M. Present: Mayor, Thomas Anderson; Councilmembers, Wilfred Scherer, William Reiser, Sarah Lutz, Thomas Crosby, Assistant Clerk, Sylvia Rudolph; Police Chief; Charles Hoover, Planning and Zoning Administrator, JoEllen Hurr; Attorney, Richard Schieffer and Michael Nash; Engineer, Paul Pearson; Building Inspector, Loren Kohnen. 1. NOVEMBER 17, 1981 MINUTES Motion by Reiser, seconded by Sarah Lutz to approve minutes of November 17, 1981, as presented. Motion carried. 2. POLICE DEPARTMENT Meadowwoods Farm - Street Lites Chief Hoover recommended 3 street lites be erected in Meadowwoods Farm, one at the entrance on Co. Rd. 24, intersection of Meadowwoods Trail and Cherokee, and also at the cul de sac. Motion by Bill Reiser, seconded by Wilfred Scherer to have street liter erected by the developer. Motion carried. Junk Accumulation - Hamel Road residences Chief Hoover reported that he had given Mr. Dayon 20 days to attempting to do so. He also reported that he hadn't looked he will do so. clean up and that he is at the Fortin property but Hamel Lumber - 3365 Mill St. Loren reported that he had given Mr. Bouley a notice to clean up old lumber and etc. around the buildings on Mill street and that it looks good. Bruce Neumann - 25 Hamel Road Bill Reiser reported that Bruce is trying to clean up to build another garage. Tom Anderson said we should of his intentions or have it cleaned up. Motion by Thomas Crosby, seconded by Wilfred Scherer letter informing him of Tom Andersons request. PUBLIC ORKE DEPARTMENT Arrowhead Drive Improvements Dick Schieffer had talked to property owners regarding easements. The property owners have agreed to sign the easements for the road improvements, and the easements have been sent. Steve Muth Road Wilfred Scherer and Ron Duran inspected Steve Muths road and reported that the right-of- way is too far north of the section line and also he only has an 80 ft. cul-de-sac. The city required a 100 ft. cul-de-sac for another developer in 1978, therefore feel that the 80 ft. cul-de-sac is not sufficient. Motion by Wilfred Scherer, seconded by Thomas Crosby to reject the request for the city to take over the Muth road. Motion carried. Hamel Sidewalk Shoveling Motion by Thomas Crosby, seconded by Bill Reiser to adopt Ordinance No. 201, requiring Snow and Ice removal from sidewalks by inserting (12 hours after snow or ice has ceased to form). Motion carried. Water Tower Approval Motion by Wilfred Scherer, seconded by Thomas Crosby to approve the Hamel Water Tower with Paul Pearsons recommendations that all work was done to plans and specifications and looks good. Motion carried. Snow Removal Material, Deisel Fuel, Gas Ron Duran reported that he would like some guidance as to how much he should spend on snow removal material, deisel fuel and gas. He would need 40 tons salt, 700 tons sand and about 3,000 gallons of deisel fuel to last until the end of March. Tom Anderson authorized Ron to buy what he needs and limit sanding to troubled areas and buy enough gas until the end of the year. 4. MEL JUSTER - ROLLING GREEN COUNTRY CLUB Mr. Juster reported that they are still negotiating selling the property. They do have a cash flow problem but they do have equity in the property. They do not want to close the golf course. Another option they would have is to have some of the individual members develop some of the land for townhouses. Motion by Tom Anderson, seconded by Thomas Crosby to levy $9,309.18 unpaid utility bill for Rolling Green Country Club on the assessment roll for 1982 Lases, if it is not to late to do so. Motion carried. 5. PLANNING AND ZONING DEPARTMENT Moorcroft Sub -Division Polly Patch presented the revised plan for approval. The 201 acres are being divided into 17 home sites, one 84 acre open space (Outlot A) and a private road (Outlot B) to serve two lots. There are two 10ft. easements for access to Outlot A - the open space and canoe trail. Thomas Anderson recommended preliminary plat approval with conditions set forth by City Attorney as follows: 1. Combine Outlot C with ajacent land by plat or agreement or have it be a_.part of Outlot A. 2. Pay a Park Dedication Fee of $6,000.00 3. Conform to the Platting and Zoning Code. 4. Covenants to be approved by City Attorney and Zoning Administrator. 5. Road to be named Oakview Road and its design and allignment to be approved by the City Engineer. 6. Drainage easements to be provided on Lot 1, Block 1 and Lot 6, Block 1. 