HomeMy Public PortalAboutOrdinance 01:4201-42 Councilman Presents the following Ordinance Seconded by Councilman AN ORDINANCE AMENDING AND SUPPLEMENTING SECTION 160-119.1 ("CERTIFICATE OF CONTINUED USE OR OCCUPANCY") OF CHAPTER 160 "LAND DEVELOPMENT" OF THE CODE OF THE BOROUGH OF CARTERET BE IT ORDAINED by the Mayor and Borough Council of the Borough of Carteret (the "Borough") as follows: Section 1 Subsection A, "Certificate required for all uses of Section 160-119.1 entitled "Certificate of continued use or occupancy" and Loading" is hereby revised to read as follows: (1) Certificate of occupancy required for all uses. Change of occupancy and/or title required. A continued Certificate of occupancy is required on change of occupancy and/or title of all real property in the Borough. It shall be the responsibility of the zoning officer to receive and review applications for continued Certificates of occupancy. Upon receipt of a completed application, the zoning officer must determine the following: 1. That the nature of the proposed use is permitted within the zone in question; 2. That no eminent health or safety hazards exist at the site, which will be determined by an inspection to be conducted by the zoning officer or his designee; 3. That all sub-code inspections have been completed; 4. That all existing code violations and summonses have been abated. The zoning officer, upon a determination that all of the foregoing items have been satisfied, shall issue a Certificate of occupancy. The fee for the Certificate of occupancy shall be specified by ordinance. (2) Change of tenancy, name and/or ownership of commercial, industrial and office usages. 01-42 PAGE 2 Section 2 Section 3 Section 4 (a) Continued Certificate of occupancy is required upon a change of tenancy, name and/or ownership of commercial, industrial and office usages in the Borough. It shall be the responsibility of the zoning officer to receive and review such applications. The review shall include, but not be limited to, a description of the proposed use, the hours of operation, the number of employees, the parking requirements, the nature of deliveries or shipments, etc. The fee for a Certificate of occupancy shall be specified by ordinance. (b) A Certificate of occupancy shall not be issued for a change of tenancy until the new tenant has registered with the Fire Prevention Bureau and has met the requirements of the New Jersey Uniform Fire Code. All ordinances or parts thereof inconsistent with the provision of this ordinance are hereby repealed limited to the extent of any such inconsistency. If any section, paragraph, sub-division, clause or provision of this ordinance is adjudged invalid, such adjudication shall apply only to the section, paragraph, sub-division, clause or provision so adjudged and the remainder of this ordinance shall be deemed valid and effective. This ordinance shall take effect upon its passage and publication according to applicable law.
