INTERLOCAL AGREEMENT BETWEEN GRAND COUNTY, THE CITY OF MOAB AND THE TOWN OF CASTLE VALLEY TO PROVIDE FOR THE ESTABLISHMENT OF 9-1-1 EMERGENCY TELEPHONE SYSTEM COMES NOW Grand County, hereinafter referred to as the "County", the City of Moab and the Town of Castle Valley, and hereby agree, pursuant to the Utah Interlocal Cooperation Act as set forth in Utah Code Annotated 11-13-1, et seq., 1953 as amended, to the establishment by Grand County of a 9-1-1 emergency telephone system and agree to the funding mechanism as provided in Utah Code Annotated 69-2. It is further agreed that: 1. The City of Moab hereby agrees that as the governing authority of a public safety agency providing fire fighting, law enforcement, medical, or other emergency services that the County may provide a 9-1-1 emergency telephone system within its jurisdiction pursuant to this agreement. The Town of Castle Valley, to the extent that it provides the same services, also agrees that the County may provide a 9-1-1 emergency telephone system within its jurisdiction pursuant to this agreement. 2. The parties hereby agree that the duration of this agreement shall be for a period of 49 years, but may be terminated at any earlier time upon mutual written agreement of both parties. 3. The parties hereto agree that Grand County shall be responsible for establishing 9-1-1 emergency telephone service as provided in Utah Code annotated 69-2, and may levy annually an emergency telephone charge in an amount not to exceed $0.50 per month on each basic local exchange assess line within the City of Moab and the Town of Castle Valley. 4. There is no new entity being created by this agreement. 5. All money received by the County for the provision of 9-1-1 emergency telephone service shall be paid over to the 1 Grand County Treasurer and deposited in a special emergency telephone fund. All monies in the emergency telephone service fund shall be expended by the County to pay the costs of establishing, installing, maintaining, and operating a 9-1-1 emergency telephone system or integrating a 9-1-1 system into an established public safety dispatch center, including contracting with the provider or local exchange telephone service and vendors of appropriate terminal equipment as necessary to implement the 9-1-1 emergency telephone service. Revenue derived for the funding of the 9-1-1 emergency telephone services may only be used for that portion of costs related to the operation of the 9- 1-1 emergency telephone system if such a system is integrated with any public safety dispatch system. 6. In implementing the 9-1-1 emergency telephone service Grand County and public safety agencies of the City of Moab, and of the Town of Castle Valley, if any, and their employees shall cooperate in establishing the service and its day to day provision. 7. Grand County shall be the governing authority of the 9-1-1 emergency telephone service and the City of Moab hereby agrees that the County may provide 9-1-1 emergency telephone service within the public safety agency jurisdiction of the City of Moab which city is the governing authority of such public safety agency. To the extent that the Town of Castle Valley is the governing authority of any public safety agency, it makes the same agreement. 8. The parties hereto agree that any word, sentence or paragraph is severable and that in the event of any controversy or the determination that any word, sentence or paragraph is unlawful, unenforceable or unconstitutional, that balance of the agreement shall be valid and construed in a manner which will make it lawful and in compliance with the spirit and intent set forth in this agreement. All such constructions shall also be designed to promote the establishment and operation of a 9-1-1 emergency telephone system by Grand County within the City of Moab and the Town of Castle Valley. 9. Each party hereto agrees that it shall adopt this agreement to be filed by resolution and cause the resolution and agreement to be filed with the keeper of its records and shall 2 further cause an authorized attorney to approve the agreement and determine the agreement is in proper form and compatible with the laws of the State of Utah. The Interlocal Agreement is amended to include the Moab Valley Fire Protection District as a party. 2. All reports of fires on the 9-1-1 emergency telephone service within the territory of the Moab Valley Fire Protection District shall be referred to the District. 3. The Interlocal Agreement, as hereby amended, is ratified by all parties hereto.
