Mayor Tyrell called the regular meeting of the City Council to order at 7:40 p.m. on Tuesday,_. December 18, 1973, in the Council Chamber of the City Hall. The invocation was given by Pastor Robert E. Adventist Church, 9664 E. Broadway. 1 z. 3. The Pledge of Allegiance to the Flag was led 4. -ROLL CALL: Present: Absent: Also Present: Knox, Seventh Day by Mayor Tyrell. Councilmen- Dennis, Gilbertson, Merritt, Tyrell Councilmen- Briggs City Manager Koski, City Attorney Martin, Assistant to the City Manager Biel, Planning Director Dragicevich, Public Works Coordinator Leonetti 5. APPROVAL OF MINUTES: Councilman meeting of as written Councilman meeting of as written Dennis moved to approve the minutes of the regular the City Council held on Tuesday, December 4, 1973, , seconded by Councilman Gilbertson and carried. Dennis moved to approve the minutes of the special the City Council held on Monday., December 17, 1973, , seconded by Councilman Merritt and carried. IBoy Scout Troop No. 161 was given recognition by Mayor Tyrell who presented a special certificate to the group. Rick Oakley gave a short history of the troop which is sponsored by the First Methodist Church, and their plans for a 50th anniversary dinner to be held in February. Rick explained some of the troop activities and introduced Scoutmaster Robert Oakley and troop members, giving rank, who were present. Mayor Tyrell read a letter of resignation from Councilman Kenneth C. Briggs effective December 5, 1973. Councilman Merritt moved to accept Councilman Briggs resignation, with regrets, and declare a vacancy on the City Council, seconded by Councilman Gilbertson and carried. Councilman Gilbertson moved to appoint Mr. Everett H. Greenberg to fill the unexpired term ending April 16, 1974, seconded by Councilman Dennis and carried. Mayor Tyrell requested Mr. Greenberg to come forward and administered the Oath of Office to him following which he was seated at the Council table. Councilman Greenberg expressed his appreciation of the confidence the Council has shown in him and pledged to do his best to fulfill the responsibility. Mayor Tyrell stated due to the resignations there were vacancies on the Youth Commission and the Parks and Recreation Commission. Councilman Merritt moved to appoint Jerry Seibert to the Parks and Recreation IIICommission, seconded by Councilman Gilbertson and carried. Councilman Dennis moved to appoint Brenda Embree to the Youth Commission, seconded by Councilman Merritt and carried. The City Clerk administered the Oath of Office to Jerry Seibert, who was present in the audience, and intro- duced him to the Council.' Commissioner Seibert thanked the Council for the opportunity to serve the City. Due to Mr. Brigg's resignation the Mayor advised there were several Council- manic vacancies as delegates and alternates to Associations, and suggested Councilman Greenberg be appointed to the Finance Committee and as an . alternate to Southern California Association of Governments. Councilman Gilbertson moved to confirm the appointments, seconded by Councilman Dennis and carried. Council Minutes, December 18, 1973 - Page 2 UNFINISHED BUSINESS: 6. PUBLIC HEARING: 7:30 p.m. RE: DETERMINATION OF PUBLIC NUISANCE - IVANHOE, 9669 E. Las Tunas Drive City Manager Koski presented background information, advising Council held public hearing 6, 1973 and again on December 4, 1973, at which time they.. continued public hearing..to give ,the owners the opportunity to complete installation of a second door at the front of the building to control the noise emanating from the inside. On site inspection was made Friday, December 14 and the front door has a fully enclosed entry which includes a second door. Assistant to the City Manager Biel advised that a Mr. Stiles of the Industrial Safety office in El Monte had been contacted, had con- ducted noise measurement tests at the Ivanhoe to determine if the noise level is sufficient to bring._action, but because of the confidentiality of their investigation, no public statement would be made at this time. Mr. Stiles will continue to follow up on this matter and to resolve the problem insofar as his jurisdiction is concerned. Mayor Tyrell declared the public hearingop.en for testimony for those wishing to speak for or against a possible public nuisance. Mr. Jack Hill, 5931 N. Kauffman Avenue, stated he has not seen any improvement; that the noise outside the Ivanhoe continues until 2:00 -3:00 a.m. Mr. John