We need your help to protect Palo Alto. We are tenants of the Hohbach Realty Property buildings, composed of Entrepreneurs, Academics, Lawyers, and other Silicon Valley professionals and leaders. These buildings are a legacy and testament of the remarkable Mr. Harold Hohbach and family. His well-known generosity and charity span from their recent $25M donation to Stanford University to maintaining affordable livings in Palo Alto to allow first-time entrepreneurs and businessmen to prosper, to give new citizens of Palo Alto an opportunity to live, to encourage new emigres their first new venture into this country. I am one of such people. As tenants, we have enjoyed decades living in these properties which we call home. With the passing of Harold Hohbach, we also witnessed the changing of the guards. The new Management bear real-estate licenses, but operate with impure intents, poor faith, unlawful breaches, gross negligence, deceptive actions. The rise in complaints with the Palo Alto City unilaterally across all Hohbach properties coincide around the time of the new Management control. We need your help, your justice, your voice to help those who are unable to protect themselves. We have now a well documented long list of problems and concerns to help direct our plea. We need your help to create new ordinances to protect all Palo Alto in the same way other adjacent cities have done it in the last weeks. We need you to call the appropriate city departments to ensure proper legal and safety compliance to Palo Alto municipal codes. There are concerning health and safety hazards. We need our City Lawyer to advocate for what is fair and reasonable. The following list is a short sample of what we have documented: (Work in progress) • Attempts to intimidate and produce fear and inject illegal fees. • A compelling list of “Landlord” Harassment divided in more than ten categories. • Failure to disclosure documented serious life hazards that are known by the City to cause cancer. • Rent increase of 2.7X~4.5X . • Violation of city and state ordinances with the intent to “make money.” • Modification of lease agreement with questionable illegal breaches and mistakes. • Cosmetic changes in buildings to “upscale” properties, while concealing years of dangerous negligence. • The misuse of the Harold’s family name to intimidate, justify, confuse long-term tenants. • Discrimination against the vulnerable families under BMR. • Misappropriation of Public spaces and common areas for their personal financial benefits. • Refuse for years to provide services paid, while giving us the option to “leave.” • Lack of prevention and planning towards the inevitable natural disasters we are all expecting. • Entering into the apartments without legal cause, advanced notice, or permission. • Changing buildings’ front door’locks without advanced notice and at the last hour of the business week • Lack of elevator maintenance, as can be seen in the certificates on the elevators’ walls. The effects of irresponsible real-estate practices produced the economic collapse of 2009, which continues as of today with more than 25 million default cases in the USA; leaving lenders, citizens, authorities and our cities dealing with the devastation of such whims. We respect Mr. Harold Hohbach’s legacy, and it is very painful to see his spirit die and be misused in the name of greed and abuse. We need your help to stop this cancer before is too late again. Be cautious of opening attachments and clicking on links.  Hello Council Members,    As this conversation regarding Barbara Gross, a hospitality consultant,  requesting an action to withdraw from  the  agreement between City of Palo Alto and SMCSVCVB no doubt updates will be forthcoming from all concerned.  I  have noted the tentative December 2nd and will continue watch for updates and confirmations. In advance of those  updates I thought it may be helpful to share my request to Barbara Gross about what she and PAHC propose for  replacing the benefits of the existing relationship  if the agreement is terminated. Also, it may be worth confirming my  POV to ensure the narrative remains focused and does not become distracted by any one personality.     The PAHC initially formed to resist the TOT increase that went into effect April 1st 2019. My perception was  effort spent fighting the increase were not best use of my time and resources. That does not reflect on the  merits of the issue but my response to issue. Additionally, I had concerns about PAHC that remain unresolved. I  removed myself from participation with the group.      PAHC directed by Barbara Gross aggressively moves toward the goal of terminating the agreement with  SMCSVCVB. Participating in this endeavor in my view is ill‐advised, incorrectly aligned with resentment of TOT  increases and counter intuitive considering the downward economic indicators. This is the period of time when  robust marketing and sales efforts are necessary. I am not in favor of terminating the agreement and for  whatever flaws may exist it is far more valuable than not   Most importantly I want to confirm the narrative remains focused on the issue at hand and not be perceived as  the opposite view points of  individuals regarding the renewal or termination. My perspective is based on  continuing with a reputable, known entity operating within industry standards for a CVB or terminating the  agreement with no discernable replacement for the benefits provided. SMCSVCVB provides resources and  expertise in attracting conventions and actively promoting Silicon Valley as a destination. Certainly there are  improvements needed but nothing remotely approaching termination.      I am advocating for continuing with the agreement not in opposition to any one individual  but in support of the  resources and benefits I need and utilize to reach my properties financial performance. Equally so, I am  advocating for continuing as it benefits the entire Palo Alto hotel industry, ancillary goods and services providers  along with restaurants, retailers and social venues that thrive providing services for residents and visitors alike.  