COUNCIL MINUTES

INITIATION:
1. Mayor Tyrell'called the`regu'lar.meeting of-the-City. Council to order
at 7:32 p.m. oh- Tuesday, January 15-;1974;-in-the-Council Chamber of
the City Hall.

5. APPROVAL OF MINUTES:
Councilman Dennis requested that the minutes of December 18, 1973 be
clarified to reflect that although he moved to find that a public
nuisance does not exist in connection with the operations of the
Ivanhoe Bar, 9669 E. Las Tunas Drive, that the very nature of the
business is associated with a clientele who create a nuisance. The .
minutes should also reflect the City Council adopted the "no objection"
method for motions as contained in Resolution No. 74 -1328.
There being no further additions or corrections, Councilman Merritt
moved to approve the minutes of the regular meeting of the City
Council held on Tuesday, December 18, 1973, seconded by Councilman_
Greenberg and carried.

UNFINISHED BUSINESS:
6. PUBLIC HEARING: 7:30 p.m. INSTALLATION OF TWO STREET LIGHTS - AVON
AVENUE, NORTH OF BURGHARDT ROAD
City Manager Koski introduced background information stating that
property owners on Avon Avenue, north of Burghardt Road` circulated
a petition requesting streetlights pursuant to Chapter 27 of the
Improvement Act of. 1911, Streets and Highways Code, which petition
was returned with signatures of owners representing 787 of the front
footage; Avon Avenue is presently in Zone A of the Temple City Muni -
cipal Lighting District and two street lights would be required to
bring Avon up to Zone A_standards. Notices have been posted and a
negative declaration of environmental impact was completed and posted.
Mayor Tyrell declared the public hearing open. No one came forward
to speak in favor of, nor in opposition to, the installation of
street lights on Avon Avenue.. Councilman Gilbertson moved to close
the public hearing, seconded by Councilman Merritt and carried.
Councilman Gilbertson moved.. to approve the negative declaration of
environmental impact, find the installation-of two street lights on
Avon Avenue, north of Burghardt Road to be in the best public interest,
and instruct the Superintendent of Streets to cause the installation

to be accomplished annd-to report one:the cost of'the •installation
when completed;' seconded by Councilman Merritt 'and carried.
7. PUBLIC HEARING: 7:30 p.m.° PLANNING :.COMMISSION RESOLUTION NO. 73 -537PC
A. APPEAL FROM PLANNING COMMISSION DECISION: ZONE CHANGE CASE
NO. 73 -394 - BALDWIN /OLIVE /GREEN /ZADELL
B. TENTATIVE TRACT MAP NO. 32040.
City Manager Koski presented background.: information stating the
Planning Couanission, at their regular meeting of December 11, 1973,
approved-the Environmental Impact Report relating-to the proposed
zone change, but denied the- zone change request from R -1 to R -3
for certain properties at:Baldwin /Olive /Green /Zadell in that public
necessity does not require the proposed change of zone and the pro-
posed change of zone is not compatible with the zoning of surrounding
properties. The zone change request was originally presented to the
Planning Commission on May 22 and June 12, 1973 and before the City
Council at their-meeting held July 1.7, 1973, at which time the City
Council referred the case back to the Planning Commission for re-
configuration of the parcel to include the three parcels at the
northeast corner of Green and. Baldwin.. Applicant filed an appeal of
the Planning Commission decision on December 14, 1973.
City Attorney Martin advised that.the appeal and tentative tract
map could be heard concurrently. Mayor Tyrell declared the public
hearing open.
Planning Director Dragicevich advised that the three parcels on the
northeast corner of Baldwin and Green. Street are now part of the zone
change request;' with a frontage. of .737 feet on Baldwin Avenue and 355
feet on Green Street, the area consists of 6.25 acres; Baldwin Avenue
is a 100 ft. primary road, Olive is a 60 ft. collector; presently the
area consists of 11 units; the proposed zone change is compatible with
the General Plan ;. the environmental impact will be one of increase in
1) residential density, 2) traffic. volume, 3) safety hazard, 4) noise
level, and 5) demand for municipal services and utilities. Mr.
Dragicevich further advised .. that if a.. change of zone is granted,
applicant plans to construct a.90.. unit _.condominium, five parcels will
be split and their rear portions added to the subdivision, over 100
trees are proposed to be removed, 210 parking spaces, 180 of which will
be covered; the units will be 1,241.sq.. ft. minimum, 1,448 sq. ft.
maximum in size, two entrances. on. Baldwin.. Avenue. If approved, staff
would recommend approximately 40 conditions to be attached to the
approval; to name a few, five fire hydrants, left turn pocket constructed
on Baldwin Avenue, certain lots to be filed separately, public works
improvements, etc.
Mayor Tyrell moved to make the staff reports and Planning Commission
testimony a part of the record, seconded by Councilman Dennis and
carried. Councilman Merritt moved to'make letters which were received
favoring the project a part of the record, seconded by Councilman
Greenberg and carried.
IN FAVOR:
Mr. James Baldwin, 4300 Campus. Drive, Newport Beach, applicant, stated
he had been able to include three of the four parcels Council had
requested at the July 17, 1973 hearing, the lot on the corner of Baldwin
and Green Avenues has one house which they intend to retain and remodel
the exterior to make a part of the condominium project, he has worked
closely with city staff and is willing to comply with all conditions
imposed by city and county, he referred to the Temple Townhouse at
Temple City Boulevard and Broadway which his firm built 9 years ago,
and advised that his firm.had won the House. Builder of the Year Award
for California. Mr. Baldwin presented pictures of Baldwin constructed
condominiums. Councilman Gilbertson moved to accept the pictures and

