NOTICE IS HEREBY GIVEN that the Planning Board of the Town of Gulf
Stream will hold a Public Hearing on Wednesday, April 4, 1990 at 9:00 A.M.
in the Commission Chambers at the Town Hall, Gulf Stream, Florida at
which the following will be considered:
1. An application submitted by Curtis D. Meade, Agent for Sally
Mills, 330 Old School Road, Gulf Stream, Florida 33483
requesting a variance from the provisions of the following:
Ordinance 83-1; ZONING, Part II; COMPREHENSIVE ZONING
ORDINANCE, Section VII.; "RS" RESIDENTIAL SINGLE-FAMILY
DISTRICT, Sub Section K.; Side Yard Required, Paragraph 1,
and Sub Section L; Rear Yard Required,Paragraph 1.
Ordinance 83-1; ZONING, Part II; COMPREHENSIVE ZONING
ORDINANCE, Section XI; NON -CONFORMING USES, Sub Section
A, Paragraph 3.; Alterations.
to permit the alteration of a non -conforming structure by the
addition of bay window and closet projection that would
encroach five and six tenths (5.6) feet into the required
nineteen and four tenths (19.4) foot side yard setback and
by enclosing an existing open, roofed porch which encroaches
ten and three tenths (10.3) feet into the required nineteen
and one half (19.5) foot rear yard setback at the address
aforementioned, the legal description of which is Lot 4,
Block 2, Plat No. 1,Polo Fields Subdivision.
2. An application submitted by James B. Orthwein, 330 Banyan
Road, Gulf Stream, Florida 33483 requesting a variance from
the provisions of the following:
Ordinance 83-1; ZONING, Part II; COMPREHENSIVE ZONING
ORDINANCE, Section X; GENERAL PROVISIONS, Sub Section F;
Garages, Storage Facilities, Etc., Paragraph 2.
to permit the garage doors of a proposed single family dwelling
structure,to be constructed on a corner lotto face the side
street. The location of the proposed construction is on the
north west corner of Polo Drive and Banyan Road which is
legally described as Lot 5, Block 3, Polo Fields, Plat No.l
3. An application submitted by Digby Bridges, Agent for W. T.
Young, P. O. Box 1110, Lexington, Ky. requesting a variance

Stream will hold a Public Hearing on Wednesday, May 2, 1990 at 9:00
A.M. and the Town Commission, sitting as the Board of Adjustment, will
hold a Public Hearing on Friday, May 11, 1990 at 9:00 A.M., both in

Mr. Lynch moved and Mr. Eaton seconded that the minutes of the
regular meeting and public hearing of March 7, 1990 be approved as
circulated. During discussion Chairman Mayer stated that he had not
been present at the meeting of March 7, 1990 and would like to discuss
the action that was reported in the minutes with regard to the Orthwein
application for a variance. He advised that he had received some
objections to the granting of the Orthwein variance and questioned if
any had been raised at the March 7 meeting. Mr. Lynch and Mr. Sheehan
advised that only one had been raised by Mr. Stevens in regard to the
garage doors facing the street which was not under consideration at
that time. However, Mr. Orthwein had reviewed drawings with Mr. Stemens
and Mr. Stevens had stated that after seeing the landscape plan, he
had no objections. Both Ohairman Mayer and Mr. Eaton advised that
they had received objections since the last meeting which they had been
unable to attend. Mrs. Orthwein advised that she was abstaining from
participating with regard to this matter. Mr. Eaton felt that no
hardship had been proven since this was a vacant piece of property and
a structure should have been designed to fit it. It was questioned if
the matter could be reconsidered. The Town Clerk noted that it was
not on the agenda, the property owners within 300' had not been noticed
that it was to be considered and the applicant, Mr. Orthwein, was also
unaware that this would be considered again. 'She went on to note that
the recommendation had already been given to the Town Commission,
sitting as the Board of Adjustment but they had not acted on the ap-
plication as yet. Mr. Lynch reminded that at this point the motion
was to approve the minutes and since they did accurately reflect the
action that had been taken, they should be approved. Chairman Mayer
called for a vote on the motion to approve the minutes of the regular
meeting and public hearing of March 7, 1990 and all voted AYE.
IV. Additions, withdrawals, deferrals, arrangement of items.
Chairman Mayer advised that a letter had been received from Dr.
Chardack, 547 Golfview Drive, advising that he was withdrawing his
application for a variance to install a satellite dish antenna. As a
result item VIII. was being withdrawn from the agenda.

