Meetings are broadcast live on the Town’s local government access cable TV channel (Comcast 67 and Verizon 35) and streamed live on the website at www.leesburgva.gov/webcasts. All Town Council, Board and Commission meetings are recorded and can be found on the Town’s Web site at www.leesburgva.gov. 1 -2- REGULARLY SCHEDULED COUNCIL MEETINGS Citizens are invited to attend and participate in Town Council meetings. The petitioner’s portion of the meeting and scheduled public hearings offer the public two opportunities to present its views to the Council during its meeting. Petitioners The petitioners’ portion of the Council agenda is the first item addressed by the Council following proclamations, certificates of appreciation, regional commission reports and presentations. This part of the meeting gives individuals the opportunity to address the Council on any matter not scheduled for a public hearing. Prior to the meeting, citizens wishing to speak should sign up on the Town’s Web site at https://www.leesburgva.gov/government/mayor- council/current-council-agenda by 4:00 p.m. the day of the meeting or on the signup sheet in the hallway outside of the Council Chamber the night of the meeting. The Mayor will give anyone the opportunity to speak that did not get a chance to sign up. Petitioners’ comments are limited to between three and five minutes at the Mayor’s discretion. Public Hearings Certain Town business items can only be conducted after the Town Council holds an advertised public hearing. Certain major issues affecting the Town’s government can also be scheduled for public hearing at Council’s discretion. Adoption of the Town budget, rezonings, special exceptions and amendments to the Town’s subdivision and zoning ordinances all require a public hearing. Prior to the meeting, citizens wishing to speak at a public hearing may sign up on the Town’s Web site at https://www.leesburgva.gov/government/mayor-council/current-council-agenda by 4:00 p.m. the day of the meeting or on the signup sheet in the hallway outside of the Council Chamber the night of the meeting. The Mayor will give anyone the opportunity to speak who did not get a chance to sign up. Public hearing comments should be limited to the topic of the public hearing and speakers will be given between three and five minutes at the Mayor’s discretion. If you wish to speak at more than one public hearing, you must sign up for each hearing separately. Decorum A person addressing the Council as a petitioner, or during a public hearing, should advance to the podium when recognized by the Mayor and state and spell his or her name for the purpose of closed captioning. If comfortable doing so, speakers should provide their address for the record. Persons should also indicate whether they are representing anyone other than themselves. Decorum will be maintained. Statements, which are demeaning or defamatory to members of the public, the staff or the Council, are inappropriate and out of order. OTHER COUNCIL MEETINGS Work Sessions Council meets twice per month, or more often as necessary, to discuss items that are placed on the agenda at the desire of the majority of Council present. Items are typically discussed at a meeting at least two weeks into the future but items may be added in a shorter time frame in accordance with Council’s adopted rules and procedures. Closed Sessions Under certain circumstances, the Virginia Freedom of Information Act permits the Town Council to meet in a session where the public is excluded. This may be a discussion of personnel matters, legal matters, the acquisition or sale of property and other selected topics. The Council can only go into closed session to discuss topics specifically exempted from the open meeting requirements and all closed sessions must be properly noticed and appropriate Code sections cited as to the specific statutory authority to go into closed session. The notice must also include the general topics to be discussed. Only those matters in the adopted motion to go into closed session can be discussed and members in attendance must certify that only those topics were discussed when they return to an open session. TOWN COUNCIL AGENDA MATERIALS Council agenda materials are available to citizens by end of day Wednesday immediately preceding the set of Council Meetings. Council agenda materials are posted to the Town Web site at https://www.leesburgva.gov/government/mayor-council/current-council-agenda. Meeting agenda packets are available for public inspection in the lobby of Town Hall on Wednesdays prior to the scheduled meeting. Council agendas can also be viewed on the Town’s Web site at https://www.leesburgva.gov/government/mayor- council/current-council-agenda. 