My priority is to maintain the connection to a strategic hospitality/tourism partner and if PAHC presents a  marketing plan,  destination marketing strategy, budget guidelines and effective cost control  I am more than  agreeable to evaluating and would fully support the transition if their plans are equal to SMCSVCVB. Thank you for sharing this update. As the Palo Alto hoteliers consider this action evaluate the decision to support or  oppose the requested action some additional information may be helpful.     Is this an official Palo Alto Hotel Council email and distribution list? If this is a personal email, are you agreeable  receiving communication regarding PAHC matters?   On the request for action to withdraw the Garden Court, with approximately 60 hotel rooms, is listed as a large  hotel supporting termination of the agreement.  Is that a correct identification of the hotels status as “large?”   If the agreement is terminated what strategies and action plans can we expect from Palo Alto Hotel Council to  replace this lost resource?  Would it be possible to see a PAHC presentation deck outlining the council’s  priorities and action plans?   If the agreement were terminated, neighboring communities and markets would change from cooperative  Silicon Valley attractions to direct competitors. What strategies are in place to respond to the disadvantage of  not being included in destination marketing for Silicon Valley? Is that included in your marketing and strategy  deck?   With Palo Alto Hotel Council acting as an industry, voice what action plans are in place to advocate for hotels  and hospitality businesses regarding Palo Alto’s proposed business tax? Does PAHC have a deck available  outlining these action steps?   Understanding the legal jeopardy of anti‐trust violations and previous lack of compliance with PAHC  documents/communications has this been effectively addressed and is PAHC membership fully informed of the  necessary steps to maintain compliance?   If the agreement is terminated and access to SMCSVCVB resources are no longer available, for Palo Alto hotels,  what is the expected PAHC funding source, vehicle for collection, compliance requirements to support PAHC  marketing endeavors and is this planned as an expense or pass through fee?  Can PAHC share an operational  budget outlining projected expenditures for print, trade show, direct selling and associated travel and  accommodation expenses for PAHC sales, marketing and promotional efforts?    3 As we review this action to withdraw, it is wise to keep in mind outlying indicators that will have downward pressure  nationally, in the Bay Area and specifically Palo Alto.  I know we have all felt the impact of International inbound travel  contracting 0.4 percent in September, marking the fifth negative month in 2019 while outbound international travel and  global international travel for non‐American destinations continues to grow. Additional hotel supply in our market is  affecting occupancy numbers as these events occur (think Nia, Hyatt and an endless list along 101.) The United States  Travel Association is pushing Congress to renew the Brand USA program, a destination marketing organization tasked  with promoting travel to the U.S. The USTA has argued before Congress that Brand USA helps keep the U.S. competitive  in the global travel market and could prevent the U.S. slide in the global travel market from being worse. For political  reasons Congress is failing to act. Just as the lack of destination, marketing has negatively affected the hotel industry on  the national level the same would apply to Palo Alto without destination marketing from SMCSVCVB.    Considering the agreement is an annual renewal it seems prudent to approve the agreement for 2020. Having the  agreement in force for 12 months is not an excessive commitment and provides Palo Alto hotels the opportunity to  focus more on the benefits of participation, could lessen the impact of downward economic indicators in Palo Alto and  provides a specific time period to evaluate if continuing is worthwhile.  Of course, the PAHC may have strategy, action  plans and financial resources that are equal to SMCSVCVB. If we could review PAHC material prior to the decision date  that could change the conversation entirely. As I believe, we all understand this is more than just a conversation  between two individuals and must be evaluated in terms of the benefits and risks to the whole. The outcome of this  decision has the potential to impact hotels, restaurants, venues and ancillary service providers such as rental cars, dry  cleaners, the mall and retailers who rely on tourism to achieve their business goals. The wrong decision would negatively  affect overall business revenues and reduce tax revenues in Palo Alto thereby diminishing their efforts to operate  effectively operate city services.    Barbara, would it be possible to distribute PAHC marketing plan, sales/marketing materials and budget plans so we have  adequate time to compare with SMCSVCVB organizational structure. Even if it is not final drafts that information would  be extremely helpful to the hotels and would be a benefit to the city of Palo Alto as they budget for expected TOT  revenues in 2020.    Thanks so much for following up on this important topic. While hotel operators are required to make the best decision  for their stakeholders I think we can all agree the best decision for Palo Alto benefits the whole. I look forward to  reviewing the PAHC materials.    