Cook, co-owner, Ivanhoe, reiterated the measures management had, taken to alleviate the problem at the Ivanhoe. Lt. Dick Wallace, Sheriff's Department, stated that since the Council meeting,yof December 4, the station has not received complaints; that the management had turned the volume of the music down from #7 to #3; that patrol cars are instructed whenever possible to main- tain surveillance of the parking lot at closing hours. Deputy Ken Bristow, Sheriff's Department, stated that in his opinion the security guard, provided by Ivanhoe, appears to be doing his job. Mr. Luis Gracia, 5921 N. Kauffman Avenue, stated the music continues to be loud; when his wife calls the Ivanhoe to complain she receives abusive language; the patrons do not pay attention to the security guard. There being no other persons to come forward to speak, Councilman Gilbertson moved to close the public hearing, by Councilman Merritt and carried. Councilman Dennis stated that on the morning of December 16, he sat outside the Ivanhoe from 1:50 a.m. to 2:15 a.m. and observed the patrons departing the Ivanhoe Bar. He is convinced by the actions of the owners they are doing everything in their power to correct the problem, however in the twenty -five minutes he spent approximately 30 people came out, 20 of whom were boisterous enough to cause awaking of sleeping neighbors. The private guard employed tries to use friendly persuasion, but they pay little attention to him. He further stated that this type of disturbance is associated with this type of business and we must determine whether we want a residential community or a community which will tolerate this type of thing. Councilman Merritt moved to re -open the public hearing to include Councilman Dennis' testimony, seconded by Councilman Gilbertson and carried. Mr. Russ Andrew, 9939 Garibaldi, suggested blocking off the parking lot with chains after 12:00 a.m. as a possible solution to the problem. Council Minutes, December 18, 1973 - Page 3 Councilman Gilbertson moved to close public hearing, seconded by Councilman Merritt and carried. Councilman Dennis moved that City Council find there is no public nuisance, seconded by Councilman Gilbertson and carried on a roll call vote: ROLL CALL: AYES: Councilmen- Dennis, Gilbertson, Merritt, Tyrell NOES: Councilmen -None ABSTAIN: Councilmen- Greenberg Council directed that the staff maintain contact with the Office of Industrial Safety concerning excessive noise inside the location and the Sheriff's Department to provide selective enforcement outside the premises at the closing hour. 7 PUBLIC HEARING: 7:30 p.m. OPEN SPACE ZONING ORDINANCE AND CHANGE OF ZONE FROM R -1 AND R -4 TO 0 -S FOR CERTAIN AREAS AND ENVIRONMENTAL IMPACT REPORT 1 I 8 City Manager Koski presented background material, stating the Planning Commission, at their regular meeting of November 13, 1973, recom- mended establishment of an Open Space (0 -S) zone and imposing . regulations thereof upon certain parcels and areas in the City._; the existing,parksites, Temple City. Park and Live Oak Park, are currently zone R -4 and R -1, respectively; the of a new 0 -S, Open Space zone is to protect a valuable open space and recreation land against the ever increasing toward urbanization. Planning Director Dragicevich advised an Environmental Impact Report had been prepared on this matter.; Live Oak Park has an area of about 15 acres; when the park is developed under the Master Plan which is under preparation, it will not have an adverse effect on the environment. Mayor Tyrell declared the public hearing open. No one came forward to speak. Councilman Gilbertson moved to close the public hearing, seconded by Councilman Dennis and carried. In closed discussion of the proposed ordinances recommending an 0 -S zone and change of zone from R -1 and R -4, Council deleted sub- section 6 (a) and (b), Section 9434 relating to Property Development Standards (length and height of buildings). Councilman Gilbertson moved to approve the Environmental Impact Report, seconded by Councilman Greenberg and carried. City Attorney Martin introduced Ordinance No. 73 -379 AN ORDINANCE OF THE CITY OF TEMPLE CITY ADDING NEW PART XIIIA TO ARTICLE IX OF THE TEMPLE CITY MUNICIPAL CODE ESTABLISHING AN OPEN SPACE (0 -S) ZONE by title only. Councilman Gilbertson moved to waive further reading, seconded by Councilman Merritt and carried. City Attorney Martin introduced Ordinance No. 73 -380 AN ORDINANCE OF