2 Council Meeting Date: February 27, 2023 TOWN OF LEESBURG TOWN COUNCIL WORK SESSION Subject: Proposed Budget for Fiscal Year 2024 - General Fund Key Enhancements and Capital Projects Including Downtown Closures Staff Contact: Kaj Dentler, Town Manager Clark Case, Director of Finance and Administrative Services Lisa Haley, Deputy Director of Finance and Administrative Services Cole Fazenbaker, Management and Budget Officer Holland Schellhase, Senior Management and Budget Analyst Council Action Requested: Budget Work Session focusing on General Fund Key Enhancements and Capital Projects that are part of the Proposed Fiscal Year 2024 Budget. There will also be discussion of downtown closures. Staff Recommendation: Work Session to review and discuss the Proposed Fiscal Year 2024 Budget General Fund Key Enhancements, Capital Improvement Projects, and the downtown closure program for King Street. Commission Recommendation: The Planning Commission held a public hearing on February 2, 2023, and voted unanimously to recommend approval of the Proposed Fiscal Year 2024-2029 Capital Improvements Program (CIP) with the following recommendations per Attachment #2: 1. Add funding for land, planning, design, and construction of transit infrastructure and structured parking to serve the Crescent District, Eastern Gateway District, and B-1 Downtown Commercial District. 2. Add funding for land, planning, design, and construction of a pedestrian bridge over Route 7 in the Eastern Gateway District as indicated in the Town Plan. 3. Prioritize an opportunity area in the Town Plan and add funding for a study to evaluate infrastructure projects within the Town purview – including capital and operating costs, order of magnitude, and possible public private partnerships – that move the vision for that opportunity area forward. 4. Evaluate alternative solutions to reduce parking demand that are less costly and more environmentally friendly than construction of structured parking. 3 Item a. Prioritize the Police Mobile Command Center project and move it into the Active Projects list and complete as early as possible. 6. Reevaluate the need for a signal as opposed to a pedestrian lighted crossing at Battlefield Parkway and Fieldstone Drive. Fiscal Impact: The Proposed Budget for Fiscal Year 2024 includes $77,915,385 for the General Fund, and $29,504,222 for the Utilities Fund operation budget. The Key Enhancements included in the Proposed Fiscal Year 2024 budget total $1,481,600 using a combination of General Fund revenue, Utilities Fund revenue, and one-time funds from the Unassigned Fund Balance. The Proposed Budget for the Capital Improvements Program (CIP) for the entire six-year schedule (Fiscal Years 2024-2029) is $415,477,510. This amount includes $38,948,264 in Fiscal Year 2024 for General Government CIP projects, and $11,123,070 in Fiscal Year 2024 for Utilities CIP projects. The proposed General Fund Budget for Fiscal Year 2024 is based upon a real estate tax rate of 17.74 cents which is the same as last fiscal year. Work Plan Impact: The Town Manager’s Proposed Budget for Fiscal Year 2024 outlines the work plan beginning July 1, 2023. Town Plan Impact: The proposed budget and Capital Improvements Programs aims to address goals and objectives of the Legacy Leesburg Town Plan. Executive Summary: The main topics for the February 27, 2023 Budget Work Session are the General Fund Key Enhancements and the Capital Improvements Program as listed below. Key Enhancements – General Fund:  Leesburg Police Department: (1) Police Compensation Initiative in the amount of $873,000. (2) Funding to hire a Police Information Technology Systems Administrator in the amount of $129,500 including salary and benefits.  Parks and Recreation: (1) Veterans Park Staffing and Equipment in the amount of $349,600.  Human Resources: (1) Safety and Risk Manager in the amount of $129,500 including salary and benefits. The Capital Improvements Program includes 9 new General Government capital projects: 1. Thomas Balch Library Rehabilitation (Summer 2027) 2. Ida Lee Park Recreation Center Locker Room and Pool Renovations (Summer 2025) 3. Miscellaneous Playground Surface and Equipment (Winter 2023/2024) 4. Traffic Signal- Fieldstone Drive and Battlefield Parkway (Winter 2028/2029) 5. Airport Apron Paving - South Hangars and North Terminal Hangars (Fall 2028) 6. Airport South End Site Preparation (Summer 2025) 7. Water Pollution Control Facility Aeration Improvements (Summer 2028) 8. Water Treatment Plant Filter #3 and #4 Underdrain Replacement (Fall 2028) 4 Item a. Water Treatment Plant Gravity Thickener Replacement (Summer 2028) Two notable projects for the long-term planning of the Town include the Police Station Expansion, which increased $3.2M to a total of $26.5M, and the Town Shop Expansion and Refurbishment which increased $2.1M to a total of $15.5M. These increases are due to inflation, supply chain disruptions, and labor costs. Sidewalk Dining Program: Discussion on the Sidewalk Dining Program is a work plan item from the January 21, 2023 Town Council Planning Retreat. The program began during the COVID-19 pandemic in July 2020 in response to indoor dining restrictions set forth by state regulations. Originally, the program was budgeted for Friday, Saturday, and Sunday during the warmer months (April – November). The program has evolved throughout the years based on experience. To address both public demand and financial efficiency, staff has developed options for Council consideration. They added some recommended revisions as detailed in the adopted motion below. 02/02/23 Planning Commission Adopted Motion I move the Fiscal Year 2024 - 2029 Capital Improvements Program as contained in the February 2, 2023, staff report be forwarded to the Town Council with a recommendation of approval on the basis that the projects listed in the Capital Improvement Program are consistent with the objectives of the Town Plan, subject to the following revisions: 1. Add funding for land, planning, design, and construction of transit infrastructure and structured parking to serve the Crescent District, Eastern Gateway District, and B-1 Downtown Commercial District. 