Best,    ‐Matt Conditions in the labor market remained tight, and wage growth was moderate. Price inflation was flat. Sales of retail goods expanded moderately, while activity in consumer and business services was solid. Conditions in the manufacturing sector strengthened modestly, and conditions in agriculture deteriorated slightly. On balance, contacts reported that residential and commercial real estate market activity expanded at a solid pace. Lending activity ticked down. Overall, price inflation was flat over the reporting period. Contacts in manufacturing and utilities observed upward pricing pressures due mainly to a further moderate pickup in the cost of metal inputs and higher financing costs for capital-intensive production. Food and beverage prices increased somewhat, reflecting higher labor costs at producers. The growth of building material prices slowed a bit, due in part to noticeably lower lumber costs, which fell because of the moderation in the housing market. Lower oil prices resulted in reduced fuel surcharges at shipping and logistics businesses and a modest decline in the price of some petroleum-based inputs to manufacturing. In the agriculture sector, prices declined modestly as demand from abroad weakened in response to trade policy changes and the stronger dollar." Federal Reserve Bank Beige Book, July 2019 By year-end 2019, San Jose-Santa Cruz hotels are forecast to see a RevPAR decrease of 2.6%. This is the result of an estimated decline in occupancy of 4.6% and a 2.2% gain in average daily room rates (ADR). The 2.6% decline in San Jose- Santa Cruz RevPAR is less than the national projection of a 0.9% increase. Both the upper and lower-priced segments of San Jose-Santa Cruz are expected to show negative RevPAR change by year end. Lower-priced hotels are forecast to attain a 1.7% gain in ADR, but suffer a 4.3% decrease in occupancy, resulting in a 2.6% RevPAR decline. Upper-priced hotels are projected to experience an ADR growth rate of 1.9%, along with a 5.0% loss in occupancy, resulting in a 3.2% RevPAR decline. Looking towards 2020, San Jose-Santa Cruz RevPAR is expected to decline 0.2%. This is better than the decline in 2019. Prospects for RevPAR growth in the upper-priced segment (positive 0.2%) are better than in the lower-priced segment (negative 2.0%). San Jose-Santa Cruz market occupancy levels are expected to range from 71.8% to 73.6% during the 5-year forecast period. heard mention that there is consideration of making Embarcadero Road 6 lanes, presumably to help mitigate traffic if  the Churchill grade crossing was closed.  Is this accurate?  Is the City proposing that Embarcadero Road become 6 lanes  in some scenario of any type?   The official who responded to the question mentioned that the right of ways already  exist to make Embarcadero Road 6 lanes, seeming to confirm that this proposal was under consideration and  could/would potentially be executed.  I don't see this possible proposal described anywhere in the City's paperwork  related to the Churchill grade crossing closure, or any other scenario whether related to Caltrain electrification or not,  nor in any of the City materials that were handed out at that meeting.       As a Palo Alto resident who lives adjacent to Embarcadero Road, I am strongly opposed to any increase in lanes for  Embarcadero Road and any additional traffic congestion being added or diverted to it.  The traffic congestion on  Embarcadero Road is already very bad, particularly at commute times and when students are riding bikes to and from  Greene MS and to Paly (as well as to Castilleja).   It is already dangerous for our biking student commuters and bicyclists  in general.  And it is already very congested, with vehicles heading from and to 101 in the morning and late in the  afternoon, at the Middlefield/Embarcadero intersection in the morning and afternoon, and all the way through the  underpass leading to Paly and Town and Country and El Camino throughout much of the day.  Adding further traffic to  this route will create heightened safety concerns for our students, add environmental concerns for nearby residents  living adjacent to Embarcadero,and will increase traffic on a vital route which is already extremely congested, increasing  commute times for everyone.    Making Embarcadero 6 lanes is essentially creating a freeway in the middle of this section of town.  Vehicles already  routinely exceed the speed limit, speeding to their locations, endangering residents and bicyclists.  Adding another lane  would only exacerbate this.     As such, based on hearing this possible proposal, I want to express my strong opposition to a Churchill grade closure and  strong opposition to any plan to increase lanes on Embarcadero Road.      Where might I read more about any possible proposal affecting Embarcadero Road, or Oregon Expressway for that  matter, whether due to a proposed Churchill grade crossing closure or not?  Should I be contacting this XCAP group as  well as the City Council and City transportation staff to express my views on the matter?  How might I contact the XCAP  group?    A Churchill grade closure would certainly add to the traffic congestion that already exists on both Embarcadero Road  and Oregon Expressway, as local traffic that hopes to cross the Caltrain tracks and get to Stanford, Stanford Hospital,  Stanford Shopping Center and vice versa, as well as other locations, would then most likely be redirected to either  Embarcadero Road or Oregon Expressway.   As such, as a Palo Alto resident, I oppose the Churchill closure.     2 (Saturday I passed by two on California Ave, and one just off California.) This seems in direct contradiction to the city councils policy of trying to reduce green house gas emissions. There are strict laws on insulation, a movement to forbid new homes from using gas, green certified city buildings. Yet you allow restaurants to do the most wasteful use of fossil fuel: Try to heat the outdoors. Please ban this environmentally destructive practice. In Denmark (where it is a lot colder than here), there are blankets at outdoor cafes. In SF the beer garden has blankets. teacher housing 'will take too much money and time without bringing concrete benefits to the district' (Daily Post, 11/7/19 "Flip Flop on teacher housing").   Palo Alto Online reported the following in relation to PAUSD teacher housing plans and the Cubberley site: but not technically included in the master plan for the site, or notify the city that district will not pursue housing in the near term there, under the proposed lease terms.    Why should terms and conditions for the Cubberley site lease between PAUSD and the City of Palo Alto depend upon  (teacher) housing plans predicated upon a fictitious basis?  