Mayor Tyrell called the regular meeting of the City Council to order at 7:35 p.m. on Tuesday, April 2, 1974, in the Council Chamber of the City Hall. 2. The invocation was given by Elder Irving Baker, Church of Jesus Christ of Latter -Day Saints, 6249 N. Kauffman Avenue. 3. The Pledge of Allegiance to the Flag was led by Mayor Tyrell. 4. ROLL CALL: Present: Councilmen- Dennis, Gilbertson, Greenberg, Tyrell Absent: Councilmen- Merritt Also Present: City Manager Koski, City Attorney Martin, Assistant to the City Manager Biel, Planning Director Dragicevich, Director of Parks and Recreation Kobett, Public Works Coordinator Leonetti Councilman Gilbertson moved to excuse Councilman Merritt for cause, seconded by Councilman Greenberg and carried. 5. APPROVAL OF MINUTES Councilman Gilbertson moved to approve the minutes'of the regular meeting of the City Council held March 19, 1974, as written, seconded by Councilman Dennis and carried. RECOGNITION: Mr. Vince Heald, President of Dad's Committee, Explorer Post No, 171, presented Explorer Post trophy to Councilman Louis T. Gilbertson in recognition of his support of Explorer Post 171 of Temple City, as well as all youth organizations. Councilman Gilbertson accepted the trophy stating that Explorer Post No. 171 is doing great work with the group, at a difficult but very important age. Mayor Tyrell presented a special certificate to Brownie Troop No. 453. Colleen Brown introduced the girls in attendance and told about their activities at meetings -and field trips they have taken and plans for a tour of the Sheriff's Department. UNFINISHED :BUSINESS: 6. PUBLIC HEARING: 7:30 p.m. ANNEXATION NO. 73 -1 City Manager Koski presented background information, stating the City Council, at their regular meeting held Tuesday, February 19, 1974, adopted Resolution No. 74 -1334 declaring that proceedings have been initiated to annex certain uninhabited territory desig- nated as Annexation No. 73 -1 and set public hearing April 2, 1974 for protests concerning the annexation of two parcels at the inter- section of Lemon and Longden Avenues. Pursuant to Government Code, notice of hearing was published twice at least 20 days prior to hearing date and written notice was mailed to property owners of territory within the annexation area. Council Minutes, April 2, 1974 - Page 2 Mayor Tyrell declared the public hearing open. There being no one come forward to speak, Councilman Greenberg moved to close public hearing, seconded by Councilman Gilbertson and carried. Councilman Gilbertson moved to waive an Environmental Impact Report by reason of the fact that the annexation is so small there is no significant impact, seconded by Councilman Dennis and carried. Councilman Gilbertson moved to adopt Resolution No. 74 -1344 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY FINDING AND DECLARING THAT A MAJORITY PROTEST WAS NOT MADE CONCERNING ANNEXATION OF CERTAIN UNINHABITED TERRITORY DESIGNATED AS TEMPLE CITY ANNEXATION NO. 73 -1 by title only, seconded by Councilman Dennis and carried. Councilman Gilbertson moved to introduce Ordinance No. 74 -383 entitled AN ORDINANCE OF THE CITY OF TEMPLE CITY APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY TO THE CITY OF TEMPLE CITY (ANNEXATION NO. 73 -1) for first reading, seconded by Councilman Dennis and carried. 7. PUBLIC HEARING: 7:30 p.m. STREET IMPROVEMENTS: Installation of 8 Street Lights - Daines Drive, Baldwin to Golden West Avenue (Pursuant to Chapter 27, Streets and Highways Code) City Manager Koski presented background information, stating that property owners on Daines Drive, between Baldwin Avenue and Golden West, circulated a petition requesting street lights.pursu- ant to Chapter 27 of the Improvement Act of 1911, Streets and Highways Code, which petition was returned with signatures of owners representing 83% of the front footage; the installation of 8 light poles will cost $128 each; energy and maintenance for one year will be $565, cost of which will be borne by the property owners until. after July 1, 1975 when they can be annexed to Zone A; notices have been posted and a negative declaration of environmental impact was completed and posted. In answer to Councilman Gilbertson's question concerning the statement in the Environmental Impact Report that 8 street lights will have a significant: impact, Planning Director Dragicevich advised there would be an insignificant impact on the total use of utilities within the City. Mayor Tyrell declared the public hearing open. Gene Reinhardt, 9909 Daines Drive, a signer of the petition,, requested information relative to cost, use of