Request filed by Josh Korte, Korte Sales LLC, property owner, for a variance from
floodplain regulations. The purpose of the request is to permit wet floodproofing of one
existing structure, two proposed future structures, and one proposed future mulch
storage bin. The property is located 115 feet west of the intersection of Oilwell Road and
Cedar City Drive and is described as Part of Section 9, Township 44 North, Range 11

Chairman Hake called the meeting to order at 7:30 a.m. and introduced Board members and asked
staff to introduce themselves. A quorum was present to hear the items on the agenda. The
following members were designated to vote: Hake, Crabtree, Lacy, Schaefer, Cartwright. Those
wishing to speak to the Board were sworn in.

Chairman Hake explained the procedures of the meeting. Ms. Bliss entered the following

6. New Business — Public Hearings
Case No. B23003 — 418 West Elm Street, Signage Variance. Request filed by Steve Albert,
property owner, on behalf of Rafael Ayala, applicant, for a variance to Chapter 3 of the City Code
Section 3-2 F.12, (roof signs are prohibited when signs are not contained within the building's
silhouette) to permit roof two mounted signs to serve a new business in the existing building situated
on the property. The property is located on the northeast corner of the intersection of Walnut Street
and West Elm Street and is described as Inlots Number 676 and 677 in the City of Jefferson, County
of Cole, Missouri.
Ms. Bliss described the location, zoning, and surrounding properties. The request is for a signage
variance to permit two roof mounted signs to serve El Espolon a restaurant housed within an
existing building on the property. The owners of the property are requesting two roof mounted signs.
One sign facing southward is visible from W. Elm Street. The second sign facing northward is visible
from Schroeder Way, W. Miller Street and Highway 50/63.
Jose Hernandez, sign contractor, 1708 Central Ave, Kansas City, KS presented the case. He
explained that they are trying to obtain a sign permit for a restaurant that has limited visibility from
the street. The roof mounted signs will be helpful for customers trying to find the restaurant. Mr.
Hernandez stated that the signs were put up without a sign permit was because there was a
miscommunication between the contractor remodeling the restaurant.
Rafael Ayala, owner of El Espolon, 147 Murphy Ford Road, Centertown, explained that there was
confusion between him and the sign contractor and that the signs were put up without a sign permit.
Mark Randolph, 4107 Liddy Lane, Jefferson City, explained that he and Steve Albert own the
building and they are trying to better the area. They also own the Highway 179 location. He stated
that the owners of both El Espolon locations are great tenants.
No one else spoke regarding the request; the Chair closed the public hearing.
Ms. Bliss described that the required findings are contained within the application forms and within
the staff report and described the recommended form of motion.
Ms. Lacy moved and Mr. Cartwright seconded to approve a signage variance from the type of roof
signs prohibited to permit two roof mounted signs as illustrated by the applicant.

Case No. B23004 — 912 West McCarty Street, Conditional Use Permit and Bufferyard
Variance. Request filed by Kaiser Electric of Central MO, applicant, for a Conditional Use Permit
to operate a contractor/trade shop with indoor operations and outdoor storage in the C-2 General
Commercial zoning district and a variance from the specific use standards which require a Type B
Bufferyard surrounding the outdoor storage yard. The property is located 140 feet east of the
intersection of Brooks Street and West McCarty Street and is described as Part of Lot Nos. 9-14 in
Block No. 9 of Lower Jefferson Addition, in the City of Jefferson, County of Cole, Missouri.

Ms. Bliss described the location, zoning, and surrounding properties. The first request is for a
conditional use permit to expand the contractor/trade shop located at 912 W. McCarty Street
westward onto two adjacent properties located at 918 and 920 W. McCarty Street. The applicant is
also requesting a variance from the Type B Bufferyard to plant shrubs and bushes as opposed to
trees.
Cole Lodge, 88 Oak Street, Eldon, presented the case. He explained that the purpose for the
conditional use request is that trucks accessing the property have difficulty delivering materials.
The property owner acquired the adjacent properties at 918 and 920 W. McCarty Street to allow
better access to the property. The area will be fenced in with a privacy barrier. There will be no
outdoor storage for materials. Mr. Lodge stated that he spoke with the neighboring property owners
and they do not have any issues with the proposed improvements.
Correspondence was received in favor of this request from Mike Yungbluth owner of 1001 W.
McCarty Street.
No one else spoke regarding the request; the Chair closed the public hearing.
Ms. Bliss described that the required findings are contained within the application forms and within
the staff report and described the recommended form of motion.
Mr. Crabtree moved and Mr. Cartwright seconded to approve the requested Conditional Use Permit
to permit a Contractor/Trade Shop with outdoor storage in a C-2 General Commercial zoning
district.

Case No. B23005 — 1129 Cedar City Drive; Variance from Floodplain
Regulations. Request filed by Korte Sales, L.L.C. for a variance to floodplain regulations.
The purpose of the request is to allow an existing structure to remain and to permit future
construction of three proposed structures, all as wet-floodproofed structures. The property is
located at 1129 Cedar City Drive, Jefferson City, Callaway County, Missouri.
NATURE OF REQUEST
The property owner sought a variance to construct wet floodproofed structures of various
configurations at this location in 2018, and the original request was approved by the Board of
Adjustment. The current proposal for a variance to floodplain regulations, which if approved, would
permit wet floodproofing of an existing 42' X 56' (approximate dimensions) buttressed concrete bunker
block walled building; construction of a proposed 60' X 75' steel building with metal siding held up
six -feet from existing ground elevation; placement of a proposed 30' X 72' movable carport constructed
on skids at existing grade; and construction of three proposed concrete bunker block walled mulch
storage bins. The Flood Code allows wet floodproofing of accessory structures up to 400 square feet.
The one existing and three proposed structures exceed the allowable square footage, and the buildings
would not be considered accessory structures for Floodplain Regulation purposes, which is why a
variance is requested. Note: The existing structure for which a variance is being sought was erroneously
constructed prior to seeking a variance. If the variance request is denied, the structure must be
demolished. The proposed structures which are included on this variance request represent potential
future structures that may be desired on this property at some point yet to be determined.