make them apart of the' record, seconded by Councilman Dennis and
carried.
Mr. Noel Baldwin, ° 5302 N ' "Baldiwin',Avenue, "gave the zoning history
of the area and advised that for .years builders : have wanted to
develop this area which had been stopped by one strategically
located owner, as evidenced by - a:letter written by one developer
which he submitted. Councilman Gilbertson moved to accept the letter
and make it a part of the record, seconded by Councilman Dennis and
carried.
Mr. Baldwin also submitted an economic study projecting income figures
of potential owners of the. condominiums. Coucilman Gilbertson moved
to accept as` part "of the record, seconded by Councilman Dennis and
carried.
Mr. J. H. McKim, 5125 Baldwin Avenue, spoke in favor of the proposed
development stating it would increase revenue in Temple City and the
traffic on Baldwin Avenue is not conducive to R -1 zoning.
Mr.-George Nicholas, "9951 -Howland Avenue, stated the proposed project
would upgrade the area and-improve the appearance of one of the major
entries to 'Temple City.
Mr. "Leland Tinkham, 10017 Green Street, stated that on July 17, 1973
his objection to the proposed project was that they would be surrounded
by two story condominiums, but that now he favored the project as
proposed.
Mrs:. Penny Graham, President, Temple: City Chamber of Commerce, stated
that the Legislative Committee and the Board of Directors had taken a
stand in favor of the project in July 1973, and that they still
supported it as an economic value to the City.
IN OPPOSITION:
Mr:`Robert Fiedler, 10063 Olive. Street, stated he believed the pro-
perty should be developed in a manner more compatible with the area,
the density is too high, granting the request would be setting a
precedent' for additional requests on Baldwin Avenue, the area should
be zoned R -1 or R -2. Mr: Fiedler presented an-alternative plan showing
possible development with lower density.
Mr. Richard Lucas, 5301 Zadell Avenue., asked Council to deny the zone
change because 1) it is not needed,.2)'itis not wanted, and 3) the
project is not a good plan. He. said only 65 of 310 R -3 zoned acres
in Temple City are developed., two - story structures would be an.invasion
of privacy to the families living there, and 250 people in the surround -
ing area have said they'd() not want a density increase of 900 %.
Mr. Robert Gannon; 5351 Zadell Avenue, listed other developments Mr.
Baldwin is building with lower-,density, stating-something could be
developed-more-realistically than 90 units, and-Temple City should be
developed-to the proper use.
Mxs.•Lina•Hargett, 10059 Randwick., stated to rezone in an attempt to
upgrade an area would encourage property owners to allow their property
to deteriorate.
Mrs. Kay Gannon, 5351 Zadell Avenue, stated the development would
affect property value and condominiums are not always a welcome
addition to a given area. She felt this should be studied along with
other inconsistencies between the General Plan and Zoning in the City.
Mrs. Robert Fiedler, 10063.- Olive .Street, stated that eventually, with
the normal turnover in real estate, the condominiums would be occupied
by people with children.

