Mr. & Mrs. Mason Heydt, 2883 Banyan Blvd., Circle N.W., Boca Raton, Fl. 33431 requesting a variance to permit construction of a second story to an existing non -conforming dwelling which would encroach 5.25' into the required 29.25' east side yard setback; to permit a single story addition to the existing non -conforming dwelling; to permit the addition of two bay windows to the existing non -conforming dwelling, one of which would encroach 14.25' into the required 29.25' eastside yard setback; and to permit the floor elevation of 6.4' above zero sea level of the existing dwelling to remain at that elevation while adding substantial improvements at 541 Banyan Road, legally described as Lots 2 & 3, Block 3, Plat #1, Polo Fields Subdiv Chairman Mayer reminded that an application for improvements at this location had been considered at the meeting held on December 5, 1990 and due to the fact that there were numerous objections from surrounding property owners, the Board had directed that all concerned meet in an effort to resolve the objections and until that had been accomplished, no recom- mendation from the Planning Board would be made. He then questioned if such a meeting had been held and asked what the result was. Mr. Mason Heydt was recognized and explained that two such meetings had taken place and the result was that he and Mrs. Heydt had agreed to return to the original design that had been considered, that of adding a second story to the existing building and adding a much smaller single story addition to the west side. He stated this would reduce the length of the structure by approximately forty feet. He stated that in adding the second story, they had attempted to move it out of the setback entirely but due to the design of the existing building, this was not structurally possible, resulting in the 5.25' encroachment. He also pointed out that if a variance were not granted to allow the floor elevation to remain as it exists, the overall height of the building would be increased. Several of the area residents were in the audience and offered no objections to what was presented. A concern was voiced that subsequent to the issuance of a building permit, there might be a plan change sought which would occur during the summer when most everyone was away. Mr. Heydt assured that this was not his intention and advised that he had supplied all involved with a letter stating this. O Mr. Eaton questioned if there had been any correspondence related to this current design. Mr. Brandt advised there had been none received. Mrs. Orthwein then moved that the recommendation to the Town Commission be that the variances as requested by Mr. & Mrs. Heydt be granted. The motion was seconded by Mr. Lynch and all voted AYE. VI. Site Plan Review A. There was no comment from the public and Mr. Lynch moved to recommend to the Town Commission that site plan approval be granted, seconded by Mrs. Orthwein and all voted AYE. B. The Architects Studio as agent for Mr. William Lamson, 5565 N.E. 29th Ave., Ft. Lauderdale, F1. 33308 requesting an amendment to a previously approved site plan to remove an outside stairway and stairwell, eliminate 2 round wood columns, and to redisign the roof, changing the roof line at 3777 N. Ocean Blvd. Mr. Brandt explained that the dwelling was under construction and that at the previous site plan review, one of the gables was not included on one of the drawings. When the current application was in the review process, this was noted. That gable is currently shown as well as the change in the roof line which became necessary when the engineers began the design for the trusses. Mr. Lynch varified that there are no variances involved. Chairman Mayer noted that it appeared that the structure was 36' in height where only 35' is permitted. It was determined that it is actually only 35' in height and that one of the numbers was not clearly written and could be interpreted to be a 6 rather than a 5. Mr. Lynch moved that the site plan be recommended to the Town Commission for approval, seconded by Mr. Eaton and all voted AYE. VII. Local Planning Agency consideration of P sed Land Development Regulations. A di . Ornance #91/1; Amending the Zoning Ordinance by adding the designations of a "Conservation District" and of a "Public OFacilities District" The Town Clerk briefly described the procedure for adoption of this and all other ordinances on the agenda as it relates to implementation of the adopted Comprehensive Plan. She further advised that these are referred to as the Land Development Regulations and that they are being considered by the Local Planning Agency (Planning Board) for recommendation for adoption by the Town Commission. She stated that they had all been reviewed and approved by Attorney Randolph, with most of the content having been organized by Resource Planning and Engineering, the Town Planning Consultant Mr. Lynch moved that Ordinance #91/1 be recommended for adoption, seconded by Mr. Sheehan and all voted AYE.
