including Caltrain projections and business plan.  They look forward to more information and to giving  input as the XCAP Committee and City Council work toward the goal of a consensus solution.        1 Brettle, Jessica From:Susan Newman <snewzy@gmail.com> on behalf of Susan Newman <snewman@workpractice.com> Sent:Friday, October 25, 2019 9:56 AM To:Council, City Cc:Steve Carlson; Michael Price; nadianaik@gmail.com Subject:Correspondence for 10/28/19 Council Meeting, Agenda Item 9 Attachments:2019.10.28SENLetterToCC.docx; ConcernsReChurchillClosure2.docx; Churchill-Caltrain-Crossing- Alternative-v9.pdf CAUTION: This email originated from outside of the organization. We make up a majority of Southgate residents, based on a survey conducted this summer. I believe a summary of our results has already been forwarded to you. In addition, I am attaching a document enumerating our concerns about the proposed closure. At the same time, we are aware of the anxiety of some of our neighbors about the only other proposal currently under consideration – the Churchill Viaduct – as well as the complexity of the problem facing the City in deciding what to do. During the last XCAP meeting, there was mention of the possibility of adding review of additional designs for grade crossings to the XCAP work plan – including ones dismissed earlier on. We strongly support this approach to the new XCAP mandate. We believe that considering new possibilities for grade separation and re‐evaluating older ones is the responsible path given the contentiousness, expense, and long‐lasting impacts of any choice that is made. In addition, we believe there is significant energy in the community for exploring alternatives, particularly in the case of Churchill. To demonstrate, we offer the attached proposal for a modified underpass. The design was created by Michael Price of Southgate, with input from a group of neighbors concerned about Churchill closure. Key features of the design are:  Separates Caltrain from Churchill Avenue while leaving the train at grade  Takes no properties  Preserves access from Churchill west of Alma to both northbound and southbound Alma  Protects Churchill east of Alma from cut‐through traffic to Embarcadero, while allowing limited access to Alma southbound  Separates bicycle and pedestrian from vehicular traffic The attached document provides details and multiple renderings of the design. While we consider this a serious proposal, it is in an early stage of development and will benefit from both technical review and further input from those who know the area well. In offering it you at this stage, our intention is to stimulate interest in further exploring the possibilities for grade separation. Mike has also developed, and we have discussed, preliminary proposals for hybrid solutions as well, including one with modest property takings and a one with no takings. If there is sufficient interest, these ideas can be worked through in more detail. Before any of that can happen, we need Council’s support for applying further resources to design development. Kollias Zoe Sarantis and 93 other documented Southgate neighbors in favor of further exploration of options   Concerns about the Possible Closure of Churchill at Alma  Southgate Residents Group      WE ARE CONCERNED THAT CLOSURE OF CHURCHILL AT ALMA WILL HAVE MULTIPLE NEGATIVE  EFFECTS FOR THE NEIGHBORHOOD.     Increased Driving Time:  Loss of access to Alma will significantly increase the time it takes for  Southgate residents to move about town for family/personal needs or to get to work, especially on  trips downtown, to the southern part of the city, and to 101.  As traffic increases over time,  residents may be ‘locked in’ by traffic congestion on Embarcadero, El Camino, and Oregon.   Effects on Neighborhood Composition: Southgate is currently home to a lovely diversity of  residents at different stages of life.  If younger families balancing work and child care cannot get to  work or to school drop‐off in a reasonable amount of time, they may be less drawn to the  neighborhood, causing us to lose both this diversity and an important source of neighborhood  renewal.  Schools may be ultimately be re‐assigned. Over time, this may change the character of  the neighborhood.   Isolation from the rest of Palo Alto:  Southgate will simply feel isolated and disconnected from  much of the rest of Palo Alto in a way it does not now.     Restricted Access of Emergency and Police Vehicles:  Eliminating access to Southgate via  Alma/Churchill while increasing congestion on El Camino, Embarcadero, and Oregon will make it  more difficult for emergency vehicles and police to get to Southgate residents quickly.     Potential Loss of Property Values:  Difficulty traveling to and from Southgate undermines an  important asset of the Southgate location – the protected feel of the neighborhood combined with  its central location and easy access not only to El Camino, Stanford, and 280, but to Downtown,  South Palo Alto, and 101.  This situation likely decreases the desirability of the neighborhood for  many, resulting in a decrease in property values.    WHAT ABOUT RE‐OPENING SOUTHGATE AT PEERS PARK?   Neighborhood Cut Throughs:  In the absence of other changes, a proposal to compensate for  restricted access – opening Southgate at Peers Park – will create incentives for drivers dropping  students at Paly to drive through our neighborhood to reach the on‐ramps for Oregon/Alma.   