Mr. Clayton Plank, 5330 Zadell, stated his objection to the walls
surrounding the condominiums.
In rebuttal, Mr. Baldwin stated :- .tha-t -Mr Gordon Howard, and others,
who signed the petition, were told that driveway access would be to
Olive Street and Zadell and that the builder is going to put up
junky apartments. He- stated the number of people per unit in this
type of development 'are historically less than the number of people
per unit in R -1 development, which would average approximately the
same number of people per acre, and that land should be used to its
best advantage; that approximately 30% of the land would be devoted
to buildings, the rest to open space and driveways,
Mayor Tyrell called a recess at 10:00 p.m., and reconvened the
meeting at 10:15 p.m., all members being present.
Councilman Gilbertson moved to close the public hearing, seconded
by Councilman Merritt and carried,
Mayor- Tyrell questioned the City Attorney as to the City's protection,
should: Council look favorably upon the appeal, against a development
which would not be approved -by ,the - -City.
City Attorney Martin advised there are some problems in granting a
zone change and-he-would recommend, at this time, his review of
possible Conditions, Covenants` -and Restrictions attached to the
tentative tract map ;'holding -the zone change in abeyance until the
developer has submitted -final map,_or.waiting for the - Residential
Planned Development ordinance to be adopted and incorporated in the
Temple City Municipal Code.
Councilman Gilbertson -:stated :he would. be interested in how many
people are in favor of.the.:proposed project, that unfortunately
residents usually come to a Council-meetingwhen they have a
personal interest; andhe.would.be in-favor of continuing the matter
to the next: :City Council meeting to give the City Attorney the
opportunity to review the matter.
Councilman Merritt' stated City. Council should have complete information
concerning any potential:prob lem Councilman. Greenberg was in agree-
ment. Councilman Dennis stated that when City Council referred the
matter back to the-Planning-Commission in July, it was done so for re-
configuration of the parcels and. to provide a method whereby the zone
change. and development could be brought together into one hearing, and
now it is back without a Method of tying the two together.
Councilman -Merritt moved to continue. the matter to the next regular
meeting of the City Council..to be held Tuesday, February 5, 1974,
seconded by Councilman Dennis and carried,-with the consent of the
applicant.
8. PUBLIC HEARING: .7:30 p.m. PLANNING COMMISSION RECOMMENDATION -
CONSIDER AMENDMENT TO TEMPLE CITY ZONING CODE RELATING TO
RESIDENTIAL PLANNED'DEVELOPMENT (RPD)
City Manager Koski presented background information stating that
the Planning Commission, at. their . regular meeting held December 11,
1973, passed Resolution No. 73 -536PC recommending amendment to the
Temple City Municipal Code relating to. Residential Planned Development
Districts, which is designed to apply to the development of residential
properties in the City, especially_to those large and partially developed
parcels located in low density residential zones. The proposed RPD
regulations are flexible with .respect to setbacks, height, open space,
density and other site qualities while insuring compliance with the
General Plan and compatibility with existing developments in surrounding
areas. There are basically four steps involved in an RPD application;
that is., 1) pre - application conference, 2) provisional plans, 3) zone
change, and 4) precise plan. An application for a change of classification