2. Members will automatically be removed from their Board or Commission if they miss more than three consecutive meetings or four meetings in a 12-month period. Attendance reports are provided for Council’s awareness. A listing of all Board and Commission vacancies is also included for Council’s reference. Background: Town Code Section 2-195(h) requires Board and Commission chairs or their designee to provide key events/actions from each meeting in summary format to Council monthly. Additionally, Town Code Section 2-195(b) requires if any member is absent from three consecutive meetings or is absent from any four meetings within any calendar year 12-month period, then the member shall automatically be removed from the position and the town council shall fill the vacancy in the manner set forth in Town Code Section 2-194. Diversity Commission • Commissioner Enrique Gonzalez ran the meeting as the Commission’s current Chair, Devon Carter, was not present. • Commissioners approved the electronic participation of Commissioner Christine Kopp, who was stuck in New Orleans due to the FAA computer system failure. • Since it was the first meeting of the New Year, commissioners introduced themselves. A warm welcome was given to new Commissioner Allison Amato. • Commissioners approved the minutes from the December 14, 2022 meeting. • Staff liaison Kara Rodriguez provided an overview of the attendance policy and electronic participation policy for commissioners. • Commissioner Gonzalez provided an overview of some of the initiatives the Commission has undertaken since its formation. Sgt. Wael Abilmona, representing the Leesburg Police Department, also went over how the department has previously engaged with the Commission. • There was agreement to hold off on the votes for chair and vice chair, along with further planning for 2023, until more commissioners were present for February’s meeting. • Commissioners Gonzalez, Kopp and Amato all said they planned to march in Monday’s MLK March, representing the Diversity Commission. Economic Development Commission • Economic Development Commission did not meet in January. Environmental Advisory Commission • Continued discussion of glass recycling. • Potential tree planting initiative using tree bank funds. • Preparation for Flower and Garden Show planning. • Preparation of Annual Report • Planning for 2022 Tolbert Award • Planning for Rain Barrel Workshops Parks & Recreation Commission • New Business: o Election of Officers: Brody McCray was elected Chair and Laurie Burke was elected Vice-Chair, both with a vote of 5-0-2. o Meeting Times: Due to the conflict of meeting dates with established Town holidays the Commission voted to change their meeting dates to the 3rd Wednesday of the month at 7:30 pm. Planning Commission January 5, 2023 • TLOA-2022-0009 Hotel Parking Standards in the B-1 Public Hearing: The public hearing was closed, and further discussion was deferred to the February 2nd meeting. • The Planning Commission adopted their 2023 meeting calendar. • The Planning Commission adopted their 2023 Inclement Weather Resolution 2023-0001. January 19, 2023 • The Planning Commission held a swearing in ceremony prior to the meeting. Reappointed Commissioners Barnes and Robinson, and newly appointed Commissioners Canton, Campbell, and Tuck took their oath of office. • The Planning Commission held their annual elections at their regular meeting. Brian McAfee was elected Chair; Jennifer Canton was elected Vice Chair; and Earl Hoovler was elected Parliamentarian. Jennifer Canton was appointed as the liaison to the RTC. A liaison will be appointed to the BAR at the February 2nd meeting. • The Planning Commission received a presentation of the FY2024-2029 Proposed Capital Improvement Program. The public hearing will be held on February 2nd. • Commissioner Orientation/Refresher: James David, Brain Boucher, Mike Watkins, Lauren Murphy, and Tina Newton led a Commissioner Orientation/Refresher training. Public Art Commission • Donna Torraca presented a proposed mural for Douglass School in Leesburg. No decision was made due to lack of members. • Election of officers will take place in February. • The 2023 calendar project was a success. All 1,000 calendars are gone. COPA will work on a 2024 calendar beginning in August. • Art in Your Yard project will take place in April. The idea is to have Town residents display artwork in their yards during the weekend of Flower & Garden. More details to come. Residential Traffic Committee • Ms. Sarah Haferman from the Foxridge Community has enquired about the status of establishing a no parking zone on Foxridge Road. Renee Lafollette, the Director Public Works and Capital Projects responded that there is no update to share due to recent changes in the staff and retirement. • Ms. Audrey Carpenter from the Country Club Green Community has enquired about the status on installing a flashing stop sign on the exit ramp of Route 15 at Club House Road. Staff Liaison Niraja Chandrapu will follow-up with VDOT and provide an update in the next RTC meeting. • Mr. Bruce Dewar and Ms. Julie Overman, who live on Memorial Drive stated that the residents are not in favor of striping of pavement on Memorial Drive. They are interested