NOTICE IS HEREBY GIVEN that the Planning Board of the Town of Gulf
Stream will hold a Public Hearing on Wednesday, December 5, 1990 at
9:00 A.M. and the Town Commission, sitting as the Board of Adjustment,
will hold a Public Hearing on Friday, December 14, 1990 at 9:00 A.M.,
both in the Commission Chambers at the Town Hall, 100 Sea Road, Gulf
Stream, Florida at which the following will be considered;
An application submitted by Digby Bridges, Marsh and
Associates, Agent for Mr. & Mrs. Alan Sipp, 3435 N.
Ocean Blvd., Gulf Stream, F1. 33483 requesting a
variance from the provisions of
Ordinance 83-1; ZONING, Part II; COMPREHENSIVE
ZONING ORDINANCE, Section VII; "RS" RESIDENTIAL
SINGLE-FAMILY DISTRICT, Sub Section K; Side Yard
Required, Paragraph 1.
to permit installation of a spa which would encroach three feet ten
inches (3'10") into the required fifteen (15) foot north side yard
setback, spa equipment which would encroach five (5) feet into the
required fifteen (15) foot north side yard setback, and an outside
shower which would be placed abutting the north property line at
the address aforementioned which is legally described as a portion
of Lot 6, Gulf Stream Ocean Tracts.

V. PUBLIC HEARING
A. Variance
1. Digby Bridges, Marsh and. Associate's, Agent for Mr. & Mrs.
Alan Sipp, 3435 N. Ocean Blvd., Gulf Stream, F1. 33483
requesting a variance to permit installation of a spa which
would encroach 314" into the required 15' north side yard
setback, spa equipment which would encroach 5' into the
required 15' side yard setback, and an outside shower which
would be placed abutting the north property line at the
address aforementioned which is legally described as a
portion of Lot 6, Gulf Stream Ocean Tracts.
Mr. Mark Marsh, representing the owner, advised that the spa had been shown
on the site plan that was approved but that there were no dimensions shown
as to how far from the lot lines it would be. He advised it was located on
the landscape drawings in the location that they are requesting to place it.
He further advised that the requested location is behind the building line
established for the dwelling thru a previous variance procedure. He stated
that he questioned the need for applying for a variance but the staff had
felt that it was not a part of the original variance request for the dwelling
and should therefore be addressed. Mrs. Orthwein asked what hardship was
being claimed in this request. Mr. Marsh replied that he assumed it would
be the same hardship that was claimed in the variance request to construct
the dwelling but did not relate what that was. Mr. Eaton inquired i"f there
had been any objections from the neighbors and.was a -'.wised there were none.

Mr. Lynch and Mr. Eaton advised they would like to be certain that the
neighbor on the south had no objection to the location of the items contained
in the variance request. Mrs. Orthwein and Chairman Mayer stated they did
not feel a hardship had been proven as to why the provisions could not be
met. Mr. Lynch moved that it be recommended to the Town Commission that the
variances be approved as requested provided the applicant presents a letter
from the property owner on the south stating that there is no objection to
the granting of the variance request. The motion was seconded by Mr. Eaton.

2. Mr. & Mrs. Mason Heydt, 2883 Banyan Blvd., Circle N.W., Boca
Raton, F1. 33431 requesting a variance to permit construction
of a dock which will encroach 14;' into the required 29'x' east
side yard setback and to permit the addition of two bay window
to a nonconforming structure, one of which will encroach
fourteen and one quarter (14.25) feet into the required twenty
nine and one quarter (29.25) foot east side yard setback and
to permit the floor elevation, that being six and four tenths
(6.4) feet above zero sea level, of the existing non conformin,
dwelling, to remain at that elevation while adding a sub-
stantial addition which will have a conforming floor elevation
of more than seven (7) feet above zero sea level at 541
Banyan Road, legally described as Lots 2 & 3, Block 3, Plat
#1, Polo Fields Subdivision.
Mr. Heydt introduced himself and gave a brief family history and reasons for
wanting to live in Gulf Stream. He advised that he had purchased the
property in Gulf Stream within a few days of it's becoming available and
had then placed his home in Boca on the market. He further advised that his
Boca property sold within 3 days of placing it on the market and quite
naturally he wanted to expedite the renovations to the Gulf Stream property.
He stated that in his haste to do so, he had not taken the time to look
at the Town and the neighborhood character resulting in the first submission
of proposed improvements having to be discarded. He related that he had
subsequently become aware of objections to the proposed improvements and
stated that at this time he was reducing the size of the dock to one which
would extend only five (5) feet from the sea wall but that he was still
requesting the variance of the side set back requirement since all others in
the area were at fifteen foot from the property line as he is requesting and
the fact that he wanted to be as far away from the Intracoastal Waterway as
possible. Mr. Heydt further advised that he also removed the driveway
from the west side of the property and that the proposed garage on the west
would be only used to store his antique cars which only leave the garage
three or four times a year. He stated there would be no work done on them
other than to wash and wax. Mr. Heydt pointed out that the west garage doors
Owill not be visible from the street and that there is also an existing hedge
that will be left in tact as a buffer from the street. He stated that he
felt the garage would be acceptable in that location due to the dwelling
on the west having the garage on the east side only 10' from the property
line. Mr. Heydt then introduced Mr. Edward Bywatters, his architect. Mr.
Bywatters displayed drawing of the proposed structure and explained that this
had been redesigned since the material had been distributed to the Planning
Board in an effort to address some of the objections of the neighbors. He
pointed out that a new connecting gable between the two structures had been
added and that all windows would be changed in the existing house and replace
with wood casement windows to match the addition. He further pointed to the
added bay windows with copper roofs and stated that on the canal side, there
would be a large open area under awning rather than having an enclosed,
air6onditioned area as originally planned. He stated the house would be
140' in length but added it was on the equivalent of two lots.