to an RPD District 'would be accompanied by a provisional plan
for the development. A "Checklist = of Standards and Requirements"
establishes guidelines in processing.s.uch:_ applications. City Council,
at their regular meeting held December 18, 1973, set public hearing
on January 15, 1974.
Mayor Tyrell declared the public hearing open.
Mr. Arthur Bauman, P. 0. Box 1201,.. Arcadia, stated that he felt
the ordinance was very confusing and could not follow the continuity
between the ordinance and the Checklist of. Standards and Requirements.
As Mr. Bauman understood it, a precise plan could be disapproved
after the developer had gone to a great deal of expense following
approval of the provisional plan. Since there seemed to be a great
deal of confusion on the part of Mr. Bauman, Council directed Planning
Director Dragicevich and Assistant City Attorney White to meet with
him in an effort to clarify the proposed ordinance.
Mr. James Baldwin inquired as to the time frame in which the ordinance
could be adopted. City Attorney Martin explained that City Council
could introduce for first reading at this time, second reading on
February 5, 1974 with the ordinance becoming effective 30 days there-
after.
Councilman Gilbertson moved to close the public hearing, seconded by
Councilman Greenberg and carried.
City Attorney Martin explained that ,reversion of Residential Planned
Development 'zone is valid, after the useful-life of improvements,
provided the developer - complies with the RPD concept of development;
however, if the City wants to change the zone after expiration of the
useful life of the improvements, it must_ hold public hearing. City
Attorney Martin introduced Ordinance No. 74 -381 AN ORDINANCE OF THE
CITY OF TEMPLE CITY ADDING NEW .PART .XIIIB TO ARTICLE IX OF THE TEMPLE
CITY MUNICIPAL CODE RELATING TO RESIDENTIAL PLANNED DEVELOPMENT
DISTRICTS for first reading by title only.
Councilman Gilbertson moved to introduce Ordinance No. 74 -381 for
first reading, deleting all of paragraph 4, Section 9436 on Page 2
and completion of sentence on top of Page 3. Councilman Merritt
seconded and motion carried.
9. ORDINANCE NO. 73 -379: 2nd read.. Establishing an Open Space (0 -S) Zone
City. Attorney Martin introduced Ordinance No. 73 -379, AN ORDINANCE OF
THE CITY OF TEMPLE CITY ADDING NEW PART XIIIA TO ARTICLE IX OF THE
TEMPLE CITY MUNICIPAL CODE ESTABLISHING AN OPEN SPACE (0 -S) ZONE for
second reading by title only
Councilman Merritt moved to waive further reading and adopt, seconded
by Councilman Gilbertson and carried.
10. ORDINANCE NO. 73 -380: 2nd read. Rezoning Certain Property
City Attorney Martin introduced Ordinance No. 73 -380, AN ORDINANCE OF
THE CITY OF TEMPLE CITY REZONING CERTAIN PROPERTY for second reading
by title only.
Councilman Merritt moved to waive further reading and adopt, seconded
by Councilman Gilbertson and carried.
NEW BUSINESS:
11. PUBLIC HEARING: 7:30 p.m CAMELLIA FAMILY BILLIARDS - Change of
Ownership
City Manager Koski advised that an application had been received for
license indicating a change of ownership for the Camellia Family