Others heading south on El Camino to Oregon, possibly including Lyft and Uber drivers, may try to  eliminate waiting at traffic signals by cutting through the neighborhood.   Effects on Peers Park, Evergreen, and California Avenue:  Aside from their effect on the Southgate  neighborhood itself, cut‐throughs to Oregon/Alma will create unwanted traffic density in Evergreen  and the California Ave Business District and decrease air quality and pedestrian and bicycle safety  around Peers Park.       WE ALSO ARE CONCERNED THAT CLOSING CHURCHILL WILL NEGATIVELY AFFECT EVERYONE WHO  LIVES IN OR TRAVELS THROUGH NORTHERN PALO ALTO.  The traffic study completed in Feb 2019*  shows an average of almost 10,000 cars traversing the Churchill/Alma intersection per average  weekday.  In the event of Churchill closure, this traffic will be displaced onto El Camino, Embarcadero,  Oregon, and University, increasing congestion on these already crowded arteries.  As a result, we  anticipate:   Immediately Longer Peak Traffic Times:  As Churchill traffic is re‐routed onto El Camino,  Oregon/Page Mill, and Embarcadero, these arteries will be congested for more hours each day.   Deterioration of Air Quality in Northern Palo Alto and Undermining of “Green Palo Alto”  Goals:  As drivers traveling through northern Palo Alto are forced to spend more time in stop‐ and‐go traffic, air pollution will inevitably get worse, undermining the City’s own goals for the  greening of Palo Alto and affecting residents’ health.  Environmental gains from CalTrain  electrification likely will be lost.   Negative Effects on Emergency and Police Access to Northern Palo Alto:  Increased traffic on  remaining North Palo Alto arteries will significantly affect response times – especially during  peak times, which will get longer.  Negative Effects Will Likely Be Compounded by Stanford Build‐out and Anticipated Growth in Palo  Alto and Surrounding Area:  In the largest project ever reviewed by the County, Stanford hopes to add  almost 10,000 additional people to the campus.  The County believes that the project will have  “significant impacts on traffic” on local roads and highways.  In addition, Palo Alto commercial and  residential development is expected to continue.  It stands to reason that the resulting growth will also  increase the traffic burden on Palo Alto roadways.  WHAT ABOUT CURRENTLY PLANNED MITIGATIONS FOR DEALING WITH INCREASED TRAFFIC ALONG  EL CAMINO, OREGON, AND EMBARCADERO?     No Widening of Main Arteries:  It seems reasonable to expect that a decision that increases  traffic on El Camino, Oregon Expressway/Page Mill and Embarcadero – already at or beyond  capacity – will necessitate adding additional traffic lanes to those arteries.  However, currently  planned mitigations do not include significantly widening any of these roads.    Unaccounted‐for Effects of Stanford Build‐Out:  Additional traffic from Stanford build‐out and  Palo Alto business growth has not been taken into account in most recent traffic study.  IN LIGHT OF THESE CONSIDERATIONS, WE FEEL THAT NORTHERN PALO ALTO CANNOT AFFORD TO  LOSE ANY OF ITS EAST‐WEST CORRIDORS FOR VEHICLE TRAFFIC.  We would like to see City Council  consider other options for the rail crossing at Churchill.          ___________________________________________________________________________________  *Final Existing Conditions Report, Palo Alto Rail Management Program, City of Palo Alto, Feb 25, 2019,  page 17.  Caltrain Grade Separation in Palo Alto Churchill Crossing: An Alternative Michael Price October 24, 2019 There has been much discussion about how to achieve grade separation at the Caltrain crossing at Churchill Avenue in Palo Alto. The city has presented a number of options in past years, but all have met with significant resistance. This proposal is an attempt to address the concerns of residents while meeting the requirements of Caltrain. The goal of this proposal is to preserve as much of the access provided by the Churchill/Alma intersection as possible. Churchill Grade Crossing Options To Date Close Churchill Avenue Not a true grade separation alternative, closing Churchill and adding a bike/pedestrian tunnel for crossing Alma is probably the least expensive option. It also insulates bikes and pedestrians from cars. However, there is widespread concern about traffic impacts on El Camino, Embarcadero and Oregon Expressway if current Churchill traffic – approximately 9500 cars per average weekday – is diverted. Based on a survey conducted in July 2019, it also appears that a majority of Southgate residents are opposed to closing Churchill Avenue. Churchill-only Viaduct Many residents whose properties are adjacent to the tracks oppose a viaduct because they fear that having an elevated structure so close to their homes will materially affect their privacy, their views, and other aspects of their quality of life. In addition, there are widespread fears that an elevated train would too-radically transform the Palo Alto visual landscape and cause train noise to be distributed more widely. Raising, then lowering, the tracks for at-grade train stations may also concern Caltrain, which may wish to avoid frequent height changes. Hybrid Design In the most common version of this option, the train is raised halfway and the roads are lowered halfway. By reducing the height of the train relative to grade, a hybrid