The Water and Wastewater Committee and Town Board have been evaluating amendments to our Plant Investment Fee Schedule and per Board direction, code amendments are being presented for consideration. As you recall, the objectives of the amendments were as follows:  Collection of PIF at certificate of occupancy rather than building permit  PIF based on size of unit (square footage)  Construction period specific service fee  Multi-family and mixed use provisions  New availability of service fee I anticipate additional discussion and questions prior to adoption, so we’ve scheduled time during the workshop session accordingly. Along with Ordinance 436 that would amend the Town Code, an excel spreadsheet is included in your packet per your request for revenue projections. As you know, the assumptions used in revenue projections are important to the outcomes. I’ve provided the spreadsheet so that you adjust the assumptions based on your level of conservativism/optimism. The first three worksheets provide baseline information regarding permit history. The last two worksheets project revenues for the current and proposed schedules based on assumptions as highlighted in the bright yellow, blue, and green columns. Please feel free to contact me if you’d like any assistance with these. We received three proposals for the Town owned FroDo Property in response to our Request for Proposals. These are included in the packet for your consideration. We have also received a request for funding from the Divide Music Festival, this is also included in your packet for your consideration. Jeff Durbin Town of Fraser PO Box 370, Fraser, CO 80442 office 970-726-5491 fax 970-726-5518 www.frasercolorado.com Town Manager Newsletter August 31, 2016 Community Matters On August 26, 2016, the Town has hosted a regular meeting of Colorado Association of Ski Towns (CAST). More than 50 people attended representing entities of Colorado and beyond whose economy mainly relies on ski tourism. CAST is an organization of 28 municipalities and four counties whose economies are largely dependent upon the ski industry and tourism. Members include the mayors, managers and council members of the resort towns. We are finishing the Keep American Beautiful (KAB)/Coca Cola Bin Grant. Fraser is the only entity in Colorado that received the grant last year! We were awarded six recycling bins and in return, we were required to track the amount of recyclables collected in them. The bins were located throughout the town. According to our final report over 700 of lbs. were collected since last summer, of which 34% were PET bottles, 32% aluminum cans, 22% glass, 8% other plastic containers, and 4% paper. Our tracking requirements of the grant are now concluded and the bins will continue to provide recycling opportunities. The Town continues to seek opportunities to work with the community on a broad basis to identify how we can better manage our solid waste streams, save money and improve environmental sustainability. Administration We have applied for a Department of Local Affair’s (DOLA) Energy/Mineral Impact Assistance Fund Grant (EIAF) for our broadband study. We recently launched our community-wide broadband study with the Vantage Point. Look forward to hearing more about this initiative in the near future. 2 Public Works Water: Public Works is preparing to isolate the transit waterline under the UPRR ROW beginning Tuesday 9/6, following the Labor Day holiday. ATH Specialties will be doing the work which is estimated to take approximately three days to complete. There will be some interruptions of traffic flows and water service depending on what is found in the ground once we start the project. Sanitary Sewer: PW staff is working with Conroy Excavating on punch list items before making final payment and starting the 12-month warranty period for the 2015 – North Sanitary Sewer System (I&I) Rehab and Replacement Project with Conroy Excavating. Streets: CDOT has tentatively scheduled the restriping of the US40 & CR8 intersection for the week of September 12th, weather permitting. Replacement valley drainage pan replacement work is underway. PW staff continues with street sweeping operations. Trails: Installation of trail wayfinding signage continues. Electrical work for the flag pole LED lights is complete, and the flags are up! Mounting of the brass plaque is slated for this week in advance of the holiday weekend. Finalizing GOCO grant reimbursements for the Pedestrian Bridge over the Fraser River. Gardens: Beds, planters, baskets and parks continue to look marvelous! PW staff continues the assault on noxious weed management (spraying) as weather, time and resources allow. Section 24-6-402(4)(e) regarding annexation agreement compliance and out of town service and to include TA McGowan and TM Durbin. Page 3 of 3 Jesse Clark addressed the Board regarding their understanding of the history of the sewer line installation. Mr. Clark asked to split the cost