energy, its effect on the existing power capacity, and placement of light standards, and declared himself to be in opposition to the installation. Harry Crump, 9902 Daines Drive, stated he was opposed to the proposed installation of street lights because'of the present energy crisis, and would oppose a pole being in front of his property. Mrs. Margaret Noonan, 9920 Daines Drive, stated she was in favor of the proposed installation. The street needs more light, partic- ularly at dusk in view of the fact that there are many young children in the block who play in the street and the number of women who live alone. Nrs. Francine Loomis, 9921 Daines Drive, stated she was in favor of the proposed installation because of the number of children playing in the street, and the problem with boys tuning their engines and ra::ing down the street. Council Minutes, April 2, 1974 - Page 3 Mayor Tyrell presented communication from Mr. Ernest M. Brewer, 9844 E. Daines Drive opposing the installation. Councilman Gilbertson moved to make the letter a part of the record, seconded by Councilman Dennis and carried. Councilman Gilbertson moved to close the public hearing, seconded by Councilman Dennis and carried. Councilman Gilbertson moved to approve the negative declaration of environmental impact, deleting the word "substantial" from Item 29, to find the project in the best public interest and instruct the Superintendent of Streets to cause the installation of eight 7,000 lumen steel electroliers with overhead service and to report on the cost of the installation when complete, seconded by Councilman Dennis and carried. 8. ORDINANCE NO. 74 -382: 2nd read. AMEND TEMPLE CITY MUNICIPAL CODE RELATING TO AUTOMOBILE PAINTING, BODY AND FENDER WORKS City Attorney Martin introduced Ordinance No. 74 -382, AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING PARAGRAPH 3 OF SECTION 9400 (a) OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO AUTOMOBILE PAINTING, BODY AND FENDER WORKS for second reading by title only. Councilman Greenberg moved to waive further reading and adopt, seconded by Councilman Dennis and carried. 9. DEVELOPMENT STANDARDS FOR R -3 AND R -4 ZONED PROPERTY AND PARKING STANDARDS City Manager Koski presented background information, stating the matter carried over from City Council meeting of March 19 for consideration of Planning Commission recomwendation relating to R -3 development standards, including modification of open space definition, minimum lot area, lot area per swelling unit; R -4 development standards and lot area per dwelling unit; and design of stall sizes, turn - arounds, and aisle widths for parking lots designed with angled parking stalls. Councilman Gilbertson moved to approve Planning Commission recom- mendation and instruct the City Attorney to prepare the necessary ordinance, eliminating Section 4 of Resolution No. 74 -545PC and renumbering subsequent section, seconded by Councilman Dennis and carried. 10. SET PUBLIC HEARING: ASSESSMENT FOR STREET IMPROVEMENTS: Installation of 2 Street Lights - Avon Avenue, north of Burghardt Road (Pursuant to Chapter 27, Streets and Highways Code) City Manager Koski presented background information, stating City Council, at their regular meeting of January 15, 1974, held public hearing anc instructed the Superintendent bf Streets to cause the installation of two street lights on Avon Avenue, north of Burg - hardt Road; installation has been completed and an assessment spread has been prepared for the purpose of assessing the property owners for the cost of the installation. Councilman Gilbertson moved to accept the installation, set public hearing April 16, 1974, 7:30 p.m. and instruct the Superintendent of Streets to notify property owners of such hearing, seconded by Councilman Dennis and carried. LOWER.AZUSA ROAD IMPROVEMENT PROJECT: (Eaton Wash to Camellia Avenue) Plans and Specifications City Manager Koski advised that the plans and specifications for the cooperative project between the County and the City for the improvement of Lower Azusa Road, between Eaton Wash and Camellia Avenue have been submitted for Council approval; the County will advertise for bids commencing April 9, 1974. Councilman Gilbertson moved to approve the plans and specifications and authorize the City Manager to sign the plans and authorize the Superintendent of Streets to obtain permits to enter private property for construction purposes within the subject limits, seconded by Councilman Greenberg and carried. NEW BUSINESS: 12. RECOMMENDATIONS FROM PLANNING COMMISSION - A. LOS ANGELES COUNTY PROPOSED ORDINANCE RE: AUTOMATIC