HomeMy Public PortalAboutResolution 96-35471 RESOLUTION NO. 96 -3547 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DECLARING THAT PUBLIC INTEREST AND NECESSITY DEMAND THE IMMEDIATE EXPENDITURE OF PUBLIC MONEY TO MAKE EMERGENCY HEATING, VENTILATION, AND AIR - CONDITIONING SYSTEM IMPROVEMENTS WITHIN THE CIVIC CENTER FACILITY LOCATED AT 5938 KAUFFMAN AVENUE AND NOTICE FOR BIDS TO LET CONTRACTS WILL NOT BE GIVEN IN ACCORDANCE WITH CHAPTER 2.5, SECTION 22050 OF THE STATE OF CALIFORNIA PUBLIC CONTRACT CODE WHEREAS, the City Council of the City of Temple City has determined that immediate repair of the heating, ventilation, and air - conditioning system located within the Civic Center facility at 5938 Kauffman Avenue is required to avoid unnecessary costs for extraordinary maintenance; and WHEREAS, Chapter 2.5, Section 22050 of the State of California Public Contract Code provides that in the case of an emergency, a public agency, pursuant to a four - fifths vote of the governing body, may repair or replace a public facility, take any directly related and immediate action required by that emergency, and procure the necessary equipment, services, and supplies for those purposes, without giving notice for bids to let contracts. NOW, THEREFORE, the City Council of the City of Temple City does hereby resolve as follows: SECTION 1. The City Council has determined that any delay or failure to make immediate repairs to said system will result in a significant increase in the cost for system improvements. SECTION 2. The City Council has determined that the public interest and necessity demand the immediate expenditure of public money to safeguard said property. SECTION 3. The City Council has determined that substantial evidence exists concerning the necessity to perform the above - mentioned improvements and the conditions will be exacerbated by any delay resulting from the solicitation of competitive bids and more immediate action is required to appropriately correct the problem without incurring additional cost. SECTION 4. The City Clerk shall certify to the passage and adoption of this resolution. PASSED, APPROVED, AND ADOPTED on this 5th day of November 1996.