7. Conform to the requirements of the City Engineers letter dated October 1, 1981. Motion by Sarah Lutz, seconded by Bill Reiser to accept the preliminary plat approval with the above conditions. Motion carried - MThomas Crosby abstaining. Mark Franklin - conditional use permit Mr. Jaeger, attorney for ,Mark Franklin, requested the right.to tape the council dis- cussion; -they had no objection. .Michael Nash, an attorney with Richard Schieffer, presented his memorandum answering •questions the council had at their November 3, 1981 meeting. A transcript of the tape will be attached as part of the minutes. Motion by Bill Reiser, seconded by Thomas Crosby to table Mark Franklins conditional use permit -variance. Motion carried. Emil Jubert -rezoning Emil Jubert appeared to request rezoning to Agricultural Preserve approximately 80 acres of his property at 1182 Hwy. 55. Motion by Wilfred Scherer, seconded by Bill Reiser to approve the rezoning request with publication being done after the Metro Council approves the Comprehensive Plan. Motion carried. Sub Standard Lots - Rayburn Anderson Mr. Anderson is to provide a copy of the perk test taken by Bob Koch to the Zoning Administrator along with a current survey of the property he owns on Lakeview Road showing buildings and hardcover. In order to be considered at the December 15, 1981 council meeting he must have the information to the city by December 8, 1981. Motion by Bill Reiser, seconded by Wilfred Scherer not to accept the ammendment to the Ordinance concerning sub -standard lots dated 11-3-81. Motion carried, Tom Crosby voted No. 4), 6. M DINA MORNINGSIDE SEWER PROJECT Burlington Northern Rail Road agreement Richard Schieffer reviewed the discussions with Mr. Farrell for a proposed permit from Burlington Northern for the installation of the Long Lake by-pass in its right- of-way. He didn't think there would be any advantage with negotiating for a permanent easement. It would not be within the cities authority to condemn a portion of the railroad right-of-way and would result in substantial legal fees. Compared to acquir- ing an'easement the $750.00 permit fee is not expensive. The contract contains a provision for the removal of pipe on 30 days notice. Mr. Farrell then agreed to a 6 month notice ,rather than 30 days. Richard Schieffer recommended approval of the $750.00 annual fee. Motion by Thomas Crosby, seconded by Sarah Lutz to approve the agreement subject to Orono approval. Motion carried. Change Order #'2 (Non -Grant Eligible) Paul Pearson presented the revised storm sewer alignment which shall be located on the property line between lots 4 and 5 Medina Morningside Third Addition. Add: 15" R.C.P. Class V (0-8' Dept) " Catch Basin Manhole Type - B w/R1642 B Casting " Black dirt and Sod - 80 S. Y. $ 437.50 $ 650.00 $ 132.00 Total cost of Change Order # 2 to be - $1,219.50 Motion by Thomas Crosby, seconded by Wilfred Scherer to approve Change Order #2 as recommended by the engineer, 0' Motion carried. Ron Peterson Motion by Thomas Crosby, seconded by Sarah Lutz to delete the storm sewer on. the Ronald Peterson and city park properties. Motion carried. Fence replacement Motion by Thomas Crosby, seconded by Bill Reiser to have the contractor remove and replace the fence on the Niles property, North of Co. Rd. 6 on the force main alignment. The charge to be $500.00. Motion carried. 7. SNOWMOBTLF TRAIL Motion by Sarah Lutz, seconded by Wilfred Scherer to send letter to the Department of Transportation from the Northwest Trails Association and the City of Medina for a Snow- mobile Trail along the South side of Hwy. 55 between the railroad tracks and Hwy. 55, and from Medina Ballroom west along Hwy. 55 about 1,000 feet past Arrowhead Drive. Motion carried. 8. CITY HALL STORM WINDOWS Tom Anderson recommended that the storm windows not be purchased at this time. His findings were that at the present oil rate it would take 21 years to realize the savings. 9. PERSONNEL POLICY The City Council requested to expand Personnel Policy to include regular part time employees working more than 20 hours per week. Motion by Thomas Crosby, seconded by Sarah Lutz to authorize Thomas Anderson to send a letter to Mr. Kuzma of Burlington Northern to authorize the railroad to relocate poles not to exceed $1,000.00. Motion carried. Motion by Thomas Crosby, seconded by Bill Reiser to allow $400.00 for acquiring a 10' permanent easement along the North line of property directly east of the Long Lake City • Hall property. Motion carried. Skip McCombs spoke to the City Council regarding continuing service to the City of Medina. 10. BILLS Motion by Bill Reiser, seconded by Thomas Crosby that we pay the bills. Order checks #9904-9967 in the amount of $293,465.81 and Payroll checks #6461-6486 in the amount of 9,258.55• Motion carried. Motion by Bill Reiser, seconded by Thomas Crosby to adjourn.