SPRINKLERS FOR HIGH RISE BUILDINGS City Manager Koski presented background information, stating the Los Angeles County Engineering Department is proposing to the Board of Supervisors a modification of the Uniform Building Code to pro- vide additional fire protection standards for multiple story buildings; Planning Commission recommends the City Council support this ordinance. Chief Roy Swank, Los Angeles Fire Department, advised the Fire Department recommends the proposed modification to the Uniform Building Code as a preventive measure to prevent loss of life in multiple story buildings. Councilman Gilbertson moved to support the proposed regulations to establish additional fire protection standards for multiple story buildings, seconded by Councilman Greenberg and carried. B. PROPERTY NUISANCE CASE #19: 9661 Las Tunas Drive City Manager Koski presented background information, stating the Planning Commission, at their regular meeting held March 12, 1974, held public hearing to determine the existence of a public nuisance on the above location and adopted Resolution No. 74 -549PC determining the existence of a public nuisance. No appeal from the Planning Commission decision was submitted by the owner as provided by law. Councilman Gilbertson moved to adopt Resolution No. 74 -1345 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DECLARING CERTAIN PREMISES TO BE A PUBLIC NUISANCE, AND ORDERING ABATEMENT THEREOF by title only, seconded by Councilman Greenberg and carried. C. PROPERTY NUISANCE CASE #20: 9834 & 9838 Las Tunas Drive City Manager Koski presented background information, stating the Planning Commission, at their regular meeting held March 12, 1974, held public hearing to determine the existence of a public nuisance on the above location and adopted Resolution No. 74 -550PC deter- mining the existence of a public nuisance. No appeal from the Plan- ning Commission decision was submitted by the owner as provided by law. Council Minutes, April 2, 1974 - Page 5 Councilman Greenberg moved to adopt Resolution No. 74 -1346 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DECLARING CERTAIN PREMISES TO BE A PUBLIC NUISANCE AND ORDERING ABATEMENT THEREOF by title only, seconded by Councilman Dennis and carried. 13. RECOMMENDATIONS FROM PARKS AND RECREATION COMMISSION - Meeting of March 20, 1974 A. TEMPLE CITY JAYCEES - Request to conduct Youth Bike Rodeo, Live Oak Park, May 4, 1974 City Manager Koski presented background information, stating the Parks and Recreation Commission, at their regular meeting held March 20, 1974, recommended to City Council that the request received from the Temple City Jaycees to conduct a Youth Bike Rodeo, stressing skills and safety, on the south parking lot at Live Oak Park, May 4, 1974 from 8:00 a.m. to 12:00 p.m. be approved. Councilman Dennis moved to approve Parks and Recreation Commission recommendation as set forth in memo dated March 25, 1974 and on file in the City Clerk's office, seconded by Councilman Greenberg and carried. Council congratulated Mr. Dennis Dynes, President of Temple City Jaycees, who was in attendance, on the Jaycees interest in the youth of the community. B. BRIGHTER SIDE SINGERS PARENT'S COMMITTEE - Request to conduct Ice Cream Social, Temple City Park, July 28, 1974 City Manager Koski presented background information, stating the Parks and Recreation Commission, at their regular meeting held Mara 20, 1974, recommended to City Council that the request received from the Parent's Committee of the Temple City High School Brighter Side Singers to conduct an Ice Cream Social and a drawing for an automobile at Temple City Park on July 28, 1974, between the hours of 2:00 p.m. and 7:00 p.m. be approved. Councilman Gilbertson moved to approve Parks and Recreation Commis sion recommendation as set forth in memo dated March 22, 1974 and on file in the City Clerk's office, seconded by Councilman Dennis and carried. 14. RESOLUTION NO. 74 -1347: ORDERING CANVASS OF GENERAL MUNICIPAL ELECTION TO BE MADE BY CITY CLERK It was moved by Councilman Dennis, seconded by Councilman Greenberg and carried, to adopt Resolution No. 74 -1347 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, ORDERING THE CANVASS OF THE GENERAL MUNICIPAL ELECTION TO BE HELD ON THE 9th DAY OF APRIL, 1974, TO BE MADE BY THE CITY CLERK OF THE CITY OF TEMPLE CITY. 15. RESOLUTION NO. 74 -1348: PROPOSED UNIFORM TRANSPORTATION ASSISTANCE ACT City Manager Koski presented background information, stating the Los Angeles County Road Commissioner has requested cities to support his stand for funding under the Uniform Transportation Assistance Act to be allocated to local governments rather than through the Southern California Association of Governments for distribution under the proposed legislation. Councilman Gilbertson moved to adopt Resolution No. 74 -1348 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ENDORSING CERTAIN BASIC CONCEPTS EMBODIED IN THE UNIFIED TRANSPORTATION ASSISTANCE ACT NOW BEING CONSIDERED BY CONGRESS Council Minutes, April 2, 1974 - Page 6 AND URGING CONGRESS TO AMEND THE PROPOSED ACT TO CLARIFY INTENT AND PROVIDE FOR A FAIR AND EQUITABLE DISTRIBUTION OF FUNDS, seconded by Councilman Dennis and carried. 