NOTICE IS HEREBY GIVEN that the Planning Board of the 'Town of Gulf
Stream will hold a Public Hearing on Wednesday, June 6, 1990 at
9:00 A.M. and the Town Commission, sitting as the Board of Adjustment,
will hold a Public Hearing on Friday, June 15, 1990 at 9:00 A.M., both
in the Commission Chambers at the Town Hall, 100 Sea Road, Gulf Stream,
Florida at which the following will be considered:
1. An application submitted by Ettore and Lovedy P. Barbatelli,
520 Middle Road, Gulf Stream, Florida 33483 requesting a
variance from the provisions of the following:
Ordinance 83-1; ZONING, Part II; COMPREHENSIVE ZONING
ORDINANCE, Section VII; "RS" RESIDENTIAL SINGLE-FAMILY
DISTRICT, Sub Section K; Side Yard Required, Paragraph
Ordinance 83-1; ZONING, Part II; COMPREHENSIVE ZONING
ORDINANCE, Section X; GENERAL PROVISIONS, Sub Section F;
Garages, Storage Facilities, Etc., Paragraph 2.

to permit the extension of a non -conforming structure by an
addition to the existing garage of four hundred five (405)
square feet that would encroach approximately eleven and
two tenths (11.2) feet into the required twenty one and
two tenths (21.2) foot side yard setback and to permit the
garage doors to continue to face Middle Road at the address
aforementioned which is legally described as all of Lots
19 and 20 Gulf Stream Cove Subdivision, less a portion of
Lot 20.
2. An application submitted by Gustavo J. Carbonell, Agent
for Janet W. Parker, 3525 Polo Drive, Gulf Stream, Florida
33483 requesting a variance from the following:

III. Minutes
A. Mr. Lynch moved and Mrs. Orthwein seconded that the minutes
of the Regular Meeting of May 9, 1990 be approved as circulated and all
voted AYE.
B. Mr. Lynch moved and Mrs. Orthwein seconded that the minutes
of the Joint Workshop Meeting of May 9, 1990 be approved as circulated
and all voted AYE.
IV. Additions, withdrawals, deferrals, arran ement of agenda items.
Mr. Brandt asked to have a letter of request from Mouw Associates
Placed on the agenda as item VIII. B.
V. PUBLIC HEARING
A. Variances
1. Ettore and Lovedy P. Barbatelli, 520 Middle Road, Gulf
Stream, Florida 33483 requesting a variance to permit
extension of a non -conforming structure by an addition
of 405 square feet to the existing garage that would
encroach approximately 11.2' into the required 21.2' side
setback and to permit the garage doors to continue to face
Middle Road at the address aforementioned.
Mr. Lynch pointed out that the extension of the garage followed the
line of the existing structure and that the garage doors faced the street
at this time. Mr. Lynch then moved that it be recommended to the Board
of Adjustment that the variance be approved as requested. The motion
was seconded by Mr. Eaton after determining that no objections had been
received from the neighbors. All voted AYE.
O2. Gustavo J. Carbonell, Agent for Janet Parker, 3525 Polo
Drive, Gulf Stream, Florida 33483 requesting a variance to
permit the addition of a bathroom which would encroach 7.2'
into the front yard setback of a corner side yard, the
proposed floor elevation being that of the existing dwelling,
6.1' above zero sea level at the address aforementioned.
Mr. Eaton asked if there had been any objections to the proposal. He was
advised that none had been received. Chairman Mayer called attention to
justification that was submitted by the applicant wherein in it was stated
that it was necessary to enlarge bathroom facilities to accomodate a
whirlpool type tub for therpy. Mr. Sheehan moved and Mrs. Orthwein seconded
that it be recommended to the Board of Adjustment that the variance be
granted as requested and all voted AYE.

