NOTICE IS HEREBY GIVEN that the Planning Board of the Town
of Gulf Stream will hold a Public Hearing on Wednesday, August 1, 1990
at 9:00 A.M. and the Town Commission will hold a Public Hearing on
Friday, August 10, 1990 at 9:00 A.M., both in the Chambers of the
Town Commission at the Town Hall, 100 Sea Road, Gulf Stream, Fl. 33483
at which the following will be considered:
An application for a Special Exception submitted by
Del Swilley, Inc., 12610 Webb Ave., Unit 8, Delray
Beach, F1. to permit the placement of a'
construction
shed as provided in ORDINANCE No. 83-1; ZONING, Part II;
COMPREHENSIVE ZONING ORDINANCE, Sub Section D; SPECIAL
EXCEPTIONS, Paragraph 1. of no greater than five hundered
(500) square feet in size, approximately two hundred forty
(240) feet from the front property line and approximately
thirty two (32) feet south of the existing fence on the
north side of the building site at 1601 North Ocean Blvd.,
Gulf Stream, Florida which is owned by Mr. & Mrs. John
McGraw.
ALL PERSONS INTERESTED in the matter may appear before the
Gulf Stream Planning Board and the Town Commission at the times and place
aforesaid and be heard.
SHOULD ANY INTERESTED PARTY SEEK TO APPEAL ANY DECISION MADE BY THE
PLANNING BOARD OR THE TOWN COMMISSION WITH RESPECT TO ANY MATTER
CONSIDERED AT THESE PUBLIC HEARINGS, SAID PARTY WILL NEED A RECORD OF
THE PROCEEDINGS, AND FOR SUCH PURPOSE, MAY NEED TO INSURE THAT A
VERBATIM RECORD OF THE PROCEEDINGS IS MADE, WHICH RECORD INCLUDES THE

III. Minutes
Mrs. Orthwein moved and Mr. Eaton seconded that the minutes of the
Regular Meeting and Public Hearing of July 11, 1990 be approved as
circulated and all voted AYE.
IV. Additions, withdrawals, deferrals, arrangement of agenda items.
There were no requests.
V. PUBLIC HEARING
A. Special Exceptions
1. Del Swilley, Inc., 12610 Webb Ave., Unit 8, Delray Beach,
Florida 33444 requesting permission to place a constructioi
shed on the site at 1601 N. Ocean Blvd., Gulf Stream,
Florida owned by Mr. & Mrs. John McGraw that would be
located approximately 240' east of the front property line
and approximately 32' south of existing fence on the north
side of the site at the address aforementioned.
Mr. Richard Brandt, Code Enforcement officer pointed out that the Gulf
Stream Code makes reference to construction trailers but says nothing
about construction sheds He noted that the shed requested is only
8'x12', much smaller than the maximum size trailer permitted. It was
further explained that Mr. Swilley would have to present construction
drawings for County review,and a building permit obtained. Mr. Sheehan
questioned if the shed would only be permitted for the same length of
time as a trailer. Mr. Brandt advised that the same rules would apply,
the permit being granted for only 6 months with a renewal option.
Mr. Eaton moved and Mrs. Orthwein seconded that the Planning Board
recommend to the Town Commission that the special exception be granted
as requested and all voted AYE.
VI. Site Plan Review
James B. Orthwein, Jr., 330 Banyan Road, Gulf Stream, Florida -
Modification of a previously approved site plan for a proposed
single family dwelling to permit the addition of a retaining
wall at the property line adjacent to Polo Drive and Banyan Rd.,
the height of which would be 2'6" above existing grade. The
location of the proposed single family dwelling is on the north-
west corner of Polo Dr. and Banyan Road.
Mr. Brandt, Code Enforcement Officer explained that due to the grade of
the street being approximately 5'.below that of the proposed garage
floor, the cars parked in the driveway would stand at a "tipped" angle
unless the grade is leveled off. He proposes to fill the property to
the top of the retaining wall. He pointed out that the drainage plan
has been modified to retain the surface drainage on site for the first
inch of rainfall.

Mrs. Orthwein stated that she is abstaining from participation in this
matter due to the fact that she is related by marriage, being a sister-
in-law to the applicant.
Mr. Eaton asked for an explanation as to how the maximum height is
determined. Mr. Brandt explained that the finished floor must be a
minimum of 7' above zero sea level and the maximum height of the
dwelling must not exceed 35' as measured from the finished floor slab.
He pointed out while there is a minimum of 7' above zero for the floor
Oelevation, there is no maximum limitation.
Mr. Eaton moved and Mr. Sheehan seconded that it be recommended to the
Town Commission that the amended site plan be approved as requested.

VII Sign Request
A. Del Swilley, Inc. requesting permission to place a constructio:
sign at 1601 N. Ocean Blvd., owned by Mr. & Mrs. John McGraw.
Mr. Eaton inquired if the sign meets the code requirements to which
Mr. Brandt replied that it did. Mrs. Orthwein moved and Mr. Sheehan
seconded that the sign be approved and all voted AYE.
VIII. Items by Staff
The report prepared by Mr. Brandt revealed there to be construction
in progress in the amount of $11,060,518.00.
Mr. Brandt offered as information the fact that the house under
construction owned by Mr. Woolley and located at 3111 N. Ocean Blvd.
is being roofed with flat tile of a light blue color and he has received
fa%Drable comments regarding this. However, he advised that he has now
received some comments that are negative in this regard. The notes on
the original drawings indicated that the owner had originally planned
to use barrel tile. Mr. Eaton commented that our Codes do not
restrict the color or style of roofs. Mr. Brandt concurred and stated
once again that he only offers this as an information item.

X. Public
Mrs. Joan LaPorte was recognized and commented that it appears
O that the very small pool that is being constructed at 3434 Oleander
Way was very close to the lot line but that it was very heavily screened.
The Board advised that the resident applied for a variance to construct
the pool and supported the request with a letter from the doctor stating
that the resident needed the pool for therapy for a back problem.

XI. Adjournment
Mr. Sheehan moved and Mrs. Orthwein seconded that the meeting
be adjourned and Chairman Mayer adjourned the meeting at 9:30 A.M.
following a unanimous vote to do so.
