HomeMy Public PortalAbout2009.135 (07-21-09)RESOLUTION NO. 2009.135 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD APPROVING THE CITY'S SANITARY SEWER SYSTEM MANAGEMENT PLAN (SSMP) IN COMPLIANCE WITH THE REQUIREMENTS OF THE STATE WATER RESOURCE CONTROL BOARD WHEREAS, on May 2, 2006 the State Water Resources Control Board (WRCD) adopted a Statewide General Waste Discharge Requirements, Monitoring, and Reporting Program (WDR) for Sanitary Sewer System by issuing Order No. 2006-0003 - DWO for all publicly owned sewer systems; and WHEREAS, the regulations in the Order resulted from growing concern about the water quality impacts of Sanitary Sewer Overflows (SSO), particularly those that cause beach closures, adverse effects to other bodies of water or pose serious health and safety or nuisance problems to the public; and WHEREAS, the goal of the DWR is to reduce the number of the sanitary sewer overflows through uniform statewide regulations; and WHEREAS, the two major components of the WDR are: owners and operators of publicly owned sewer collection systems, a mile long or greater, must apply for coverage under the WDR; and, the owners/operators must develop and implement a system specific Sewer System Management Plan (SSMP); and WHEREAS, in compliance with. the first component the City filed the required initial application form with the SWRCB on October 25, 2006, enabling the City to conduct the required online SSO reporting; and WHEREAS, in compliance with the second component, the City has prepared the proposed SSMP consisting of 11 elements required by WDR; and WHEREAS, the SSMP .provides reporting guidelines for routine and emergency events; and ; ~1 ... , WHEREAS, the SSMP requires auditing for evaluation and effectiveness of the program every two (2) years with the first audit being planned for April 2011; and WHEREAS, the SSMP requires updating every five (5) years; and WHEREAS, on July 9, 2009 a Notice of Public Hearing was published in The Press, a newspaper meeting the statutory qualifications for publishing such notices; and WHEREAS, in accordance with the requirements of the SWRCB regulations the SSMP must be approved by the City Council by August 2, 2009. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY FIND, PROCLAIM, ORDER, AND RESOLVE AS FOLLOWS: Section 1. Pursuant to SWRCB's WDR Order No. 2006-0003-DWO, the City Council hereby approves the City's Sanitary Sewer System Management Plan (SSMP). Section 2. This Resolution shall take effect immediately upon its adoption. Section 3. The City Clerk shall certify as to the adoption of this Resolution.
