Prior to site plan approval Downer Davis emailed me the comments below for the two storage containers at 201 McKenzie Street. EMAIL FROM DOWNER DAVIS MAY 9, 2012 2 Wearhouse site plan From strictly a drainage standpoint, I have no issues. I met with William at the site yesterday and he agreed to the following conditions. "While the intent is for the containers to be reasonably level, the north ends of each will be slightly higher than the south sides as necessary. This is to provide a slope for drainage purposes to not shorten the time of concentration of any stormwater runoff leaving the site." "The areas beneath the containers will be stripped of vegetation and a 2-3" layer of#57 stone installed. The surface elevations shall remain the same beneath the containers. The containers are to be placed on timbers running perpendicular to the containers to avoid the containers altering the existing drainage pattern." Below are Downer's comments from our inspection on Tuesday, August 14, 2012. Based on my observations during our site visit this morning at 9:15 am I offer the following comments: I only had two comments to William that I previously documented to you: "While the intent is for the containers to be reasonably level, the north ends of each will be slightly higher than the south sides as necessary. This is to provide a slope for drainage purposes to not shorten the time of concentration of any storm water runoff leaving the site." While it is difficult to verify this by eye, it appeared the southern one conforms and the northern one doesn't. "The areas beneath the containers will be stripped of vegetation and a 2-3"layer of#57 stone installed. There was no evidence this had occurred. The surface elevations shall remain the same beneath the containers. The containers are to be placed on timbers running perpendicular to the containers to avoid the containers altering the existing drainage pattern." This was not done. I do not see how runoff has not been increased from leaving this commercial property. It is my recommendation this be corrected immediately. There are other alternatives for addressing this but I will refrain from offering them due to the 3 agreement with the applicant not being fulfilled. If the above restated conditions are not complied with, I recommend any alternatives to this only be considered based on submittals from a registered design professional. This was a simple small straight-forward situation that should not have required a drainage plan prepared by an applicant's registered design professional. However, this turned out to be an example of why I should never recommend to your office reasonable lenient interpretation from Tybee's Code. I cannot think of one instance where such consideration has not resulted in undue extra work on your and other City departments. William,this situation requires your immediate attention. Please submit a proposed correction plan. This needs to be writing and accomplished as soon as possible. I did not review your comments prior to my visit as I thought all I needed to check was the privacy fence installation that the City Council had required. But then I remembered your comments. I failed to check the slope of the containers. I did not see a layer of#57 stone or any timbers. As striping the rock is usually not preferred by owners, Curb stops or linear curb materials with bold wide (yellow) paint will be allowed. 6) Please ensure that the Applicant has a copy of the detail showing the State Accessibility Code compliant signage (Including the van accessible portion). 7) As the access aisle cannot reasonably be striped, signage prohibiting parking in that space may be substituted. The above issues were all discussed with Grady. With the Applicant's concurrence of the conditions of comments (except #3 which is a recommendation), I see not need for a revision prior to CC review. However, this exhibit does not represent a survey as there are NO dimensions of bearings of the subject area shown. Therefore, I recommend we review this against the surveys in the file to assure we are not violating a parking design minimum distance requirement. 2. Where: 201 McKenzie Diane—The Minutes of the 06/14/2012 Council meeting are below.William is understanding the buffering requirement that was part of the motion differently than I am. I understood it to be an 8-foot tall privacy fence.William believes it was an 8-foot wide vegetated area.Section 3-160 below is the buffering ordinance. I don't think Council was requiring the 8-foot fence AND the 5-foot vegetation. Site Plan, William Navon/Wearhouse, 201 McKenzie Street, Storage Buildings. Ms. Otto stated that this is a request to put two storage containers on the property. The area is zoned C-2 and the Planning Commission voted 4-1 to deny. Mayor Buelterman asked Ms. Otto on what basis did the Planning Commission deny this request. Ms. Otto stated that her interpretation of their discussion was that they were concerned about setting precedence with these types of containers being used as out buildings. Mr. Wolff asked Ms. Otto how these structures would fit into the Code. She explained that they are considered accessory structures and are required to meet the se back of 5 feet from the property line. Mr. Wolff further asked is there a limit to the accessory structures that be placed on the lots and will this negatively affect our CRS rating. Ms. Otto stated no as they are not habitable and will be anchored. Mr. Schuman confirmed with Ms. Otto that there are other such containers on the Island. She confirmed as Ocean Rescue, Water Department, Police Department and DPW uses them for storage. Mr. Schuman then asked if this was to be permanent or temporary. Ms. Otto stated that the applicant is requesting permanent use. William Navon approached mayor and council and agreed to add a buffer on the proposed location of the containers. Mr. Brown asked Mr. Navon why he chose this location as opposed to his other locations. Mr. Navon stated there is 1 less public view at this location and is in close proximity to their warehouse. He further explained that these containers will be used for storage only when they receive large shipments from overseas. Mr. Schuman once again asked that there be a buffer between properties. Mr. Groover stated he has concerns regarding McKenzie as the street is in need of repair due to delivery trucks. Mr. Navon confirmed that these containers will receive inventory only once a year so there will not be additional trucks on McKenzie. Mr. Wolff would like to limit the use to two containers on the property and require a privacy fence bordering the residential area. Mr. Navon agreed. Mayor Buelterman then read a letter from Kimberly Doyle, Doyle Landscaping, supporting the application. Paul Wolff made a motion to approve with stipulations to include no more than two containers be placed on the five lots and an eight foot tall buffer be constructed between the containers and the adjacent residents. Bill Garbett seconded. Voting in favor were Paul Wolff, Frank Schuman, and Bill Garbett. Voting against were Barry Brown and Tom Groover. Wanda Doyle recused herself. Motion carried 3-2. Sec. 3-160. - Protective screening of adjacent property where commercial use and residential use abut. No buffer is required for a commercial use adjacent to a commercial use. In cases where a commercial and residential use abut or will abut and where: (A) New construction is proposed; or (B) Existing improvements are to be expanded by enlarging the footprint of existing occupied or usable improved space by 25 percent or more; or (C) A change in the kind, character or degree of use of improved property is proposed, and there is no existing buffer in place on the property that is to be improved or any existing buffer on such property would not meet the requirements below, the owner or applicant shall be required to seek special review unless a buffer satisfying the following requirements is met: (1) Basic requirements. a. An arboreal landscaped buffer not less than five feet wide with a well maintained masonry wall or privacy fence no less than eight feet in height above grade shall be provided and properly maintained along its entire length by the users of the property to be built upon or expanded. Such buffer shall be planted with deciduous trees, evergreens, flowering trees, ornamental trees, or any combination of the same not set further than ten feet apart at any given point along the buffer. The buffer shall be measured from the property line of the property to be improved. In no instance will a street, sidewalk or other like improvement be permissible as a buffer. In no instance will a dumpster or mechanical unit be permitted in a buffer. b. The area beneath and between the planted trees shall be kept free of foreign debris and unmanaged undergrowth. All landscaping shall be maintained in a healthy growing condition, neat and orderly in appearance. c.