THE CITY OF TEMPLE CITY REZONING CERTAIN PROPERTY by title only. Councilman Gilbertson moved to waive further reading, seconded by Councilman Merritt and carried. PUBLIC HEARING: 7:30 p.m. APPEAL FROM PLANNING COMMISSION DECISION ZONE VARIANCE CASE 73 -406, 5243 Temple City Boulevard City Manager Koski presented background information, stating the Planning Commission, at their regular meeting held November 13, 1973, denied a request to divide subject property into four parcels, one with substandard lot area and three with less than the required lot width and/or street frontage. Applicant filed an appeal and Council, at their meeting of December 4, 1973, set public hearing for December 18, 1973. Council Minutes, December 18, 1973 - Page 4 Planning „Director Dragicevich advised the property as it presently exists consists of one dwelling unit; explained with the use of exhibits the proposed development of four parcels; the applicant is in the process of acquiring a 3, foot strip to the south of the property making the street frontage on parcel 4 51.5 instead of 48.5; the property is zone R -1; that, if Council finds in favor of the applicant, staff recommends 1) demolition of shacks on the property; 2) public works improvements; 3) common ingress and egress recorded for parcels 1 and 2, acceptable to the City, Attorney; 4) fire hydrant at the northeast corner of Blackley and Temple City be updated in accordance with Fire Department standards. The Planning Commission's, objections to the development are that parcels 1 and 2 are basically flag lots and access from Blackley Street would be detrimental to the residential properties on Blackley, creating additional parking problems. ThA, Troiect will not have a substantial effect on the environment and create very little increase for municipal services. Councilman Gilbertson moved that in view of the contentions made in the appeal concerning applicant being deprived of substantial pro - perty rights, the appeal be held as public hearing,,. .seconded by Councilman Merritt and carried. Mayor Tyrell stated a petition in support of the applicant had been filed with the City Clerk's office, signed by approximately 50 people. Mayor Tyrell declared the public hearing open for those who wish to speak in favor or against the appeal. In favor: Mrs. Misao Hirohata, applicant, 9587 E. Las Rosa Drive, stated the decision of the Planning Cowu�iission deprived her of a substantial property right enjoyed by others in the immediate area; the project would be a betterment to the neighborhood; she'd contacted people who had received notice of the hearing and had received very favorable reaction from them. Mr. Morris Finley, 1039 S. San Gabriel Blvd., San Gabriel, representing the applicant, said the applicant lost the southerly 3 feet of her property through a tax sale years ago without her being aware of it, that she is negotiating_to acquire that 3 feet now, which would increase the lot width of parcel 4 from 48.5 to 51.5; they planned to continue east Blackley Street in the form of a driveway by giving . street access and building a segment of a cul -de -sac with a 40 -50 foot radius; the development will take away only one parking space on Blackley; adjacent properties were allowed to develop with 51 -58 foot frontages and an average of 7500 sq. ft. per parcel. In answer to questions asked by Council, Mr. Finley stated the homes will be three bedrooms with approximately 1800 sq. ft,, the fan shaped driveway planned is of sufficient size to allow resident to back into it and drive onto Blackley in a forward motion; that drainage would be as approved by the County Engineer. Mr, Matson, 9439 Longden Avenue, stated that he felt the improvement would be of benefit to the City of Temple City, Mr. Henry Murakani, 5325 Temple City Boulevard, stated the shacks should be demolished and the project would be an improvement to the area. Against: Mr. Robert Garvin, 9574 Blackley Street, spoke to the matter and presented pictures of homes on Blackley Street, saying the proposed development would have a detrimental economic effect on their homes; that Blackley has an appearance of being a through street when viewed easterly from Cloverly Avenue and the proposed driveway would definitely give that impression, causing traffic on the cul -de -sac; that the Council Minutes, December 18, 1973 - Page 5 applicant does not meet the criteria for a variance and urged a denial. Mr, Charles Collins, 