mitigates some of the concerns about the Viaduct, but in most versions involves significant property takings. Churchill Caltrain Crossing Page 1 of 16 Michael Price - 2019/10/24 Underground Options – Tunnel or Trench Lowering the grade for train traffic below ground has a number of aesthetic and functional advantages very appealing to residents. However, both underground options are by far the most expensive designs and require the longest construction time, with accompanying disruption of traffic along Alma. They also involve significant property takings, as the temporary tracks would need to be placed along Alma, preventing residents from accessing their properties during construction. Design Objectives Analysis of previous options and their drawbacks leads to the following objectives for the Churchill Avenue crossing: 1. Separate Caltrain tracks from Churchill Avenue 2. Take no private properties 3. Allow vehicular access to Alma from Churchill Avenue 4. Improve bike and pedestrian safety while crossing Alma 5. Avoid rapid grade changes along the tracks (don’t convert Caltrain into a roller coaster) Design Features of This Proposal 1. Separates Caltrain from Churchill Avenue 2. Requires no property takings 3. Partially closes Churchill Avenue, but preserves access to Alma – and therefore downtown and south Palo Alto – for Southgate and other residents west of Alma. 4. Prevents use of Churchill as a cut-through to Embarcadero, thereby reducing traffic congestion on Churchill east of Alma (Churchill East). 5. It requires lowering both Churchill and Alma about 21 feet to allow West Churchill to pass underneath the Caltrain tracks, while keeping East Churchill at grade and closing it to through traffic from West Churchill. While a full underpass would preserve all traffic, bike, and pedestrian access between Churchill and Alma, it would also require the taking of many private properties. This proposal sacrifices some movement of traffic but avoids takings by stopping the underpass at East Churchill while preserving one lane at existing grade on both Alma and Churchill to allow access to properties on those streets. The underpass depth and road slope/grade is copied from the Jefferson Street underpass in Redwood City. The most significant traffic-flow change is that no through traffic is allowed on Churchill across Alma. The table below summarizes traffic movement at the Alma/Churchill intersection. At Maceo May we saw big savings from eliminating gas fired hydronic  heating, the gas connection, and the solar thermal required by T24. The savings paid for continuous exterior insulation, energy recovery  ventilators (eliminating Z‐ducts), electric resistance heat, and PVs. With  these upgrades we are beating Title 24 by 20%, getting more Green Points,  and lower GHGs on a grid that’s getting cleaner. Most project types work just fine.  We are doing a 500,000 sf all electric  office for Microsoft, with major cost savings using heat pumps vs a  central plant.  We do lots of detailed cost analysis with developers to find the most  cost‐effective solution.  For example, at Bay Meadows our all electric  design for 1 million sf of development was significantly less expensive  than a traditional rooftop package unit + boiler + reheat system. A huge benefit for heat pumps is reducing water use.  Using an air source  heat pump for cooling rather than a cooling tower has large water  savings. We’ve done several all electric commercial food service projects that  have been very successful.  The Chef’s quite skeptical at the beginning,  but now say they will never go back to cooking on gas. Last year I interviewed seven leading mechanical engineers that we work  with asking if the building industry is ready to go all electric.  They agreed  that the vast majority of buildings can go all‐electric, and the cost is  competitive with a few exceptions. Be cautious of opening attachments and clicking on links.  Honorable Council Members,    Please find attached a letter from Carbon Free Palo Alto presenting our comments and recommendation to pass the  reach code and to resolve to  implement an all‐electric mandate for new building by July, 2020.     Carbon Free Palo Alto    Carbon Free Palo Alto Recommendations on the 2019 Palo Alto Reach Code and All-Electric Ordinance Proposals Executive Summary Carbon Free Palo Alto (CFPA) has evaluated the ​proposed 2019 Palo Alto Reach Code ​and recommends that Council approve the proposal as is with the exception that the timeline for an all-electric ordinance be moved forward from 2022 to 2020. The case for mandating all electric building is both robust and urgent now in our deepening climate crisis and we have the benefit of several examples to follow with a number of other area cities approving all-electric ordinances for new buildings in 2020 as part of their own reach code efforts. Introduction CFPA reviewed the staff proposal based on public presentations, participation in the Green Building Technical Advisory Committee and additional conversations with staff, community members, CCEs and reach code advocates in the Bay Area. The proposal presents a generally strong reach code to encourage all-electric building and importantly combines it with a mandate for new buildings in 2022. Mandate timing aside, this combination aligns well with Palo Alto’s goals, including cost savings, climate protection, health, safety and energy infrastructure