I hope the City of Palo Alto will take this into consideration as happened to Isaac in his Old Age? Isaac lost his Sight. Who did something before the Life of Esau that is related to the  Field that was of High Significance wherein the Protagonist was in a Likewise Key Position in Lineage? Cain requested his  Brother Able to come into the Field [the Plain]. And Cain had been warned by Elohim when Cain's Countenance was  Dejected that Able's Gift was acceptable while Cain's was not acceptable. Able and his Gifts were looked upon. Is this  what would lead to the Division of Male and Female to have a Wife? Did Cain remain undivided and therefore Wifeless?  "Though thou hast offered right, yet if thou hast not rightly divided, hast thou not sinned?" Instead of being Composed,  Cain slew his Brother Able. Perhaps Cain was grieved because Able's Division meant that in the Physical Realm Able now the Search for the Cure whereby Terah makes a Pursuit of Comparative Idolatry because Terah was Tenacious and Be cautious of opening attachments and clicking on links.  Dear Palo Alto City Council members, We appreciate the efforts that the City Council and City staff have made in trying to find the appropriate community position on the matter of rail crossings and grade separations. We support the process to make a decision by mid 2020, and sooner if possible, so we can all move ahead and plan our lives accordingly. We have communicated with the City Council several times in the past relative to our position on the matters as associated with the Churchill rail crossing and want to again emphasis our position. We live on the West side of Mariposa Ave and OPPOSE the viaduct option. We are certain that when all of the facts are properly considered they will lead to a decision to close Churchill and we fully support that option with appropriate provisions for safe bike and pedestrian access. Factors such as cost, taking of private residential land, need for significant fixes to the Embarcadero underpass, and need for grade separations in the South part of the City where there are now none, compared to several in the North part of the City, are just a few of the issues that clearly support Churchill closure and spending of very limited funds in a more prudent and equitable manner. Given the information on the Connecting Palo Alto site, we feel the Churchill closure provides the best solution for us, our neighborhood and the greater community. One or our neighbors collected 459 signatures from Palo Alto residents that feel the same way, and we’re looking forward to sharing these findings in upcoming meetings with you. We feel that the viaduct option will adversely increase traffic on Churchill and reduce children safety, including the kids going to Paly. The viaduct will substantially increase noise in the neighborhood, provide massive visual blight and have significant impact on land values not only in Southgate but all along the rail and Alma corridor where land conditions are so constrained. The viaduct would result in trains and riders at 30 to 40 ft above ground just a few feet from adjacent properties looking directly into back yards and homes along this constrained section of the rail corridor. The viaduct would force those who live along the corridor to have unacceptable degradation to their homes, properties and quality of life, all contrary to the residential values for quality of life set forth in the City's comprehensive plan. There is simply no way a viaduct or any raised option in this constrained area of Palo Alto would not do more to divide the City than unite it. Plus, without a major change to our local public feeder transportation system, traffic along Churchill and in the adjacent neighborhoods will get substantially worse in any case if Churchill is kept open. In addition to the above, now that Stanford has withdrawn it's GUP application from Santa Clara County consideration, any funds hoped for from Stanford for the rail crossing will clearly not be available for the foreseeable future. But, I do have a suggestion. The insets at the ack of the courts should have garbage cans not nice little benches. People DO NOT take their tennis cans, plastic drink bottle or any other trash to the bins outside the court. garbage piles up. Give people a chance to be better citizens...put garbage cans at the back of the courts. People may actually use them when they do not take trash out to the bins. Understand people...and give them a chance to do the right thing with their trash and keep our courts in better shape. Thank you. The human impacts of natural disasters are often worsened when our telecommunications infrastructure isn't resilient to the damage caused by disasters, which is an issue California is currently facing as it battles the Kincade Fire in Sonoma County and numerous fires in Los Angeles and Ventura Countries, including the Getty, Saddleridge, Tick, and Easy Fires. As you know so well, our telecommunications infrastructure is critical for how public safety officials respond to wildfires, hurricanes, tornados, and so many other natural disasters. In California, our telecommunications infrastructure has failed many times when the public and .public safety officials needed it most. Here are a few recent examples: • In October 2017, Napa County residents faced issues receiving evacuation orders as 77 cell towers were destroyed or damaged and public safety officials faced challenges with an emergency alert system during the Atlas Peak, Tubbs, and Pa1trick Fires.1 • Many Californians did not receive evacuation orders and could not download updated fire maps during the Camp Fire last year, the deadliest recorded fire in state history, because fiberoptic cables connecting cell towers melted.2 • Last year during the Mendocino Complex Fire, the largest recorded fire in California's history, an internet service provider throttled the data speeds of the Santa Clara County's firefighters, significantly undermining department personnel's ability to respond to the fire.3 As we wl'ite to you, the Kincade Fire and several other fires are burning nearly 100,000 acres of California. The Pacific Gas and Electric Company began cutting off electricity in parts of Northern California recently, including many of the communities in the congressional districts we represent. During these shutdowns, many residents realized that