MOAB CITY COUNCIL and PLANNING COMMISSION
SPECIAL MEETING MINUTES
MAY 23, 2019--DRAFT
Call to Order and Attendance:
The Moab City Council held a Special Council Meeting on the above date in the City Council
Chambers located at 217 East Center Street. The purpose of the meeting was for a joint City
Council and City Planning Commission workshop for a Future Land Use Plan Update. An audio

Allison Brown called the meeting to order at 5:00 PM. In attendance were Councilmembers
Rani Derasary, Tawny Knuteson-Boyd, Kalen Jones and Karen Guzman-Newton. Planning
Commission members Kya Marienfield, Marianne Becnel, Jeanette Kopell, Cory Shurtleff and
Becky Wells were present. Brian Ballard arrived at 5:27 PM. Also in attendance were City
Manager Joel Linares, Recorder Sommar Johnson, Planner Nora Shepard, Assistant Engineer
Eric Johanson and Recorder/Project Specialist Eve Tallman. Thirty-three members of the public
and media attended.
Planner Shepard introduced the Future Land Use Plan and provided an overview with proposed
options for Council including expanded overlay zones. Councilmember Jones asked about the
downtown edge area as compared to the downtown core. Councilmember Derasary asked how
many overnight accommodations were currently in the City and County and Shepard stated
there were approximately 3,800. Wells brought up condominiums in currently-existing
subdivisions which are not yet licensed as short term rentals and discussion ensued regarding
existing property owners and future uses. Councilmember Derasary presented a scenario for
other commercial uses such as restaurants and noted she was in favor of Option 5.
Councilmember Jones also stated his support for Option 5 and added there was a need for more
nuanced future development such as Option 4 could accommodate. Chair Brown asked for
clarification regarding the priority to removed overnight accommodations from all zones.
Councilmember Guzman-Newton brought up a desire to give Landmark consultants more
directives. Wells asked about redevelopment in the event an existing overnight accommodation
burns down. City Manager Linares explained redevelopment is a grandfathered right within the
same building footprint. Discussion followed regarding lenders approving grandfathered uses
and vested rights. Wells spoke in favor of protecting existing condominium subdivisions with
overlay zones. The option of protecting future rights through business licensing met with one
“thumbs up” from Councilmembers. Councilmember Jones clarified he wanted staff advice.
Assignments for Landmark consultants were suggested including proposed overlay zones and
mixed-use ideas. Councilmember Guzman-Newton asked for the “North of Downtown” area to
equal the existing Resort Commercial (RC) zone. Councilmember Jones brought up the example
of Durango for ideas. Mayor Niehaus clarified her understanding that redevelopment would be
limited to the same number of overnight accommodations as currently exist. Planner Shepard
noted drafting options would take some time. Councilmember Derasary stated her desire for
expansion that incorporates mixed uses and Councilmember Jones concurred.
Community nodes incorporating neighborhood commercial uses was mentioned as being farther
out on the timeline with no overnight accommodations allowed. Mayor Niehaus asked if an
existing commercial campground could be redeveloped as a hotel and the answer was no. More
discussion regarding the development of new campgrounds followed. Becnel brought up the
purchase or transfer of development rights. Councilmember Jones asked about the list of new
units exempt from the moratoria and Shepard confirmed there could be 6,200 overnight

accommodations at buildout. Dialogue arose about the implications of the General Plan
regarding a vision for the future of tourism impacts such as noise and crowding. Councilmember
Derasary suggested participation of federal agencies regarding campground development.
Adjournment: Marienfield moved to adjourn the meeting. Becnel seconded the motion. The
motion passed unanimously. Mayor Niehaus adjourned the meeting at 7:06 PM.

Background/Summary:
This is the next procedural step to meet the requirement that compensation ranges be
adopted annually by Ordinance after a Public Hearing. Attached are the proposed pay
ranges for fiscal year 2019-2020. These ranges have been adjusted by a 2% Cost of
Living Adjustment (COLA) as a result of the last budget workshop as well as an
increase to Elected Officials salaries as requested.

ORDINANCE NO. 2018-11
AN ORDINANCE ADOPTING THE CITY OF MOAB PAY PLAN SCHEDULE
AND ADOPTING THE EXEMPT AND ELECTED OFFICIALS SALARIES FOR
FISCAL YEAR 2018-2019
WHEREAS, the Moab City Personnel Policies and Procedures Manual allows that pay
ranges may be adjusted periodically for comparable work in other municipalities; and
WHEREAS, the Moab City Personnel, Policies and Procedures Manual calls for annual
surveys of salaries; and
WHEREAS, in 2016 the City conducted a comprehensive salary survey through the
utilization of Personnel Systems Inc. and has presented the survey results to the
Governing Body; and
WHEREAS, positions within the City are rated and ranked according to four factors: Job
Knowledge, Responsibility, Difficulty and Work Environment and salaries are calculated
based on those ratings and rankings and incorporated into the pay plan schedule; and
WHEREAS, the proposed “City of Moab 2018-19 Proposed Pay Plan” is attached to this
ordinance as Attachment A, respectively; and
WHEREAS, the proposed “Exempt and Elected Officials Salaries” is attached to this
ordinance as Attachment B, respectively; and
WHEREAS, Moab Municipal Code Section 2.44.010 states that all salaries of the
elective and appointive officers of the City and the other employees of the City shall be
fixed by motion or resolution of the City Council as in accordance with existing law.
NOW, THEREFORE, WE, THE GOVERNING BODY OF THE CITY OF MOAB
RESOLVE TO ADOPT The City of Moab 2018-19 Proposed Pay Plan (Attachment A)
and the Exempt and Elected Officials Salaries (Attachment B) as referred herein.