modernization. Incentives​. We are pleased to see that the proposal includes incentives and outreach to promote voluntary electrification of existing homes. Rebates can be a powerful incentive for remodels or where owners simply see the value in electrifying their building sooner rather than later. We look forward to seeing more details made public. ADUs and Major Remodels​. The latest proposal drops applicability of the Reach Code to ADUs and pushes applicability to residential additions out 18 months. We believe that ADUs should not be exempt and that additions and major remodels should be covered as soon as possible in 2020 as an excellent way to expand impact into the existing building stock. It is our shared responsibility to take rapid, unprecedented and far reaching action to avoid the worst consequences of global warming.​ The principal greenhouse gas (GHG) emitted by buildings is natural gas (NG), and its use needs to be vastly curtailed in order to meet the climate goals of both Palo Alto and the State of California. The 2019 Reach Code is clearly designed to dissuade NG use in new construction which would otherwise lock in high GHG emissions throughout the lifetime of the building. Natural gas (methane) leakage goes unreported, meaning cities are vastly underestimating their real building emissions.​ We must again call out the rising number of reports highlighting the impact of methane leakage (upstream, all along the supply chain) and the fact that current GHG accounting rules do not yet take them into account. A ​recent study (Environmental Science & Technology, Oct. 2019) assesses the effective emissions from mixed fuel homes allowed under California’s new 2019 base code for a realistic range of reported leakage rates (2.4 - 5.1%) in CA. It concludes: ​“​The impact that upstream natural gas leaks have on residential emissions cannot be overstated and action must be taken regardless of what actual leak rates are found to be​.​” Palo Alto would have to increase its official buildings GHG emissions count by a factor of at least 2 to reflect the actual warming caused by the NG use. We believe Palo Alto should at least report and ideally account for the impact of leakage ​now​ despite the current lack of ​GHG protocols to do so. Recommendations ●Pass the reach code as proposed ○It generally aligns with the reach code model proposed by the ​2019 Building Electrification & EV Infrastructure Reach Code Initiative​ (sponsored by Peninsula Clean Energy​ (PCE), ​Silicon Valley Clean Energy​ (SVCE) and the ​San Mateo County Office of Sustainability​ (OOS) (​https://peninsulareachcodes.org/)​. ○The reach code is a reasonable step forward now while the City determines how quickly it can move to the preferred endpoint of a prohibition on gas connections to new buildings. The reach code provides the flexibility and time that Staff requests to address the lack of awareness in the market that is creating some resistance. However, since the code only encourages all electric building it is really just a guess as to whether it will achieve its main objective to stop adding to our NG use. Note that the 2016 Reach Code achieved only very limited success in encouraging all-electric building construction. ●Request a Staff report by January, 2020 for recommendations on the details of an all-electric building ordinance for new construction with an implementation date no later than July 1, 2020. ○Staff’s​ ​proposed timeline (2022) for an all-electric ordinance for new buildings is unnecessarily slow. On every measure that counts - cost, safety, health, control, efficiency, emissions and avoiding stranded assets - new all-electric buildings are a relatively easy and impactful climate action to take today. We see no good reason to delay. The lack of awareness and training of some builders and installers is a temporary issue that can be resolved in a matter of months, not years. ○This will be a clear, strong and long term signal to owners and builders that they can and should confidently invest in all-electric solutions. ○The July 2020 date allows staff time to study the examples, address possible risks for Palo Alto and build a case that can be presented for approval by council. ○This will save our city, residents and businesses from further wasteful expansion of the gas network and equipment which will become stranded assets as we start phasing out gas. ●Request staff to present by January 2020, the options we have for decarbonizing existing buildings (the vast majority) in line with our official goal of an 80% reduction in GHGs for all of Palo Alto by 2030 (80 by 30) ○The vast majority of Palo Alto’s natural gas emissions are from existing buildings - where we have made little progress to date. ○Our city, with its own utility and building development operations, plays a central role in determining how easy and advantageous it is for residents and businesses to switch from gas to electricity. ○The general Palo Alto public remains unaware of the true size and scope of the building electrification opportunity. On the other hand, Palo Alto has expert and engaged stakeholders that can contribute insights and connect to complementary resources needed to address it. Bringing practical and realistic options forward for deliberation will enable us to take effective action now, rather than continuing to postpone meaningful action as our climate liabilities mount year after year. Discussion The market is ready to go all-electric in 2020. ​Mixed fuel buildings (gas plus electric powered) have been the default choice for decades in California so it is normal that all-electric building is still perceived as a novel and risky in some cases. Yet twenty-five percent of new and existing homes in the U.S. are already all-electric and they are becoming ever more popular in CA. And, the cost effectiveness, inclusivity and other advantages of new all-electric buildings in CA are well-documented. Misconceptions about modern electric induction cooking are common.