their landlines are voice-over- internet-protocol connections that are not operational when the power is out and that cell towers are often also solely dependent on local power supplies. Otherwise, the remaining balance of unspent funds at the end of the fiscal year shall return to the General Fund. G. Any carryover of Council travel budgets from one fiscal year to the next shall require the approval of the Council during the annual carryover process. III. Travel Arrangements. A. Travel arrangements shall be made as far in advance as possible to obtain the best possible fares and rates. Registration for conferences and training shall be made far enough in advance to take advantage of early (discounted) fees, and to avoid late registration fees. If travel arrangements must be canceled for any reason, the person who made the arrangements shall cancel them in sufficient time to prevent the City from incurring unnecessary costs when possible. B. Unless Councilmember's opt to book their own travel, staff shall makes arrangem~nts for City Council travel including registrations, transportation and lodging, and travel cash advances (if requested by the Councilmember). Staff shall prepare a travel information packet for each Councilmember traveling to any of the main annual conferences: the National League of Cities (NLC) spring and fall conferences, the League of California Cities (LCC) annual fall conference, and the U.S. Conference of Mayors (USCM) spring and summer conferences. IV. Transportation. A. Travelers shall use whatever mode of transportation is the most logical and least expensive. If a Councilmember elects to use a mode of transportation other than the most logical and least expensive, the City shall pay only the cost of the most logical and least expensive mode. 7.4.4-Page - 3 COUNCIL POLICY MANUAL B. Air Travel. Councilmembers shall not limit their air travel options by specifying an airline. The airline offering the lowest fare for a logical route shall be selected. C. Use of Private Vehicles. Councilmembers shall be compensated for the use of their private vehicles for approved business travel at the current IRS standard mileage rate, provided that it is the most logical and least expensive method of transportation. The City shall pay all expenses, such as bridge tolls and parking fees, incurred as the result of a Councilmember·s authorized use of a vehicle while traveling on City business. Councilmembers requesting reimbursement for the payment of such expenses shall obtain receipts and submit them with their Travel Expense Reports. To drive a City or privately owned vehicle on City business, Councilmembers must possess a valid California driver's license. A driver of a privately owned vehicle must also carry adequate liability insurance coverage, and be responsible for any damage, service, or repair to the car occurring on the trip, as these costs are included in the City's per mile cost reimbursement. D. Train and Other Mass Transit. Councilmembers shall be compensated for train or other mass transit fares and fees provided that it is the most logical and least expensive method of travel. E. Ground Transportation at Destination. Supplementary transportation within the destination city shall be accomplished by hotel courtesy buses, local shuttle services or public transportation, if available and logical. Taxi or car service may be used when no other convenient, less costly mode of transportation is available. F. Rental Vehicles. Rental vehicles shall be used only when no other mode of transportation is available or when alternate transportation would be more expensive or impractical and must be authorized in advance. If a rental vehicle is authorized, Councilmembers shall request the least expensive vehicle category that meets their needs. Optional insurance offered by the rental agency should be declined. V. Lodizing. A. The City shall pay lodging expenses for approved travel, including the evening preceding or subsequent to a meeting or business event when the Councilmember would otherwise have to travel from his/her residence before 6 a.m. or after 9 p.m. to reach or return from his or her destination. B. When there is not a specific lodging site associated with official City business, the City shall pay for actual lodging expenses up to the General Services Administration (GSA) maximum rate allowed by location 7.4.4 -Page -4 COUNCIL POLICY MANUAL (http://www.!!sa.gov/portal/category/21287). Note that the GSA maximum rate applies to the base room rate only, and does not include taxes. Every effort shall be made to obtain lodging at or near the facility where official City business is to take place to minimize travel time and transportation costs. The lodging should also be clean, safe and appropriate for business travel. Government rates are often available and should be sought. C. The City shall pay only for standard single rooms at conference, government or corporate rates. The City shall pay additional charges for a double room only if two Councilmembers share the room. Additional charges arising from the registration or the sharing of a room with a spouse or guest are not reimbursable. D. Councilmembers shall notify the Executive Assistant to Mayor and Council regarding any reservations for lodging they will not use. Any charge for an unused reservation shall be considered the Councilmember's personal expense unless failure to cancel the reservation was due to circumstances reasonably beyond the Councilmember's control. VI. Meals. A. The City shall pay for a Councilmember's meals during authorized travel, including tax and tips, up to the per diem amount established by the GSA for the destination location (available at: http://www.gsa.gov/portal/category/21287 -"Meals Breakdown"), except that the City shall not pay for the following: 1. Breakfast on the first day of travel. 2. Meals that the Councilmember elects to purchase from another source when the meals are included in the cost of a conference, training registration fee, or hotel stay. 3. Alcoholic beverages. B. The City shall pay for meals during partial days of travel on a pro-rated basis, as follows: 1. If the partial day includes travel before 8 a.m., the City shall pay for breakfast. 