Gary Sanders, Ciphers Design Company, represented Paul Scarborough for a Site Plan Approval petition (Land Development Code Section 5-080) 406 First Street, PIN 4-0003-13-020, Zone C-2. The plan was for a new retail/commercial building. Sanders said that it would be connected to the High Tide building. He spoke of one of the biggest challenges being the trees on the property. David Postle said that it appeared there were eight oak trees slated for removal. He said the trees were between 7- and 27- inches in diameter and between 25 and 250 years in age. He asked Sanders the plans to save as many trees as they could. Sanders said that parking drives the size of the development. He said the site was both blessed and cursed with many trees. He counted fifteen trees that they had put parking around. He said that he hated to see anything happen to the 27-inch tree and that with relaxation of the 24-foot maneuvering space needed for parking, they could save the tree and the one behind it. Postle, Sanders, Brannyn Allen, Sandy Chandler, Libby Bacon, John Major, and Chuck Powell discussed trees, greenspace, the parking/drive aisle plan, and the Land Development Code. At Postle's request, Allen agreed to review the parking standards of the Land Development Code. Allen said that should the Commissioners decide to make a motion for approval they could condition it in a variety of ways that would save the trees. Following discussion of possible conditions, Allen said that any variances would be tacitly approved as part of the Site Plan. Powell asked if anyone from the public wished to speak for or against the project. Chandler motioned to approve with the condition of allowing a decrease of up to 3 feet in some sections of the drive aisle width only in an effort to save trees as well as the labeling of the affected parking spaces "for compact vehicle use only." James Boyle seconded. Whitley Reynolds asked if they were being too vague on the motion. After discussion which included the estimated number of remaining parking spaces, the vote on the motion was unanimous. The motion to approve with the conditions of allowing a decrease of up to 3 feet in some sections of the drive aisle width in an effort to save trees and the labeling of the affected parking spaces "for compact vehicle use only" passed. City Council would consider the petition on April 10. Bonnie Gaster represented Randolph Bishop for a Zoning Variance petition (Land Development Code Section 5-090) from Section 5-010(J), Shore Protection with Variance Clause, for 8 Palmwood Court, PIN 4-0002-24-005, Zone PUD. The applicant was requesting a shore protection line variance for a single-family dwelling proposed to be built 10 feet landward of the toe of the dune. The difference between that line and Tybee's line was approximately 15 feet at the widest point and 3-1/2 feet at the narrowest. Whitley Reynolds recused himself because he had worked on the project. Demery Bishop said that there was no relationship between Randolph Bishop and himself. Gaster said the footprint with the Tybee jurisdictional line was almost 50% less than was originally approved. She said it was a planned unit development with an approved footprint that followed the toe of the dune. She requested going by what was recommended by DNR. She said as it was they would only have a 47-foot footprint on the north side. John Major said that the DNR jurisdictional line was more restrictive than the Tybee line and, in the absence of trees and structures, the DNR generally uses ten feet. He said he would not agree with Gaster that it was what DNR recommends; it was what they recommend absent anything else. Gaster agreed. Powell asked if anyone from the public wished to speak for or against the proposal. Sandy Chandler motioned to approve. Anne Miller seconded. Major said that this was one of the lots where Tybee's line was questionable and that what was recommended was reasonable. Minor changes to the location may be allowed or required in areas that have eroded or accreted subsequent to the original jurisdictional determination. 7. No construction materials maybe disposed of in the jurisdictional area of the Shore Protection Act. 8. Any incidental impacts associated with the construction of this project must be rectified by restoring areas to their pre-construction topographic and vegetative states. 9. The public shall maintain rights of ingress and egress on the foreshore beach area seaward of the ordinary high water mark. 10. If the permitted improvements are damaged, fall into disrepair, become dilapidated, are not meeting their expected usefulness, or are not maintained at a serviceable level, then it is the responsibility of the owner to remove the improvements. A new permit will be required to retain and repair the structure, improvement or asset if it loses its structural integrity and is no longer serviceable. 11. The Shore Protection Committee is not bound in the future to protect any asset or improvements authorized by the permit. 12. SPECIAL CONDITIONS: 1. A landscape plan must be provided to the Department for approval prior to installation. Landscaping will consist of native species and shall not change the jurisdiction of the Shore Protection Act in the future. 