Low Speed Vehicles (LSVs). No Low Speed Vehicles (LSVs), as defined in 49 CFR s. 571.3(b), ay be operated on any public roadway within the Borough. The oregoing prohibition shall not apply to any LSV being operated u def the auspices of a governmental entity. Section 2. All Ordinances and/or provisions thereof inconsistent with the provision of this Ordinance shall b and are hereby repealed as to the extent of any such inconsistenc es. Section 3. If any section, subsection, part, cIa se or phrase of this Ordinance shall be declared invalid by judgm nt of any Court of competent jurisdiction, the section, subsectio , part, clause or phrase shall be deemed to be sever able from th remainder of this Ordinance. The vehicle cannot be powered by gas or esel fuel and must comply with federal safety standards as noted in 49 CFR 5.571 ,500. Municipalities may ban these veblcles on aU their roads by ordinance under this Dew law. In recognition of the fact that the I w will allow these vehicles on 25 per mile municipal streets before it will be possible or municipalities to put such an ordinance in place, the Motor Vehicle Commission has a eed as a courtesy to temporarily put a list of m\lI1icipalities who have notified the Commi sion of plans to ban LSV's on their website, so that residents will be infò 0 e an e re purc asing and licensing the velùcles. Until further notice. if your municipality plans to an LSVs, you may fax an advisory of that fact to Daria Gerard of the MVC at 609-984-13 O. If you would like a call to confinn receipt, you must put the phone number and contact son on the fax. The following are some general guidelines fo LSV's: · LSVs may not be driven on roadw s with speed limits that exceed 25 mph. In limited cases, if deemed appropriate b a municipality or county or DOT, LSVs may be permitted on roadways with speed imits that do not exceed 35 mph. · LSV operators should watch for and abide by road signs prohibiting use even on lower speed roads. . LSV s may not be modified golf carts. · An LSV must have a 17 digit Vehicle dentification Number, . Clùld restraints in LSVs must meet e same standards as clùld restraints used in passenger vehicles, · LSVs must be operated by a person with a valid driver license only (no permits, provisional or suspended licenses). · Properly titled, registered and insured LSVs may be leased or rented for temporary use. · An LSV may be registered in the n e of an individUàl, business or government entity, but may not be used as a comm ial vehicle. · LSVs and their owners/operators are subject to e same motor vehicle violations as other vehicles and drivers except for the regular inspe<: ion requirements. . All LSVs shall have a safety infonnation de<:al, provided by the manufacturer, affixed in a conspicuous place on the rear of the vehic e. The decal shall display in prominent lettering "25 MPH Vehicle." . LSV s displaying only one license plate shall hay that license plate affixed on the rear of the car, More information on this new law will be available on the MVC website, htto://www.ni.l!ov/mvc/. The Department of Transpo lion will issue guidelines on the notice that municipalities must provide to DOT to ban or limit the use of these vehicles on their roads.
