NOTICE IS HEREBY GIVEN that the Architectural Review and Planning Board
of the Town of Gulf Stream will hold a public hearing on Wednesday,
September 22, 1993 at 9:00 A.M. and the Town Commission will hold a
public hearing on Friday, October 15, 1993 at 9:00 A.M., both in the
Commission Chambers at the Town Hall, 100 Sea Road, Gulf Stream, Florida,
at which the following will be considered.
An application submitted by Digby Bridges of Digby Bridges,
Marsh and Associates, as agent for John & Margaret Carson,
11 Hidden Harbour Dr., Gulf Stream, F1. 33483, requesting
a variance from the provisions of the Code of Ordinances
of the Town of Gulf Stream, Chapter 66; ZONING, Article
VI.; DISTRICT REGULATIONS,, Division 2.; RS SINGLE-FAMILY
RESIDENTIAL DISTRICT, Section 66-205; Lot coverage and floor
area ratio.
to permit the removal of an existing tennis court and the addition of
a thirteen hundred (1,300) square foot addition to the existing single
family dwelling at the address stated herein that would increase the
lot coverage to six thousand five hundred twenty four (6,524) square
feet, that being four hundred ninety seven and seventy five one
hundreths (497.75) square feet over the six thousand twenty six and
twenty five one hundreths (6,026.25) square foot maximum that is
permitted by the Zoning Code. The legal description of this property
is Lot 8, Hidden Harbour Estates.
PERSONS INTERESTED in this matter may appear before the Architectural
Review and Planning Board and the Town Commission, sitting as the Board
of Adjustment, of the Town of Gulf Stream at the times and place aforesaid
and be heard.

NOTICE IS HEREBY GIVEN that the Architectural Review and Planning Board
of the Town of Gulf Stream will hold a public hearing on Wednesday,
September 22, 1993 at 9:00 A.M. and the Town Commission will hold a

agent for Diane Kessenich, 2423 N. Ocean Blvd., Gulf Stream,
Florida 33483, requesting a variance from the provisions of
the Code of Ordinances of the Town of Gulf Stream, Chapter 66;
ZONING, Article VI., DISTRICT REGULATIONS, Division 2.; RS
RESIDENTIAL DISTRICT, Section 66-203; Side yard required.
to permit the construction of an open wood arbor connecting the dwelling
to the separate studio which would extend eight (8) feet into the
required fifteen (15) foot side yard on the west side of the property.

III. Minutes of the Regular Meeting of August 25, 1993.
Mrs. Souder moved and Mr. McGraw seconded that the minutes be
approved as circulated. Roll Call: Mr. McGraw; AYE, Mrs. Souder; AYE,
and Chairman Orthwein; AYE.

There were no changes in the agenda.
V. PUBLIC HEARING.
A. Variances
1. Digby Bridges, Digby Bridges, Marsh & Associates, as Agent
for John & Margaret Carson, 11 Hidden Harbour Dr., Gulf
Stream, Florida -Addition to existing single family dwelling
which would increase the lot coverage to 6,524 square feet,
exceeding the maximum permitted by 497.75 square feet,
at the address stated herein which is legally described as
Lot 8, Hidden Harbour Estates.
Mark Marsh of Digby Bridges, Marsh & Associates explained that they
propose to remove an existing tennis court which consists of 6,000 square
feet and add a master bedroom wing consisting of 1,339 square feet, which
would create additional landscaped area. Mr. Marsh stated that the Zoning
Code provides that screen enclosures be counted at 50% of their square
footage when computing lot coverage. Inasmuch as there is a screen
enclosure over the pool, the maximum lot coverage would be exceeded by
497.75 square feet with the addition of the new wing. Mr. Marsh then
displayed a site plan showing the proposed improvements and a color render-
ing of the structure with the proposed improvements in place. He pointed
out that the addition will bring balance to the structure, giving a more
pleasing appearance. Mr. Marsh believed that the fact that the appearance
of the structure would be improved along with the creation of more land-
scaped areas, resulting from the removal of the tennis court, more than
offsets the requested variance.