ORDINANCE NO. 2019-12
AN ORDINANCE ADOPTING THE CITY OF MOAB PAY PLAN SCHEDULE
AND ADOPTING THE EXEMPT AND ELECTED OFFICIALS SALARIES FOR
FISCAL YEAR 2019-2020
WHEREAS, the Moab City Personnel Policies and Procedures Manual allows that pay
ranges may be adjusted periodically for comparable work in other municipalities; and
WHEREAS, the Moab City Personnel, Policies and Procedures Manual calls for annual
surveys of salaries; and
WHEREAS, in 2016 the City conducted a comprehensive salary survey through the
utilization of Personnel Systems Inc. and has presented the survey results to the
Governing Body; and
WHEREAS, positions within the City are rated and ranked according to four factors: Job
Knowledge, Responsibility, Difficulty and Work Environment and salaries are calculated
based on those ratings and rankings and incorporated into the pay plan schedule; and
WHEREAS, the proposed “City of Moab 2019-2020 Proposed Pay Plan” is attached to
this ordinance as Attachment A, respectively; and
WHEREAS, the proposed “Exempt and Elected Officials Salaries” is attached to this
ordinance as Attachment B, respectively; and
WHEREAS, Moab Municipal Code Section 2.44.010 states that all salaries of the
elective and appointive officers of the City and the other employees of the City shall be
fixed by motion or resolution of the City Council as in accordance with existing law.
NOW, THEREFORE, WE, THE GOVERNING BODY OF THE CITY OF MOAB
RESOLVE TO ADOPT The City of Moab 2019-2020 Proposed Pay Plan (Attachment A)
and the Exempt and Elected Officials Salaries (Attachment B) as referred herein.

Background/Summary:
This is the next procedural step to meet the requirement that compensation ranges be
adopted annually by Ordinance after a Public Hearing. Attached are the proposed pay
ranges for fiscal year 2019-2020. These ranges have been adjusted by a 2% Cost of
Living Adjustment (COLA) as a result of the last budget workshop as well as an
increase to Elected Officials salaries as requested.

ORDINANCE NO. 2019-12
AN ORDINANCE ADOPTING THE CITY OF MOAB PAY PLAN SCHEDULE
AND ADOPTING THE EXEMPT AND ELECTED OFFICIALS SALARIES FOR
FISCAL YEAR 2019-2020
WHEREAS, the Moab City Personnel Policies and Procedures Manual allows that pay
ranges may be adjusted periodically for comparable work in other municipalities; and
WHEREAS, the Moab City Personnel, Policies and Procedures Manual calls for annual
surveys of salaries; and
WHEREAS, in 2016 the City conducted a comprehensive salary survey through the
utilization of Personnel Systems Inc. and has presented the survey results to the
Governing Body; and
WHEREAS, positions within the City are rated and ranked according to four factors: Job
Knowledge, Responsibility, Difficulty and Work Environment and salaries are calculated
based on those ratings and rankings and incorporated into the pay plan schedule; and
WHEREAS, the proposed “City of Moab 2019-2020 Proposed Pay Plan” is attached to
this ordinance as Attachment A, respectively; and
WHEREAS, the proposed “Exempt and Elected Officials Salaries” is attached to this
ordinance as Attachment B, respectively; and
WHEREAS, Moab Municipal Code Section 2.44.010 states that all salaries of the
elective and appointive officers of the City and the other employees of the City shall be
fixed by motion or resolution of the City Council as in accordance with existing law.
NOW, THEREFORE, WE, THE GOVERNING BODY OF THE CITY OF MOAB
RESOLVE TO ADOPT The City of Moab 2019-2020 Proposed Pay Plan (Attachment A)
and the Exempt and Elected Officials Salaries (Attachment B) as referred herein.