Mr. Henry Wright from the audience was encouraged by what had been said and
felt that something could be worked out to everyones satisfaction.
Mr. James Stenson questioned how many cars and boats would be parked at the
residence to which Mr. Heydt replied there would be four cars which included
two antique cars and two boats, one a 33' and one an antique 20' Chris Craft
which he did not leave in the water more than four or five days at a time
and is stored on a trailer at his factory. Mr. Stenson stated that he was
opposed to there being two garages and felt that the antique cars could be
\� stored in the existing garage and the other two parked on the driveway. Mr.
\� Heydt felt this would be a hardship as he feels the cars should be protected
in a building and pointed out that 11 homes in Gulf Stream have awning
garages. He was advised that that is no longer permitted.
Mrs. James Stenson objected to the appearance of the addition remarking that
rather than trying to make the existing house look like a part of the new
addition, it would be better to design the new addition to fit the style of
the existing house. Mr. Bywatters felt that if the Board and the residents
could see the proposed- structure in three dimension, they would feel
differently about it.
Mrs. Charles Winston questioned how many square feet were in the dwelling as
proposed and how many in the garage. Mr. Bywatters advised that there are
6,500 sq. feet in the dwelling and 560 sq. feet in the garage.
Mr. James Orthwein expressed appreciation for Mr. Heydt's openness and
expressed his concern about the amount of garage space that would be availabl
in the event the property were to be sold in the future. He feared that
the extra garage space that Mr. Heydt would use for storing the antique
would become an "active" garage.
Attorney Jeffrey Thistle, representing the concerned property owners,
observed that more discussion will probably be required since all of the
changes had just been made and there had been no time to review them. He
went on record for the property owners that they were opposed to any
variance being given for the loc tion of the dock. He also voiced the
concerns of his clients regard/iN bulk or mass of the building as proposed.
Mr. Heydt stated that he would withdraw the variance request for the location
of the dock and it would be placed at 30' from the property line.
Mr. Wright suggested that any decision on this matter be postponed and
that the property owners and the Heydt's confer further.
Mrs. Orthwein noted that the portion of the variance request dealing with
the floor elevation cannot be addressed until the questions regarding the
Oextent of the non -conformity of the structure is decided.
Chairman Mayer observed that while some of the objections to the development
had been resolved, there were still several areas of concern. He suggested
that the two groups get together to resolve them. Mr. Heydt agreed but
urged that it be done at once.
Mr. Charles Velie expressed concern with the mass or bulk of the structure.
He suggested that some consideration be given to restricting the amount of
square footage being permitted in the second story. He felt the proposed
structure is out of character with the neighborhood.
Correspondence objecting to proposed improvements from Charles Hallock,
Alexander Stokes, Manes Stenson, William Souder, Henry Wright, James
Orthwein and Charles Duryea was made a part of the record.

