IN THE TOWN HALL, 100 SEA ROAD, GULF STREAM, FLORIDA. I. The meeting was called to order at 9:00 A.M. by Joan Orthwein, Chairman. II. Special Meeting of April 3, 1991 Mr. Lynch moved that the minutes of the April 3, 1991 be approved as circulated, seconded voted AYE on a roll call vote. B. Regular Meeting of April 3, 1991 Mr. Lynch moved and Mr. McGraw seconded Regular Meeting be approved as circulated and all C. Special Meeting of April 23, 1991 Mr. McGraw moved that the minutes of the 23,1991 be approved as circulated, seconded by -Mrs AYE on the roll call vote. Special Meeting of by Mr. McGraw and all that the minutes of the voted AYE at roll call. Special Meeting of April Souder and all voted D. Special Meeting of May 2, 1991 Mr. McGraw moved and Mrs. Souder seconded the motion to approve the minutes of the Special Meeting of May 2, 1991. All voted AYE in a roll call vote. IV. Additions, withdrawals, deferrals, arrangement of agenda items ^ There were none. f 1 V. Assignments from the Town Commission ���//J A. Review of Proposed Ordinances 1. Ordinance #91/16; Establishing an Overlay District to be known as the North Ocean Blvd. District. Mr. Velie questioned if golf courses should be exempt. and Mr. Breazele stated that the Task Force does not want to include golf courses. Mrs. Stensen believed the trees on the golf courses add to the looks of the corridor. Mr. McGraw noted that the 50' of property on the golf courses would not include the playing area and should be no problem. Attorney Randolph pointed out that there are no real estate signs permitted in the corridor and that the Commission would like to have a recommendation regarding this from the ARPB. Mrs. Stensen displayed the type of sign Regular Meeting -Architectural Review and Planning Board -May 15, 1991 page -2- that is Permitted in the Town of Palm Beach which was small and displayed only the words "for sale" and a phone number. There was a general co:. - census that real estate signs should be permitted if they were of the size used in Palm Beach and that they should be placed on the site of the property that was being advertised for sale. Mr. Lynch moved and Mr. McGra seconded that it be recommended to the Town Commission that Ordinance #91/1 be approved as written with the exception that a paragraph (d) be added under section 2.F. to exempt real estate signs from prohibition provided ^ they are of the size used in Palm Beach and they are placed on the site that is being advertised for sale. Roll Call: Mr. McGraw; AYE, Mrs. Souder; AYE, Mr. Lynch; AYE, Mrs. LaPorte; AYE, and Chairman Orthwein; AYE. 2. Ordinance #91/17; Restricting second story construction to a maximum of 308 of the first floor area. Mr. Lynch felt this was too restrictive and it would not be necessary to employ an architect for design because everyone would be limited to the point everything would look very similar. Mr. McGraw agreed and felt that the second floor could be 508 to 608 of the first floor area and pointed out that costs would increase if the second floor were not permitted to utilize the bearing walls on the first floor. Digby Bridges agreed with Mr. McGraw and added that he did not feel the second story would be a problem if the height of the structure is controlled. Chairman Othwein wondered if some provision could be made to create a "partial" second story and allow a greater percentage of lot coverage in that instance. Mrs. Souder reminded that a two story house shades a small house adjacent if it is not controlled. Mr. Bridges suggested that a formula to create "daylight cones" could be worked out. Attorney Randolph advised that Palm Beach and many other towns have this type of provision and called attention to the insert that was a part of the agenda packet showing a drawing and the provision for this used by Ocean Ridge. Mr. McGraw suggested that any recommendation with regard to Ord. #91/17 be delayed until the matter of height had been settled as it would be much better to have an established point from which to start the measurements. Mr. Lynchmovedthat a recommendation for Ordinance #91/17 be deferred until Ordinance #91/18 dealing with the first floor finished floor elevation has been decided. The motion was seconded by Mr. McGraw followed by roll Call: Mr. McGraw, AYE, Mrs. Souder; AYE, Mr. Lynch; AYE, Mrs. LaPorte; AYE, and Chairman Orthwein; AYE. 3. Ordinance #91/18; Providing for a maximum height for the first floor finished floor elevation. Digby Bridges believed that the finished floor elevation should be established at 1.5' above the crown of the road or 8.5' above 0 sea level, which ever is higher and that the maximum height of a building should be measured to the tie beam rather than the peak of the roof. He stated that the break in the flood insurance rates are at 8.5' and he suggested anything less than that could expose the Town to some liability in case of flood. Mrs. Stenson felt this would be too high and Mary Wendel agreed. Mrs. Wendel stated that in checking some insurance companie she had found no break in the rate. She reported that she had done a survey of some of the properties that had been developed prior to 4 years previous and found that there were no two story structures that exceeded 27' in height. She noted that a two story home results in less lot coverag but that a 35' high structure adjacent to a one story home is just too high Chairman Orthwein pointed out that what is being addressed in Ordinance # 91/18 deals only with finished floor elevation and maximum height of buildings appears later on the agenda. Mr. Lynch moved to recommend that the finished max. floor elevation be at 8.5' -above.0 sea level or 16 inches above the crowm of abutting roads, whichever is higher, and that Regular Meeting of the Architectural Review and Planning Board -May 15, 1991 page -3- in the eaent the existing