Billiards located at 9055 E. Las_Turnas.._ Drive. Notice of public
hearing was posted, 'the Sheriff's ::.report . -has been received marked
approved, no appeals have been received. The application is for
the current hours of operation for this establishment as approved
by the City Council April 1, 1970, which are Sunday through Saturday,
11:00 a.m. to 2 :00 a.m.
Mayor Tyrell declared the public:hearing open. There being no one
to speak to the matter; Councilman.Dennis moved to close the public
hearing, seconded by Councilman Gilbertson and carried.
Councilman Gilbertson advised the..Youth Commission has expressed
concern with cigarette vending machines being operated in an
establishment frequented by minors. City Attorney explained that
state law preempted any controls.by the City. Councilman Dennis
moved to approve the application as set forth in memo dated January
10, 1974, seconded by Mayor Tyrell and carried.
12. RECOMMENDATIONS FROM'PARKS AND RECREATION COMMISSION - Meeting of
December 19, 1973
A. COSPONSORSHIP OF TEMPLE CITY AMERICAN LITTLE LEAGUE
City Manager Koski advised that the Parks and Recreation Commission,
at their regular meeting held December 19, 1973, recommended to
City Council that the Temple City American Little League request for
City cosponsorship be approved. Such approval would create one change
in their present use of Live Oak Park., that of using Recreation Depart-
ment field marking material free of charge whereas in the past they
paid the City for the amount used.
Councilman Gilbertson moved to approve.City.cosponsorship of the
Temple City American Little League, seconded by Councilman Greenberg
and carried.
B. RECOSPONSORSHIP OF: TEMPLE CITY SENIOR CITIZENS CLUB
CONVERTIBLE. TOPS #506 OF TEMPLE CITY

City Manager Koski advised that the Parks and Recreation Commission,
at their regular meeting held December 19, 1973, recommended to
City Council that Temple City Senior Citizens Club, which was
originally cosponsored by the City in 1963, Temple City Convertible
Tops #506, which was originally cosponsored in 1964, and Temple City
Creative Arts, which was originally cosponsored in 1965, all with
yearly requests for renewal granted, be recosponsored for the year 1974.
Councilman Gilbertson moved to approve recosponsorship of Temple City
Senior Citizens Club, Convertible Tops #506 of Temple City, and Temple
City Creative Arts, seconded by Councilman Greenberg and carried.
13. RECOMMENDATION FROM TRAFFIC COMMISSION - Meeting of January 2, 1974
TRAFFIC SIGNAL MODIFICATIONS
A. TEMPLE CITY BOULEVARD AND'LOWER AZUSA ROAD
B. OAK AVENUE AND LONGDEN AVENUE
City Manager Koski advised that the Traffic Commission, at their
regular meeting held January 2, 1974 . .reviewed the times of operation
of the signals at the subject intersections and recommended to City
Council the placing of traffic signals at Temple City Boulevard and
Lower Azusa Road on full 24 -hour operation, and at Oak and Longden
Avenues to operate on the normal three -phase sequence from 7 a.m. to
10 p.m. and on flashing four -way red from 10 p.m. to 7 a.m.

