Request for Sign Review and Approval according to Sec. X, Gen. Provisions C &B Zoning Ordinance, Town of Gulf Stream. a. Signs for Place Au Soleil Gate House On motion duly made and seconded the Board approved the signs as presented by Mr. Dittman. b. Placement of Construction Sign at 3180 Polo Drive, residence of Dr. and Mrs. G. Mueller - (J.J. Baker sign). On motion duly made and seconded the Board approved placement of noted sign. Variance Requests a. Thomas Crocker residence, 3265 No. Ocean Blvd. Mr. Dixson read for the Record part of a letter from the Gulf Stream Civic Association objecting to Petitioner's request to increase the building height to forty -two feet (42'). Said letter is attached hereto and made a permanent part of this record. Mr. Crocker and his architect respectfully requested a two foot ten inch (2'10 ") increase, making a presentation of the residence at that height. Mayer Chairman, Planning & Zoning Board Town of Gulf Stream 100 Sea Road Gulf Stream,Fl. 33483 Dear Mr. Mayer: This letter is submitted on behalf of the Town of Gulf Stream Civic Association, Inc, in opposition to the proposal for a variance increasing the height of a one - family residence from thirty -five feet to forty -two feet, as requested by Mr. Thomas Crocker. The Town of Gulf Stream Civic Association is an organization for the purpose of advancing the civic interests of the Town of Gulf Stream including the protection of persons and property and the values of the latter. It is a non - profit corporation with 371 members. The reasons for Civic Association opposition to the variance proposal are as follows: 1. The granting of the variance would be contrary to the best interests of the Town of Gulf Stream and could adversely affect the value of similiar properties. 2. The proposal is the first in our recollection to exceed the thirty -five foot height limitation as contained in the Town Zoning Ordinance. 3. The granting of this variance would establish a dangerous precedent for future building. It could be that future variances might be sought at various heights above the thirty -five foot limitation. There is no way of predicting what impact such a precedent would have on future building. 4. The proposal to increase the height of a one - family residence from thirty -five feet to forty -two feet even exceeds the maximum limitation placed on the building of multi -story buildings. 4 Civic Association - Crocker Page Two 5. There are no one - family residences either on the ocean -front or elsewhere which exceed the maximum thirty -five foot limitation provided in the Zoning Ordinance. 6. No prior review in the application process provided in the Zoning Ordinance has been held. 7. In presenting the application for variance the applicant is required to show that "a literal enforcement of the provision of the Ordinance will result in unnecessary hardship." Actually, the variance is sought solely to meet the esthetic and building desires of the owner and architect. The conditions from which the owner and architect desire to be relieved are, therefore, of their own creation. It was never intended that the provisions of the Zoning Ordinance should not be strictly respected and enforced merely to meet the individual desire of a particular owner- builder. 8. It can reasonably and easily be observed that, with architectural imagination and ingenuity, a modification in the building plans can be made which would then provide compliance with the thirty - five foot height limitation. It is respectfully requested that the application be denied thus serving the best interest of the community and that an appropriate recommendation to this effect be made to the Town Commission. My present one -story C.B.S. residence has an existing U foot $-inch side yard setback on the southern side yard of my property. It is to be installed at the most southernly portion of the existing wood dock. As you will see, this is the only solid area that exists on the new, improved and installed retaining /sea wall per the approved plans and permitted work that has been performed on the enclosed survey. The dock that has been installed was originally approved for 100', we shortened the dock to 90' with the anticipation of putting in a boat lift at the south end of the dock. Mayer Chairman of The Planning & Zoning Board 100 Sea Road Gulfstream, Fl, 33444 Re: The Sipe Residence Dear Mr. Chairman & Board Members: Upon purchasing the property at 3435 North Ocean Boulevard in December of 1988, there was a 20' easement on the northern boundary, thus separating the property from the northern neigh- bor's property. During 1989 the Town of Gulf Steam vacated their easement and, therefore, the 20' easement no longer exists along the northern boundary line. The purchase of the property was based on the fact that the easement would be maintained by the Town. Since the easement was vacated by -the Town, the property to the north was sub - divided creating an additional building lot. The vacated easement and sub - division was unpre- dicted at the time of purchase of the property. After checking with the Town (November, 1988) prior to the acquisition of the property, no mention of the vacated easement was conveyed to the owner at that time. At present the existing side yard set backs to the eves are as follows: On the South side the set back is 910" and on the North side the set back is 9'8 ". With the proposed design, the South set back becomes 1612" to the eves which is 112" in excess of the required set back, the reason for this is to enable the pool area to have an open feel and a view to the ocean. The set back on this boundary is increased by 7'2 ". The required set back on the northern boundary would be 15'0" to the eves. We are requesting that we place the northern wall of the new residence at the same position as the now existing garage wall (i.e. 1216" to the wall) The new set back would be 11'2" to the eves, requiring a variance of 3110 ". The ground floor area to the site area ratio is 16.4 %, which is small and does indicate that the site is not being over devel- oped. This being an old 100' lot it is felt that to provide the owner and the town of Gulfstream with a residence of the highest quality that the request for a variance only on the northern boundary, where there now exists a structure is the minimum request to enable our client to construct this dwelling. To the south is the parking lot for the Gulfstream Golf Club. As the present building is in very poor condition with inadequate foundations, it is desirable to demolish the structure, and replace it with the new building. A major element to the resulting design is the desire to save three very old and beautiful Sea Grapes. The placement of the building around these sea grapes adds to the elongation of the building along the ocean front. Hence, it is the desire to keep the sea grapes which causes a hardship for our client. In addition, the desirability of having ocean views from as many rooms as possible is of paramount when one purchases a site having the ocean view. Not to allow an owner to realize these views would be a further hardship. We would request a variance of 12'5/8" on the south side, where the property abuts the parking lot for the club. We would be placing the building 10'0" from the boundary to the eves. The required set back is 22' 5/8" to the eves. We are also improving the condition on the South by removing an existing pool which is 6' from the property line. This area will be improved by adding landscaping. On the northern side of the site, the existing garage has a 16' 2" set back to the walls. With the new proposed set back of the new bathroom and new garage, we would increase this set back by 1110" with a new set back of 1810" to the walls, or 1618" to the eves. This requires a variance of 5' 4 5/8" from this required set back of 22'5/8 ". We would like to point out that this request is only for a width of 16'6" for the bathroom, and CHARTERED ARCHITECTS - PLANNERS - INTERIOR DESIGNERS The Young Residence - Page 2 33'0" for the garage, making a total of 4916" which is less the 128 of the northern boundary.