V. Public Hearing
A. Variances
1. Curtis D. Meade, Agent for Sally Mills, 330 Old School
Road, Gulf Stream, F1. 33483 requesting a variance to permit alteration
of a non -conforming structure by the addition of a bay window and closet
projection which would encroach 5.6' into the required 19.4' side yard
and by enclosing an existing open, roofed porch which encroaches 10.3'
Ointo the required 19.5' rear yard setback at the address aforementioned.
Mr. Meade presented the request on behalf of Ms. Mills and added that
the existing porch had originally been enclosed by had been converted
to an open area several years previously. Mr. Lynch moved and Mr. Eaton
seconded that it be recommended to the Board of Adjustment that the
variance be granted as requested and all voted AYE.
2. James B. Orthwein, 330 Banyan Road, Gulf Stream, F1.
33483 requesting a variance to permit the garage doors of a proposed
single family dwelling to be constructed on a corner lot, to face the
side street, said construction to take place on the property located
on the north west corner of Polo Drive and Banyan Road.
There was no one present to represent the applicant regarding the request.
Mr. Brandt, Code Enforcement Officer, advised that this should have
been a part of the variance request for the setbacks that was heard on
March 7, 1990 but that it had not been realized that a variance for the
garage doors would be necessary until after the advertising had been run.
Chairman Mayor noted that if the variance for the setbacks was not
granted by the Board of Adjustment, there would be no need for this
request. Mr. Eaton moved and Mr. Sheehan seconded that no recommendation
to the Board of Adjustment be made with regard to this request due to
the fact that no dceision has been made by the Board of Adjustment with
regard to the request for the setback variance. At a roll call vote,
Mr. Lynch voted Nay, Mrs. Orthwein abstained due to the fact that the
applicant is related by marriage, Mr. Eaton, Mr. Sheehan and Chairman
Mayor voted AYE.
3. Digby Bridges & Associates, Agent for W. T. Young, P. O.
Box 1110, Lexington, Ky. requesting a variance to permit modification
of the floor plan of a proposed single family dwelling by the addition
of a den/study which will encroach 6'4" into the required 22' side
yard setback at 2411 N. Ocean Blvd., Gulf Stream, F1.
Mr. Mark Marsh from the Digby Bridges & Associates firm representing
O Mr. W. T. Young explained that the original design provided for the den
on the west side of the home and the owner, after considering the fact
that he now intends to spend more time in the home, wants to provide
an ocean view from the den. He also stated that it has not been decided
if the addition would have bay windows but the variance that is being
requested would accomodate bay windows. He also pointed out that a
variance had already been granted on the same side for another area
of construction. Mr. Eaton asked if this was on the side next to the
club to which the answer was, yes. Mrs. Orthwein moved and Mr. Eaton
seconded that the Planning Board recommend to the Board of Adjustment
that the variance be granted provided there is a letter of "no objection"
from the Club that can become a part of the file. All voted AYE.
Mr. Marsh advised that he would get such letter.

