NOTICE IS HEREBY GIVEN that the Planning Board of the Town
of Gulf Stream will hold a Public Hearing on Wednesday, July 11, 1990
at 9:00 A.M. and the Town Commission will hold a Public Hearing on
Friday, July 13, 1990 at 9:00 A.M., both in the Commission Chambers
at the Town Hall, Gulf Stream, Florida at which the following will
be considered:
An application for a Special Exception submitted by
Del Swilley, Inc. to permit the placement of a
construction trailer as provided in Ordinance No. 83-1;
ZONING, Part II; COMPREHENSIVE ZONING ORDINANCE, Section
VII; "RS" RESIDENTIAL SINGLE-FAMILY DISTRICT, Sub Section
D; SPECIAL EXCEPTIONS, Paragraph 1. of no greater than five
hundred (500) square feet in size, approximately sixty
four (64) feet from the front property line and approximately
twenty four (24) feet from the north side property line
at 2411 North Ocean Blvd., Gulf Stream, Florida which
is owned by Mr. & Mrs. William T. Young.
ALL PERSONS INTERESTED in the matter may appear before the
Gulf Stream Planning Board and the Town Commission at the times
and place aforesaid and be heard.
SHOULD ANY INTERESTED PARTY SEEK TO APPEAL ANY DECISION MADE BY THE
PLANNING BOARD OR THE TOWN COMMISSION WITH RESPECT TO ANY MATTER
CONSIDERED AT THIS PUBLIC HEARING, SAID PARTY WILL NEED A RECORD OF THE
PROCEEDINGS, AND FOR SUCH PURPOSE, MAY NEED TO INSURE THAT A VERBATIM
RECORD OF THE PROCEEDINGS IS MADE, WHICH RECORD INCLUDES THE TESTIMONY

REGULAR MEETING AND PUBLIC HEARING OF THE PLANNING BOARD OF THE TOWN

I. The meeting was called to order at 9:00 A.M. by Chairman Mayer.

III. Minutes
Mr. Eaton moved and Mr. Sheehan seconded that the minutes of the
Regular Meeting and Public Hearing of June 6, 1990 be approved as
circulated and all voted AYE.
IV. Additions, withdrawals, deferrals, arranqement of aqenda items.
Mr. Eaton advised that Mayor Koch had requested that the Plannin
Board re -review the variance application submitted by Ettore Barbatelli
in that the Board of Adjustment had deferred action on the matter until
July 13, 1990. He suggested that the re -review be added to the agenda.
There being no objections, the Clerk assigned the item number IX. A.
V. PUBLIC HEARING
A. Special Exceptions
1. Del Swilley, Inc., 12610 Webb Ave., Unit 8, Delray Beach,
Florida 33444 requesting permission to place a construction
trailer on the construction site at 2411 N. Ocean Blvd.,
Gulf Stream, Florida which is owned by Mr. & Mrs. William
Young, that would be located approximately 64' from the
front property line and approximately 24' from the north
side property line at the address aforementioned.
Mr. Eaton question if Mr. Brandt had checked out the site to which
Mr. Brandt replied that while he had not visited the site, he had
determined the location to be acceptable and went on to add that the
applicant has requested to cut an opening in the existing wall to
enable the construction vehicles to access the site since the existing
driveway is shared by other dwellings and is very narrow. All members
of the Planning Board agreed that this was necessary and Mr. Eaton
O moved that placement of the construction trailer be recommended.
The motion was seconded by Mr. Sheehan and all voted AYE.
VI. Site Plan Review
A. Samuel Ogren, Jr., Agent for Steven D. Wymer, 2401 Santiago,
Newport Beach, California 92660 -Construction of a single

described as the north 201 feet of the sough 309 feet of
Lot 4, Gulf Stream Ocean Tracts, Gulf Stream, Florida.
Mr.Richard Brandt, Code Enforcement Officer, advised that while there
was a complete site plan presented, there were no building elevations
included for the garage. He also advised that the County would require

a separate permit for the garage. Mr. Brandt was of the opinion that
consideration could be given to the plan as presented, withholding a
recommendation on the garage until building elevations had been reviewed.
Mr. Brandt also pointed out that the site plan indicates that one Pine
Tree would be removed to provide access to the property off AlA and
that the Town had declared Zoning in Progress which would include the
possibility of declaring the trees along AlA a historical district and
giving them a Landmark designation. It was determined that removing
one tree was the only means of access. Mr. Sheehan moved and Mr. Eaton
O seconded that it be recommended that the site plan be approved as
submitted with the exception of the garage for which there were no
drawings submitted. All voted AYE.
VII. Sign Request
A. Del Swilley, Inc. requesting permission to place a
construction sign at 2411 N. Ocean Blvd., owned by Wm. Young.
Mr. Eaton asked if the sign meets the code requirements to which Mr.
Brandt replied that it did. Mr. Eaton moved and Mr. Sheehan seconded
that the sign be approved and all voted AYE.
VIII. Items by Staff
A. Report of Construction in Progress
The report prepared by Mr. Brandt revealed there to be construction
in progress in the amount of $10,295,798.00.
IX. Items by Board Members
A. RE -review of variance application submitted by Ettore and
Lovedy P. Barbatelli, 520 Middle Road, Gulf Stream, Florida
33483 requesting a variance to permit extension of a non-
conforming structure by an addition of 405 square feet to
the existing garage that would encroach approximately 11.2'
into the required 21.2' side setback and to permit the garage
doors to continue to face Middle Road at the address
aforementioned.
Mr. Eaton repeated that Mayor Koch had asked the Board to re -review the
application and report their recommendation to the Board of Adjustment
at their meeting of July 13, 1990. He stated that he and Chairman
Mayer had visited the site and confirmed that the garage doors are
facing the street at this time and that the proposed addition would not
intrude into the setback a greater distance that the existing structure.
He pointed out that there were no objections to the addition from any
of the neighbors. Mr. Eaton moved that it be recommend to the Board of
O Adjustment that the variance be granted as requested. The motion was
seconded by Mr. Sheehan and all voted AYE.

There was no comment from the public.
XI. Adjournment
Mr. Eaton moved that the meeting be adjourned, seconded by Mr. Sheehan.
Chairman Mayer adjourned the meeting at 9:20 A.M.