in what Hospital management is 18 Item a. 4 | P a g e willing to do on their exit, narrowing the lane for slowing the traffic. Mr. Grossman stated that striping wouldn’t happen until at least the March timeframe due to the weather. • Wells and Associates provided an overview of the speed reduction study with the potential of lowering the speed limit to 20 MPH in the core downtown area. Based on the evaluation of speed data, improvements to pedestrian safety, and matching existing driver expectations, a reduced 20 mph speed zone is recommended for Downtown Leesburg south of North Street from the North, east of Ayr Street from the west, and at the study area boundary from the east and south. The commission members agree with the study’s recommendation to lower the speed limit to 20 MPH in the Downtown Leesburg area. The commission is anticipated to make a motion to approve their recommendation of lowering the speed limit to 20 MPH on the core Downtown Leesburg Streets in the next RTC meeting. • The commission discussed on how to evaluate and measure the success of 13 action items taken thus far on Memorial Drive to alter the driver behavior. In the last RTC meeting, the commission heard from the residents that the residents are not in support of striping of pavement on the Memorial Drive. The recommendation of commission members is to wait until the month of March to evaluate the effectiveness of the efforts made on Memorial Drive. This is because it is currently too early to determine which measures are effective and which are not. Additionally, by March, the commission will have a better understanding of what Hospital can do on their exit lane to improve the situation. Technology/Communications Commission • Digital Town Hall presentation for future FY24 budget presentation and discussion with consensus of the commission on the plans and staffing for Information Technology. • Discussion of 2022 Annual Report for Town Council • Postponement of Elections of Officers, and approval of the Commission calendar until February meeting so new commissioners can decide in the leadership and meeting times of the Commission for 2023. Thomas Balch Library Commission • Approved the minutes of the 14 December 2022 meeting. • Welcomed the newly appointed commissioner Candace Baracat-Donovan with introductions from all the attending commissioners. • Received the Library Director’s report: o Newsletter has gone out to the printer and copies should soon be available online and in hard copy. o A new flextime person has been added to the staff. o Progress is being made in updating the Family File and the cataloguing project. • Don Cooper gave the Friends of TBL report: o Their next board meeting will be Tuesday, 17 January, at which they will elect new officers. o Fundraising in the past year, Cooper noted, had been the best in at least a decade. • Alexandra Gressitt gave the TBL Foundation report: o The next board meeting will be at noon on 17 January at Balch. o The chief agenda item is a vote on a small increase in expenditure on a Loudoun related historic document purchased via auction. • Old Business: o The library director reported on progress with the cataloguing project which is moving along under the direction of a newly hired staff person. The project will go on throughout the spring, looking toward a summer completion. It is a long-needed revamping of Balch’s catalogue of materials that will make it compatible with the Library of Congress system, making the library more useful to a far wider range of users. 19 Item a. 5 | P a g e o The chairman gave a report on the progress of the Potter’s Field site based upon a recent inspection of it in Union Cemetery. The re-interments are completed, and the original small stone moved to the new site and the area is being prepared for the rest of the memorial. The Library Director indicated that a spring dedication is being planned. o By a unanimous vote, the commission recommended the planting of a pink dogwood tree in the library garden, with a plaque, to honor Martha Schonberger, a deceased former commission chair. • New Business: o The commission elected James Hershman and Elizabeth Scheib, respectively, as chair and vice- chair for 2023 • Commissioners’ comments followed with the theme of welcoming the new member and looking forward to the coming year. Tree Commission • Audio clips and pictures are needed for the new Tree Tour App. Mr. Marshall volunteered to record the audio files himself. • The Commission received the 2010-2020 canopy study data from the LCPS. Mr. Atkins will assess it. • The Commission discussed using tree bank funds to plant trees in town. Mr. Marshall offered to attend the next Treesburg meeting. • The Town of Leesburg earned the Tree City USA award again for another year. • The Commission approved receiving funds from a town citizen to plant a memorial tree in honor of their dead relative. • The Commission discussed the species and number of trees to be given away at the Flower and Garden Festival. • Mr. Howard and Mr. Groothuis were nominated again for Chair and Vice Chair. • Mr. Roe from Capitol Projects introduced a new concept plan for the sidewalk improvements along Plaza Street. Tree Preservation will be a major priority of the project. • The new Commission member, Mr. Schneider was welcomed. He recommended we plant more evergreens in the Town. 20 Item a.