​ Induction cooking has compelling advantages over gas but is relatively unfamiliar in CA where gas is the norm. Its recognized advantages include indoor air quality, responsiveness, speed, safety, flexibility and efficiency. It should come as no surprise then, that induction stoves now receive the highest ratings of all stoves in Consumer Reports and restaurants are increasingly opting to install induction cooking equipment. Education and hands on experience are proving very effective in addressing consumer concerns about switching from gas to electric cooking. See the “Resources” below for links to more information. Start now with new buildings to kickstart the nascent market associated with retrofitting existing buildings​. Combining a strong reach code and a commitment to a 100% all-electric new buildings as soon as possible demonstrates a clear commitment to the path toward 100% electric buildings. There is a learning curve involved in bringing electric building into general practice in Palo Alto and across the nation. The building community needs to see a robust and long-term commitment by cities and utilities to all-electric building codes and other forthcoming policies in order to confidently invest in their all-electric capabilities and customer base. This engagement and investment will increase availability and lower costs as Palo Alto intensifies efforts to electrify its much more sizable base of existing buildings. Stop the expansion of the city’s natural gas network and avoid installing assets that will become stranded in the future​. Reaching the climate goals listed in the proposal presentation, including carbon-free electricity and carbon neutrality by 2045 in California and an 80% GHG reduction by 2030 in Palo Alto (80 by 30), implies that Palo Alto’s existing natural gas network will eventually become a stranded asset. Our understanding is that the City is planning to progressively electrify buildings while decommissioning the gas network in a yet to be determined timeframe that may be consistent with the above mentioned goals. Stopping further investment that would otherwise expand the NG network is a financially responsible move that will reduce the total liability that the city will incur to pay down stranded gas assets. We believe this is why PG&E, which also manages a combined gas and electric utility, has publicly supported the all-electric ordinances in Berkeley, San Jose and other cities. In Palo Alto, eliminating new NG appliances will save building owners from future losses on early retirement of their gas devices and electric retrofit costs. In other words, Palo Alto should stop digging the stranded gas assets hole deeper now that we have good alternatives to gas in the form of electrification. Align with other forward-thinking cities in California.​ Several cities in our area are also going beyond the common reach code model referenced above by adding electric mandates where there is no good justification to delay. Seven out of the twelve Santa Clara cities working on reach codes are considering or have approved some level of electric ordinance according to SVCE. For example, ​Menlo Park approved an ordinance ​that mandates electric space and water heating in all new residential and commercial (with reasonable exceptions) buildings. The Mountain View council also unanimously passed an all-electric ordinance in its first hearing of its Reach Code. The City of Berkeley approved an all-electric ordinance for new buildings with some reasonable, temporary exceptions. The Berkeley Council resolution details the robust case for their ordinance that could reasonably serve to support similar ordinances in any California city. A clear and specific all-electric ordinance that eliminates mixed-fuel options will save significant effort for building project teams and city staff. An ordinance eliminates the need to model, estimate and negotiate the complicated range of mixed fuel building efficiency and equipment combinations in order to build with gas based on perceived preferences for gas cooking and fireplaces. There are off-the-shelf electric radiant floor heating solutions for new buildings.