2. Should the dunes shift landward,which is considered a natural function of the sand sharing system, every effort must be made to protect the dynamic area. 3. During construction,no materials or equipment can be stored in the dune area. During construction, silt fence must be placed landward of the existing dune to clearly delineate the dune area in which no impacts are permitted. 4. All proposed driveways must be constructed of pervious materials. 5. In order to minimize the disruption of nesting activity from artificial lighting from the subject parcel, the permit must comply with the attached conditions entitled, "Shore Protection Act O.C.G.A. § 12-5-230 SPECIAL Permit Conditions Regarding Artificial Lighting Specific to Sensitive Sea turtle nesting areas"in developing a lighting plan for the subject parcel. 6. Exterior artificial light fixtures within direct line-of-sight of the beach shall be designed and oriented such that: (a.)Fixtures are completely shielded (b.)Full cut-off design (c.)Oriented in a downward direction 3. Decorative exterior artificial lighting not necessary for safety is prohibited, to include the following, unless a determination is made that any such lighting is necessary for safety, in which case turtle friendly lighting as specified in(4, 5)below must be used: (a.)Pond lights (b.)Uplights (c.)Dune walkover lights (d.)Tree-strap downlights 4. The use of private balcony lights must be minimized and may only be used for safety and security purposes, and in conformance with conditions (1-11). 7. Only low intensity lighting shall be used in parking areas within line-of-sight of the beach, and shall be: (a.)Set on a base which raises the source of light no higher than 48 inches off the ground (b.)Positioned or shielded so that the light is cast downward and the source of light or any reflective surface of the light fixture is not visible from the beach and does not directly or indirectly illuminate the beach. (c.)Bulbs used in parking area fixtures must comply with section(4) a-e. 8. Parking areas and roadways, including any paved or unpaved areas upon which motorized vehicles will park or operate, shall be designed and located to prevent vehicular headlights from directly or indirectly illuminating the beach. 9. Vehicular lighting, parking area lighting, and roadway lighting shall be shielded from the beach through the use of ground-level barriers. Ground-level barriers must not interfere with marine turtle nesting or hatchling emergence, or cause short- or long- term damage to the beach/dune system. 10. Swimming pool and pool deck lights shall be turned off when the pool is closed unless required for safety and security, in which case such lights must conform to condition(5). 11. Tinted glass shall be installed on all windows and glass doors of single or multi-story structures within line-of-sight of the beach. III. Following are Definitions as used in the above conditions: 1. "Artificial light" or"artificial lighting"means the light emanating from any human- made device. 2. "Beach"means the zone of unconsolidated material that extends landward from the ordinary low water mark to the line of permanent vegetation. 3. "Cumulatively illuminated"means illuminated by numerous artificial light sources that as a group illuminate any portion of the beach. 4. "Frontal dune"means the first natural or man-made mound or bluff of sand which is located landward of the beach and which has sufficient vegetation, height, continuity, and configuration to offer protective value. 7. "Ground-level barrier"means any vegetation, natural feature or artificial structure rising from the ground,which prevents beachfront lighting from shining directly onto the beach-dune system. 8. "Hatchling"means any species of marine turtle, within or outside of a nest that has recently hatched from an egg. 9. "Indirectly illuminated"means illuminated as a result of the glowing element(s), lamp(s), globe(s), or reflector(s) of an artificial light source, which is not visible to an observer on the beach. 10. "Sea turtle"means any marine-dwelling reptile of the families Cheloniidae or Dermochelyidae found in Georgia waters or using the beach as nesting habitat, including the species: Caretta caretta (loggerhead), Chelonia mydas (green), Dermochelys coriacea (leatherback),Eretmochelys imbricata (hawksbill), and Lepidochelys kempi (Kemp's ridley). For purposes of this rule, sea turtle is synonymous with marine turtle. 11. "Nest"means an area where sea turtle eggs have been naturally deposited or subsequently relocated. 12. "Nesting season"means the period from May 1 through October 31 of each year. 13. "Nighttime"means the locally effective time period between sunset and sunrise. 