of the line installation with the Town. Trustee Miller moved, and Trustee Meyring seconded the motion that the Town participate to the 30% level, the Town take care of repairs to the valley pan and public streets, that the property owner is responsible for repairs to The Divide Condos driveway, the route chosen would be to connect at Doc Susie, and that the service line becomes a private service line, the property owner is responsible for future maintenance and a low interest loan is offered. Motion carried: 5 -2. WHEREAS; the Water and Wastewater Committee and Town Board have evaluated the water and sewer Plant Investment Fee schedules and related matters and have determined these amendments to be in the best interest of the community. NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF FRASER, COLORADO, THAT: PART 1: ADOPTION OF AMENDMENTS TO TOWN CODE. PART 4: SEVERABILITY. If any section, subsection, sentence, clause or phrase of this Ordinance is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this Ordinance. An applicant for water service from the Town shall pay all connection fees prior to connection as established by the Board of Trustees. Connection fees include, but are not limited to, meter assembly, sill cock and other necessary appurtenances; and such meter installation shall become the property of the Town.  Sec. 13-2-210. – (Water) Plant investment fees. (a) An applicant for water service shall pay a water plant investment fee for each water- using unit requesting such service. Water plant investment fees will be established by the Board of Trustees by resolution and are subject to change from time to time. Such fee shall be paid in full prior to the time a building permit is issued and prior to the time that each water-using unit is connected to the Town water system issuance of a certificate of occupancy for any water using unit. Said fee shall be in addition to all other fees or charges relating to water service elsewhere described in this Article, and in no case shall such plant investment fee be rebated under any circumstances. (b) The water plant investment fee for each SFE unit is contained in Appendix A to this Code. (c) Upon payment of the plant investment fee issuance of a building permit, the water- using unit may access the Town water system for construction and firefighting purposes in accordance with the provisions of the Article. Water service fees are applicable to the water- using unit ninety (90) days after payment of the plant investment fee. After issuance of a building permit, and prior to issuance of a certificate of occupancy, water service fees shall be assessed at 33% of the normal base service fee applicable to the unit. (d) The water plant investment fee for any new development or change of use shall be determined by multiplying the "water plant investment fee per SFE" rate by the applicable SFE multiplier set forth in the SFE Schedule for Plant Investment Fees set forth below. This - 4 - SFE schedule is based upon typical expectations for the specified meter size and/or use. Unusual circumstances, or uses not specified within the schedule, may require further evaluation to determine the applicable SFE rate. SFE SCHEDULE FOR PLANT INVESTMENT FEES (1) A single-family residence is considered as a unit for all rate and fee calculations and is referred to as a Single-Family Equivalent (SFE) All residential units shall be assessed at a rate of .0004 SFE per square foot of habitable space, with a minimum of .2 SFE per residence. (2) Due to fire sprinkler and other requirements in some neighborhoods, single-family residences are provided service by a range of water meter sizes between five-eights- inch and one-inch meters. A single-family residence serviced by such size water meter shall be considered one (1) SFE. A single-family residence requiring a meter larger than one (1) inch shall be assessed SFEs as provided in section 1 above or pursuant to the schedule provided by Paragraph (5) (4) below, whichever is greater. (3) Accessory dwelling units as provided by the Zoning Ordinance shall assessed at a rate of .0004 SFE per square foot of habitable space with a maximum of be considered .35 SFE. (4) Multi-family residential units (townhomes, apartments, condominium units, mobile homes) shall be assessed one (1) SFE per unit. (5) (4) Commercial structures shall be assessed a number of SFEs based upon the meter size in accordance with the following schedule: Commercial Meter Size ¾" meter 1 SFE - 5 - Commercial Meter Size 1" meter 2 SFE 1½" meter 4 SFE 2 inch meter 8 SFE 3" meter 12 SFE 4" meter 24 SFE 6" meter 48 SFE (6) (4) Mixed use residential and commercial structures shall be assessed SFE’s based upon the commercial meter size as provided by Paragraph (5) (3) above plus the residential component as provided by Paragraph (4) above. (e) A water-using unit that replaces an existing water meter with a larger water meter shall be responsible for additional plant investment fees in accordance with the increase in SFEs. (f) A water-using property that has paid a plant investment fee but has not yet connected to the water system or has not yet passed the water meter inspection for a new meter will be charged the applicable base rate without a consumption charge. - 6 -  Sec. 13-2-240. - Water service rates. Fees are hereby levied and assessed for water and water service at the rates as established from time to time by resolution adopted by the Board of Trustees. Such rates are hereby found, determined and declared by the Board of Trustees to be equitable and just.  