HomeMy Public PortalAbout12/02/75 CCMThe Council of the City of Medina met in regular session on Tuesday December 2, 1975 at 1 5 9 7:35 P.M. Members present: Mayor, Wayne Neddermeyer; Councilmen, William Reiser, Donald DesLauriers, Robert Franklin, Arthur Theis; Clerk, Donna Roehl; Attorney Richard Schieffer. Motion by Donald DesLauriers, seconded by Arthur Theis to accept the minutes, as presented, of the meeting of November 18, 1975. Motion carried unanimously 1. HENNEPIN COUNTY PARK RESERVE Ed Sorgatz, Park Manager, presented signed consent forms of John Gangelhoff, Willis Kohnen, and Marjorie Brantingham. This will allow the park to erect "No Parking" signs along portions of Parkview Drive and Hamel Road. Motion by Robert Franklin, seconded by Donald DesLauriers to recommend that "No Parking" signs be erected by Hennepin County Public Works Department on the following roads: Parkview Drive from the junction of Parkview Dr. and Hanel Rd. to a point about 1/2 mile South of that junction. Also Hamel Rd. from the junction of Hamel Rd. and Parkview Drive West to the end of the golf course; With the exception that no sign be erected on the North side of Hamel Rd. for a distance of 100 yards either side of Mrs. Brantingham's driveway. Motion carried unanimously Council reviewed with Mr. Sorgatz a letter written by Ray Hoosier, Weed Inspector, asking for Park intentions as to weed control for 1976. Also the statement that there have been contin- uing problems with the Park as to weed control. Mr. Sorgatz stated that he does not agree with the statement regarding the parks failure to control weeds and he also feels that there is a lack of communciation between them and Mr. Hoosier. He stated that he would inform Mr. Hoosier, in the Form of a letter, as to the plans to use a County sprayer with trained per- sonnel for a 2 week period during the summer of 1976 and that there are monies budgeted for this program. 2. SPECIAL ASSESSMENT, PAYMENT Virgil Morin and Walter Kohnen have requested permission to pay sewer special assessments in connection with the Independence Beach project although the November 15th deadline for paying such assessments has passed. They have stated that they did not know of the cut-off date. Hennepin County Finance Division requested that a Resolution be passed identifying properties involved and asking that the individuals be allowed to pay the special assessments. Council discussed the matter of interest being charged,in this case,and attorney instructed to determine the matter. Motion by Robert Franklin, seconded by William Reiser to approve Resolution 75-43, allowing - for payment of special assessments of Virgil Morin and Walter Kohnen. Motion carried unanimously 3. DENNIS KLAGES Mr. Klages requested that a setback variance be granted him to allow him to erect a house on Lot 2 Block 20, Independence Beach. He has signed form with the Building Inspector stating that the house on Block 21 will be razed when new home is completed. He has also signed lot combination forms for the 2 lots. Motion by Robert Franklin, seconded by Arthur Theis to grant a variance to Dennis Klages for a 30 ft. front yard setback from road right-of-way on Lot 2,.Block 20, Independence Beach, on the condition that the existing house on Block 21 be removed by June 1, 1976, and that Mr. Klages submit a satisfactory site plan, application for variance and pay any appropriate fees before the permit be issued. Motion carried unanimously 4. AUDITOR Richar Schieffer stated he had contacted a municipal auditor and that they would be at the December 16th meeting. Also Roger Johnson is interested and will be asked to attend the meeting. 