14. "Tinted glass"means any glass treated to achieve an industry-approved, inside-to- outside light transmittance value of 45% or less. Such transmittance is limited to the visible spectrum (400 to 700 nanometers) and is measured as the percentage of light that is transmitted through the glass. The lot is situated on the east side of Waterside Walk and is the second fot from the ocean. The total lot area is 23,786 S.F. and about half is seaward of the DNR flagged Toe of Dune Line. The lot also has two recorded egress easements that are 20 FT.wide on the north and south sides. The north easement is a utility easement. The north side easement allows access to lot 12 and the south side easement allows access to lot 4 and existing neighborhood boardwalk. The proposed project will be a single family two story residence with parking below the living area. Entrance to the property will be by means of a porous brick paver driveway from Palmwood Court.The driveway will be a kept to an approximate length of 60 FT. The building footprint dimensions are 60 FT. X 98 with an 18 X 30 Cut Out for a total of 5,340 S.F. and the driveway is 25FT. X 60 FT for a total of 1,500 S.F. The total area needed for construction of building and driveway is 6,840 S.F. which is approximately 28% coverage of the total lot size. % The area needed for clearing and excavation is approximately 7,000 S.F. After construction is complete, all building setback areas will be landscaped with plants that are compatible to the area. Basic construction methods will be concrete footings and pier foundations with wood framing above. Exterior finishes will be painted fiber cement siding to emulate wood on living area with stucco on the lower enclosed paring area. The major roof area will be asphalt architectural grade shingles with metal standing seam on flatter covered porch areas. During construction, no material or equipment will be allowed in or near the dune area. Erosion control will be maintained by the use of silt fencing around the construction project. All construction methods and material will meet or exceed local and state building codes along with FEMA regulations. ALTERNATIVES CONSIDERED: Due to the constraints of remaining behind the toe of the dune, the side easements, and the encroaching circle of the paved street, there really were no alternatives that would fit on these confinements. The house is over the maximum buildable area of 5000 square feet.Note that the maximum of 4000 square feet may be adjusted by the review board for ocean front lots, but no formal approval has yet been considered. b. The house does not fit within the building setback lines as outlined in the covenants.The front setback along the"boardwalk"should be 52 feet with the first 8'of this facade to be a covered porch area.The rear yard setback should be 25 feet,and the setback from the property line shared with lot 6 should be 15 feet.Currently the home is substantially over the buildable area of the lot. 2. The design does not meet the Architectural Code as follows: 1) The ground level design is shown as stucco. The infill between the piers is required to be of an appropriate wood or lattice material.The garage doors should be styled in the same infill treatment. 2) Fenestration does not in all cases meet recommended prototype of a vertically proportioned double hung window with the 1.5 to 1 height to width proportion. 3) The site plan should be at an appropriate scale so that the dimensional relationships between the house and the property lines can be ascertained. I recommend at least a 1" 10 ft scale.The service yard is not shown on the site plan,and should be indicated. Bishop Single-Family Residence Tybee Island, Atlantic Ocean, C Tatham County This serves as notification from the Shore Protection Committee and the Georgia Department of Natural Resources' Habitat Management Program of a request from Randolph C. Bishop for a Shore Protection Act Permit under Official Code of Georgia Annotated (O.C.G.A.) 12-5-230 et. seq. to construct and maintain a single- family residence on Lot 5, #8 Palmwood Court, Seaside Colony Phase 2, Fort Screven Ward, Tybee Island, Chatham County, Georgia. The applicant proposes to construct and maintain a single-family residence with porches, stairs and a driveway in the state's shore jurisdiction. The dune system in this area is stable although scarping is seen on the wet sand beach. The proposed structures are approximately 10 feet landward of the most landward dune and approximately 240 feet landward of the ordinary high water mark. The lot is approximately 23,786 square feet with approximately 20,542 square feet located in the state's jurisdiction. The building footprint including porches and stairs is approximately 5,340 square feet. The residence will be accessed from Palmwood Court by an approximately 1,600 square feet of brick paved drive. Parking will be under the building. Approximately 3,903 square feet (19 %) of the state's jurisdictional area will be impacted by the building, porches, stairs and driveway. The lot has been previously maintained by mowing. Little natural vegetation exists at this time. The landscaping plan includes native vegetation. Sod will be of the Paspalum vaginatum (Seashore Paspalum) variety. Drainage will be directed away from the dunes. No construction or landscaping is proposed in the dune areas. During construction no materials or equipment will be stored in the dune area. Access to the beach will be via an existing shared dune path. No new crosswalk from this property is proposed.