9585 Blackley, stated he felt the project would ,create °'`a flag lot and asked for a denial. Mr. Charles Dorman, 9560 Blackley, stated he was against the project the substandard lots would diminish the value of his property., and would take a substantial part of, his front yard. Mr. Bernard Braun, 9591 Blackley, stated he lived at the end of the Blackley -cul-de-sac and did not feel, being experienced at parking on a curve, that the radius in the proposed driveway . was sufficient for its purpose. Mr. Robert Wade, 9554 Blackley, stated he was against the project and thought that people coming,,into the cul -de -sac would use the driveway to turn around. Mr. Glenn Boyles, 9575 Blackley, stated that he would not object so strongly to the property being developed into three parcels. Mr. Ray Bennett, 9559 Blackley, stated he was against the project. Miss Debbie Dorman, 9560 Blackley, questioned whether those signing the petition were within the 300 foot radius of the involved property. In rebuttal Mr. Finley stated there would be no problem in turning around in the fan shaped driveway, that the development would not substantially increase traffic, that the lots are usable if not adequate frontage,, that the applicant is willing to acquire an additional 3 feet. Councilman Gilbertson moved to close the public hearing, seconded by Councilman Greenberg and carried. Councilman Gilbertson stated he is not in favor of the proposed project, that a flag lot situation would be created, that the property at 9564 Blackley. Street would have 1600 sq. ft. of additional asphalt around his property. Councilman Dennis stated the applicant is being denied a high economic use of his property, but not use of the property and is not in favor of the development. Councilman Greenberg stated he agreed with the Planning Commission in their denial 1) street frontage on Blackley is not adequate, and 2) the proposed land division would be detrimental to the properties on Blackley Street. Councilman Merritt agreed with what had been said and felt that if developed into three parcels or the proposed four, is not going to solve the problem of the driveway off Blackley. Councilman Merritt moved to deny the appeal and sustain the Planning Commission decision, seconded by Councilman Greenberg and carried on a roll call vote: ROLL CALL: AYES: Councilmen- Dennis, Gilbertson ,Greenberg,Merritt,Tyrell NOES: Councilmen -None RECESS: Mayor Tyrell called a recess at 10:05 p.m. and reconvened the meeting at 10:16 p.m., all Councilmen being present. PUBLIC HEARING: 7:30 p.m. APPEAL FROM PLANNING COMMISSION DENIAL OF ZONE VARIANCE CASE 73 -400, 9925 -31 Garibaldi Avenue and ENVIRONMENTAL IMPACT REPORT Mayor Tyrell declared he had represented the applicant on another matter and turned the chair over to Mayor ProTem Dennis. City Manager Koski presented background information, stating the Planning Commission, at their regular meeting held November 13,1973, denied a zone variance to create a 6 -lot subdivision with reduced setbacks, average lot width and lot area in an R -1 zone. Applicant filed an appeal and City Council, at their regular meeting, held December 4, 1973, set public hearing for December 18, 1973. Councilman Gilbertson moved to hear the appeal on the record, seconded by Councilman Merritt and carried. All Councilmen declared they were familiar with the record and had visited the site of the proposed subdivision. Councilman Merritt stated he had studied the maps and plot plans, the lot sizes, in his opinion, were not particularly small, Plan B would be a considerable improvement in the area and he would be in favor of approving the appeal, on the basis of Plan B. In answer to his question regarding the development of Plan B, Planning Director Dragicevich stated the developer would prefer to use Plan B in the event the Planning Commission denial is reversed. Councilman Merritt moved to approve the appeal on the basis of Plan B, seconded by Councilman Gilbertson. Motion failed to carry on a roll call vote: ROLL CALL: AYES: Councilmen- Merritt NOES: Councilmen - Dennis, Gilbertson, Greenberg Councilman Gilbertson stated he did not approve the plan entirely but he would want the_property developed as single family residential. Councilman Greenberg stated he had visited the site and agrees the development would improve the area, however, he would concur with the Planning Commission's findings and be in favor of denial. Mayor ProTem Dennis