VI. Site'Plan Review
A. Ettore and Lovedy P. Barbatelli, 520 Middle Road, Gulf Stream,
Florida 33483 -Extension of an existing garage.
Mr. Lynch moved and Mr. Sheehan Seconded that the Planning Board recommend
to the Town Commission that the site plan be approved and all voted AYE.
B. Gustavo J. Carbonell, Agent for Janet Parker, 3-25 Polo Drive,
Gulf Stream, Florida 33483 -Addition of a bathroom.
OMr. Sheehan moved and Mr. Eaton seconded that the recommendation to the
Town Commission be that the site plan be approved as requested and all
voted AYE.
C. Place Au Soleil Homeowners Association, Gulf Stream, Florida
33483 -Installation of a decorative entrance wall.
Mr. Brandt explained that if the wall were to be permitted, the existing
identification sign would be removed from it's location and affixed to the
new wall. Mr. Sheehan ask if there had been any comments from residents
of the development. Mr. Brandt advised that he had received a few
comments regarding the wall, some of which questioned the need for one
and others directed to the proposed height of 5', suggesting a 4' height
might be better. Mr. Lynch moved that the Planning Board recommend to
the Town Commission that the request be granted provided the height be
reduced to 4' maximum. The motion was seconded by Mr. Sheehan and all
voted AYE.
D. R. S. Harrell of North South Construction Corp. as Agent for
William Walsh, 2010 Lindell Boulevard, Delray Beach, Florida 33444 -
Amending an approved site plan to relocate the unattached garage from the
S. W. corner to become an attached garage to the N. W. corner of the
dwelling to be located at 3501 N. Ocean Blvd., Gulf Stream, F1. 33483.
Mr. Brandt advised that this change of design does meet the codes and
no variances are required. Mr. Lynch moved and Mrs. Orthwein seconded
that the Planning Board recommend to the Town Commission that the site
plan amendment be approved as requested and the motion was seconded by
Mrs. Orthwein. All voted AYE.
E. Curtis D. Meade, Agent for James T. Pearce, Jr. 3737 N. Ocean
Blvd., Gulf Stream, F1. 33483 -Reconstruction of a pool cabana partially
destroyed by fire.
Mr. Sheehan questioned if the reconstructed structure would be exactly
O the same as had been there before and in the same location. Mr. Brandt
stated that this was true and that they are using the same drawings as
had been used originally except for updating to current safety codes.
Mr. Lynch moved that it be recommended to the Town Commission that the
site plan be approved as presented and Mrs. Orthwein seconded the motion.
All voted AYE.
VII. Sign Requests

Mr. Bridges was recognized and explained that he was only requesting signs
of three sq. ft. even tho a 6 sq. foot sign was permitted. He explained
that the reason for this was that an additional 3 sq. ft. would be availabl
to accomodate a sign for the contractor. Mr. Brandt confirmed that the
code permits one sign of not more than 6 sq. ft. Mr. Lynch moved that
Mr. Bridge's request be granted for all five locations and the motion
was seconded by Mr. Sheehan. All voted AYE.
VIII. Items by Staff
A. Report of Construction in Progress.
It was noted that there is a total of $11,070,180.00 worth of construction
in progress at this time.
B. Letter of request from Mouw Associates
A letter requesting permission to commence construction work at 7 A.M.
at the Bath & Tennis Club rather than the permitted 8 A.M. was read.
The letter was addressed to Mr. Brandt but it was noted that Mr. Brandt
or the Town Manager do not have authority to grant special consideration
for a period of longer than 3 days duration.
Mr. Sheehan moved and Mr. Lynch seconded that it be recommended to the
Town Commission that the special request be granted and all voted AYE.
IX. Items by Board Members
A. Historical Preservation Ordinance -Chairman Mayer.
Chairman Mayer advised that he was aware that no ordinance had been
prepared as yet but he once again asked to have comments from the Board
regarding this proposed ordinance. All members agreed that the historical
issue must be addressed since it is required as a part of the Comprehensive
Plan. However, all agreed that landmark designating should only be
done on a voluntairy basis with the request to come from the property
owner. The Town Clerk advised that the Attorney was directed to prepare
the ordinance and the Town Commission had assured that there would be a
public hearing held during the season prior to any adoption.

There was no comment from the Public.
