Mr. Hopkins moved and Mr. Ogren seconded that the minutes be
approved as circulated. Roll Call: Mr. Hopkins; AYE, Mr. Ogren; AYE, and

V. Assignments from the Town Commission Continued from August 3, 1992
A. Regulation of Structures on the Beach
Town Manager Harrington advised that he and Mr. Ogren had met
as directed by the Board at the meeting of August 3, 1992 in aieffort to
draft regulations to control the development of structures on the beach.
Mr. Harrington called attention to the contents of the draft that provides
for side setbacks to be the same as for the primary structure on the
property and for the rear yard setback to be equal to half the distance
between the mean high water mark and the crest of the dune or seawall,
whichever is further west. There are also provisions for relief from
these restrictions under certain circumstances. The beach structures,
referred to as Beach Shade Huts, are limited in number to one support pole
for each 50' of lineal beach frontage and limited in size to a maximum of
one square foot under roof for each lineal foot of beach frontage with the
area under any attached benches and tables being included in the area under
roof calculation even if they are under the roof. The height is restricted
to a maximum of 12' and the huts shall contain no walls, floors or lighting.
A maximum of one storage box attached to each permitted support pole, not
to exceed one cubic foot in volume,is permitted. All materials used for
the but shall be native, natural materials with thatched roofs, excepting
nails, etc.,and shall be maintained in good repair. Failure to maintain
the structure in good repair will be cause for the Town to order removal of
the structure. The support poles shall be anchored oniv Dy the soil and
sand present in the area in which they are located. _r. Harrington than
distributed photographs of three beach shade huts that are presently in
place on the beach. He explained that two of them had been there for some
time but the third was constructed approximately ore year previously. Mr.
Harrington added that he had advised the owners of the last but constructed
tha;: it would be necessary for them to obtain permits from both the County
and the State before application could be made to the Town, and that they
are in the process of doing this.

Mr. Hopkins asked if there had been any objections to the huts that are
on the beach to which Mr. Harrington replied that there had been one.
Mr. Hopkins added that he did not feel the huts added to the appearance
of the area and were really not in keeping with type of primary structures
that are along the beach. Mr. Hopkins did feel uncomfortable with
prohibiting them entirely in that the County and State do permit the huts
if they meet the standards that have been established by the agencies.
n Mr. Ogren had no personal objection to them but felt that since there are
three at this time, there would no doubt be more to follow and that they
should certainly be regulated. Mr. Harrington questioned if there would
be too many more in that the permitting process with all agencies involved
is quite costly and lengthy. Both Chairman Orthwein and Mr. Hopkins expres-
sed concern that this type of structure falls into disrepair rather rapidly
and could become unsightly. They did recognize that there are provisions
for the Town to order the huts removed in this instance.
Mr. Ogren moved that the Board recommend to the Town Commission that the
regulations drafted for consideration be adopted provided the language
is altered in the area of structural materials to restrict the structure
to a thatched type hut. The motion was seconded by Mr. Hopkins. Roll Call:
Mr. Hopkins; AYE, Mr. Ogren; AYE, and Chairman Orthwein; AYE.
B. Zoning Code Requirements for Decks
Mr. Harrington presented the draft of proposed regulations related to
decks and placement of mechanical equipment in the setback areas. He
pointed out that paving, decking or other impervious built-up surfaces, othe:
than those intended for use by vehicles, that extend more than 4" above
the surrounding finished grade elevation may not be located in the setback
areas. However, that which is less than 4" above grade could extend to
within 3' of the property line provided they are screened from adjacent
properties with a wall, fence or hedge of at least 4' in height. With
regard to mechanical equipment, none would be permitted in the setback areas
of lots of more than 20,000 square feet. On lots of less than 20,000 square
feet, equipment of not more than 4' in height may extend not more than 5'
into the required sied and rear yard setbacks provided they are screened
from an off premise view with a wall,fence or hedge. However, in no case
shall said mechanical equipment be located in a required setback closer to
a property line than to the structure which it serves.
Mr. Ogren moved and Mr. Hopkins seconded that it be recommended to the Town
Commission that the proposed regulations for the placement of decks and
mechanical equipment be adopted as a part of the Town Code. Roll Call:

of construction in progress in July, 1992.

Chairman Orthwein adjourned the meeting at 9:45 A.M. on a motion
by Mr. Ogren which was seconded by Mr. Hopkins with all voting AYE.

NOTICE OF APPLICATION FOR DEVELOPMENT APPROVAL
The firm of Digby Bridges, Marsh & Associates as agent for Mr. & Mrs.
John McGraw, the owner of real property located at 1601 N. Ocean Blvd.,
Gulf Stream, Florida, has submitted an application for a Site Plan Review
to permit the construction of an accessory structure to the primary
single family dwelling,consisting of a two story building to function
as a storage facility with a caretakers apartment on the second floor.
Complete application materials are on file with the Town of Gulf Stream
Planning and Building Department located at 100 Sea Road, Gulf Stream,
OFlorida 33483 and may be inspected during regular business hours which
generally include non -holiday weekdays from 9:00 A.M. to 4:00 P.M.
The Town of Gulf Stream Architectural Review and Planning Board will
consider the subject application at its meeting on September 23, 1992,
at 9:00 A.M., in the Commission Chambers in the Gulf Stream Town Hall
located at 100 Sea Road, Gulf Stream, Florida 33483 and shall make a
recommendation to the Town Commission regarding the subject application.
Said meeting may be adjourned from time to time and place to place as
may be necessary to hear all parties and evidence.
The Town of Gulf Stream Town Commission will consider the subject
application at its meeting on October 9, 1992, at 9:00 A.M., in the
Commission Chambers in the Gulf Stream Town Hall located at 100 Sea
Road, Gulf Stream, Florida 33483 and shall make a final decision regarding
the subject application. Said meeting may be adjourned from time to time
and place to place as necessary to hear all parties and evidence.
All persons interested may appear before the Architectural Review and
Planning Board and Town Commission of the Town of Gulf Stream at the
times and place aforesaid and be heard.
Should any interested party seek to appeal any decision made by the
Architectural Review and Planning Board or Town Commission with respect
to any matter considered at these meetings, said party will need a record
of the proceedings, and for such purpose, may need to insure that a
verbatim record of the proceedings is made, which record includes the
testimony and evidence upon which the appeal is to be based. 286.0105, F.S.S