Chairman Orthwein stated that she was unable to see a hardship in this
instance since the variance could be avoided by removing the screen
enclosure over the pool. Mr. Marsh replied that the Carsons are full
time residents and with the property being very close to a mangrove
area, a screen enclosure over the pool is a necessity in summer time due
l..J to the insects from the mangrove area. He went on to point out that
the screen enclosure is hardly visible due to heavy plantings and added
that there are mature shade trees in the pool area which drop debris,
also making the screen enclosure over the pool a necessity.
Mr. McGraw believed the screen enclosure was a necessity in this area and
further commented that the proposed improvements would be more aesthetically
pleasing.
Mrs. Souder agreed that the proposed addition improved the look of the
structure but that she was not happly with the screen enclosure.
Mr. Marsh felt that each site should be considered individually when applying
the 508 computation to screen enclosures, pointing out that this is a
large lot and is fully screened with landscape material. He believed this
508 computation has created a hardship for his client.
Mr. McGraw moved and Mrs. Souder seconded that it be recommended to the
Town Commission,sitting as the Board of Adjustment, that the variance
be granted as requested. Roll Call: Mr. McGraw; AYE, Mrs. Souder; AYE,
and Chairman Orthwein; NAY. Chairman Orthwein stated that she too felt
that the addition would improve the property but that she did not believe
there was a proven hardship in that the screen enclosure could be removed
and the addition would be in compliance. She added that the Zoning Code
had just recently been amended and that the 508 computation for screen
enclosures had been carefully considered at that time and was felt to
be fair and necessary in computing total lot coverage.

Mr. Alvaro Vera advised that Mrs. Kessenich had delayed her departure in
order to appear at this hearing and would explain the application.
OMrs. Kessenich was recognized and stated that her property was one of the
smallest in Gulf Stream in that it was originally a part of the Phipps
estate that contained several buildings which had been divided several
years previously. She advised that because these lots had building on them,
there are many non -conformities, such as setbacks. The buildings on the
various lots are rather close and she would like to increase the privacy
along the west side of the property. Mrs. Kessenich stated that this
could be acomplished by increasing the height of the 4 foot wall that
currently separates the property and that to the west but she would much
prefer to add to the beauty of the unique enclave by constructing the
arbor which would be covered with various vines and plant material. Mrs.
Kessenich closed by advising she had spoken to the neighbors and they are

all very pleased with the proposed arbor.
Mr. McGraw moved that it be recommended to the Town Commission, sitting
as the Board of Adjustment, that the variance be granted as requested.
The motion was seconded by Mrs. Souder. Roll Call: Mr. McGraw; AYE, Mrs.
Souder; AYE, and Chairman Orthwein; AYE.
VI. Site Plan Review.

court to construct an addition to the existing dwelling at the
address stated herein.
Mr. McGraw moved and Mrs. Souder seconded that the site plan incorporating
the variance that was previously granted be recommended for approval as
presented. Roll Call: Mr. McGraw; AYE, Mrs. Souder; AYE, and Chairman
Orthwein; NAY. Chairman Orthwein stated she is so voting due to the fact
she did not feel a hardship had been proven in the variance request that
had been granted.

Gulf Stream, F1. - Construction of an open wooden arbor to
connect the dwelling to a separate studio at the address stated.
Mr. McGraw moved that it be recommended to the Town Commission that the

VII. Items by Staff.
A. November Meeting Date.
The members of the ARPB unanimously agreed that the meeting would be held
on November 16, 1993 at 9:00 A.M. Brief discussion was held regarding
the December date. December 29, 1993 was given consideration but it was
decided to wait until the October meeting to decide on a December date.
B. Construction in Progress Report for August, 1993.
The report revealed there to be $6,521,942 worth of construction in
progress in the month of August, 1993.
VIII. Items by Board Members.
Mrs. Souder questioned if there were any problems related to develop-
ment at this time. Town Manager Harrington gave a brief report on the
current status of the Lepkanich project and also a report regarding a
recent visit an auditor from the Federal Emergency Management Agency made
to the Town,dealing with substantial improvement of properties with a
finished floor elevation of the structure being less than the base flood
elevation.