agreed with Councilman Greenberg, feeling that the land could be put to better use, and would be receptive to a better planned development. Councilman Gilbertson moved to deny the appeal and sustain Planning Commission action, seconded by,_Councilman Greenberg._,.and carried on a roll call vote: ROLL CALL: AYES: Councilmen- Gilbertson, Greenberg, Dennis NOES: Councilmen- Merritt ABSTAIN: Councilmen - Tyrell Mayor Tyrell resumed the'chair.... NEW BUSINESS: I 10. RECOMMENDATION FROM PLANNING COMMISSION - Meeting of December 11,1973 SET PUBLIC HEARING: TO CONSIDER AMENDMENT TO TEMPLE CITY ZONING CODE RELATING TO RESIDENTIAL PLANNED DEVELOPMENT City Manager Koski presented background material, stating the Planning Commission, at their regular meeting held Tuesday, December 11, 1973, adopted Resolution No. 73- 536PC..recommending amendment to the Temple City Municipal Code relating to Residential Planned Development Districts. The proposed amendment is designed to apply to the develop- ment of residential properties in the City, especially to those large and partially developed parcels located in low density residential zones. Council Minutes, December 18, 1973 - Page 7 Councilman Merritt moved to set public hearing January 15, 1974, to consider amendment to Temple City Zoning Code relating to Residential. Planned Development, seconded by, Councilman Greenberg and carried. 11. RECOMMENDATIONS FROM TRAFFIC COMMISSION - Meeting of December 12,1973 A. HART AVENUE: LAS TUNAS DRIVE NORTHERLY TO THE EAST -WEST ALLEY OFFSET DOUBLE CENTERLINE AND EXTENSION OF RED CURB City Manager Koski presented background information, stating,that continued congestion at subject location results in conflict between north and southbound traffic immediately north of Las Tunas Drive on Hart Avenue.; Traffic Commission reviewed the configuration of traffic at this intersection and recommends that city place additional 97 feet of red curb on the west- side of Hart Avenue from the alley south of the existing red curbing, and offset double centerline to 12 feet east of the west curb line and terminating. 20 feet south of the alley north of Las Tunas Drive. Councilman Greenberg moved to approve recommendation of Traffic Commission as forth in memo dated December 13, 1973, seconded by Councilman Dennis and carried. B. SULTANA AVENUE: LAS TUNAS DRIVE NORTHERLY TO ELM AVENUE - ADDITIONAL OFFSET CENTERLINE AND RED CURB City Manager Koski presented background information, stating that red curb markings . on the west side of Sultana Avenue from Las Tunas Drive northerly to the first alley, and placement of offset centerline striping - from Las Tunas Drive northerly to the east -west alley were made in order to provide better circulation of traffic in the area Traffic Engineer recommended that an extension of these regulations would provide for a smoother flow of vehicular traffic southbound on Sultana Avenue. Councilman Gilbertson moved to approve Traffic Commission recommendation as set forth in memo dated December 13, 1973, seconded by Councilman Dennis and carried. C. McCULLOCH AND DAINES DRIVE - REVERSAL OF STOP SIGNS FROM EAST -WEST TO NORTH -SOUTH City Manager Koski presented background information, stating that in response to an inquiry from Councilman Dennis concerning. subject intersection, Traffic Engineer performed a six hour hand count to determine the existing volumes of traffic flow in each direction. The major carrier of traffic is being.stopped, which presents a hazard, however did not warrant the intersection being,a four. way stop. Following consideration of Traffic Commission recommendations, Councilman Gilbertson moved to approve recommendations as forth in memo dated December 13, 1973, with an additional recommendation to place "Stop. Ahead" pavement markings. on McCulloch at approaches to Daines Drive, _seconded by Councilman Greenberg and.carried. D. GIDLEY STREET, WEST OF CLOVERLY AVENUE - TIME LIMIT PARKING REGULATIONS City Manager Koski presented background information, advising of a conflict in customer parking_involving, the Natter Manufacturing Corporation and Castlecrag Scottie Kennels on Gidley Street,. A meeting was held on November 28, 1973 with Mrs. Dunham of Castlecrag Kennels, Mr. Christensen of Natter Manufacturing Corp., Public Works Coordinator Leonetti and Traffic Engineer Envall. Traffic Commission, at their meeting held December 12, 1973, reviewed the recommendations of the Traffic Engineer and .concurred with his recommendations to correct the problem. 