​ However, we also know that more designers and suppliers are claiming radiant floor heating has a diminishing comfort advantage in new construction of today’s well-insulated homes. Many decide with their clients against adding a separate gas powered radiant heating system in favor of combining space heating and cooling in one, less expensive heat pump system that avoids the need for gas infrastructure. Resiliency in the face of temporary electricity outages. ​The recent move by PG&E to institute Public Safety Power Shutoffs during dangerous weather events raises the question of losing power in buildings for hours or days at a time. It should first be noted that with modern gas appliances generally cannot operate without electric power. Local battery storage and generation in buildings or groups of buildings (within a microgrid) are the main solutions to keep buildings powered during temporary outages today. The market is changing fast to meet the need. Electric vehicles are already used in some countries (mainly Japan today) to effectively power homes during such outages (today’s EV batteries are large enough to power an all electric home for several days). Such “vehicle to home” solutions are targeted to become available in the U.S. in 2020 as a promising long-term resiliency measure. In Closing We are heartened by Palo Alto’s effort to establish a Reach Code, an all-electric ordinance and supporting incentives to electrify and decarbonize new and remodeled buildings. We hope our recommendations are accepted in the spirit of working together as a community to upgrade our energy infrastructure, improve our quality of life and meet Palo Alto’s ambitious 80 by 30 climate action target. My name is David Coale and I am a member of the Green Building Advisory Group that is mentioned in the Staff report. The group reviewed Staff’s proposal for the latest reach code update for 2020. Many in the group want to see an all-electric reach code with no mixed fuel option. I would like to make the case for an all-electric reach code, i.e. no gas for new residential and multi-family construction and larger remodels including small businesses. “We’ll go down in history as the first society that wouldn’t save itself because it wasn’t cost-effective.” - Kurt Vonnegut The good news is that staff has two studies1 that show that all electric homes, multi-family dwellings, small business and large remodels, are cost effective. The case for all-electric buildings becomes even stronger when you correctly account for up stream emissions including leakage of natural gas and compromised indoor air quality. This was not done in either of the studies. Staff’s latest proposal gives builders two options: 1) All-electric construction which only has to meet current State code for efficiency and 2) a mixed-fuel option where construction would have to be much more efficient but could also include natural gas appliances. For the mixed fuel construction, the buildings would also have to be pre-wired for future electrification. A ban on gas for new construction would go into place by 2022. For the mixed fuel option, Staff set the bar for greater efficiency pretty high in the hopes that most builders would go the all-electric route. When pressed by some committee members on why not go all- electric now, they said there was “push-back” from other stake holders, but would not elaborate. It is important to note, it was not for technical or cost effectiveness reasons. Some of the challenges listed for all-electric construction are people not wanting to give up gas cooking and fireplaces. Induction cooking is actually better in many respects than cooking with gas. It actually heats up and cools faster than gas cooking, offers accurate temperature control, indoor air quality is better, it is much safer and does not add extra heat to the kitchen (more efficient). In other words, this is largely an educational issue. When you correctly account for the up stream emissions of natural gas and take into account leakage, you find that using natural gas is about the same as burning coal and we would never consider burning coal in our homes for any reason. Here are the reasons Palo Alto should adopt an all-electric reach code now: 1) It is cost effective to go all-electric and better for your health. There are now two studies showing the cost effectiveness of going all-electric1. The Utility department, along with the Utility Advisory Committee really gets this along with the reductions of greenhouse gases (GHGs). In fact, just this month there was a great utility bill insert about electrification3 that also points to a city web page4 that has great resources for electrification. Palo Alto Utilities also put on an excellent Electrification Expo with expert speakers and venders showing electric solutions for all appliances. 3) Greater GHG reduction is needed sooner then later. The city still has a lot to do to reach the 80% GHG reductions by 2030 goal – a top priority for the city. We can’t afford to delay actions on climate change. Climate change is happening faster than governments can act, and while compromise is normally a good strategy for governance, every time you compromise with climate change you fall farther behind, as every report on climate change says it is happening faster than previously expected. 4) We need to send a strong message to the industry to build all-electric homes now. Even though this is a very small amount of the housing stock, setting this example for new construction and especially for retrofit and remodels is very important. Many industries must be pushed by regulations (seatbelts, catalytic converters, unleaded gasoline, etc.) before they will change. 5) All electric construction is easier. The calculations and construction required for greater efficiency in the mixed fuel option are more complex and costly. This is also true for plan checking, permitting and inspection as well. And there no need for a Certified Energy Analyst report to ensure compliance. 