16 9. COMMUNITY DEVELOPMENT BLOCK GRANT Mr. Schieffer explained what he knew about the program and discussion as to how the money was allowed to be used. Motion by Robert Franklin, seconded by Donald DesLauriers to join with Hennepin County for Block Grant and request additional information regarding how money is to be used. Motion carried unanimously 6. ANNE DORWEILER Ms. Dorweiler explained briefly that She had been contacted by Diversified Insulation for a land division and by Wm. Morton regarding division of the Virgil Eisinger property. She also requested that council delay discussion of. Comprehensive Plan until December 16 and presented redrawn zoning maps. Discussion of her using her own duplicating machine and charging city for -supplies. Motion by Robert Franklin, seconded by William Reiser to authorize Anne Dorweiler to charge city for duplicating machine supplies used for city business. Motion carried unanimously 7. BILLS Discussion of bill for removing school bus from Chippewa Rd. Amount calculated to be approximately $112.50 for equipment rent and labor. Attorney felt that Leo Leuer.should bill the bus company as the city is not in the business of towing private vehicles. It was sugg- ested that the Bus company be represented at the December 16th meeting to discuss the bill. Discussion -of snow fences that were stolen in that same area and that a police report should be made. 8. MAPLE PLAIN WATER Robert Franklin read letter he had written to Maple Plain asking if they would be interested in providing water to those Medina residents in or near their service area. Members agreed letter should be sent. 9. SUBURBAN NURSING SERVICE Arthur Theis explained that he had been discussing the matter of nursing services for Medina with the Orono School nurse and others and would continue to seek information as to how to serve Medina residents. Donna Roehl explained that Holy Name School had been notified that services would no longer be provided and they had been billed for vision and hearing screening that had been conducted this fall. 10.. INDEPENDENCE BEACH SEWER AND WATER RATES Motion by Robert Franklin, seconded by Arthur Theis to charge the same rates for sewer and water service to the Independence Beach area as the Hamel residents are now:paying. Motion carried unanimously '11. JORDAN-DAYON COUNTERCLAIM Discussion of counterclaim of Denis Jordan and Archie Dayon regarding trespassing by Barbar ossa in 1969 to install Hamel sewer and water. Clerk will search the files for past infor- mation regarding this matter and attorney will take appropraiate action at time Of court appearance. 12. SEWER AND WATER BILLS Discussion of late payment and penalties that may be charged for unpaid bills. Attorney stated that he would. draft an ordinance amendment that would clarify penalties and meet with the clerk to discuss the matter. 13. GORDON TAUER Discussion of claim of Gordon Tauer for tree damage done by snow plow. Letters from McCombs -Knutson and insurance carrier were read. Attorney will discuss with Mr. Tauer his having a survey to determine whether trees are on private or road right-of-way property ll 14. EQUIPMENT Motion by Robert Franklin, seconded by Arthur Theis to authorize road chairman, Donald Des- Lauriers to spend $1600.00 or less to aquire fuel storage tank and accessories. Motion carried unanimously 161 15. SNOW PLOWING APPLICANTS Applications were put on file for road supervisor to contact when needed. 16. BILLS J Motion by Donald DesLauriers, seconded by Arthur Theis to pay the bills, except the $60.00 paid to Leo Leuer for equipment rent in connection with removing bus from Chippewa Rd. Order checks in the amount of 5157,410.30; Payroll in the amount of $8246.63. Motion carried unanimously 17. ,POLICE,CAR Police Chief Hoover asked if'he could secure prices on a new police car. Motion by Robert Franklin, seconded by William Reiser to authorize the Chief of Police to secure prices on a car compareblerto'a Chevrolet Malibu or an Oldsmobile. Motion ca.rriedrunsnimously 18. BOB'S 55 CLUB Discussion of signed complaints by Hennepin County Sheriff's Deputy and Medina Officer, dated November 22, 1975 regarding establishment being open past required closing time. • 19. DONALD ,DFWSLATRIEW ND DIVISION Donald DesLauriers explained division of parcel of land owned by him and requested informat- ion.regarding-neceessity.ct% platting to allow a building to be erected on said property. 20: OAVANAU B ROAD) - • . - - Discussion or Mr.=,<MCKinney having purchased, -a lot.in Il!e Hamel Industrial Park and the need for the road to be constructed at this time. Mr. Cavanaugh has stated that he has cohtraoted with a construction company to put in the road. All parties will be asked to submit plans to the Planning Commission.