Sec. 13-2-250. - Basis for water service fee. All rates for water service shall be based on the SFE schedule as defined in Subsection 13-2- 210(d) of this Article for water service fees as set forth below. Fees for water service will be established and subject to change from time to time upon approval of the Board of Trustees by resolution. (7) Vacant platted residential lots shall be assessed an availability of service fee which shall be 5% of the base service fee. Sec. 13-2-290. - Delinquent charges placed on tax rolls. In addition to or as an alternative to the foregoing sections for collection of unpaid water charges, and to the other remedies provided in this Article, in the event that any charges as provided in this Article are not paid when due, which charges shall include service fees, plant - 8 - investment fees, penalties, interest and attorneys' fees, among any other charges, the Town Clerk may certify such delinquent charges to the County Treasurer to be placed by the County Treasurer upon the tax rolls for the current year, to be collected in the same manner as other taxes are collected, with ten percent (10%) of the amount of such delinquency added thereto to defray the costs of collection; and all laws of the State for the assessment and collection of general taxes and the enforcement of liens therefor, including the laws of the sale of property, delinquency taxes and redemption of the same, shall apply. The property to be assessed the delinquent charges shall be that real property which is being benefited by the water service provided by the Town or contemplated to be provided by the Town, for which the particular water charges have not yet been paid. This certification and assessment may be made by the Town Clerk whenever any delinquent charges exist. Sec. 13-4-50. – (Sewer) Plant investment fees. (a) An applicant for sanitary sewer service shall pay a sanitary sewer plant investment fee for each sanitary sewer-using unit requesting such service. Sanitary sewer plant investment fees will be established by the Board of Trustees by resolution and are subject to change from time to time. Such fee shall be paid in full prior to the time a building permit is issued and prior to the time that each sanitary sewer-using unit is connected to the Town sanitary sewer system issuance of a certificate of occupancy for any sewer using unit. Said fee shall be in addition to all other fees or changes related to water service elsewhere described in this Chapter, and such plant investment fee shall not be rebated under any circumstances. (b) The sanitary sewer plant investment fee for each SFE unit is contained in Appendix A to this Code. (c) Upon payment of the plant investment fee issuance of a building permit, the sanitary sewer-using unit may access the Town sanitary sewer system for construction in accordance with the provisions of this Article. Vacant platted residential lots shall be assessed an availability of service fee which shall be 5% of the base rate. Sec. 13-4-110. - Delinquent charges placed on tax rolls. In addition to or as an alternative to the foregoing sections for collection of unpaid sanitary sewer charges, and to the other remedies provided in this Article, in the event that any charges as provided in this Article are not paid when due, which charges shall include service fees, plant investment fees, penalties, interest and attorneys' fees, among any other charges, the Town Clerk may certify such delinquent charges to the County Treasurer, to be placed by the County Treasurer upon the tax rolls for the current year, to be collected in the same - 10 - manner as other taxes are collected, with ten percent (10%) of the amount of such delinquency added thereto to defray the costs of collection; and all laws of the State for the assessment and collection of general taxes and the enforcement of liens therefor, including the laws of the sales of property, delinquency taxes and redemption of the same, shall apply. The property to be assessed the delinquent charges shall be that real property which is being benefited by the sanitary sewer service provided by the Town, or contemplated to be provided by the Town, for which the particular sanitary sewer charges have not yet been paid. This certification and assessment may be made by the Town Clerk whenever any delinquent charges exist.