6) Action on climate change does not depend on what others are doing. Almost all cities (and countries) are wondering where they are with respect to addressing climate change. Addressing climate change is an absolute issue, not a relative one; so while being better than your neighbor is considered “winning”, it is not so simple with climate change. That said, Palo Alto is now clearly lagging behind Berkley, San Jose, Menlo Park, Mt. View, and Morgan Hill. We should at least step up to our top priority of Climate Change and set the mark clearly out front. 7) We are already behind our own requirements for electrification. While this is somewhat true for power outages, the home heating still goes out as this requires electricity and in some areas, the recent PSPS have included gas shut offs as well. In our area, the greatest threat is from earthquakes where natural gas to the home is a major hazard. 10) We have a moral obligation to address climate change now. In light of the recent and continuing fires, droughts, hurricanes, flooding and other disasters made worse with global worming we cannot afford to delay any longer actions to address climate change. (b) Requirements.--Each Regional Ombudsman shall-- (1) serve as a regional liaison with the public, including community groups, on issues regarding aircraft noise, pollution, and safety; (2) make recommendations to the Administrator for the region to address concerns raised by the public and improve the consideration of public comments in decision-making processes; and (3) be consulted on proposed changes in aircraft operations affecting the region, including arrival and departure routes, in order to minimize environmental impacts, including noise.   2) Advisory Committees:   As Mr. Palmer mentioned, Nextgen gets done like a business with various advisory committees. These committees  are stacked against the public who have to sustain the various ambitious industry business plans ‐ which have a direct  impact on our communities and especially Palo Alto. The Nextgen Advisory Committee would benefit from having the  Ombudsmen participating (the Ombudsman we don't have yet!). As a recent Inspector General report about Nextgen  has reported, Nextgen needs to have better methods to measure benefits, among other things.     Separately, I ask that you please clarify the information about the 2012 legislation for Catex provided by Mr.  Palmer. The way it sounded was that this law means that it's "game over" in terms of Nextgen procedures or because  the NorCal 2014 Metroplex is completed communities have no rights. Los Angeles has a very different view of this as  illustrated by the attached two letters about Burbank Airport showing they legally achieved getting reconsideration of  three Catex procedures (after Metroplex) and are asserting on having adequate review of procedures which have not  previously been studied in Metroplex. Centennial Airport goes further;  they didn't even wait to get a record of  decision for an EA to challenge FAA about flawed environmental processes and called FAA on the 2018 laws that need  to be considered.    These cities who are fighting for truthful environmental processes have brought a lot of light  ‐ from the smallest cities  to the largest, there is much that is within your power to do.     Thanks,  1 Brettle, Jessica From:Susan Powers <susapow@yahoo.com> Sent:Sunday, October 27, 2019 4:32 PM To:Council, City Subject:AJ Capital bribery CAUTION: This email originated from outside of the organization. Be cautious of opening attachments and clicking on links.  Dear Friends of Buena Vista ~     There have been some changes for Buena Vista with more to come that I knew you would want to know about if you  missed them.      Buena Vista was saved in May of 2017, so that its residents could remain there and the site preserved for affordable  housing (75 years as a mobile home park or similar). The new owner, Santa Clara County Housing Authority  soon contracted with the nonprofit mobilehome park owner, Caritas, to oversee ground operations and  management. Caritas made badly needed repairs and addressed many other problems needing immediate attention. It  also strengthened the already strong community through it’s children’s reading program, mini‐scholarships for the  college bound BV students, and providing the space for the Homework Club and the BV Board meets in.     Now Housing Authority is looking forward to the next stage of progress ‐ the rehabilitation to BV’s infrastructure  (electrical, sewer, paving, etc) and housing, so John Stewart Co. (JSC) has been retained to replace Caritas with a  somewhat different skill‐set and already works with Housing Authority.  JSC is a large residential housing company that  was involved with the Stevenson House rehabilitation and temporary resident relocation in Palo Alto, and with the  Opportunity Center.      Housing Authority and a representative from JSC met last week with BV residents to inform them of this change to new  management. So it’s a fond farewell to Caritas who is owed a deep thanks for its caring hard work. And a big welcome is  extended to folks at John Stewart Co. who I know will come to appreciate Buena Vistans as we do. And thank you to  Housing Authority for caring and having faith in Buena Vista.     The effort to save BV began in September of 2012 which found its safe harbor in May of 2017, but those years donʹt  encapsulate our support. Our support is needed and continues for place and residents as we have seen this year. Buena  Vista ‐ʺ Good Viewʺ is not removed from the travails of the world of hurt and harm, and at sometime a future that will  include disruptive changes to home and hearth. Friends of Buena Vista will be there as needed.     