1 ■ 13. SET PUBLIC HEARING: PETITION REQUESTING INSTALLATION OF TWO STREET LIGHTS - AVON AVENUE, NORTH OF BURGHARDT ROAD Council Minutes, December 18, 1973 - Page 8 Councilman Gilbertson moved to approve Traffic Commission recom- mendations as set forth in memo dated December 13, 1973, seconded by Councilman Merritt and carried. E. SANTA ANITA CONVALESCENT HOSPITAL & RETIREMENT CENTER - ' 5522 GRACEWOOD AVENUE - PASSENGER LOADING ZONE City Manager Koski presented background information, stating the Santa Anita Convalescent Hospital had requested two .parkin w,spaces reserved as a passenger loading,,zone at the main entrance to the facility on Gracewood. Traffic Engineer made a field investigation and recommended that a loading, zone would provide the necessary access to the entrance to the facility as well as a more rapid turnover of vehicular traffic. Councilman Gilbertson moved to approve Traffic Commission recommendation as set forth in memo dated December 13, 1973, seconded by Councilman Dennis and carried. 12. RECOMMENDATION FROM YOUTH COMMISSION - Meeting of December 12, 1973 City. Manager Koski advised that over the past several months the Youth Commission has been developing a format for a Youth ;Bulletin to distribute to the youth coiiuuunity, to acquaint youth in the area with the Commission and make them aware of the events and activities being conducted, as well as special recognition for youth groups and individuals involved in noteworthy activities. Councilman Gilbertson moved to authorize publication of the Youth Bulletin, with the assistance of the staff, and amend the 1973 -74 budget in the amount of $90 for three issues of the Temple City Youth Bulletin "Write On ", seconded by Councilman Merritt and carried. 1 City Manager Koski presented background information, advising that property owners on Avon Avenue, north of Burghardt Road, circulated a petition requesting street lights pursuant to Chapter 27 of the Improvement Act of 1911, Streets and Highways Code; signatures of owners on the petition represent 787 of the front footage of Avon Avenue; Avon Avenue is presently in Zone A of the Temple City Municipal Lighting,,Di.strict and in order to bring., Avon up, to the Zone A standards, two street lights would be required. Councilman Gilbertson moved to accept the petition and set public hearing January 15, 1974, pursuant to Chapter 27 of the Improvement Act of. 1911, Streets and Highways Code, seconded by. Councilman Merritt and carried. 14. RESOLUTION NO. 73 -1322: CALLING FOR GENERAL. MUNICIPAL ELECTION ON APRIL 9, 1974 City.Manage.r presented Resolution No, 73 -1322, A RESOLUTION OF THE CITY. COUNCIL OF THE CITY OF TEMPLE 'CITY,, CALIFORNIA, .CALLING AND GIVING NOTICE OF THE HOLDING'OF A GENERAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY,''THE 9TH DAY OF APRIL, 1974, FOR THE ELECTION OF CERTAIN OFFICERS OF SAID CITY AS REQUIRED BY T;HE.PRO- VISIONS OF THE CHARTER OF THE CITY OF TEMPLE CITY by title only Councilman Merritt moved to adopt,. seconded by_Councilman Greenberg and carried. 15. RESOLUTION NO. 73 -1323: REQUESTING THE BOARD OF SUPERVISORS TO PERMIT THE REGISTRAR OF VOTERS TO RENDER SERVICES TO THE CITY FOR THE GENERAL MUNICIPAL ELECTION ON APRIL 9, 1974, City Manager Koski presented Resolution No 73 -1323, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF LOS ANGELES TO PERMIT THE REGISTRAR Council Minutes, December 18, 1973 - Page 9 OF VOTERS OF SAID COUNTY TO RENDER SPECIFIED SERVICES TO THE CITY OF TEMPLE CITY RELATING TO THE CONDUCT OF A GENERAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON APRIL 9, 1974 by title only. Councilman Gilbertson moved to adopt., seconded by.,Mayor_.Tyrell and carried. 16. RESOLUTION NO. 73 -1324: WARRANTS & DEMANDS, Demand Nos. 9082 through 9167 in the amount of $137,944.92. City Manager Koski presented Resolution No. 73 -1324, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $137,944.92, DEMAND NOS. 9082 'IHRU 9167 by title only. Councilman Gilbertson moved to adopt, seconded by Councilman Dennis and carried. 