16. RESOLUTION NO. 74 -1349: Employment of Personnel It was moved by Councilman Gilbertson, seconded by Councilman Dennis and carried, to adopt Resolution No. 74 -1349 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING PERSONNEL. 17. RESOLUTION NO. 74 -1350: WARRANTS & DEMANDS, Demand Nos. 9647 through 9717 in the amount of $109,293.61. It was moved by Councilman Gilbertson, seconded by Councilman Dennis and carried, to adopt Resolution No.. 74 -1350 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $109,293.61, DEMAND NOS. 9647 THRU 9717. 18. COMMUNICATIONS: A. California Anti - Litter League - Request for Proclamation City Council supported the Mayor proclaiming the month of May as ANTI - LITTER MONTH IN TEMPLE CITY. B. Mrs. I. G. Bertolone, 9755 E. Val - Claim for Damages City Manager Koski presented a claim in the amount of $207 for damages to roof at 9755 E. Val Street due to branches of tree falling during tree trimming performed by city forces. Councilman Gilbertson moved to deny claim and refer to insurance carrier, seconded by Councilman Dennis and carried._ 19. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Mr. Frank Zrna, 9021 E. Emperor, inquired as to the action taken with regard to development standards for R -3 and R -4 zoned property. Mayor Tyrell advised the City Attorney had been instructed to pre- pare appropriate ordinances and they will be on the agenda of the next City Council meeting to be held April 16, at which time they <:. will be further discussed. Mrs. Penny Graham, President, Temple City Chamber of Commerce, advised the Chamber's membership drive has been completed with a result that 17 new businesses and 10 new residents have become members, making a total of 203 members. Mrs. Graham also reported the monthly membership meeting to be held at Tiffany's, April 10, 12:00 noon, will feature a speaker on OSHA and that the merchants are preparing for Shop Thursday Night in Temple City. RECESS TO MEET AS CRA On motion by Councilman Gilbertson, seconded by Councilman Greenberg, and carried, Council recessed at 8:45 p.m. to meet as the Community Redevelopment Agency. Council convened as the Community Redevelopment Agency, excused Mr. Merritt for cause, adopted the Rules and Regulations for Relocation, received copies of communications from Eugene Jacob's office to Envi- ronmental Protection Agency and Air Resources Board for Council comment. RECONVENE AS CITY COUNCIL 20. MATTERS FROM CITY OFFICIALS: A. American Institute of Planners - 1974 Calchapter Conference Newport Beach, May 1 -4, 1974 City Manager Koski presented a request for Planning Director Dragicevich to attend the 1974 Calchapter Conference of American Institute of Planners to be held in Newport Beach May 1 -4, 1974. Councilman Gilbertson moved to approve attendance, with registra- tion and attendant expenses paid, seconded by Councilman Dennis and carried. B. Request from CRA for loan to initiate the following work: $ 3,000 14,500 1,800 Councilman Gilbertson moved to approve request for loan to the Community Redevelopment Agency as set forth and appropriate the necessary funds from the General Fund and amend the Adopted Bud- get accordingly, seconded by Councilman Dennis and carried. C. Communication received from the Parks and Recreation Commission requesting a joint study session with City Council to discuss Live Oak Park development. Joint study session was scheduled Monday, April 15, 1974, 7:30 p.m. in the City Hall. D. City Manager Koski advised he had received one nominee for the Bicentennial Committee from Councilman Gilbertson. E. Mayor Tyrell advised he had received a registration form for the Sixth Annual National Institute on Community Involvement and the Criminal Justice System and would place it in circulate for Council review. 21. ADJOURNMENT: On motion by Councilman Dennis, seconded by Councilman Gilbertson, the meeting adjourned at 9:00 p.m. to a study session with the Parks and Recreation °mission to be held Monday, April 15, 1974, 7:30 p.m. in the City Hall.