But we do know it will never again happen that a resident at Buena Vista will go to bed worried that they will wake up to  be told they must leave their home forever.     Keep the faith in Palo Alto’s core value ‐ our caring for each other.     Winter Dellenbach  Friends of Buena Vista  fobv.org      Here is article about the above:    copy and paste into server:   2 https://www.paloaltoonline.com/news/2019/10/17/housing‐agency‐eyes‐complex‐rehabilitation‐of‐buena‐vista‐ mobile‐home‐park      1 Brettle, Jessica From:Huseyin Bulutoglu <gyrospaloalto@gmail.com> Sent:Tuesday, October 29, 2019 2:34 PM To:Council, City Subject:Gyros Gyros Restaurant CAUTION: This email originated from outside of the organization. I do not think we will be able to stay in business even though we have 8 years left on our lease because of this increase. We would not be able to provide competitive pricing to our customers. We would just have to shut our doors. I 5 am hoping that we do not have to wait four years for these corrections at Donald.)    Your note lists one mitigating step that is supposed to help the dangerous situation on Arastradero: the addition of more signage/traffic warning devices to explain the very confusing situation that City Staff designed. Since one of the main issues is the visual overload-arrows going in all directions, red, white, green, yellow, black markings, straight lines, jagged lines, arrows shifting directionally in short distances, parking signs in the middle of the road, bumper car protrusions along the street, lack of turning radius at corners-could you please explain to the uninitiated how adding new signage-thereby creating more visual confusion-is supposed to help? With all these visual detractions, you have done nothing but keep drivers from paying attention to cars/students/bikers along the road. Trying to read the signage and pay attention traffic warning devices has the same net effect as texting while driving: distracting from paying attention to the road. What genius came up with this plan? What textbook proposes a plan that supposedly creates safer driving conditions by maximum distraction of drivers? But Supervisor Shamann Walton, who represents San Francisco’s southeastern neighborhoods, and other city leaders, also want Faster Bay Area to help reform Caltrain. The agency shares staff with another transit entity, SamTrans, which holds the small-but-growing train system back from reaching its full potential, Walton argues. Caltrain ridership has tripled in the last decade but officials want it to grow even more to help a booming region commute more efficiently. Walton’s also got backing from San Francisco Supervisor Aaron Peskin, who is the chair of the San Francisco County Transportation Authority Board, an important purse doling out funding for San Francisco transit projects. At the transportation authority board on Tuesday, Walton levied his proposal to Faster Bay Area’s leadership. “We will require any revenue measure, at the state or regional level, include a clause that says Caltrain should separate from SamTrans in order to receive support from the county of San Francisco,” Walton said. Caltrain and SamTrans sharing staff, Walton said, “is simply bad governance.” Peskin also supported Walton’s proposal. He was particularly concerned with the next construction phase of the Salesforce Transit Terminal, which will see newly electrified Caltrain vehicles run to the station in coming years. The transit terminal project itself went over budget, forcing the previous leadership to be ousted by San Francisco. “It’s going to be very difficult for this county to support that measure until we have a regional governance entity,” Peskin said of Faster Bay Area. “If we’re really going to make Caltrain everything it can be we’re going to have to reset and regionalize that rail opportunity.” It is unclear how many San Francisco officials support the pair of supervisors, but Walton intends to bring a non-binding policy resolution to the Board of Supervisors to put them on the record for or against his plan. Cohen said the Faster Bay Area effort is trying not to spell out, in detail, every project the $100 billion would be 3 spent on, since it is a far-reaching funding effort. Responding to Walton’s request for Faster Bay Area to tilt the scales on Caltrain’s independence, Cohen said, “That just came up and we haven’t entertained it.” Walton also serves as a director on The Peninsula Corridor Joint Powers Board which governs Caltrain. His fellow director, Charles M. Stone, who is also a Belmont city councilmember, said Faster Bay Area could be transformative for the region’s transit, which could alleviate clogged roads and crushing traffic. “To hold it hostage for some sort of power move, that may not be the best for the organization,” Stone said, “it seems short-sighted and strange.” Additionally, Stone said, there is already an ongoing effort by Caltrain to analyze its own governance structure, which includes a workshop hosted by Caltrain on November 21. “Candidly, things are moving along as they should,” he said. “Director Walton has to answer his CEQA Regulation 15305 (Categorical Exemption 5) is not applicable because the proposal is for a change in density.