4. Jean B. Gross, Agent for Mary B. Bromwell estate, 3023
Polo Drive, Gulf Stream, F1. 33483 requesting a variance to permit the
addition of a garage which would encroach 16.38' into the required
41.38' front yard setback of a corner side yard and to permit the
garage doors to face Polo Drive at the address aforementioned.
Mrs. Gross explained the proposed plan and presented an artist rendering
of the property. She advised there was no garage at the present time
O and the setback variance would provide for the addition of one. Chairman
Mayer suggested that the proposed garage be moved farther back so that
the amount of variance requested would not be so great. Mrs. Gross
advised that more closet space was desired and if the garage were to
moved, the new closets could not be included. Mrs. Gross explained the
additional landscaping that would be added also. Mrs. Orthwein moved
and Mr. Lynch seconded that it be recommended to:..the Board of Adjustment
that the variance be granted as requested and all voted AYE.
VI. Site Plan Review
A.Curtis D. Meade, Agent for Sally Mills, 330 Old School Road
Gulf Stream, F1. -Addition of a bay window and closet, enclosure of an
open, roofed porch and installation of a spa.
Mr. Lynch moved and Mrs. Orthwein seconded that it be recommended that
the site plan be approved as presented and all voted AYE.
B. James B. Orthwein, 330 Banyan Road, Gulf Stream F1. -Con-
struction of a single family dwelling having the garage doors facing
the side street on the corner lot located on the north west corner of
Polo Drive and Banyan Road.
Mr. Lynch moved and Mrs. Orthwein seconded that no recommendation to the
Board of Adjustment be made inasmuch as there has been no decision by
the Board of Adjustment on the variance request for setback encroachment.
All voted AYE.
C. Digby Bridges and Associates, Agent for W. T. Young, P. O.
Box 1110, Lexington, Ky.-Modification of a previously approved site
plan for a proposed single family dwelling to permit addition of a den/
study, construction of which will be located at 2411 N. Ocean Blvd.,
Gulf Stream, F1. 33483.
Mr. Lynch moved and Mrs. Orthwein seconded that it be recommended that
amended site plan be approved which includes the relocation of the den.
O provided a letter of "no objection" is obtained from the Club and made
a part of the file. All voted AYE.
D. Jean B. Gross, Agent for Mary B. Bromwell estate, 3023
Polo Drive, Gulf Stream, F1. 33483 -Addition to an existing dwelling
that will include a garage and the installation of a swimming pool.
Mr. Lynch moved, seconded by Mr. Sheehan, that a recommendation be made
to approve the site plan as presented by Mrs. Gross and all voted AYE.
VII. Sign Request
A. Seawood Builders, Inc. requesting permission for a
construction sign to be placed at the construction site at 3545 N. Ocean
Blvd. owned by Patricia Ruggiere.

After determination that the requested sign meets the size requirements
of the Code, Mr. Lynch moved and Mrs. Orthwein seconded that the sign
be permitted as requested and all voted AYE.
VIII. Assignments from the Town Commission
A. The application of Dr. Chardack had been withdrawn from the
agenda under Item IV.
OIX. Items by Staff
A. Report of Construction in Progress. It was moved by Mrs.
Orthwein and seconded by Mr. Sheehan that the report be accepted as
circulated and all voted AYE.
X. Items by Board Members
A. Chairman Mayer -Reconsideration of proposed Landmark Preserv-
ation Ordinance.
Chairman Mayer advised that at the last meeting the Planning Board had
recommended that no local legislation be adopted with regard to Historic
Landmark Preservation and that those wishing to place their property on
the list of Historic Landmarks could do so with higher agencies. He
went on to advise that it has since been determined that the State
Planning Act mandates that this be addressed in local Comprehensive
Plans and that has been done in the Gulf Stream Plan. It now follows
that it must be implemented with legislation so it will be necessary to
have some type of local legislation. He suggested that an Ordinance
be prepared that would include provisions only to the extent that is
needed to implement the plan with a listing of properties to be compiled
from those requesting to be listed and that a review procedure be
established for those properties utilizing the Planning Board for the
first review and the Board of Adjustment, or Town Commission being the
second review body. The suggestion of the Chairman was placed before
the Planning Board in the form of a motion by Mr. Lynch which was
seconded by Mrs. Orthwein and all voted AYE.
Chairman Mayer announced that a request for a site plan review had been
received from The Little Club and in an effort to accommodate them and
allow them to expedite their project, he is calling a Special Meeting
at 3:45 P.M. on April 17, 1990, just ahead of the joint workshop meeting,
to review the plan. All members acknowledged they would be in attendance.
