REGULAR MEETING OF THE ARCHITECTURAL REVIEW AND PLANNING BOARD OF THE
TOWN OF GULF STREAM, FLORIDA HELD IN THE TOWN HALL ON WEDNESDAY,
SEPTEMBER 25, 1991 AT 9:00 A.M., 100 SEA ROAD, GULF STREAM, FLORIDA.
I. The meeting was called to order at 9:00 A.M. by Joan
Orthwein, Chairman.

Mrs. LaPorte moved and Mr. McGraw seconded that the minutes
be approved as circulated and all voted AYE on a roll call vote.

A. Proposed Ordinances
1. Ordinance No. 91/23; Providing for a maximum floor
area ratio, amending building height limit, amending
setback requirements for front, side and rear yards,
amending provisions relating to maximum lot coverage,
providing for garage doors to face the street on lots
of less than 20,000 sq. feet, amending site plan
review requirements.
Mr. Harrington called attention to Section 3. B. 1. e. in which it is
stated that a site plan review is required for "Changes in exterior
wall, roofing, window or door materials or combination thereof which are
significantly different in color - - - - He questioned if it was
the intent to require a review when repainting a home with a significant
change of color. He advised that in drafting the language he had more
intended that a review of the color would be in connection with a change
of material. He added that it would be difficult to enforce a site
plan review for just painting a house since no building permit is
required for that task. Attorney Randolph advised that if it was the
intention to recommend that a review of color be tied to those
improvements requiring a building permit, a language change could be
made in the paragraph under consideration. Mr. McGraw moved and Dr.
True seconded that it be recommended to the Town Commission that
Ordinance No. 91/23 as proposed be adopted with amended language
to tie the requirement for site plan review regarding color to those
improvements requiring a building permit. Roll Call: Mr. McGraw; AYE,
Mrs. LaPorte; AYE, Dr. True; AYE, Mr. Ogren; AYE, and Chairman
Orthwein; AYE.

2. Ordinance No. 91/24; To regulate the size and
placement of docks along with ancillary structures.
Mr. McGraw stated that he was concerned with Section 3.e.2. with
regard to the provision that dolphins were not permitted to extend
further than 20' into any waterway. He advised that there are
coves in the Town that are quite wide as opposed to finger canals
and some of them are privately owened by the adjacent property owners
with ownership extending to the center of each. He felt that in
these circumstances dolphins should not be restricted to a placement
of only 20' into the waterway; adding that he believes that his
existing dolphins are at a greater distance than 20'. Mr. Harrington
stated that he felt the code should be applied consistently throughout
the Town and suggested that perhaps rather than setting an exact
distance in feet, a formula by percentage of the width of the water-
way could be used. He thought that possibly dolphins could be
permitted to project into the waterway a distance of one third of
the total width of the waterway. Mr. McGraw moved to recommend to
the Town Commission the adoption of Ordinance No. 91/24 as proposed
with the restriction on the placement of dolphins amended to regulate
their location on a formula based on the -total -width of the waterway in
which they will be located, seconded by Mr. Ogren. Roll Call: Mr.
McGraw; AYE, Mrs. LaPorte; AYE, Dr. True; AYE, Mr. Ogren; AYE, and
Chairman Orthwein; AYE.

The Construction in Progress Report as circulated revealed
there to be $7,474,286.00 worth in progress during August, 1991.