grade of the property is higher, then the maximum first floor finished floor elevation shall be 6" above the existing grade. Mr. McGraw seconded the motion and the roll call was: Mr. McGraw; AYE, Mrs. Souder; AYE, Mr. Lynch; AYE, Mrs. LaPorte; AYE, and Chairman Orthwein; AYE. 4. Ordinance #91/19; Providing for the preservation of trees within the Town. Attorney Randolph explained that there had been a question at the Commission meeting regarding the applicability of the Ordinance to the golf courses. He pointed out that this places no restrictions on them as they are considered as being developed property and unless there was a specimen or historic tree located on their property, developed property is exempt. Mrs. Breazeale felt that the Palm Beach County Ord. should be adopted by reference in order to make the provisions in Section 23 and 24 more restrictive. It was pointed out that if it is more restric- tive, it will apply until such time as the Town creates one more restrictiv than that of the County. The members of the Board were opposed to making any reference to County Ordinances. The Town Clerk pointed out that this ordinance places additional responsibility on the building department and that members of this department are not really knowledgeable about plants and trees. She reminded that if this increases the work load too much, it will be necessary to add personnel to the building department. Mrs. LaPorte suggested that Mr. Swan Brown might be asked to advised what trees might qualify as specimen trees since he had been in the area for some time, which would make it unnecessary for an individual to enter on private property for the purpose of evaluating trees thereon. Mr. Lynch moved and Mr. McGraw seconded that it be recommended to the Town Commission that Ordinance #91/19 be approved as written. Roll Call: Mr. McGraw; AYE, Mrs. Souder; AYE, Mr. Lynch; AYE, Mrs. LaPorte; AYE, and Chairman Orthwein; AYE. Mr. Lynch excused himself and left the meeting at this point. 5. Un -numbered Ordinance; Amending the terms and duties of the Architectural Review and Planning Board. Noting that the Board was being given the review of permit applications for demolition, Mrs. Souder felt there should be a provision for a time delay before any demolition could take place. Attorney Randolph explained that this could be done if there were a reason for such delay such as the possibility the property was landmarked and time would be needed for an investigation. He stated that without that status, the most that could be gained would be the time it would take to review what was planned for the property after demolition; that a permit cannot be held up without proper justification. Mrs. Souder then moved that it be recommended to the Commission that the amending ordinance to limit the terms of the members of the Architectural Review and Planning Board and O to add the responsibility of reviewing applications for demolition permits be adopted as written. The motion was seconded by Mr. McGraw and the roll call was: Mr. McGraw; AYE, Mrs. Souder; AYE, Mrs. LaPorte; AYE and Chairman Orthwein; AYE. B. Review of existing zoning regulations 1. Building Height There were several suggestions regarding the maximum permit- ted height of structures some of which were that there be a maximum of 27' from the finished floor elevation, 30' from the finished floor, 22' to the tie beam, 25' to the tie beam, etc. Most agreed that 35' to the peak was too high except possibly along the beach. Mrs. Souder felt the Town should be divided into sections with lower heights west of AlA and higher structures permitted along the beach. Attorney Randolph felt that this Regular Meeting of the Architectural Review and Planning Board -May 15, 1991 page -4- could be done but advised that it would result in creating different districts and that becomes much more involved. He noted that much had been said about using the provisions that are used in other municipalities but he advised that these were created for given situations and he felt that what might work one place may not work in another. He suggested that perhaps a planner should work on some of these proposals to determine what the impact may be. Mr. McGraw suggested that perhaps Mr. Ogren, the ^ architectural member on the Board could meet with some of the Task Force �) to give some guidance as to the effect the changes would have on the neighbors and the Town, and then report back at the June meeting. This suggestion was favorably received and Mr. McGraw moved that Mr. Ogren be requested to meet with the Task Force representatives to evaluate and recommend to the ARPB changes in the existing ordinances with regard to the bulk, the height, maximum square footage, differentiation of districts, and setbacks on waterways. The motion was seconded by Mrs. Souder. Roll Call: Mr. McGraw; AYE, Mrs. Souder; AYE, Mrs. LaPorte; AYE, and Chairman Orthwein; AYE. VI. Items by Staff A. Report of Construction in Progress There was reported to be $8,249,649.00 worth of permitted work in progress. VII. Items by Board Members A. Change of Regular Meeting Dates Mrs. Souder advised that she has found she has a conflict with meeting on the third Wednesday of the month and questioned if it would be possible to change the regular meeting to the 4th Wednesday beginning in September, 1991. She added that she had spoken to Mr. Lynch before he left and he had no objection. Everyone present was agreeable and Mrs. Souder moved that the date of the regular meeting of the Architectural Review and Planning Board be changed from the 3rd Wednesday to the 4th Wednesday of the month beginning in the month of September, 1991. Mr. McGraw seconded the motion and roll call was: Mr. McGraw; AYE, Mrs. Souder; AYE, Mrs. LaPorte; AYE, and Chairman Orthwein; AYE. VIII. Public There was no comment from the public. IX.