Mr. Bywatters called attention to a two story house under construction
on the corner of the same block as Mr. Heydt's property and observed that
a much larger percentage of the lot is being covered than what Mr. Heydt
proposes. Mr. Heydt stated that he will have over 608 green space after
removing the proposed driveway and he wanted this in order to provide his
children and their friends as much area for recreation as possible.
Chairman Mayer felt that no recommendation could be made until the surroundii
Oproperty owners were in agreement with the Heydt's proposal.
Mrs. Orthwein moved that no further consideration be given to a recom-
mendation until such time as the parties involved have had an opportunity
to resolve their differences, but with that being no later than the date
of the next meeting. The motion was seconded by Mr. Sheehan and all voted
AYE.
3. Digby Bridges, Marsh & Associates, Agent for Mrs. Jane B.
Speer, 2817 N. Ocean Blvd., Gulf Stream, F1. requesting
a variance to permit construction of a dwelling and accessory
structures on a parcel of land on which there currently
exists a dwelling and:accessory structures which would
result in there being 2 dwelling units in a single-family
zoning district; AND/OR ALTERNATIVELY to permit, in the
event the parcel of land is divided to create a lot of
approximately 100' and a lot of approximately 200' in
width, the existing bath house which would be located across
the newly created property line dividing the parcel to
remain, resulting in an encroachment of 30' into the required
30' south side yard setback on the 200' lot and an encroach-
ment of 15' into the north side yard setback on the 100'
lot at the address aforementioned, legally described
as the North 300' of Government Lot 3 Section 3/46/43.
Mr. Marsh, Agent for Mrs. Speer explained that he had originally requested
the variance to permit the encroachment of the bath house on the south
100' that was planned as the site of a single family dwelling. The
encroachment, he explained would be removed at the sale of either parcel
of property or at making application for renovations to the existing house
on the north 2001. Attorney Randolph had requested that an alternative
variance also be included, considering the parcel of land as one lot and
asking a variance to construct a second dwelling on the lot in a single
family residential district. Mrs. Orthwein questioned what the hardship
was to justify this request to which Mr. Marsh replied that Mrs. Speer
owned both properties and would be moving into the new dwelling with
possibly other members of her family using the existing home. He said that
the bath house would be used by both and the hardship would be that Mrs.
Speer would be denied the facility if it were to be removed. Mr. Brandt
reminded that there had been a similar situation in Town and that the
property owner had been required to cut off the portion of the building
across the line before he was issued a building permit for the vacant
parcel. Mr. Lynch moved to recommend to the Town Commission that the
encroachment of the bath house on both the 100' and the 200' parcels be
permitted until such time as construction of the new dwelling is completed
but that no Certificate of Occupancy shall be issued until the bath house
is removed. The motion was seconded by Mrs. Orthwein and all voted AYE.
At this point, Mr. Lynch left the meeting.

B. Special Exception
1. Lisa Dunlevie, Agent for Steven Wymer, requesting permission
to place a construction trailer that would be located
approximately 75' from the front property line and 75' from
the north side property line at the construction site of a
single family dwelling owned by Mr. & Mrs. Steven Wymer at
3223 N. Ocean Blvd., Gulf Stream, F1.
Mrs. Orthwein moved and Mr. Eaton seconded that it be recommended to the
oTown Commission that the special exception request be granted as requested
and all voted AYE.
VI. Site Plan Review
A. Digby Bridges, Marsh & Associates, Agent for Mr. & Mrs. Alan
Sipp, 3435 N. Ocean Blvd., Gulf Stream, F1. 33483 -Installation
of a spa, spa equipment and an outside shower which was either
not shown on the original site plan for the new single family
dwelling or had been shown in a different location.
Mr. Eaton moved and Mr. Sheehan seconded that it be recommended to the Town
Commission that the site plan be approved provided the applicant submits a
letter from the property owner on the south stating that he has no objection
to the location of the items on the application. All voted AYE.
B. Mr. & Mrs. Mason Heydt, 2883 Banyan Blvd., Circle N.W., Boca Raton
F1. 33431 -Improvements to existing structure, two story addition
to existing structure and installation of a dock at 541 Banyan
Road, Gulf Stream, F1. 33483.
Mr. Eaton remarked that he would like to revisit the matter of the requested
variances considered earlier on the agenda that were submitted by Mr. Heydt
in view of the time constraints outlined by the Heydt's. It was pointed
out that not much could be done until Mr. Heydt had conferred with the
surrounding property owners. Mr. Eaton moved to reconsider the matter of
the variance request, seconded by Mr. Sheehan and all voted AYE. Mr. Eaton
thEnsuggested that perhaps a recommendation could be made to the Town
Commission contingent upon an agreement with the other property owners being
reached. Some discussion followed during which it was stated that since a
great amount of interest and concern was. demonstrated in this matter, it
would seem to dictate that the Planning Board must review any new submission
to determine if any of the agreed upon changes violated the codes in other
areas. With that in mind, Mr. Eaton moved to recind his motion to reconsider
the variance request, seconded by Mr. Sheehan and all voted AYE. Mrs.
Orthwein then moved that the recommendation to the Town Commission regarding
the site plan review of the proposed improvements submitted by Mr. Heydt
be held at the meeting wherein the variance request will once again be
considered. The motion was seconded by Mr. Sheehan and all voted AYE.
Chairman Mayer stated that if some sort of an agreement between the Heydt's
and the surrounding property owners was reached prior to. the Town Commission
Meeting of December 14, 1990, he would call a Special Meeting.

Mrs. Orthwein moved and Mr. Sheehan seconded that it be recommended to the
Town Commission that the site plan be approved as presented and all voted AYE.

Mark Marsh advised that he had asked to have the site plan review even tho
it was not known at the time as to whether any variances would be granted
for the bath house encroachment. He explained that the proposed single
family dwelling met all requirements of the proposed zoning changes and
no variances would be required. Mr. Brandt advised that in reviewing the
drawings it was noted that the garage doors faced AlA. He stated that this
was not considered in the variance considerations as the documents and
drawings for the site plan review were not received until the deadline for
the advertising had passed. Mr. Marsh then requested that a recommendation
for the site plan be rendered excluding the garage which could be addressed
at a later time since it is not attached to the dwelling.
Mrs. Orthwein moved that the site plan be recommended for approval excluding
the garage. The motion was -seconded by Mr. Sheehan and all voted AYE.