2. If the partial day includes travel between 11 a.m. and 1 p.m., the City shall pay for lunch. 3. If the partial day includes travel after 5 p.m., the City shall pay for dinner. 7.4.4-Page - 5 COUNCIL POLICY MANUAL C. Any meal reimbursement where a Councilmember is not required to travel away from home overnight shall be taxable in the amount of the meal reimbursement under Internal Revenue Code Section 162(a) (2). VIL Miscellaneous Fees/Business Expenses. A. Gratuitiesrrips. The City shall pay reasonable and customary gratmt1es and tips during City business travel. Tips for meals are included in the standard per diem rate. B. Business Expenses. The City shall pay for goods and/or services deemed necessary for the completion of official business, such as faxes, copier and computer usage, etc.; for Internet usage at actual cost and for all business telephone calls. Cellular phones are often more cost-effective than using hotel phones directly and should be considered as a primary option. Collect calls should be avoided. Fees which include use of local calls, wireless internet access, or other such amenities shall be covered by the City. The City shall also pay for printed materials. tapes or other training materials that may be available for sale at training, conferences, etc., provided that the materials are of benefit to the City and shall remain the City's property. C. Baggage Fees. If the airline charges for all checked baggage, the City shall cover the cost for one checked bag only. Excess baggage charges are not reimbursable. D. Personal Expenses. Personal expenses shall not be paid by the City. In addition to those items identified as personal expenses throughout this policy, personal expenses include personal telephone calls, in-room movies, spas and gyms, optional recreational events in connection with a conference, laundry or dry cleaning, miscellaneous sundries, or other items of a personal nature. Personal travel shall not be mixed with business travel if it will cost the City or harm the City's interest in any way. The City shall not pay for any expenses of a spouse or other person who accompanies a Councilmember on business travel. VIII. Payment of Expenses. Councilmembers may pay for allowable travel expenses by requesting a travel advance in an amount up to the total estimated expenses for the trip minus any pre-paid expenses. Allowable expenses may also be paid out of pocket and reimbursed upon completion of travel. IX. Settlement of Expenses. 7.4.4 -Page -6 COUNCIL POLICY MANUAL A. Within three weeks of a Councilmember's return from a business trip, a final accounting of all expenses associated with the trip shall be made by completing a Travel Expense Report, and an associated Mileage Reporting Form, if applicable, attaching original receipts substantiating all reported expenses with the exception of meals, and submitting the report to the Executive Assistant to Mayor and Council. B. If the Councilmember received a travel advance and actual expenses were less than the amount advanced, any unused amount of the travel advance shall be returned to the City via a payroll deduction. Should a Councilmember who has received a travel advance fail to submit a Travel Expense Report within three weeks of return, the Department of Finance may deduct the amount of the travel advance from the Councilmember's next pay check unless the Councilmember can verify timely submission of papenvork or an extension has been requested and approved with valid reason. C. If the Councilmember personally paid for allowable business trip expenses, the City shall reimburse the employee through the bi-weekly payroll process. Reimbursement of travel expenses received from an outside source must be forwarded to the Executive Assistant to Mayor and Council upon receipt. 0. The Mayor's signature is required as approval of Council expense statements. The Vice Mayor approves the Mayor's expense statements. E. To the extent that another agency or organization pays for the travel or conference expenses of a Councilmember, the City shall not pay for those same expenses. Councilmembers shall either submit the other agency's payment to the City (in which case the City shall pay for the Councilmember's entire expenses), or refrain from claiming expenses for that portion of his/her expenses paid for by the other agency. F. For multiple Council meals paid for by a single Councilmember, the total expense for the meal shall be submitted on the expense report of the paying Councilmember, along with a written breakdown of amounts to be charged to the budgets of other Councilmembers. B. When Councilmembers attend a group dinner where the individual cost of each meal is unavailable, the Mayor shall determine a fair and equitable method of distributing the charges among the various Councilmembers in attendance. The City may pay for meals of official guests of the Council. Costs for meals of guests invited by a single Councilmember shall be charged to the individual Councilmember's budget. The cost of meals for guests invited by the Mayor or four or more Councilmembers shall be paid 7.4.4 -Page -7 COUNCIL POLICY MANUAL by the City out of the Council program budget but need not be charged to any Councilmember's travel buaget. X. Exceptions to the Policy. This policy does not claim to address all contingencies and conditions. However. any exception requires Mayoral approval via a Travel Authorization Request (TAR) for anticipated/known exceptions or via a Travel Expense Report for unanticipated/unplanned expenses. Requests for exceptions should be accompanied by the traveler's written justification for the expense. Examples of exceptions to this policy include, but are not limited to, the following: o Unusual business expenses; o Per diem and/or lodging expenses which exceed GSA limits: • The purchase of one or more meals from another source even though they were included in a conference and/or seminar registration fee: o The use of an alternate mode of transportation under the Americans with Disabilities Act; • Travel costs in excess of budgeted amounts. XI. Audits. The Department of Finance shall conduct periodic audits to ensure