Councilman Dennis moved to approve. the Traffic Commission recom-
mendations per memo dated January 3, 1974, seconded by Councilman
Greenberg and carried.
14. RENEWAL OF AGREEMENT: County of Los Angeles re: Grounds Maintenance
for Property - Adjacent to Library and Engineering Building
City Manager Koski advised that the Agreement with the Los Angeles
County Department of Real Estate Management for the City of Temple
City to provide grounds maintenance services adjacent to County
library building and County Engineer's parking lot will expire on
June 30., 1974. The Department. of Real Estate Management requests
an estimate of costs for a five -year agreement commencing July 1,
1974. Estimate for the fiscal year 1974 -75 would increase from
$800 to $851.
Councilman Merritt moved to negotiate with Los Angeles County
Department of Real Estate Management to renew agreement on a
one -year basis in the amount of $851, seconded by Mayor Tyrell and
carried.
15. RESOLUTION NO. 74 -1325: Adopting:1973 Edition Uniform Standard
Specifications for Public Works Construction
City Manager Koski advised .that. the_ 1973 Supplement to Uniform
Standard Specifications for.Public Works Construction reflected
changes accrued and studied during the preceding months by a joint
committee composed of members of the. Southern California Chapter of
American Public Works. Association. and the Associated General Con-
tractors of America, and that the new supplement should be adopted
now so that the City's requirement for materials and construction
in public works is complete and up to date.
Councilman Gilbertson moved to.adop.t.Resolution No. 74 -1325 A
RESOLUTION OF THE CITY COUNCIL. 0F. THE- CITY OF TEMPLE CITY ADOPTING
THE 1973 EDITION OF THE UNIFORM. STANDARD SPECIFICATIONS FOR PUBLIC
WORKS CONSTRUCTION, seconded by Councilman Dennis and carried.
16. RESOLUTION NO. 74 -1326: Employment of Personnel
It was moved by Councilman Merritt, seconded by Councilman Dennis
and carried to adopt Resolution No. 74 -1326 entitled A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING TEMPORARY
PERSONNEL.
17. RESOLUTION NO. 74 -1327: WARRANTS & DEMANDS, Demand Nos. 9168 through
9305 in the amount of $70,929,36..
Councilman Gilbertson moved to adopt Resolution No. 74 -1327 entitled
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING
CLAIMS AND DEMANDS IN THE SUM:. OF $70,929.36, DEMAND NOS. 9168 THRU
9305, seconded by Councilman Dennis and carried.
18. COMMUNICATIONS:
A. Reverend Roger Winans, Casa Robles Missionary Home, 6355 Oak Avenue -
Claim for Damages
A communication. dated. December 27, 1973, from Rev. Everette Howard,
Superintendent, Casa Robles Missionary Home on behalf of Rev. Roger
Winans, submitting claim for damage to an electric shopper on
December 20, 1973, resulting from a limb from a street tree which
fell into the street, some of the branches hitting the vehicle.
Councilman Gilbertson moved to deny and to refer to the City's
insurance carrier, seconded by Mayor Tyrell and carried.

B. Church of Jesus Christ of Latter- Day.Saints - Request to
substitute alternative to Master Street Tree Plan
A communication dated January 8, 1974, from Church of Jesus Christ
of Latter -Day Saints, requesting :. permission to plant five Ficus
Nitida in the right of way along Kauffman Avenue, replacing the
designated Holly 0ak, planting to be at the expense of the church.
Councilman Gilbertson moved to grant the request of Church of Jesus
Christ of Latter -Day Saints to.plant -five Ficus Nitida in the right
of way along Kauffman Avenue, seconded by Councilman Merritt and
carried.
19. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK:

20. MATTERS FROM CITY OFFICIALS:
A. Preliminary Assessed Value Estimates
City Manager Koski advised that pursuant to Government Code Section
27421, County Assessors are required to furnish an estimate of the
assessed valuation of'property within cities no later than May 15
when requested by the City prior to February 20.
Councilman Gilbertson moved to direct staff to request preliminary
assessed value estimates from the County Assessor, seconded by
Councilman Merritt and-carried.
B. Planning Commission Institute - February 6 -8, Palm Springs
City Manager Koski presented request for Commissioners Carl Clark
and Robert Stacy, to attend the League, of California Cities,
Planning Commission .Institute, to be held in Palm Springs on
February 6 -8, 1974. Funds for this purpose are in the budget.
Councilman Dennis moved to approve the request, seconded by
Councilman Greenberg and carried.
C. Community Redevelopment Agency - Status Report
Executive Director of the Community. Redevelopment Agency, Karl
Koski, presented a status report. City Council received and filed.
D. Live Oak Park Development Land Acquisition
City Manager Koski advised staff had met with property owner and
conducted preliminary negotiations. City Council directed staff
to prepare purchase agreement and present to City Council at their
next regular meeting for approval.
E. Emergency Communication Equipment
City Manager Koski advised that as part of the remodeling plan
staff requests consideration of relocating the local government
base station in the basement .of.the City Hall. A remote console
could then be moved to any location and plugged in; however normal
location would be at the receptionist counter. Purchase of a
remote control would necessitate the appropriation of $280 from
the General Fund and amend the adopted budget.
Councilman Gilbertson moved to approve purchase of remote console,
appropriate additional funds in the amount of $280 from the General
Fund and amend the adopted budget accordingly, seconded by Councilman
Greenberg and carried.