17. COMMUNICATIONS: A. National Safety Council - Request for Proclamation City Manager Koski presented letter from the National Safety Council requesting City supported the Mayor proclaiming the week of December 24 HOLIDAY SAFETY WEEK. B. A letter from the Board of Supervisors advising they adopted a resolution requestingT the President and Congress to enact an Excess Energy.. Profits Tax was received and filed. C. A communication from Governor Reagan, concerning_ythe establishment of a 55 mile per hour speed limit was received and filed. D. A communication from the Temple City Ministerial Association concerning, invocations opening Council meetings was discussed. It was the consensus of the Council that, in keeping with the established practice, it is recommended that ministers be invited to attend City Council meetings to make the invocation. 18. TIME FOR THOSE IN AUDIENCE WHO WISH TO SPEAK: Marianne Milch, Executive Secretary, _Temple City Chamber of Commerce, advised that Penny Graham, President, was hospitalized'`tor° observation at the Methodist Hospital. She also called Council's attention to the following. Chamber activities: 1) Christmas Open. House Friday, December 21, 10:00 a.m. to 2:00 p.m.; 2) Social Mixer, December 26, Youman's Station; and 3) Membership Luncheon meeting, January 9,1974, when a representative of the AAA would speak on "Toward a Better Tomorrow ". Mrs. Milch also spoke to the apparent success of the "Temple Trolley ". 19. MATTERS FROM CITY OFFICIALS: A. Appeal from Planning Decision - Zone Change Case No. 73 -394, Baldwin /OliveLGreen /Zadell City Manager Koski advised that at their regular meeting of December 11, 1973, Planning Commission denied a zone change request from R -1 to R -3, that the applicant filed an appeal of the Planning Com- mission decision December 14, 1973. Councilman Dennis moved to set public hearing January 15, 1974, to consider the appeal from Planning Commission decision, Zone Change Case 73 -394, seconded by Councilman Gilbertson and carried. B. Annexation Status Report City, Manager Koski presented a status report on annexation, stating that proposal for the sphere of influence for the east portion of the City has been submitted to Local Agency Formation Commission and will be formulated at a future date. Also an annexation has been filed Council Minutes, December 18, 1973 - Page 10 under the Uninhabited Annexation Act in the established .sphere of influence in the north portion of the City. This annexation hearing will be held by LAFCO on February 13, 1974 which will then be returned to Council for their action. C. Withdrawal from Social Security Council received for study a comprehensive report concerning City withdrawal from Social Security, City having, initiated withdrawal proceedings by Resolution No. 72 -1172 dated April 4, 1972. D. Mayor Tyrell requested staff communicate with representatives in Washington concerning the . general,philos.phy of SB 268 "Land Use Policy and PlanningT,,Assistance Act" and similar bills to transfer land use and.p,anningaway from the local jurisdictions. E. Mayor Tyrell called Council's attention to communication from Governor Reagan concerning 1972 Young American Medal for Bravery. Council directed the communication to the attention of the Youth Commission for recommendation. F. Mayor Tyrell directed Council's attention to the establishment of a County Energy Commission by the Board of Supervisors and directed staff communicate with the Board to request any information they may have. G. Council requested a report from Mr. Chet Otting, Community Disposal Company, on the allocation of diesel oil. Mr. Otting reported his allocation for December 1973 will be 69% of fuel used in December 1972, and would request Council consider a cut back to once a week rubbish service, with reduction in service charge, should it become necessary. Council requested Mr. Otting keep the City informed concerning any changes in allotment. RECESS TO MEET AS CRA On motion of Councilman Gilbertson, seconded by Mayor Tyrell, Council recessed at 11:00 p.m. to meet as the Community Redevelopment Agency. Council convened as the Community Redevelopment all members being present, and received a report concerning soil engineering services. City Manager Koski reported that the Disposition and Development Agreement places the burden of soil testing in Parcel "B" of the Rosemead Boulevard Development Project on the developer. Three written bids were secured by EGSMetro Development Construction Company and one by staff, Mr. Gilbertson moved to approve recommendation as set forth in memo dated December 18, 1973, and authorize staff to prepare an agreement between the Agency and EGSMetro and authorize the Executive .Director to sign, seconded by Mr. Merritt and carried on .a roll call vote:. .