compliance with this policy. Audit results shall be submitted to the Mayor and City Manager. Communicating with representatives of regional, State, and national government on City-adopted policy positions; b. Attending educational seminars designed to improve an official's skill and knowledge levels directly related to City business; c. Attending a conference or organized educational activity conducted in compliance with Government Code Section 54952.2(c), including ethics training required by Government Code Sections 53234, et seq.; d. Attending a meeting of any multi-jurisdictional governmental body on which the Councilmember serves as the City's designated representative; e. Attending any meeting or providing service on a given day at the formal request of the Council or attending other regional events or meetings where representing the City in an official capacity; f. Expenses for which a City Councilmember receives reimbursement from another agency are not reimbursable. The amount of travel expense reimbursed to the City by organizations such as the U.S. Conference of Mayors, National League of Cities, League of California Cities, or other organizations for travel by a Councilmember shall be credited to the travel budget of that Councilmember; b. Reimbursements of Nonrefundable Expenses Councilmembers must reimburse the City with personal funds for any nonrefundable expenses if they register for an event (e.g., conference, dinner meeting, etc.) but do not attend, unless they designate a substitute attendee, or if they cannot attend as the result of a personal illness or emergency, which is limited to one paid event per year. 5. Management Development Funds Councilmembers are eligible for Management Development Funds, which may be combined with amounts provided under this Policy, as follows : a. City Souvenirs City souvenirs are intended for official distribution. A log sheet describing the type and number of items requested by a Councilmember shall be maintained by the City Clerk and copy of the log shall be distributed to the Council quarterly or semiannually. Souvenirs shall be regulated to the following types of items: ' • One City logo item per year, at the discretion of the Mayor, is included as part of the City Council budget. Each Councilmember shall receive an annual communication budget, and the Mayor shall receive a supplemental amount as adopted by the Council in the annual Adopted Budget. This budgeted amount is intended to cover all telecommunication costs including telephones, fax lines, cellphones, data plans, computers, Internet access, etc. A communications allowance or stipend shall be provided to each Councilmember semi-annually based on the amount included in the Adopted Budget for cellular telephones and tablet devices. The communication allowance shall be a reasonable amount to represent the reimbursement for actual costs associated with telecommunication items noted above. For all other communication costs (e.g., telephone, fax lines, computer data plans, and Internet access), amounts shall be reimbursed based on actual costs and detail receipts shall be required for all reimbursement claims. Such items used shall be for business purposes with a de minimis amount of personal usage allowed. Amounts provided are subject to IRS regulations and guidelines. d. Per-Term Allowances Councilmembers must have office equipment to discharge their functions and communicate with staff. For each term of office, Councilmembers will be reimbursed by providing supporting documentation, up to the amount adopted by the Council for office equipment. Amounts may not be combined. Any unspent amounts do not carry forward to a subsequent term. Allmvance may not be used for monthly service or usage charges. 7. Council Travel, Meals, and Lodging All expenses must be incurred in the course of official Councilmember duties for the City. The expenses described in this section shall not exceed the budget allocated to each Councilmember in Section 9 of this policy. All expenses and reimbursement claims must be documented with detailed receipts; however, a City Incidental Expense Receipt Form may be used to claim reimbursement for those incidental expenses for a receipt which is lost or not normally provided. Expenses permitted while traveling outside of the City include, but are not limited to, the following: a. Airfare. Transportation costs to and from the authorized destination shall not exceed economy-class airfare unless such fare is not available. b. Automobile Mileage; Parking; Tolls. Parking, bridge, and road tolls (including FasTrak and mileage (which shall be recorded and reimbursed at the current Internal Revenue Service rate for nonitemized travel)). [NOTE: See www.irs.gov.] . c. Car Rental. Rental rates must be the best available rate for a midsize or smaller car. d. Taxis/Shuttles. Taxi or shuttle fares, including a 15 percent gratuity per fare, when the cost of such fares is equal to or less than the cost of car rentals, mileage, and parking combined, or when such transportation is necessary for time efficiency. Baggage fees for up to two pieces of checked bags. g. Telecommunication Charges. Official business incurred when traveling such as faxing, photocopying, or computer service; and other normal, necessary, and reasonable expenses. h. Lodging. If lodging is required in connection with a conference or meeting, lodging expenses shall not exceed the maximum group rate published by the conference or activity sponsor for the meeting if such rates are available at the time of booking. If the group rate is not available, the Councilmember shall use comparable lodging at the best available rate for that area. i. Meals. Meal expenses, associated gratuities, and incidentals up to a total of One Hundred Dollars ($100) per day, with detailed receipts provided. 