F. Budget Adjustment - Account 1823, General Government Buildings
(Maintenance and Repair)
City Manager Koski advised that insufficient funds were budgeted
in account 1823 to maintain :the air conditioning system due to
changing contractors mid -year, and the need for critical repairs
by the new contractor which were not anticipated during the budget
period.
Councilman Gilbertson moved to appropriate additional funds in
the amount of $1,077 from the General Fund and amend the adopted
budget accordingly, seconded by Councilman Merritt and carried.
G. 1974 General Municipal Election - Candidate's Statement of
Qualifications
City Manager Koski advised that.int the past Council established
an amount of $100 as a deposit to be provided by candidates
wishing to have "Candidate Statement of Qualfications" printed and
distributed with sample ballots; however a check with Martin and
Chapman reveals they expect a 10% increase in printing costs.
Councilman Greenberg moved to approve a deposit of $110 be required
for candidates submitting "Candidates Statement of Qualifications"
seconded by Councilman Gilbertson and carried.
H. California Contract Cities Association Legislative Conference -
January 16 -17, Sacramento
Councilman Greenberg moved to.: authorize ..the attendance of Councilman
Gilbertson and City Manager Koski at subject conference as official
representatives of the City and approve the expenditure of funds
for necessary expenses not to exceed $290, seconded by Councilman
Dennis and carried.
I. Purchase of Vehicle - 1972 Chrysler Station Wagon
Councilman Gilbertson moved to authorize the purchase of the 1972
Chrysler Station Wagon in the amount of $3,150 and amend the adopted
budget accordingly, seconded by Councilman Dennis and carried.
J. Set Public Hearing: Curb,.Gutter and Driveway'Approaches -
(Pursuan t to Chapter 27, Streets and Highways Code)

City Manager Koski presen tedbackground information, advising that
in March 1973, the City of.E1 Monte granted jurisdiction over that
portion of Ellis Lane, from Lower Azusa Road southerly which lies
in the. City of El Monte... .0n March .b_, 1973, City Council held
public hearing and found impr.ovements...on the west side of Ellis
Lane between Lower Azusa Road and Temple City Boulevard to be in
the best public interest and..instr.ucted..the Superintendent of Streets
to cause the work to be done. No hearing.was held on the construction
of curb and-gutter improvements on the east side; however, designs
for both sides.of Ellis Lane have been completed. Because the entire
right of way of Ellis Lane. from the Temple City boundary to Temple
City Boulevard is within the jurisdiction of the City of Temple City,
it is possible to assess the property.owners on the east side of
Ellis Lane- for.the construction of improvements, pursuant to Section
5895.50 of the Streets and Highways Code.
Councilman Merritt moved to set public hearing on February 5, 1974
to consider the. construction of curb.,.gutter and driveway improvements
on the east side of Ellis Lane between Lower Azusa Road and Temple
City Boulevard, on the east side of Temple City Boulevard from Ellis
Lane to approximately 350' southerly, and to instruct the Superintendent
Council Minutes, January 15, 1974 - Page 10
of Streets to post necessary notices and. cause plans and speci-
fications to be drawn up, seconded by Councilman Gilbertson and
carried.
K. Natter Manufacturing-Company = Request for waiver of sewer
assessment fee
City Manager Koski presented - request from Natter Manufacturing
Company to waive charges for sewer .. reconstruction system in the
City in the amount of $809.60 in connection with a current
building permit for a new plant a.t. the. southwest corner of Gidley
Street and Temple City Boulevard. The company spent $7,300 for
300 feet of City sewer line on Temple City Boulevard before an
occupancy permit could be issued for the completed manufacturing
plant at 9570 Gidley Street in 1971 prior to the adoption of
Ordinance No. 72 -355.
Councilman Gilbertson moved to approve the request to waive sewer
assessment fee in the amount of $809.60, seconded by Councilman
Merritt and carried.
