NOTICE IS HEREBY GIVEN that the Architectural Review and Planning Board
of the Town of Gulf Stream will hold a Public Hearing on Wednesday,
May 25, 1994, at 9:00 A.M. and the Town Commission, sitting as the Board
of Adjustment, will hold a Public Hearing on Friday, June 10, 1994, at
9:00 A.M., both in the Commission Chambers at the Town Hall, 100 Sea
Road, Gulf Stream, Florida,at which the following will be considered:
An application submitted by Ralph Clark as Agent for Mr.
and Mrs. Peter Roby, #2 Little Club Road, Gulf Stream,
Florida 33483 that is legally described as #2, Las Casitas
Property, requesting variances from the provisions of the
Code of Ordinances of the Town of Gulf Stream, Chapter 66;
ZONING., Article VI.; DISTRICT REGULATIONS, Division 3. RM
MULTIPLE -FAMILY RESIDENTIAL DISTRICT, Section 66-236; Rear
yard required, Section 66-240; Accessory building requirements
to permit the construction of a swimming pool which would encroach
eighteen (18) feet into the required twenty five (25) foot rear yard
setback, and installation of pool equipment that would encroach twenty
four (24) feet into the required twenty five (25) foot rear yard setback
at the location stated herein.
ALL PERSONS INTERESTED in these matters may appear before the architect-
ural Review and Planning Board and the Town Commission, sitting as the
Board of Adjustment, of the Town of Gulf Stream at the times and place
aforesaid and be heard.
SHOULD ANY INTERESTED PARTY SEEK TO APPEAL ANY DECISION MADE BY THE
ARCHITECTURAL REVIEW AND PLANNING BOARD OR THE TOWN COMMISSION, SITTING
AS THE BOARD OF ADJUSTMENT, WITH RESPECT TO ANY MATTER CONSIDERED AT
THESE PUBLIC HEARINGS, SAID PARTY WILL NEED A RECORD OF THE PROCEEDINGS,
AND FOR SUCH PURPOSE, MAY NEED TO INSURE THAT A VERBATIM RECORD OF THE
PROCEEDINGS IS MADE, WHICH RECORD INCLUDES THE TESTIMONY AND EVIDENCE

V. PUBLIC HEARING.
A. Variance
1. Ralph Clark as Agent for Mr. & Mrs. Peter Roby, #2 Little
Club Road, Gulf Stream, Florida -Installation of a pool and
pool equipment, both of which would encroach into the rear
yard setback (next to Intracoastal), at the address stated
herein - described as #2, Las Casitas.
Town Manager Harrington explained that this property is zoned multi -family
and consists of detached units which are more similar to single family
dwellings. He advised that the required setback for both the pool and the
pool equipment is 25' and that the applicant is requesting a variance of
19' for the pool and 24' for the pool equipment. Mr. Harrington stated
that the setback in question is adjacent to the Intracoastal and not another
property line, with the properties on both sides of the applicant having
pools in similar locations to that proposed. Mr. Harrington then
pointed out that the applicant had proposed to install the pool equipment
below grade but is now considering placing it at grade. He suggested if
the variance were to be granted and the equipment not placed below grade,
that either a two foot wide, four foot high landscape strip be provided
/lbetween the equipment and the seawall, or a wall of three foot in height.
Mr. Clark stated that he believes the pool equipment can be installed in
a waterproof box below grade. Mr. Ogren advised that many who install
equipment below grade also install a sump pump to keep the equipment dry.
Mrs. Souder and Chairman Orthwein were not in favor of a wall being
constructed for purposes of screening. They called attention to the very
dense hedge maintained on the property line on each side of the property
and believed a hedge should be used as a screen if the equipment is not
below grade.

Mr. Harrington next questioned if the Board felt the existing hedges on
the property lines, which would satisfy the Gulf Stream Code in relation
to providing a barrier for entry to the pool area,wrne adequate or if
it was felt the Palm Beach County Code, which mandates fencing around a
npool, should be applied. The existing hedge was felt to be adequate.
Mr. Lynch moved that it be recommended to the Town Commission that the
variance for the pool and for the pool equipment be granted as requested
provided that as a first option, the pool equipment be installed below
grade with a sump pump, or, as a second option, there be a hedge 2' wide
and 41 feet hight planted between the equipment and the seawall, with the
provisions of the Gulf Stream Code being applied in relation to providing
a barrier for entry to the pool area. The motion was seconded by Mrs.
Souder. Roll Call: Mr. McGraw; AYE, Mrs. Souder; AYE, Mr. Lynch; AYE,
Mr. Ogren; AYE, and Chairman Orthwein; AYE.

Commission that the site plan be approved as presented with the conditions
that are connected with the variance recommendation. Roll Call: Mr.

Orthwein; AYE.

These meetings were announced by Town Manager Harrington. He explained that
the joint meetings would be informational, dealing with the proposed new
Design Guidelines and resulting changes in the Zoning Codes.
C. Construction in Progress Report for April, 1994.
The report revealed there to be $7,842,432 worth of construction in progress
in the month of April, 1994.