8. Local and Miscellaneous Expenses a. Guests. Dinner or admission expenses which require a Coundlmember' s attendance as an official representative of the City and at which a guest would be invited to attend, is permitted. Each Councilmember is allowed to utilize his or her expense account for guest expenses for a maximum of four events. The Mayor is allowed two additional guest expenses for a total of six events. b. Local Meals. Costs incurred by a Councilmember for local meals or lunches in the course of meeting with constituents, staff, or other Councilmembers are not reimbursable and shall not be charged on a Councilmember's procurement card. The portion of the cost of ad.mission or a ticket or donation to an event which represents a charitable, political, or other contribution is not an authorized expense and not reimbursable. d. Professional Development. Costs incurred for professional development (seminars, publications, and memberships) related to a Councilmember's duties as an elected official may be reimbursed as provided for in the City's Professional/Management Development Program Policy and this policy, and are the same amount as provided to unrepresented employees. 9. Budget a. Annual Council Budget. The annual budget for the Council expenses shall be recommended by a subcommittee of the Council and approved by the Council in the annual City budget. b. Mayor's Budget. A supplemental amount may be allocated to the Mayor to be used as a contingency for the additional duties of the office. Because the term of the Mayor does not coincide with the fiscal year, the incumbent Mayor will be allocated one-half of this amount for each of the two fiscal years in office. c. Budget Adjustments. Outgoing Councilmembers shall be allocated 50 percent of the budget for their seat. Incoming Councilmembers shall be allocated 50 percent of the budget for their seat. d. Training and Conference Reserve. A training and conference reserve (the "ReseIYe") account shall be established in an amount approved by the City Council. The Reserve may be used by any Councilmember, Mayor, or Vice Mayor who has exhausted the amount budgeted for Training, Conference, and Travel for their seat, for a purpose consistent with this Policy. The Mayor or Vice Mayor must give prior approval for use of the Reserve by Councilmembers in accordance with Section 10.d. Following adoption of the annual budget, upon request, staff will work with each Councilmember to develop an annual budget within the allocated amount for each member in order to provide a monitoring tool for Councilrnembers. £. No Transfer of Councilrnember Budget. The budget amount allocated to a Councilmember may not be used to pay for the expenses of, or transferred to, another Councilrnember. g. Amendment. The budget may be amended by the Council at any time. 10. Monitoring and Reporting a. Expense Report. AU expenses and claims for reimbursement shall be submitted to the Finance and Administrative Services Department on City expense report forms within 60 days of the incurred expense, and within the fiscal year in which they were incurred. All expense reports shall be accompanied by detailed receipts and shall document that the expenses comply with this Policy for expenditure of public resources. Inability to provide such documentation in a timely manner may result in the expense being borne by the Councilrnember. All expense reports are subject to audits. b. Tracking Expenses. Expenses of Councilmembers are tracked individually against the budgeted amount and reported to Councilmembers as requested. c. Receipts Required. Detailed, itemized receipts are required for all expenses and reimbursement claims. d. Use of Reserve Except as Otherwise Provided in Section 9.d of this Policy. The Mayor, or Vice Mayor in the absence of the Mayor, must approve use of the Reserve under Section 5.d of this policy and shall interpret any questions of policy, legislative intent, and interpretation of a qu~stioned expenditure consistent with this Policy. Neither the Mayor nor Vice Mayor may make interpretations or determinations regarding their own expenditures or use of the "Reserve." Disputes may be appealed to the Council Finance Committee by individual Councilrnembers. e. Personal Responsibility for Payment. Expenditures in excess of the budget amounts or any expenditure not in compliance with this Policy is the responsibility of the individual Councilmember. f. Report to the Council. Each official shall briefly report on meetings attended at City expense at the next scheduled Council meeting. If multiple Councilrnembers attended, a joint report may be made. 11. Violation of This Policv Use of public resources or falsifying expense reports in violation of this Policy may result in any or all of the following: (1) loss of procurement card and/ or reimbursement privileges; (2) a demand for restitution to the City; (3) the City's reporting the expenses as income to the elected official to State and Federal tax authorities; (4) civil penalties of up to $1,000 per day and three times the value of the resources used; and (5) prosecution for misuse of public resources pursuant to Section 424 of the Penal Code. Famiiles may start staying overnight at the Seven Trees Community Center parking lot as early as Nov. 1. The pilot program will start with five families. More than 4,000 people are living on the streets in San Jose. The city says more than a hundred are families with young children who do not have a safe place to sleep at night. Some who use the Seven Trees Community Center in East San Jose have concerns about the pilot program and crime. "As long as it is in a controlled environment and there is security, I think it might be OK," San Jose resident George Witzel said. "But I've had friends who have had their cars broken into in this lot and we don't want that to happen." The program, run by Life Moves, will cost $250,000 to operate for nine months. Families will be allowed to stay in their cars from 7 p.m. to 7 a.m. "This program is focused on families with children under 5 who are working," said Ragan Henninger, San Jose deputy director of housing. The hope is in a few months the program will expand to allow 17 families to stay overnight. "We know we have a lot more work to do to house the homeless, but this is a program that is quick to get up and running," San Jose Mayor Sam Liccardo said. "And we hope to expand it to other community centers." Liccardo said the city is already looking at the Bascom Community Center as another potential site for a safe parking program.