Background/Summary:
The City of Moab held a public hearing on May 14, 2019 to consider vacating a
portion of Emma Boulevard and amend the UTEX Subdivision, Plat B, Lot 14,
Section 36, T25S, R21E, SLBM.
As part of the proposed action the owner of Lot 14 will dedicate to the City
11,628 square feet of Lot 14 which will be used for a future shared use path
connecting the east side of HWY‐191 with the shared use path on the west
side of HWY‐191 that currently ends on Emma Boulevard. Per the proposed
Plat Map (attached) the parcel will be known as Minnie Lee Avenue, a public
street, which may be used as a future roadway connecting to HWY‐191.
The other part of the proposed action is for the City of Moab to grant a private
easement to Lots 14, 15 16 &17 for purposes of pedestrian and vehicle
ingress/egress, parking, utilities, and the construction/maintenance of a
parking lot.
The UDOT is including the extension of the shared use path on the east side of
HWY‐191 and a HAWK (pedestrian activated signal crossing) as part of the
HWY‐191 widening project which is scheduled to begin construction in late
fall of 2019.If the proposed action is approved then the shared use path will
utilize the Minnie Lee Avenue right‐of‐way for access to Hwy‐191.

Background/Summary:
At the end of each budget year we find it necessary to open our budget to
accommodate any changes that have happened throughout the year. A
detailed summary of the changes is attached, and the current financial
statement is available for review on the shared Google Drive. My apologies, I
won’t be attending the public hearing – I will provide a more detailed
explanation here:
General Fund
We received a grant, mid-year, for the Victim Advocate program. This
was not included in our original budget and is budgeted for the next FY.
This includes the revenue and expenditures.
Due to the difference of the City being on a fiscal year and Grand County
being on a calendar year, we neglected to budget for the last payment to
the County for building inspection services. This reflects the last
contractual payment for building inspection services.
The solid waste collection fee structure has changed along with the
addition of recycling services. These are pass through revenues and
expenses, and we don’t have a complete estimate yet of the changes. I
have purposefully estimated high to be safe. I don’t anticipate the
changes will be this high, however if we don’t bring in the revenue, we
don’t pay it out to the contractor.
Our auction of surplus city property brought in more revenue than
expected.
Community Development Fund
The Housing Authority of Southeastern Utah applied for and was awarded
grant fund through the Community Development Block Grant program. We
are a pass-through funding agency – we receive the funds on behalf of HASU
and then disburse the funds to HASU. This corrects the budget to reflect this
year’s funding.
Health Insurance Fund
This is a new fund this fiscal year so that we can segregate our self funding
costs associated with our health and dental insurance along with all health
related benefit costs. The incoming revenue represents the amounts charged
to departments for this expense. The expenses shown in this fund are the
payments made to benefit providers for either premiums or actual claims. I
anticipate a transfer to fund balance at the end of this fiscal year.
Sewer Fund
To prepare the Water Reclamation Facility budget for this year, we received
estimates of operating costs from our contract engineer, Bowen Collins and
Associates. As these were just estimates and we haven’t had a full year to
operate the plant, we’ve had shortfalls in several areas. If you would like
more details on the operational processes represented here, please let our
City Manager know. We are able to cover these shortfalls with an increase in
revenue for both Sewer Service Charges as well as the portion of impact fee
collections that is allowed for operational usages.

A RESOLUTION DESIGNATING DEPOSITORIES FOR MOAB CITY FUNDS

WHEREAS, at a Regular Meeting of the Moab City Council of the City of Moab, held
on the 11th day of June, 2019, at which a quorum was present, the following officers were duly
appointed for the ensuing year and until their successors shall be appointed and shall have
qualified; to have signature authority for Moab City Corporation at the above mentioned
financial institutions which hold city (public) funds:

Billing Clerk, Marcy Mason
Recorder, Sommar Johnson
Deputy Recorder, Kerri Kirk
City Manager, Joel Linares
NOW THEREFORE, BE IT RESOLVED, that under the rules of the City of Moab,
any funds deposited to its credit with Zion’s First National Bank of Moab, Wells Fargo Bank of
Moab or Utah Public Treasurer’s Investment Fund (PTIF) may be withdrawn by the combined
signatures of one (1) of the Recorder or Deputy Recorder and any one (1) Treasurer or Billing
Clerk who are authorized to endorse and sign checks, drafts, and orders for payment of money in
accordance with signature cards accompanying this authorization. In the absence of either both
the Recorder and Deputy Recorder or both the Treasurer or Billing Clerk, the above mentioned
City Manager shall be authorized to endorse and sign checks, drafts, and order for payment of
money in accordance with signature cards accompanying this authorization by the combined
signatures of one (1) Recorder or Deputy Recorder or (1) Treasurer or Billing Clerk and one (1)
City Manager.
BE IT FURTHER RESOLVED, that as required by the Office of the State Treasurer of
Utah, the attached public entity resolution (attachment A) is also adopted by this Resolution of
the Governing Body of the City of Moab to certify authorized users for the City of Moab’s PTIF
Accounts.
PASSED, ADOPTED, APPROVED AND EFFECTIVE this 11th day of June 2019 in
open Council at Moab, Utah.
